7 94 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC, 1J dated 29-6-1979, the following decisions have been taken by ttje Government in respect of quota allocation for ready- made garments of cotton, wool and man-made fibre.MINISTRY OF COMMERCE, CIVIL SUPPLIES AND COOPERATION
(Department of Commerce) New Delhi, the 30th July, 1979 EXPORT TRADE CONTROL
PUBLIC NOTICE NO. 51-ETC(PN) /79
Sub : Scheme for exports under OGL. 3 of textiles made from cotton, wool and man-made fibres to U.S.A. and EEC Member States from 1-7-1979 to 31-12-1979.
FHe No. Z/26/78-EL—Attention is invited to the Exports (Control) Amendment Order No. E(C)O, 1977/AM(85), dated 1-1-1979 and Public Notices No. 2-ETC(PN)/79 dated 1-1-1979 and No. 43-ETC(PN)/79 dated 29-6-1979.
2. In partial modification of the scheme of exports an- nounced through the Public Notice No. 43-ETC(PN)/79 3. It has been decided that extension of the period of shipment may be allowed till 31-8-1979 for quotas obtained during January—June, 1979 if the exporter has shown evi- dence of adequate interest in exports. Thus, relaxation for shipment will be allowed to such exports who have made shipments to the extent of 2/3rd (Two-third) of their quota by 30th June, 1979 in the particular category-country group. As actual verification in tnis regard may take time, the Apparels Export Promotion Council will allow extension if the request for it is backed by an aflidiivit from the exporter in this regard to be followed later by actual pioof of ship- ment to the extent of 2/3rd (by 30th June, 1979) within one month. If the claim regarding 2/3rd shipment is found wrong, penalty provisions as outlined in the above said Public Notice of 29-6-1979 may be applied and the exporter may be debarred from further quota allocation. Further, penal provisions may be applied on usual lines if export is bdow 95 per cent of the allotment for which extension ha" been allowed. As usual Textile Commissioner would decide on cases of "force majeure" conditions in this regard for which appropriate exemption may be provided.
4. With a view to utilising more quotas in respect of slow moving garments items, it has been decided that for such country—category group where shipment upto 30-6-1979 has not been to the extent of even 50 per cent of the annual level, the allocation will be quite free either for ready goods or for reservation of contracts without the condition of bank, guarantee or cash deposit Allocation for firm con- tracts will of course be made only if the application Is ac- companied by L/C. Category 338/339/340 (shirts) for USA and Category 7 (bluses) for West Germany are also included in this category of slow moving items as these are bulk items.
5. In respect of Category 341 (blouses) for USA, the availability has been studied after taking into account de- mand under ready goods and it has now been decided to leave aside some quantity under this category for alloca- tion against contract reservation basis. The quantity will 'be determined by the Government according to the necessity and keeping in view the demand. This approach may also bo applied in cases where (a) no contract reservation was open- ed earlier, (b) the quota utilisation has been less than 75 per cent of the annual level by 30-6-1979 and (c) the quan- tity available is adequate to justify opening a "contract re- servation" window. In all such cases, shipment may be effected by 15-11-1979, unless further extension is granted. The terminal date criterion of unit price will remain opera- tive. All other provisions namely, production of L/C, usual penal provisions for shipment below 90 per cent etc may remain valid,
6. All other terms and conditions outlined in the Public Notice No. 43-ETC(PNJ/79 dated 29-6-1979 referred to above will remain unchanged,
