( 2) इन विनियमों में प्रयुक्त अन्य सभी शब्दों तथा अभिव्यक्तियों का, जिन्हें इनमें परिभाषित नहीं किया गया है , परन्तु भारतीय विदेश सेवा, शाब्बा 'ख' ( भर्ती, संवर्ग वरीयता एवं पदोन्नति) नियमावली , 1964 में परिभाषित किया गया है , क्रमशः वही अर्थ होगा जो इन नियमों में विया गया है ।
3. परीक्षा का आयोजन ( 1 ) यह परीक्षा संघ लोक सेवा श्रायोग द्वारा विदेश मंत्रालय की ओर से समय -समय पर अधिसूचित तरीके से आयोजित की जाएगी ।
सा० का० नि० 340 ( अ ) भारतीय विदेश सेवा , शास्त्रा 'ख' ( भर्ती, संवर्ग , वरीयता एवं पदोति ) नियमावली, 1964 के नियम 12 के उप-नियम 3 ( क ) के अनुपालन में विदेश मंत्रालय , इसके द्वारा निम्न- लिखित विनियम बनाता है, अर्थात्
(2) परीक्षा की तारीख और स्थान आयोग द्वारा निश्चित किया आएगा ।
1. संक्षिप्त शीर्षक: ( 1 ) ये विनिमय भारतीय विदेश सेवा, शाखा 'ब' सामान्य , संघर्ग का वर्ग 1 अनुसूचित जाति तथा अनुसूचित जनजाति की आरक्षित रिक्तियों को भरने के लिए ( सीमित विभागीय प्रतियोगिता परीक्षा ) विनियम कहलायेंगे ।
( 2) ये सरकारी राजपक्ष में प्रकाशन की तारीख से लागू होगे ।
2. परिभाषा: ( 1 ) इन विनियमों में, जब तक सन्दर्भ में अन्यथा अपेक्षित न हो:
(क ) " निर्णायक तारीख " से अभिप्रेत होगा जिस वर्ष परीक्षा होनी है उस वर्ष से पूर्व वर्ष के विसम्बर मास का इकतीसवां दिन ।
4. पालता की शर्तें: भारतीय विदेश सेवा, शाखा ' ख' के अनुभाग अधिकारी वर्ग ( सामाम्य संबर्ग के एकीकृत वर्ग II और III ) अथवा भाशुलिपिक उप-संवर्ग के प्रवरण वर्ग का कोई भी स्थायी अधिकारी अथवा कोई अधिकारी जिसका नाम भारतीय विदेश सेवा-शाखा ' ख ' के भनुभाग अधिकारी वर्ग ( सामान्य संवर्ग का एकीकृत वर्ग II और III ) की चयन सूची में या भाशुलिपिक उप-संवर्ग के प्रवरण वर्ग की चयन सूची में शामिल हो और जो अनुसूचित जाति प्रथवा अनुसूचित जनजाति का हो और जो निर्णायक तारीख को निम्नलिखित शर्तें पूरी करता हो, इस परीक्षा में बैठ सकता है , यथा:-
( ७) "परीक्षा" से अभिप्रेत होगा प्रारक्षित रिक्तियों को भरने के लिए सामान्य संवर्ग के वर्ग 1 की चयन सूची में संवर्धन के लिए आयोग द्वारा आयोजित सीमित विभागीय प्रतियोगिता परीक्षा जो अनुसूचित जाति एवं अनुसूचित जनजाति के उम्मीदवारों तक सीमित होगी ।
( 1) सेवा की अवधिः उसने भारतीय विवेश सेवा के अनुभाग अधिकारी वर्ग ( सामाम्य संवर्ग का एकीकृत वर्ग II और III ) में अथवा श्राशुलिपिक उप-संवर्ग के प्रवरण वर्ग में अथवा दोनों में , जैसी भी स्थिति हो, कम से कम चार वर्ष की अनुमोदित और निरन्तर सेवा की हो ।

टिप्पणी ( 1 ) भारतीय विदेश सेवा, शाखा 'ख' के श्राशुलिपिक उप-संवर्ग के प्रवरण वर्ग के मामले में अनुमोषित सेवा में भारतीय विदेश सेवा, शाम्बा 'न' के आशु- लिपिक उप-संवर्ग के वर्ग 1 में की गयी अनुमोदित सेवा की आधी अवधि शामिल होगी ।
