का. आ. 618 (अ) -18 कक/उ.वि.वि.अ./79 .-यतः मैसर्स श्री सरस्वती प्रैस लिमिटेड , 11 , बैरकपुर ट्रंक रोड , बेलघरिया , कलकत्ता (जिसे एतद्भश्चात् उक्त औद्योगिक उपक्रम कहा गया है) एक अनुसूचित उद्योग अर्थात् प्रिंटिंग उद्योग में कार्यरत है ।
और चूंकि केन्द्रीय सरकार के अपने कब्जे में की दस्तावेजी और अन्य साक्ष्य से यह समाधान हो गया है कि उक्त औद्योगिक उपक्रम तीन महीनों से अन्यून अवधि के लिए बन्द रहा है और इस प्रकार का बन्द किया जाना संबंधित अनुसूचित 789 GI /79

उद्योग के हितों के प्रतिकूल है व औद्योगिक उपक्रम के स्वामित्व वाली कम्पनी की वित्तीय स्थिति तथा ऐसे उपक्रम का संयंत्र और मशीनें ऐसी हैं कि इस उपक्रम को पुनः चालू करना सम्भव है तथा इस प्रकार उसका पुनः चलाया जाना आम जनता के हितों के लिए आवश्यक है ;
अतः अब केन्द्रीय सरकार उद्योग (विकास तथा विनियमन) अधिनियम 1951 ( 1951 का 65) की धारा 18 कक की उप - धारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सेक्रेटरी क्लोज्ड एण्ड सिकइन्डस्ट्रीज डिपार्ट- मेंट , पश्चिमी बंगाल सरकार कलकत्ता( जिसे एतपश्चात् प्राधिकृत व्यक्ति कहा गया है) उक्त औद्योगिक उपक्रम के सम्पूर्ण प्रबन्ध को निम्नलिखित निबन्धनों एवं यतों के अधीन हाथ में लेने के लिए प्राधिकृत करती है , अर्थात्: -
(1) प्राधिकृत व्यक्ति उन सभी निदेशों का पालन करेंगे जो केन्द्रीय सरकार समय- समय पर जारी करे ।
(2) प्राधिकृत व्यक्ति इस आदेश के राजपत्र में प्रकाशन की तारीख से तीन वर्षों की अवधि तक पद धारण करेगा ।
(3) केन्द्रीय सरकार , यदि वह ऐसा करना आवश्यक समझे , प्राधि- कृत व्यक्ति की नियुक्ति पहले भी समाप्त कर सकेगी ।
2. यह आदेश राजपत्र की तारीख से प्रारम्भ होते हुए तीन वर्षों की अवधि तक प्रभावी रहेगा ।

ORDER
New Delhi , the 31st October , 1979
S.O. 618 (E ) / 18AA /IDRA / 79 . Whereas Sree Saraswati Press Limited, 11 , Barrackpore Trunk Road, Belgharia , Calcutta ( hereinafter referred to as the said industrial undertaking ) is engaged in a scheduled industry , namely , printing ;
And, whereas , from the documentary and other evidence in its possession , the Central Government is satisfied, in relation to the said industrial undertaking , that it has been closed for a period of not less than three months and such closure is prejudicial to the concerned scheduled industry and that the financial condition of the company owning the industrial undertaking and the condition of the plant and machinery of such undertaking are such that it is possible to re- start the undertaking and such re- starting is necessary in the interests of the general public ;
Now, therefore , in exercise of the powers conferred by clause (b) of sub- section ( 1 ) of Section 18AA of the Industries (Development and Regulation) Act, 1951 (65 of 1951 ) , the Central Government hereby authorises Secretary, Closed and Sick Industries Department , Government of West Bengal , Calcutta भारत का राजपत्र असाधारण

(hereinafter referred to as the authorised person) , to take over the management of the whole of the said industrial undertaking , subject to the following terms and conditions , namely :-
( 1) the authorised person shall comply with all the directions issued from time to time by the Central Government ;
(2) the authorisel person shall hold office for a period of three years from the date of publication of this order in the Official Gazette ;
(3) thre Central Government may terminate the appointment of the authorised person earlier if it considers it necessary , to do so .
2. This order shall have effect for a period of three years from the date of its publication in the Official Gazette .
