सा० फा० ति० 399 ( ८) कतिपय नियमों का निम्नलिखित मसौदा कलकत्ता पत्तन कान्यासी मण्डल ( न्यासियों को शुल्क और भत्तों की भवायगी ) नियम, 1975 का संशोधन करने के लिए जिन्हें केन्द्रीय सरकार ने महा बत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 122 की उपधारा ( 1 ) द्वारा प्रवस शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव किया है, उक्त धारा की उप-धारा ( 3 ) द्वारा यथापेक्षित उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है जिनके उक्त नियमों से प्रभाषित होने की संभावना है और यह सूचित किया जाता है कि इस अधिसूचना के राजपक्ष में प्रकाशित होने की तारीख से लेकर पैंतालीस वियों को अवधि समाप्त होने पर या उसके बाद उक्त मसौदे पर विचार किया जायेगा ।
केन्द्रीय सरकार उक्त अवधि समाप्त होने से पूर्व उक्त मझौवे के संबंध में किसी भी व्यक्ति से प्राप्त होने वाली आपत्तियों या सुझावों पर विचार करेगी ।
नियों का मसौक
1. ( 1 ) इन नियमों का नाम कलकत्ता पतन का न्यासी मण्डल (क्या- मियों को शुल्क धौर भत्तों की धंदामगी ) संबोधन निमम, 1979 है।

( 2) ये राजपत्र में प्रकाशित होने की तारीख को प्रवृत होंगे ।
2. कलकत्ता पत्तभ का न्यासी मण्डल ( न्यासियों को शुल्क और भत्तों की अदायगी ) नियम, 1975 में, नियम 4 के बाद, निम्मलिखित नियम रखा जाएगा, अर्थात्
" 5 जो न्यासी संतव सवस्य ही था राज्य विधान सभा का सदस्य हो, उसे कुछ भत्तों की भवायगी करना:-
निमम 2 और 3 में कुछ भी कहे जाने के बावजूद कोई भी ग्यासी जो संसद सदस्य अथवा राज्य विधानसभा का सदस्य भी हो, संतथ ( निरै- हता निवारण ) अधिनियम, 1959 ( 1959 का 10 ) की धारा 2 के खण्ड (क) में यथापरिभाषित प्रतिपूरक भत्ते की छोड़कर, जेसी भी स्थिति हो, अन्य किसी भी शुल्क का हकदार नहीं होगा, या उभ भत्तों को छोड़कर , यदि कोई हों तो, जिन्हें राज्य विधान सभा का सदस्य इस प्रकार की निरहंता के बिना राज्य विधानसभा की सदस्यता के लिए निरहंता निवारण के संबंध में राज्य में उस समय लागू किसी भी काढून के अधीन प्राप्त करता हो अन्य किसी भी शुल्क का हकदार नहीं होगा । "

the Central Government proposes to make in exercise of the powers conferred by sub- section ( 1) of section 122 of the Major Port Trusts Act , 1963 (38 of 1963 ) , is hereby pub- lished, as required by sub- section (2) of the said section, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration on or after the expiry of a period of forty five days from the date of publication of this notification in the Official Gazette .
Any objections or suggestions which may be received from any person with respect to the said draft before the expiry of the said period will be taken into consderation by the Central Government ,
DRAFT RULES
1. (1) These rules may be called the Board of Trustees of the Port of Calcutta (Payment of Fees and Allowances to Trustees) Amendment Rules, 1979 .
(2) They shall come into force on the date of their pub- lication in the Official Gazette .
2. In the Board of Trustees of the Port of Calcutta (Pay- ment of Fees and Allowances to Trustees) Rules , 1975 after rule 4 , the following rule shall be inserted , namely :
"5. Payment of certain allowances to a Trustee who is a member of Parliament or of the Legislature of a State Notwithstanding anything contained in rules 2 and 3 , a Trustees who is also a member of Par- liament or of the Legislature of a State , shall not be entitled to any fees other than the compensatory allowance as defined in clause ( a) of section 2 of the Parliament (Prevention of Disqualification) Act , 1959 ( 10 of 1959) or , as the case may be , other than the allowances , if any, which a member of the Legislature of the State may, under any law for the time being in force in the State relating to prevention of disqualification for membership of the State Legislature , receive without incurring such disqualification ." the