( ii) सैनिक ड्यूटी में रहने पर अनुपस्थिति की किसी भी अधि को उक्त पदों में से किसी भी पद के लिए निर्धारित सेवा काल में गिनने की अनुमति दी जाएगी ।
( 2) भारतीय विदेश सेवा, शाखा 'स्व' के सामान्य संवर्ग के एकीकृत वर्ग ii और iii के अनुभाग अधिकारी और श्राशुलिपिक उप-संवर्ग के प्रयग्ण वर्ग के अधिकारी , जो संवर्ग -वाह्य पद पर प्रतिनियुक्त है , यदि अन्यथा योग्य हो तो, इस परीक्षा में बैठ सकते है ।
( 3) भारतीय विदेश सेवा ( स्ट्र) के सामान्य संवर्ग के एकीकृत वर्ग ii और iii का कोई ऐसा अनुभाग अधिकारी या श्रणु- लिपिक उप -संवर्ग के प्रवरण वर्ग का कोई ऐसा अधिकारी जोकिसी संवर्ग-वाह्य पत्र पर नियुक्त हुआ हो अथवा स्थानान्तरण पर किसी अन्य सेवा में नियुक्त किया गया हो और जिसका भारतीय विदेश सेवा शाखा ( ख ) के अनुभाग अधिकारी में य आशुलिपिक उप-संवर्ग के प्रवरण वर्ग में, जैसी भी स्थिति हो, पुनर्ग्रहणाधिकार न हो, इस परीक्षा में नहीं बैठ सकेगा ।
5. पात्रता का निर्णय परीक्षा में प्रवेश के लिए उम्मीदवार की पात्रता अथवा उसके बारे में आयोग का कोई अन्य निर्णय अन्तिम होगा और किमी भी उम्मीदवार को, जिसे आयोग ने प्रवेश प्रमाण-पत्र जारी किया हो, परीक्षा में प्रवेश की अनुमति नहीं दी जाएगी ।
6. परिणाम: ( 1 ) उन उम्मीदवारों के नामों की, जिन्हें प्रायोग किसी परीक्षा के परिणाम के आधार पर चयन के लिए उपयुक्त समझा जाएगा, योग्यताक्रम के अनुसार दो अलग- अलग सूचिया बनाई जाएंगी जिनमें से एक में अनुसूचित जाति के और दूसरी में अनुसूचित जनजाति के सदस्य होंगे , और उसी क्रम में जितने उम्मीदवारों को आयोग द्वारा परीक्षा योग्य ठहराया गया हो उनकी श्रायोग द्वारा अपेक्षित संख्या नक उम्मीदवारों की उपर्युक्त दोनों कोटियों की क्षयन सूची में शामिल किये जाने के लिए सिफारिश की जाएगी ।
( 2 ) प्रत्येक उम्मीदवार को परीक्षा का परिणाम श्रायोग द्वारा निर्धारित किसी तरीके से आयोग द्वारा भी भेजा जाएगा ।
7. चयन: परीक्षा में मफलता से सामान्य सवर्ग के वर्ग 1 की चयन सूची में शामिल किये जाने का अधिकार नहीं मिल जाता जब तक कि केन्द्र सरकार अपेक्षित जांच करवा लेने के बाद इस ओर से सन्तुष्ट नहीं हो जाती कि उम्मीदवार , सेवा में उसके आचरण को ध्यान में रखते हुए, चयन के लिए सभी तरह से योग्य और उपयुक्त है:
लेकिन किसी विशिष्ट उम्मीदवार के वयन की अयोग्यता का निर्णय जिसके लिए आयोग ने सिफारिश की हो, भायोग के परामर्श से किया आएगा ।
8. दुराचरण के लिए दण्ड उस उम्मीदवार को , जिसे आयोग ने निम्मलिखित कारणों से दोषी घोषित किया हो:-
(क) किसी भी तरीके से अपनी अभ्यर्थिता के लिए समर्थन प्राप्त करने; श्रथवा
(ख) प्रतिरूपण करने; श्रथवा
(ग) किसी व्यक्ति द्वारा प्रतिरूपण करवाने; अथवा
(घ) जाली अथवा ऐसे वस्तावेज प्रस्तुत करने जिनमें हेर-फेर किया हो; अथवा
(ङ) गलत अथवा असत्य विवरण देने अथवा तथ्य को छिपाने; अथवा

