का. आ. 230 ( अ ) . संख्पा ई( सी ) ओ, 1977/ ए एम ( 109).-आयात तथा निर्यात (नियंत्रण) अधिनियम, 1947 (1947 का 18) के खण्ड-3वास प्रदत्त अधिकारों का प्रयोग करते हुए, केन्द्रीय सरकार एतद्वारा निर्यात (नियंत्रण) आवंश , 1977 में और आगे संशोधन करने के लिए निम्नलिखित आदेश का निर्माण करती हूं', अर्थात् :-
1. (1 ) इस आदेश को निर्यात (नियंत्रण ) 24वां संशोधन आदेश, 1979 की संज्ञा दी जाये ।
(2) यह सरकारी राजपत्र में प्रकाशन की तिथि से लागू होगा ।
2. निर्यात (नियंत्रण ) आदेश , 1977 (इसके बाद इसे उक्त आदेश की संज्ञा दी जाएगी ) की धारा-2 में उप -धारा (घ) के लिए निम्न- लिखित उप-धारा को प्रतिस्थापित किया जाएगा , अर्थात् :-
" (डी) "लाइसेंस " में शामिल है-
(1 ) इस आदेश के अन्तर्गत लवान बिल पर किया गया लाइसेंस पृष्ठांकन,
(2 ) इस आदेश के अन्तर्गत आबंटित माल के निर्यात के लिए एक कोटा चाहे इस सम्बन्ध में ऐसा आवंटन एक लाइसेंस प्राधिकारी अथवा लाइसेंस प्राधिकारी द्वारा प्राधिकृत किसी अभिकरण द्वारा किया जाता है , "

3. उक्त आदेश की धारा-5 में,
(1) उप -धारा (एम ) में,
(क) "निर्देशक" शब्द के स्थान पर " पूर्ण समय के लिए निर्देशक अथवा प्रबंधक निर्देशक " शब्द प्रतिस्थापित किया जाएगा ।
(ख) शब्द और अंक " धारा-7 के अधीन " के लिए शब्द और अंक "धारा-7 या 8 या 9 के अधीन " प्रतिस्थापित किए जाएंगे ।
(2) उप-धारा ( एन) में, शब्द कोष्ठक और अंकों " धारा-7 की उप-धारा-2 के अधीन " के स्थान पर शब्द और अंक " धारा-7 , धारा 8 अथवा धारा-9 के अधीन " प्रतिस्थापित किया जाएगा ।
(3) उप-धारा (ओ) में , शब्द "निवेशक" के स्थान पर शब्द "पूरे समय के लिए निर्देशक अथवा प्रबन्धक निर्देशक" प्रतिस्थापित्त किया जाएगा ।
4. उक्त आवंश की धारा-7 में:-
(1) कंडिका (क) की उप -कंडिका (2 ) और उप-धारा (2 ) की कंडिका (ख ) में निहित प्रावधान में शब्द "निर्देशक" के स्थान पर शब्द " पूरे समय के लिए निर्देशक या प्रबन्ध निर्देशक" प्रतिस्थापित किए जाएंगे ।
(2) उप-धारा ( 2 ) के बाद निम्नलिखित उप-धारा को जोड़ा जाएगा अर्थात्: --
" (3 ) केन्द्रीय सरकार अथवा मुख्य नियंत्रक, आयात-निर्यात किसी लाइसेंसधारी अथवा निर्यातक अथवा किसी अन्य व्यक्ति को इस सम्बन्ध में "ऐिसे व्यक्ति के विरुद्ध

