फा०मा० 798 (प्र) . केन्द्रीय सरकार , उद्योग (विकास भौर विनियमन) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18- क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग ) के भावेण सं ० का०मा० 840( २० ) / 18-फ/ उ०वि० वि०८०/ 77, तारीख 15 दिसम्बर , 1977 ( तत्पश्चात् यथा संशोधित ) में निम्नलिखित और संशोधन करती है, प्रथीत्:--

का० ग्रा० 799 ( प्र). केन्द्रीय सरकार ने , उद्योग विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65) की धारा 18 - भख की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत के उश्योग मंत्रालय (औद्योगिक विकास विभाग ) के आदेश सं ० का ०२१० 844 ( भ)/ 18-चख/ उ ० वि ० वि०२०/ 72 , तारीख 17 दिसम्बर, 1977 द्वारा ( जिसे इसमें इसके पश्चात् उक्त भादेश कहा गया है) घोषित किया था कि उक्त आदेश के जारी होने की तारीख से ठीक पूर्व प्रवृत्त ऐसी सभी संविधानों, सम्मत्ति हस्तान्तरण पक्षों, करारों , व्यवस्थापनों, पंचाटों, स्थायी प्रादेशों या अन्य लिखतों ( उनसे दिन जो बैंकों भौर वित्तीय संस्थानों के प्रतिभूत वायित्वों से सम्बन्धित है ) का प्रवर्तम , जिनका बंगाल कैमिकल एण्ड फार्मास्यूटिकल वगर्स लिमिटेड , कलकत्ता नामक प्रौद्योगिक उपक्रम एक पक्षकार है या जो उक्त भौद्योगिक उपक्रम को लागू हों, एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख से पूर्व उनके अधीन प्रोभूत या उद्भूत सभी अधिकार, विशेषाधिकार, बाध्यताएं और वायित्व उक्त अवधि तक निलम्बित रहेंगे;
और भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग) के आदेश सं ० का ०आ० 711 (म ) , तारीख 15 दिसम्बर, 1978 द्वारा उक्त भावेश की अवधि तक के लिए विस्तारित कर दी गई थी;

In exercise of the powers conferred by sec- tion 18A of the Industries (Development and Regulation ) Act, 1951 ( 65 of 1951 ) , the Central Government hereby makes the following further amendment in the Order of the Government of India in the Ministry of Industry (Depart- ment of Industrial Development ) No. S.O. 840(E)/18A/ IDRA/77 dated the 15th December, 1977, ( as subsequently amended) , namely :-
In the said Order , for the headings " Chairman " and "Mem- bers" and the entries thereunder , the following shall be substi- tuted, namely :-
और केन्द्रीय सरकार का समाधान हो गया है कि उक्त भावेश की अवधि 14 दिसम्बर , 1980 तक के लिए और विस्तारित कर दी आनी चाहिए;

S.O. 799 (E ) . Whereas by the Order of the Government of India in the Ministry of Industry ( Department of Indust- rial Development) No. S.O. 844 (E ) / 18FB / IDRA/ 72 dated the 17 December , 1977, (hereinafter referred to as the said Order) , the Central Government , in exercise of the powers conferred by sub- section ( 1 ) of section 18FB of the Industries (Development and Regulation) Act , 1951 (65 of 1951 ) , declared that the operation of all contracts, assurances of property, agreements , settlements , awards, standing orders or other instruments in force immediately before the date of issue of the said Order ( other than those relating to secured liabilities to banks and financial institutions ) to which the industrial undertaking known as Bengal Chemical and Phar- maceutical Works Limited, Calcutta, is a party or which may be applicable to the said Industrial undertaking shall remain suspended for a period of one year and that all rights, privi- leges , obligations and liabilities accruing or arising thereunder before the said date shall remain suspended for the period; said 7. Dr. S. Ramachandran, Chief Executive, Bengal Immunity Company, Calcutta.
And whereas by the order of the Government of India in the Ministry of Industry (Department of Industrial Develop ment) No. S.O. 711 ( E) dated the 15th December , 1978 , the duration of the said Order was extended for a further period Chief Executive (Full - time) :
8. Shri P. K. Rudra , Bengal Chemical and Pharmaceutical Works Limited , Calcutta.
And, whereas , the Central Government is satisfied that the duration of the said Order should be extended for a furthe period upto the 14th December, 1980 ;

Now, therefore , in exercise of the powers conferred by sub section ( 1 ) , read with sub - section (2) of section 18FB O the IndustrieIndustries (Development and Regulation ) Act, 1951 (6 . of 1951 ), the Central Government hereby extends the dura tion of the said Order by a further period upto the 14t] Decomber, 1980.

Now , therefore , in exercise of the powers conferred by sub- section ( 1 ) read with sub- section ( 2 ) of section 18FB of the Industries (Development and Regulation ) Act , 1951 (65 of 1951) , the Central Government hereby extends the duration ofthe said Order by a further period upto the 14th Decem- ber, 1980.