(च) परीक्षा के लिए अपनी अभ्यधिता के सम्बन्ध में किसी अन्य अनिर्यामत अथवा अनुचित तरीकों से काम लेने; प्रथजा
(छ) परीक्षा भवन में अमुचित तरीके अपनाने; अथवा
(ज) परीक्षा भवन में दुर्व्यवहार करने; अथत्रा
( स) उल्लिखित धाराओं में बताया गया कोई कार्य करने का प्रयत्म अगर कोई करता हो या इन कामो को करने के लिए किसी को उकसाता हो तो उसके खिलाफ अपराधिक अभियोग तो चलाया ही जा सकता है, इसके प्रतिरिक्त उने:-
(क) श्रायोग द्वारा उम परीक्षा के लिए अयोग्य ठहराया जा मकता है जिसके लिए वह उम्मीदवार हैः पथवा
(ख) ( i ) भायोग द्वारा उसके द्वारा आयोजित किमी भी परीक्षा अथव चयन या;
(ii ) केन्द्र सरकार द्वार अपने अधीन किसी भी नियोजन से;
स्थायी रूप से अथवा किसी विनिदिष्ट अधि के लिए बहिष्कृत किया जा सकत है ।
(ग) समुचित नियमों के अन्तर्गत अनुणासनिक कार्यवाही की जा सकती है ।

MINISTRY OF EXTERNAL AFFAIRS NOTIFICATION New Delhi , the 31st May, 1979
G.S.R. 340(E).In pursuance of sub - rule 3 (a ) of Rule- 12 of the Indian Foreign Service , Branch 'B ' ( Recruitment , Cadre , Seniority and Promotion ) Rules , 1964, the Ministry of Ex- ternal Affairs hereby makes the following regulations. namely
1. Short title. ( 1 ) These regulations may be calied the Indian Foreign Service, Branch ' B' Grade - I of the General Cadre ( Limited Departmental Competitive Examination for filling vacancies reserved for Scheduled Castes and Scheduled Tribes) Regulations , 1979 .
(2) They shall come into force on the date of their pub- lication in the Official Gazette .
2. Definitions . ( 1 ) In these regulations , unless the context otherwise requires :-
( a) " Crucial date " means the thirty first day of Decem- ber of the year preceding the year in which the examination is held.
(b) " examination" means a Limited Departmental Com- petitive Examination held by the Commission and confined to the candidates belongnig to the Scheduled Castes and Scheduled Tribes for making additions to the Select List for Grade- 1 of the General Cadre against reserved vacancies .
(2) All other words and expressions used in these regula- tions and not defined but defined in the Indian Foreign Ser- vice, Branch ' B ' ( Recruitment, Cadre , Seniority and Promotion) Rules , 1964 shall have the meanings respectively assigned to them in these Rules .
3. Holding of the examination. ( 1 ) The examination shall be conducted by the Commission in the manner notified by the Ministry of External Affairs from time to time.
(2) The dates on which and the places at which the exami- nation shall be held shall be fixed by the Commission .