EXPORT TRADE CONTROL
New Delhi , the 27th April , 1979 की जाने वाली अन्य कार्रवाई के अतिरिक्त लाइसेंस प्राप्त करने से अथवा कोई माल निर्यात करने से वंचित कर सकते हैं और इस आदेश के अन्तर्गत विशिष्टकृत अवधि के लिए ऐसे व्यक्ति को कोई लाइसेंस प्रदान नहीं किया जाएगा अथवा कोई माल निर्यात करने की अनुमति नहीं दी जाएगी यदि केन्द्रीय सरकार अथवा मुख्य नियंत्रक, आयात-निर्यात के विचार मैं यह पाया जाता है कि:-
(क) ऐसा लाइसेंसधारी, निर्यातक अथवा अन्य व्यक्ति , अथवा
S.O. 230( E ) . No. E( C ) O, 1977/ AM( 109 ) ,-In exercise of the powers conferred by section 3 of the Imports and Exports (Control ) Act , 1947 (18 of 1947 ) , the Central Government hereby makes the following order further to amend the Exports ( Control ) Order , 1977 , namely :-
1. (1) This Order may be called the Exports ( Control ) Twenty Fourth Amendment Order , 1979 .
(2) It shall come into force on the date of its pub- lication in the Official Gazette .
(ख) जहां ऐसा लाइसेंसधारी जैसा भी मामला हो निर्यातक , अथवा अन्य व्यक्ति साझेदार फर्म अथवा एक लिमि टेड कंपनी, कोई साझेदार अथवा पूरे समय के लिए उनका निर्देशक अथवा उसका प्रबंधक निर्देशक है अथवा
2. In the Exports (Control ) Order , 1977 ( hereinafter re- ferred to as the said Order) , in clause 2, for sub - clause (d) , the following sub -clause shall be substituted, namely :---
" (d ) " licence " includes-
(i) a licensing endorsement made on a shipping Bill under this Order ;
(ग) जहां ऐसा लाइसेंसधारी आयातक अथवा अन्य व्यक्ति एक साझेदारी फर्म में साझेदार अथषा पूरे समय के लिए निर्देशक अथवा लि. कम्पनी का प्रबंधक निर्देशक है और ऐसी साझेदारी फर्म अथवा सीमित कम्पनी , जैसा भी मामला हो,
( ii) a quota for the export of goods allocated under this Order, whether such allocation is made by a licen- sing authority or by any agency authorised by the licensing authority in this behalf; "
3. In the said Order, in clause 5,-
(i) in sub - clause ( m) ,
(a) for the word ' director ' , the words 'whole time dir- ector or managing director' shall be substituted;
(1 ) ऐसे लाइसेंसधारी , निर्यातक , अथवा अन्य व्यक्ति अथवा ऐसा साझीदार अथवा पूरे समय के लिए निर्देशक अथवा प्रबंधक निर्देशक अथवा ऐसी साझीदार फर्म अथवा लि. कम्पनी जैसा भी मामला हो को प्रदान किए गए किसी भी निर्यात लाइसेंस या कोर्ट के आबंटन को उपयोग करने या पूर्ण रूप से उपयोग करने में बिना उचित कारण बताए असफल रहा है , अथवा
(b) for the words and figure " under clause 7" the words and figures " under clause 7 or clause 8 or clause 9 " shall be substituted ;
(2) आयात (नियंत्रण ) आदेश, 1955 की धारा-8 की उप-धारा (3 ) के पैरा ( 1 ) में निहित कोई कार्य किया है । "
( ii) in sub - clause ( n) , for the words , brackets and figures " under sub-clause ( 2) of clause 7 " , the words and figures " under clause 7 or clause 8 or clause 9" shall besubstituted;
(iii ) in sub -clause ( o ) , for the word ' director ', the words "whole time director or managing director " shall be substituted.
5. उक्त आवंश की धारा-11 कौ उप-धारा (2 ) के उप-पैरा ( ख) और उसमें निहित, प्रावधान के अन्तर्गत शब्द "निर्देशक " के स्थान पर शब्द "पूरे समय के लिए निर्देशक अथवा प्रबन्धक निर्देशक " प्रतिस्थापित किया जाएगा ।
4. In clause 7 of the said Order-
(i) in sub-paragraph ( ii ) of paragraph ( a) and pro- viso given under paragraph ( b) of sub-clause ( 2) , for the word " director " , the words " whole time director or managing director " shall be substituted ;
6. उक्त आदेश की धारा-12 में उप-धारा ( 1 ) में शब्द और अंक " धारा -7 या धारा-8 या धारा-11 " के स्थान पर शब्द, कांष्ठ और अंक " धारा-7 की उप - धारा ( 1 ) या उप- धारा ( 3 ) या धारा -8 या धारा 11 की उप- धारा ( 1 ) " प्रतिस्थापित किए जाएंगे ।
( il) after sub -clause (2 ) , the following sub- clause shall be inserted, namely :--
7. उक्त आदंश की धारा-14क के आरम्भ के वाक्य में शब्द, अंक और कोष्ठ " धारा -7 ( 1 ) के अधीन लिया गया है " के स्थान पर शब्द, अंक और कोष्ठ " धारा-7 की उप -धारा ( 1 ) था उप-धारा ( 3 ) के या धारा -11 की उप -धारा ( 1 ) के अधीन लाइसेंस रद्द करने का कार्य आरम्भ कर दिया या पूर्ण कर दिया गया है ( चाहं जो भी परिणाम हो) " प्रतिस्थापित किए जाएंगे ।

" (3 ) The Central Government or the Chief Controller of Imports and Exports may debar a licensee or exporter or any other person from receiving li- cences or from exporting any goods and direct , without prejudice to any other action that may be taken against such person in this behalf , that no licence shall be granted to such person or no per- mission shall be granted to such person for ex- porting any goods for a specified period under this Order, if in the opinion of the Central Govern- ment or the Chief Controller of Imports and Exports :-
का. वैं. शेषात्रि , मुख्य नियंत्रक, आयात-निर्यात
(a) such licensee , exporter or other person ; or 436/1

(b) where such licensee , exporter or other person is a partnership firm or a limited company , any partner or whole time director or managing director thereof , as the case may be or
(c) where such licensce , importer or other person is a partner in a partnership firm or a whole time director or managing director of a limited company, such partnership firm or limited com- pany, as the case may be,
has-
(i) failed, without sufficient cause , to utilise or to uti- lise fully, any export licence granted or allotment of quota made to such licensee , exporter or other per- son or such partner or whole time director or mana- ing director or such partnership firm or limited com- pany, as the case may be ; or
( ii) committed any act referred to in paragraph ( i ) of sub -clause ( 3 ) of clause 8 of Imports (Control ) Order, 1955 .
5. In clause 11 of the said Order in sub -paragraph ( b ) of sub-clause ( 2 ) and the proviso given thereunder , for the word "director" , the words " whole time director or managing dir- ector" shall be substituted .
6. In clause 12 of the said Order , in sub- clause ( 1 ) , for the words and figures " clause 7 or clause 8 or clause 11 " , the words , brackets and figures " sub- clause ( 1 ) or sub - clause (3) of clause 7 or clause 8 or sub -clause ( 1 ) of clause 11 " shall be substituted .
7. In clause 14A of the said Order, in the opening sen- tence, for the words , figures and bracket " under clause 7 ( 1 ) has been taken" , the words , brackets and figures " under sub- clause ( 1 ) or sub - clause ( 3 ) of clause 7, or to cancel a licence under sub - clause ( 1 ) of clause 11 , has been initiated or comp- leted (whatever the result may be ) " shall be substituted.
