36,000 57,600 G. S. R. 7 (K).~- Tn exercise of the powers conferred by sub-section (I) of section 35 of the Indian Ports Act, 1908 (15 of 1908) , the Central Government hereby amends the Kandla Port Pilotage (Fees), Order, 1975, as follows, namely :—

1. (1) This Order may be called the Kandla Fort Pilotage

(Fees) Amendment Order. 1980.

(2) it shall come into force at once.

2. In the Kandla Port Pilotage (Fees) Order, 1975, for

rule 6, the following shall be substituted, nnirtely:—

(4) For detention of a tug during berthing, unberthing or mooring, unmooring or shifting, for more than half an hour owing to any reason except for reasons of stress of weather, desertion of crew or such other reasons beyond the control of the Master, fees as under will be charged for detention per hour or part thereof in addition to the charges to be levied for the services rendered by the tug.

(ii)

(0 If a tug is used for attendance or pulling or pushing of a vessel in harbour for berthing, unberthing or shifting of the vassel to be piloted, fees as under will be charged in addi- tion to pilotage fees or shifting charges. No such charges will be levied when the tug is utilised to suit the con\emerKe of the port or when the tug is utilised for shifting vessels loading or unloading upto 3000 tonnes of cargo, not being liquid cargo in bulk.

(2) For attending a vessel under weigh in the approach channel during pilotage (if such attendance is considered nece- ssary by the Deputy Conservator) fees as under will be charged for such attendance. If, however, the tug is used for pushing or pulling an additional fee of Rs. 525/- for coastal vessel and Rs. 825/- for foreign vessel shall be levied for a vessel under weight :—

Explanations : For the purpose of sub-clauses (6) the time taken for attendance will be counted from the time to the tug leaves her mooring to the time tug return to her mooring and for usage the actual time the tug was engaged in usage shall be taken.

(3) For towing a vessel in the pilotage limits of Kandla

(7) When a vessel is under weigh in approach channel and ,

New Delhi, the 14 January, 1980

G. S. R. 8 (Ej—In exercise of the powers conferred by sub- section (1) of section 35 of the Indian Ports Act, 1908 (15 of 1908), the Central Government hereby makes the following amendment to amend the Port of Madras Pilotage and Other Services (Foe) Order 1973—namely :—

1. (1) This Order may be called the Port of Madras Pilotage

and Other Services (.Fee) Amendment Order, 1980.

(2) It shall come into force at once.

2. In the Schedule to the said Order, in item 2, in the ope- ning paragraph, before the words "Vessels, which are not registered ", the words "Vessels belonging to Coast Guard Service And any other", shall be inserted.