2. बम्बई पत्तन का न्यासी मण्डल ( न्यासियों को शुल्क और भत्तों की अदायगी ) नियम, 1975 में , नियम 4 के बाद , निम्नलिखित नियम रखा जाएगा, अर्थात्:-
" 5 जो न्यासी संसद सदस्य हो या राज्य विधान सभा का सदस्य हो, उसे कुछ भत्तों की भदायगी करना:-
नियम 2मौर 3 में कुछ भी कहे जाने के बावजूद कोई भी न्यासी जो संसद सदस्य अथवा राज्य विधानसभा का सदस्य भी हो, संसद ( निरर्हता निवारण)

अधिनियम, 1959 (1959 का 10) की धारा 2 के खण्ड ( क ) में यथापरिभाषित प्रतिपूरक भत्ते को छोड़कर , जेसी भी स्थिति हो, मभ्व किसी भी शुल्क का हकदार नहीं होगा, या उन भत्तों को छोड़कर , यवि कोর্জ हों तो, जिन्हें राज्य विधान सभा का सदस्य इस प्रकार की निरहंता के बिना राज्य विधानसभा की सदस्यता के लिए निरर्हता निवारण के संबंध में राज्य में उस समय लागू किसी भी कानून के अधीन प्राप्त करता हो अन्य किश्ती भी शुल्क का हकदार नहीं होगा । "

नियमों का मौका
1. ( 1 ) क्षण नियमों का नाम मद्रास क्त्तन का प्यासी मंडल (न्यासियों को शुल्क और भत्तों की अवामगी ) संशोधन नियम, 1979 है।
(2) वे राजपन में प्रकाशित होने की तारीख को प्रवृप्त होंने ।
2. मद्रास पसन का न्यामी मण्डल (न्यासियों को शुल्क और भत्तों की अदायगी) नियम, 1975 में, नियम 2 के बाव, निलिखित नियम रखा जायेगा, अर्थात:--
3 जो म्यासी संसद सदस्य हो या राज्य विधान सभा का सदस्य हो, उसे कुछ भत्तों की अदायगी करना:--
नियम 2 में कुछ भी कहे जाने के बावजूद कोई भी न्यासी जो समव सदस्य अथवा राज्य विधानसभा का सदस्य भी हों, संसथ (निरंहता मिवारण ) अधिनियम, 1959 ( 1959 का 10 ) की धारा 2 के खण्ड (क) में ग्रथापरिभाषित प्रतिपूरक भले को फोड़कर, जैसी भीस्थिति हो, अन्य किसी भी शुल्क का हकदार नहीं होगा , या उन भत्तों को छोड़कर, यदि कोई हो तो, जिन्हें राज्य विधान सभा का सदस्य इस प्रकार की निरर्हता के बिना राज्य विधानसभा की सदस्यता के लिये निरहंता निवारण के संबंध में राज्य में उस समय लागू किसी भी कानून के अधीन प्राप्त करता हो अन्य किसी भी शुल्क का हकदार नहीं होगा ।

सा० का०नि० 402 (प्र) कतिपय नियमों का निम्नलिखित मसौषा तूतीकोरिन पत्तन का म्यासी मध्ाल (म्यासियों की शुल्क और नतों की अदायगी ) नियम, 1979 का संशोधन करने के लिये जिन्हें हैसीय सरकार ने महा-पत्तम न्यास अधिनियम, 1963 (1963 का 38 ) की धारा 122 की उपधारा ( 1 ) द्वारा प्रदत्त बस्तियों का प्रयोग करते हुए वनाने का प्रस्ताव किया है , उक्त धारा को रुपवारा ( 2) द्वारा यथापेक्षित उन सभी व्यक्तियों की जानकारी के लिये प्रकाशित किया जाता है जिनके उक्त नियमों से प्रभावित होने की संभावना है और यह सूचित किया जाता है । कि इस अधिसूचना के राजपक्ष में प्रकाशित होने की तारीख से लेकर पेंतालीस वितों की अवधि समाप्त होने पर या उसके उसके भाव उक्त मसौदे पर विचार किया जायेगा ।
केन्द्रीय सरकार उक्त भवधि समाप्त होने से पूर्व उक्त मसीचे के संबंध में किसी भी भ्यक्ति से प्राप्त होने बासी मापत्तियों या सुझावों पर विचार करेगी ।

