Aggarwal beiDg the competent authority under Section 269B of the Income-Tax Act, 1961 (43 of 1961) (herein-after referred to as the 'said Act') have reason to bclive thut the immovable property, having a fair market value exceeding Rs. 25,000 and beai'ing No. land si'iuilcd at Beawar (and more fully described in the schedule annexed hereto) ha? been transfer- red under the Registration Act, 1908 (16 of 1908) in the office of the Registering Officer at Beawar on 29-12-79 lot am apparent consideration which is less than the fair market value of the afforesaid property and I have reason lo believe that the fair market value of the property ns afoicsaid exceeds the apparent consideration by more than fifteen per- cent of such apparent consideration and thai the considera- (a) facilitating the reduction or evasion of the liability of the 'ransferor to pay tax under the said Act in respect of any income arising from the transfer ; and/or
(b) facilitating the concealment of any income or any moneys or other assets which have not been or which ought to be disclosed by the transferee for ;he purpose of the Indian Income-tax Act, 1922 (11 of 1922) or ihc said Act or the wealth-tax Act, 1957 (27 of 1957) ;

Explanation :—The terms and expic. sinus herein as are defined in chapter XXA of the said Act, shall have the same meaning as given in the Chapter.