No. 4/26/76-Cuc ] का० आ० ४०० ( प्र)-केन्द्रीय सरकार ने , उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65) की धारा 18 -चख की उपधारा ( 1 ) द्वारा प्रदन शक्तियों का प्रयोग करते हुए, भाग्न सरकार के उद्योग मंत्रालय ( श्रौद्योगिक विकास विभाग ) के श्रादेश सं ० का०मा० 21 ( थ) / 18-चख/उ ० वि० वि०८०/ 78 , तारीख 16 जनवरी , 1978 द्वारा ( जिसे इसमें इसके पश्चात् उक्त आवेश कहा गया है) , घोषित किया था कि 15 विमग्बर , 1977 के पूर्व किए गए और राजपत्र में उक्त भावेश के प्रकाशन की तारीख के डोरु पूर्व प्रवृत्त, तथा ऐमे बैंकों और विसीय संस्थानों से सम्बन्धिन, जिनका बंगाल कैमिकल एण्ड फार्मास्यूटिकल वक्स लिमिटेड , कलकत्ता, नामक श्रौद्योगिक उपक्रम एक पक्षकार है या जो उक्त औद्योगिक उपक्रम को लागू हों, सभी मंविदाओं, सम्पति हस्तान्तरण पत्रों, करारों , व्यवस्थापनों, पंचाटों, स्थायी आवेशों या अन्य लिखतों का प्रवर्तन , उक्त आदेश के प्रकाशन की तारीख से एक वर्ष की अवधि के लिए निलम्बित रहेगा तथा उक्त तारीख से पूर्व उनके अधीन प्रोद्भूत या उद्भूत सभी अधिकार , विशेषाधिकार , बाध्यताएं और दायित्व उक्त अवधि तक निलम्बित रहेंगे ;
क ० ग्रा० 801 ( अ) -भारत सरकार के उद्योग मंत्रालय ( श्रौद्योगिक विकास विभाग ) के ग्रादेश सं० का ०आ० 840 (प्र) / 18-क्र (उ ० वि०वि ० प्र०/ 77, तारीख 15 दिसम्बर, 1977 द्वारा ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) , बंगाल कैमिकल एण्ड फार्मास्यूटिकल वर्क्स लिमिटेड, कलकत्सा , नामक प्रौद्योगिक उपक्रम का सम्पूर्ण प्रबन्धक, उद्योग (विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 क के अधीन, 15 दिसम्बर , 1977 से दो वर्ष की अवधि के लिए ग्रहण कर लिया गया था;
मौर भारत सरकार के उद्योग मंत्रालय ( श्रौद्योगिक विकास विभाग) के आवेश सं ० का ०श्रा० 28 (प्र) , तारीख 15 जनवरी , 1979 द्वारा उक्त आदेश की अवधि 14 दिसम्बर, 1979 तक के लिए विस्तारित कर दी गई थी;
ौर केन्द्रीय सरकार की राय है कि लोकहित में यह समीचीन है कि उक्त औद्योगिक उपक्रम का उक्त प्रबन्ध एक वर्ष की और अवधि के लिए बना रहना चाहिए;
और केन्द्रीय सरकार का समाधान हो गया है कि उक्त प्रादेश की अवधि 14 दिसम्बर , 1980 तक के लिए और विस्तारित कर दी जानी चाहिए ;
अतः, अब, केन्द्रीय सरकार , उद्योग ( विकास प्रौर विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 18 क की उपधारा ( 2) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह निवेश देती है कि उक्त श्रादेश एक वर्ष की और अवधि के लिए प्रभावी बना रहेगा ।
अत, अत्र, केन्द्रीय सरकार , उद्योग ( विकाम और विनियमन ) अधि- नियम , 1951 ( 1951 का 65) की धारा 18- चख की उपधारा ( 2 ) के साथ पठित , उपधारा ( 1 ) द्वारा प्रदत्त शाक्तयों का प्रयोग करते हुए , उक्त आदेश की अवधि 14 दिसम्बर , 1980 तक के लिए और विस्तारित करती है ।

S.O. 801 (E ) . Whereas by the Order of the Government of India in the Ministry of Industry ( Department of Industrial Devclopment) No. S.O. 840 (E)/ 18A/ IDRA/ 77 dated the 15th December , 1977 , ( hereinafter referred to as the said Order) , the management of the whole of the industrial under- taking known as Bengal Chemical and Pharmaceutical Works Limited, Calcutta, was taken over under Section 18A of the Industries (Development and Regulation ) Act, 1951 ( 65 of 1951 ) , for a period of two years from the 15th December, 1977 ;
And whereas the Central Government is of opinion that it is expedient in the public interest that the management of the said industrial undertaking should continue for a further period of one year ;
S.O. 800(E) .- Whereas by the Order of the Government of India in the Ministry of Industry ( Department of Industrial Development) No. S.O. 21 (E)/ 18FB/IDRA/ 78 dated the 16th January , 1978 (hereinafter referred to as the said Order ) , the Central Government in exercise of the powers conferred by sub -section ( 1 ) of section 18FB of the Industries (Development and Regulation) Act, 1951 (65 of 1951 ) , declared that the operation of all the contracts , assurances of property agreements , settlements , awards , standing orders or other instruments entered into before the 15th December , 1977 and in force immediately before the date of publication of the said order in the Official Gazette , and relating to banks and financial institutions to which the industrial undertaking known as Bengal Chemical and Pharmaceutical Works Limited, Calcutta, is a party or which may be appli- cable to the sald industrial undertaking shall remain suspend- ed for a period of one year from the date of publication of the said Order and that all the rights, privileges , obligations and liabilities accuring or arising thereunder before the said date shall remain suspended for the said period ;
Now, therefore , in exercise of the powers conferred by the proviso to sub -section (2) of section 18A of the Industries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government hereby directs that the sald Order shall continue to have effect for a further period of one year .
And whereas by the Order of the Government of India in the Ministry of Industry (Department of Industrial Develop- ment) S.O. No. 28 (E) dated the 15th January , 1979 , the