1. ( 1 ) इन नियमों का नाम तूतीकोरिन पत्तन का न्यासी मण्डल (ग्यासियों को शुल्क और भत्तों की अदायगी) संशोधन नियम, 1979 है। (2 ) वे राजपत्र में प्रकाशित होने की तारीख को प्रवृत्त होंगे ।
2. तूतीकोरिन पत्तन का म्यासी मण्डल (न्यासियों को शुल्क और भतों की भषायगी ) नियम, 1979 में, नियम 3 के बाद, निम्नलिखित नियम रखा जायेगा , अर्थात-
" 4. जो न्यासी संसद सदस्य हो या राज्य विधाम सभा का सदस्य हो, उसे कुछ भत्तों की अदायगी करना:--
नियम 2 और 3 में कुछ भी कहे जाने के बावजूद कोई भी प्यासी भो संसद सदस्य भथवा राज्य विधानसभा का सदस्य भी हो, संधव (निरहंता निवारण ) अधिनियम, 1959 ( 1959 का 10 ) की धारा 2 के खण्ड (क ) में यथापरिभाषित प्रतिपूरक भत्त को छोड़कर , जैसी भी स्थिति हो , अन्य किसी भी शुल्क का हकवार महीं होगा , या उन भत्तों को छोड़कर , यदि कोई हों तो, जिन्हें राज्य विधान सभा का सदस्य इस प्रकार की निरहंता के बिना राज्य विधानसभा की सदस्यता के लिये निरहंता निवारण के संबंध में राज्य में उस समय लागू किसी भी काम्न के अधीन प्राप्त करता हो अम्म किसी भी सुल्क का तुफदार नहीं होगा । "

2. In the Board of Trustees of the Port of Tuticorin (Pay- ment of Fees and Allowances to Trustees) Rules , 1979 after rule 3 the following rules shall be inserted, namely:-
"4. 2. In the Mormugao Port Trust ( Payment of Fees and Allowances to Trustees) Rules 1964 , after rule 4, the follow- ing tule shall be inserted , namely :

सा०का० ति० 403 (थ ) कतिपय नियमां का निम्नलिखित मसौदा मार्मुगाश्रो पत्लत का न्यासी मण्डल (न्यामियों को शुरुत श्रऔर भत्तों की अदायगी ) नियम , 1964 का संशोधन करने के लिये जिन्हें केन्द्रीय सरकार महा पतन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 122 की उपधारा ( 1 ) द्वारा प्रवर शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव किया है, उक्त धारा को उपधारा ( 2 ) द्वारा यथा- पेक्षित उन सभी व्यक्तियों की जानकारी के लिये प्रकाशित किया जाता है जिनको उक्त नियमों से प्रभावित होने की संभावना है और यह मूचित किया जाता है कि इस अधिसूचना के राजपत्त में प्रकाशित होने की तारीख से लेकर पैतालीम विनों की अवधि समाप्त होने पर या उसके बाद उक्ल मसौदे पर विचार किया जायेगा ।
केन्द्रीय सरकार उक्त अवधि समाप्त होने के से पूर्व उक्न मसौदे के संबंध में किसी भी व्यक्ति से प्राप्त होने वाली मापत्तियों या सुझावों पर विचार करेगी ।

