EXPORT TRADE CONTROL

SUB :—Determination of quotas for the export of Garments for the year 1980 under "Past Performance" Scheme.

N".2/25/78-E.I Attention i9 invited to the Ministry of Commerce Export Trade Control Public No. 64-ETC(PN)/79 dated 14th September, 1979, according to which, 40% of the annual level of the quotas for the export of garments for the year 1980 have been car- mirked for allotment on the basis of "Past Performance" and the basic quota for this purpose has to be determined on the basis of actual exports made during the basic period i.e. years 1976, 1977 and 1978 as an average of actual exports made during these three years. It has aho been provided In the aforesaid Public Notice that such of the exporters of garments who wish to take advantage of the exports during the year 1979 (i.e. 1st January to 30th June, 1979) may also do so, but in such cases the basic quota will be determined by dividing their exports daring the basic period including the year 1979 as aforesaid, by Four. The determination of quotas on the basis of "past performance" is to be done by the Chief Controller of Imports and Exports, Udyog Bhawan, New Delhi.

2. The intending exporters of garments who desire to apply for allotment of quotas on the basis of "past performance" should submit their applications In tho form given in Anncxure I to this Public Notice so as to reach the office of the Chief Controller of Imports and Exparts, Udyog Bhawan, New Delhi, by 5th October, 1979, the latest. Applications received after the prescribed date will be ' summarily rejected and no correspondence In this regard will be entertained,

3. The applications whould be accompanied by the following documents :—

(a) Shipping Bill/Air-way Bill duly attested by the Customs-—original or photostat copy. (b) Bank certificate, in original. (c) Invoice duly attested by the bank, in original. (d) Statement showing export of garments during the basic period, duly certified by a Charteied Accountant in practice, in the fcim prescribed in Annexure II to this Public Notice.

(o) A Treasury Receipt of Rs. 50/- (Rupees fifty) credited under the Head "Export Licence Application Fee" subordinate to the Major Head "097—Foreign Trade and Export Promotion".

The application fee should be deposited in any one of the branches of Central Bank of India, who have been authorised to receive rTC/ETC deposits. If the applicant is located in a district which does not have a branch of Central Bank of India authorised to receive such deposits tho facility of remittance of application fee through Bank Draft will be available.

It is clarified that even if a party does not have any exports during any of the years in the prescribed basic period viz, 1976,1977 and 1978, the exports during any one or two years of this period will still be divisible by 3 to arrive at the basic average exports during the basic period. Similarly, in cases where exports during the year 1979 (upto 30th June, 1979) are also claimed for computation of basic quota, the exports made in any one, two or three years of the basic period will be divisible by 4 to arrive at the basic average exports during the basic period.

5. As exports of samples do not qualify for allotment of quota, such exports should not be included in the Statement of exports.

6. An exporter need submit details of past performance only for such country-category formation in whichJie is claiming quota for past performance.

7. The applications and the accompanying documents should be complete in all respects. Incomplete applications will be summa- rily rejected and no correspondence in this regard will be entertained.

8. The quotas for the export of garments for the year 1980 under "Past Performance" Scheme will be intimated by the office of Chief Controller of Imports and Exports to tho Apparels Export Promotion Council for issue of quota Certificates, in due course. No corres- pDndcnce in this regard will be entertained by the Chief Controller of Imports and Exports.

9. Attention of the Exporters is specifically invited to the declaration incorporated in the Statement of Exports (Annexure II), accor- ding to which the information to be given in the Statement should be true and correct. It is to be clearly understord that any quota gran- ted on the basis of the information and the supporting documents, will be liable for cancellation, in addition to any other penal action that may b= taken in this behalf, if it is found that any part of the information furnished is incorrect, false or misleading.