4. Conditions of eligibility. Any permanent officer of the Section Officers ' Grade ( Integrated Grades -II & III of the General Cadre ) or Selection Grade of the Stenographers' Sub-Cadre of the Indian Foreign Service, Branch ' B' or any officer whose name has been included in the Select List for भारत का राजपत्र असाधारण

the Section Officers' Grade ( Integrated Grades - II and III of the General Cadre ) or the Select List for Selection Grade of the Stenographers ' Sub - Cadre of IFS ( B ) and who belongs to any Scheduled Caste or Scheduled Tribe and who , on the crucial date , satisfies the following conditions shall be eligible to appear at the examination , namely :-
(1) Length of Service . He should have rendered not less than 4 years approved and continuous service in the Section Officers ' Grade ( Integrated Grades - II and III of the General Cadre ) or in the Selection Grade of the Stenographers ' Sub -Cadre of the Indian Foreign Service, Branch ' B' or in the both , as the case may be .
Note (0 ) In the case Selection Grade Officers of the Steno- graphers' Sub - Cadre of the Indian Foreign Service , Branch 'B' the approved service shall include halt of the approved service rendered in Grade- l of the Stenographers ' Sub- Cadre of the Indian Foreign Service , Branch 'B' .
(ii) Any period of absence on Military duties may he allowed to be counted towards the prescribed length of service in any of the above posts.
( 2) Section Oflicers of the Integrated Grades - II and III of the General Cadre and Officers of Selection Grade of the Stenographers ' Sub- Cadre of IFS ( B ) who are on deputation to ex- cadre post shall be eligible to appear at the examination if otherwise cligible.
(3 ) A Section Officer of the Integrated Grades - II and 111 of the General Cadre or an officer of Selection Grade of the Stenographers ' Sub- Cadre of IFS ( B ) who has been appointed to an ex - cadre post or to another service on transfer and does not have a lien in the Section Officers' Grade or Selection Grade of the Stenographers ' Sub - Cadre of the IFS (B ) , as the case may be , sha'l not be eligible to appear at the examination .
5. Decision as to eligibility.-- The decision of the Commis- sion to the cligibility or otherwise of a candidate for admis- sion to the examination shall be linal and no candidate to whom a certificate of admission has not been issued by the Commission shall be admitted to the examination,
6. Results . ( 1 ) The names of the candidates who are con- sidered by the Commission to be suitable for selection on the result of any examination shall be arranged in the order of merit in two separate lists , one being for candidates belonging to the Scheduled Castes and the other being for candidates belonging to the Scheduled Tribes , and in that order as many candidates , as are found by the Commissionto be qualified shall be recommended for inclusion in the Sclect List for each of the aforesaid two categories of candidates upto the required number .

(2 ) The results of the examination shall be communicated to individual candidates by the Commission in such manner as may be determined by the Commission .
7. Selection. Success in the examination confers no right to be included in the Select List for Grade -I of the General Cadre unless the Central Government is satisfied , after such enquiry as may be considered necessary , that the candidate , having regard to his conduct in service, is suitable in all res- pects for sclection :
Provided that the decision as to whether a particular can- didate recommended for selection by the Commission is not suitable shall be taken in consultation with the Commission .
8. Penalty for Misconduct . A candidate who is or has been declared by the Commission to be guilty of :-
( a ) Obtaining support for his candidature by any means ; or
(b) Impersonating , or
( c) Procuring impersonation by any person ; o
(d) Submitting fabricated documents or documents which have been tampered with or
(c) Making statements which are incorrect or false ; or suppressing material information ; or
(f) Resorting to any other irregular or improper means in connection with his candidature for the examina- tion; or
(g ) Using unfair means in the examination hall ; or
(h) Misbehaving in the examination hall ; or
(i ) Attemptingto commit or , as the case maybe , abet- ting the Commission of all or any of the acts spe- cified in the foregoing clauses,
may in addition to rendering himself liable to criminal pro- secution , be liable :-
(A) to be disqualified by the Conunission from the examination for which he is a candidate ; or
(B ) to be debarred either permanently or for a specified period:-
( i) by the Commission , from any examination or Selection held by them ;
( ii) by the Central Government from any employment under them ; and
( c ) to disciplinary action under the appropriate rules .