1. (1 ) इन नियमों का नाम मार्मुगाभो पत्तम का म्यासी मण्डल (म्यासियों को शुल्क भौर भत्तों की अवायगी ) संशोधन नियम , 1979 है । ( 2 ) वे राजपक्ष में प्रकाशित होने की तारीख को प्रवृत्त होंगें ।
2. मार्भुगाभो पत्तन का ग्यासी मण्डल ( न्यासियों को शुल्क और भत्तों की अदायगी ) नियम , 1964 में, नियम 3 के बाद , निम्नलिखित नियम रखा जाएगा, भर्थात-
" 5. जो न्यासी संप्तद् सदस्य हो या राज्य विधान सभा का सवस्म
हो, उसे कुछ पत्तों की अदायगी करना:
नियम 3 और 4 में कुछ भी कहे जाने के बावजूद कोई भी न्यासी जो संप्तद् सवस्म अथवा राज्य विधान सभा का सवस्थ भी हो, संतव ( निरहंता निबारण) अधिनियम, 1959 ( 1959 का 10 ) की धारा 2 के खण्ड (क ) में यथापरिभाषित प्रतिपुरक भत्ते को छोड़कर जैमी भी स्थिति हो, अन्य किसी भी शुल्क का हकदार नहीं होगा , या उन भलों को छोड़कर, यदि कोई हो तो , जिन्हें राज्य विधान सभा का सदस्य इस प्रकार के निरर्हता के बिना राज्य विधान सभा की सदस्यता के लिए निरर्हता निवारण के संबंध में राज्य में उस समय लागू किमी भी कानून के अधीन प्राप्त करता हो अन्य किसी भी शुल्क का हकदार नहीं होगा ।

सा०फा० ति ० 404 ( अ ) फतिपय नियमों का निम्नलिखित मसौषा पारादीप पत्तन का न्यासी मण्डल ( न्यासियों को शुक्क भौर भत्तों की भदायगी ) नियम, 1967 का संशोधन करने के लिये जिन्हें केन्द्रीय सरकार ने महा पत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 122 की उपधारा ( 1 ) द्वारा प्रदत्त सक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव किया है, उक्न धारा की उपधारा ( 2 ) द्वारा मथापेक्षित उन सभी व्यक्तियों की जानकारी के लिये प्रकाशित किया जाता है जिनके उक्त नियमों से प्रभावि होने की संभावना है और यह सूचित किया जाता है कि इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से लेकर पैतालीस विनों की अवधि समाप्त होने पर या उसके बाद उक्त मसौदे पर विचार किया जायेगा ।
कैन्द्रीय सरकार उक्त अवधि ममाप्त होने से पूर्व उक्त मसौदे के संबंध में किसी भी व्यक्ति से प्राप्त होने वाली आापतियों या सुझावों पर विचार करेगी ।
नियमों का मसौवा
1. (1) इन नियमों का नाम पारावीप पत्तन का त्यासी मण्डल ( न्यासियों को शुल्क और भत्तों की अदायगी ) संशोधन नियम , 1979 है ।
(2) वे राजपत्र में प्रकाशित होने की तारीख को प्रवृत्त होंगें । 2. पारादीप पत्तन का न्यासी मण्डल (म्यासियों की शुल्क भौर भत्तों की प्रदायगी) नियम , 1967 में, नियम 3 के बाद निम्नलिखित नियम रखा जायगा अर्थात्:--
" 4. जो ग्यासी संतष मवस्य हो या राज्य विधान सभा का सदस्य हो, उसे कुछ भत्तों की अदायगी करना:
नियम 2 और 3 में कुछ भी कहे जाने के बावजूद कोई भी न्यासी जो संपद सवस्य अथवा राज्य विधान सभा का सदस्य भी हो, संतव निरहेता निवारण ) अधिनियम, 1959 (1959 का 10 ) को धारा 2 के खण्ड ( क ) में यथापरिभाषित प्रतिपूरक भन्ने को छोड़कर जैसी भी स्थिति हो, प्रत्य किसी मुल्क का हकदार नहीं होगा, या उन भत्तों को छोड़कर यदि कोई हो तो, जिन्हे राज्य विधान सभा का सदस्य इस प्रकार के निर हंता के लिये बिना राज्य विधान सभा की सदस्यता के लिये निरहंता निवारक के संबंध में राज्य में उम ममय लागू किसी भी स्वीय विधि कानून के अधीन प्राप्त करता हो अन्य किसी भी शुल्क का हकदार नहीं होगा ।

