का. आ. 725 (अ ) केन्द्रीय सरकार की मैसर्स काशीराम टी इन्डस्ट्रीज लिमिटेड, पी-11, न्यू हावड़ा ब्रिज , एप्रोच रोड , कलकत्ता के स्वामित्वाधीन दार्जिलिंग जिले में स्थित सामावियोंग टी एस्टेट , कलिपोंग सब डिवीजन , नामक चाय एकक की बावत यह राय है कि
(1) पांच वर्ष की अवधि में उक्त चाय एकक को हुई है । अर्थात , 1974 से 1978 की अवधि में , 1974 से लगातार चार वर्ष तक हानि

(2 ) वर्ष 1974 से 1978 के दौरान इस चाय एकक की औसत उपज , जिले की औसत उपज से पच्चीस प्रतिशत ( 25 % ) कम रही हैं ;
(3 ) चाय एकक का प्रबन्ध ऐसे ढंग से किया जा रहा है जो चाय उद्योग तथा लोक हित के लिए बहुत अपायकर है ।
अतः अब केन्द्रीय सरकार , पाय अधिनियम , 1953 ( 1953 का 29 ) की धारा 16 - स की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त चाय एकक के मामलों का पूर्ण और व्यापक आवेषण करने के प्रयोजनार्थ व्यक्तियों का एक निकाय नियुक्त करती है , जिसमें निम्नलिखित होंगे :-
(1) श्री एस. एस. नन्दकील्यार , निवेशक , चाय विकास , चाय बोर्ड ।
(2) श्री ए . वत्ता , वित्तीय सलाहकार और मुख्य लेखा अधिकारी , चाय बोर्ड ।
(3) श्री सी. आर . गौतम , उपसचिव , वाणिज्य और उद्योग विभाग , पश्चिमी बंगाल सरकार , कलकत्ता ।
(4) श्री ए . के. रायचौधरी , उपसलाहकार (वित्त) , लोक उद्यम ब्यूरो , मयूर भवन , कलकत्ता ।
(5) श्री आर . सी. निगम , संयुक्त निदेशक (लेखा) , क्षेत्रीय निवेशक कम्पनी विधि बोर्ड , कलकत्ता का कार्यालय ।
2. व्यक्तियों का उक्त निकाय इस आदेश के राजपत्र में प्रकाशन की तारीख से नब्बे दिन की अवधि के भीतर अपनी रिपोर्ट केन्द्रीय सरकार को प्रस्तुत करेगा ।

ORDER
New Delhi , the 14th November , 1979
S.O. 725 ( E ) . Whereas the Central Government is of opinion in respect of the tea unit known as Samabeong Tea Estate in Kalimpong Sub-division of Darjeeling district , owned by M /s . Kashiram Tea Industries Ltd. , P - 11 , New Howrah Bridge Approach Road , Calcutta - 1, that
( i) out of the period of five years , 1974-78 , the tea unit has made losses consecutively for four years from 1974 ;

(ii ) the average yield of the tea unit during the years 1974 το 1978 has been lower than the district average yield by twenty - five per cent ( 25 % ) ;
( iii) the tea unit is being managed in a mamer highly detrimental to the tea industry and to public interest ;
Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) of section 16B of the Tea Act, 1953 ( 29 of 1953 ) , the Central Government hereby appoints , for the purpose of making a full and complete investigation into the affairs of the said tea unit , a body of persons consisting of:
( 1 ) Shri S. S. Nandkeolyar , Director of Tea Development , Tea Board .
(2) Shri A. Dutta , Financial Adviser and Chief Accounts, Officer , Tea Board.
(3 ) Shri C. R. Gautam , Deputy Secretary , Department of Commerce and Industries , Government of West Bengal , Calcutta .
(4) Shri A. K. Roychowdhury , Deputy Adviser ( Finance ) , Bureau of Public Enterprises , Mayur Bhavan , New Delhi .
(5) Shri R. C. Nigam , Joint Director (Accounts ) , 0/0 the Regional Director , Company Law Board , Calcutta .
2. The said body of persons shall submit its report to the Central Govern- ment within a period of ninety days from the date of publication of this Order in the Official Gazette .