(38 of 1963 ) , is hereby published, as requiredby sub - section (2) of the said section, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration on or after the expiгу of a period of forty - five days from the date of publication of this notification in the Official Gazette .
Any objections or suggestions which may be received from arry person with respect to the said draft before the expiry of the said period will be taken into consideration by the Central Government .
DRAFT RULES
1. ( 1 ) These rules may be called the Paradip Port Trust (Payment of Fees and Allowances to Trustees ) Amendment Rules, 1979.
(2) They shall come into force on the date of their publi- cation in the Official Gazette .
2. In the Paradip Port Trust ( Payment of Fees and Allow- ances to Trustees) Rules , 1967 , after rule 3 , the following rule shall be inserted , namely :-
"4. Payment of certain allowances to a Trustee who is a member of Parliament or of the Legis'ature of a State: Notwithstanding anything contained in rules 2 and 3 , a Trustee who is also a member of Parliament or of the Legislature of a State , shall not be entitled to any fees other than the compensatory allowance as defined in clause ( a) of section 2 of the Parlia- ment (Prevention of Disqualification) Act, 1959 (10 of 1959) or , as the case may be , other than the allowances , if any , which a member of Legislature of the State may, under any law for the time being in force in the State relating to the prevention of dis- qualification for membership of the State Legislature, receive without incurring such disqualification. "

सा०फा० नि० 405 ( प्र) . कतिपय नियमों का निम्मलिखित मसौषा महा पत्तम न्यास ( न्यासियों को शुल्क और भत्तों की प्रवायगी ) नियम , 1964 का संशोधन करने के लिये जिन्हें केन्द्रीय सरकार ने महा पक्षन म्यास प्रधिनियम , 1963 ( 1963 का 38) की धारा 122 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव किया है, उक्स धारा की उपधारा ( 2 ) द्वारा यथाधपेक्षित उन सभी व्यक्तियों की जानकारी के लिये प्रकाशित किया आता है जिनके उक्त नियमों से प्रभावित होने की संभावना है और यह सूचित किया जाता है कि इस अधि- सूचना के राजपत्र में प्रकाणित होने की तारीखा से लेकर पैतालीस विनों की अवधि समाप्त होने पर या उसके बाद उक्त मसौदे पर विचार किया जायेगा ।
केन्द्रीय मरकर उक्त अवधि समाप्त होने से पूर्व उक्त मसौदे के संबंध में किसी भी व्यक्ति से प्राप्त होने वाली प्रापत्तियों या सुझावों पर विचार करेगी ।
नियमों का मलौवा
1. ( 1 ) इन नियमों का नाम महा पत्तन का ग्यासी मण्डल ( म्पासियों को शुल्क और भत्तों की अदायगी ) संशोधन मियम, 1979 है ।
( 2 ) के राजपक्ष में प्रकाशित होने की तारीख को प्रवृत्त होंगे ।
2. महा पत्तन का न्यासी मण्डल ( न्यासियों को शुल्क और भत्तों की भदायगी ) मियम, 1964 में , नियम 4 के बाव निम्नलिखित नियम रखा जायगा, अर्थात
" 5. जो न्यासी संसद सदस्य हो या राज्य विधान सभा का सवस्य हो. उसे कुछ भत्तों की अदायगी करना:-
नियम 3 और 4 में कुछ भी कहे जाने के बावजूद कोई भी प्यासी जो संसद सदस्य अथवा राज्य विधान सभा का सदस्य हो , संसद ( निरर्हता निवारण) अधिनियम , 1959 ( 1959 का 10 ) को धारा 2 के खण्ड (क ) में यथा परिभाषित प्रतिपूरक भत्ते को छोड़कर जैसी भी स्थिति हो, झन्य किसी भी शुल्क का हकवार नहीं होगा, या उन भत्तों को छोड़कर यदि कोई हो , तो जिन्हें राज्य विधान सभा का सदस्य इस प्रकार के निरहंता के बिना राज्य विधान सभा की सदस्यता के लिये निरहंता निवारण के संबंत में राज्य में उस समय लागू किसी भी कानून के अधीन प्राप्त करता हो अन्य किसी भी शुल्क का हुकदार नहीं होगा ।
