मेट्रो रेलवे ( निर्माण -कार्यों का निर्माण ) अधिनियम, 1978 की धारा 21 ( 1 ) ( क ) के अंतर्गत अधिसूचना का० प्रा० 21 ( प्र ) .-- चूंकि केन्द्रीय सरकार की यह राय है कि कलकत्ता में मेट्रो रेलवे का निर्माण करने के लिए भीवे श्रभसूची में यथावणित इमारतों में, जो भेट्रो संरेखण से 10 मीटर से अनधिक की दूरी के भीतर है, नीचे अनुसूची में यथाणिन परिवर्तन करना आवश्यक है, अतः धारा 21 ( 1 ) ( क ) के अन्तर्गत प्राप्त शक्ति का प्रयोग करते हुए, एतद्वारा यह निदेश दिया जाता है कि ऐसे मालिक/व्यक्ति, जिनके पास नीचे अनुसूची में यथावणित इमारत का नियं- क्षण हो, वे इस अधिसूचना के प्रकाशन की तारीख से तीन महीने के भीतर ऐसी इमारत को गिरा दें अथवा उसमें नीचे अनुसूची में दिये गये म्यौरे के अनुसार परिवर्तन कर दें ।
इस संबंध में ऐसे मालिकों/व्यक्तियों, जिनके पास इमारत का नियंत्रण हो, का ध्यान मेट्रो रेलवे ( निर्माण-कार्यों का निर्माण ) अधिनियम , 1978 की द्वारा 22 की ओर भी प्राकृष्ट किया जाता है । इसके अधीन दिये गये निदेश का अनुपालन न होने पर मेट्रो रेलवे ( निर्माण-कार्यों का निर्माण ) अधिनियम, 1978 के अन्तर्गत बनाये गये नियमों के नियम 16 में दिये गये उपबन्धों के साथ-साथ अधिनियम की धारा 36 के उपबंध भी लागू होंगे ।
ऐसे मालिकों/व्यक्तियों, जिनके पास इमारत का नियंत्रण हो, के सूचनार्थ यह आगे और अधिसूचित किया जाता है कि मेट्रो रेलवे ( निर्माण-कार्यों का निर्माण) अधिनियम, 1978 के अन्तर्गत वचाविनिर्दिष्ट सक्षम प्रात्रिकारी का कार्यालय मैकिनान मैकेन्जी मिस्टिंग , 16 स्ट्रैण्ड रोष, कलकत्ता-700001 की दूसरी मंजिल में स्थित है ।

Notification under section 21 (1 ) (a) of Metro Railway ( Construction of Works) Act, 1978
S.O. 21 (E) . As the Central Government is of the opinion that for facilitating the construction of Metro Railway at Calcutta , it is necessary to make such alteration to the building as described in the Schedule below which is within a distance not exceeding 10 metres from the Metro alignment , therefore , in exercise of the power conferred under section 21 ( 1 ) ( a ) , it is hereby directed that owners / persons having control over such building as described in the Schedule below , do demolish or make such alterations as detailed in the Schedule to such building within three months from the date of publication of this notification .
Attention of the owners/persons having control over the building is also drawn to section 22 of the Metro Railway ( Construction of Works) Act , 1978 , in this connection . Non -compliance to the direction as made hereunder shall invite application of section 36 of the Act along with provisions as contained in Rule 16 of the Rules as framed under the Metro Railway ( Construction of Works ) Act , 1978 .
It is further notified for information of the owners /persons having control over the building , that the Competent Authority as prescri- bed under the Metro Railway ( Construction of Works ) Act , 1978 has his office located at Second floor of the Mackinnon Mackenzie Building, 16, Strand Road, Calcutta- 700001 .

S. O. 35(E) . As the Central Government is of the opinion, that for facilitating the construction of Metro Railway at Calcutta , it is necessaryto make such alteration to the building as described in the Schedule below which is within a distance not ex- ceeding 10 metres from the Metro alignment , therefore , in exercise of the powe : corred under section 21 ( 1 )(a) it is hereby directed that owners /persons having control over such building as described in the Schedule below ,do demolish or make such alterations as detailed in the Schedule to such building within three months from date of publication of this notification.
Attention of the owners/persons having control over the building is also drawn to section 22 of the Metro Railway ( Construction of Works) Act , 1978 , in this connection. Non -compliance to the direction as made hereunder shall invite application of section 36 of the Act , along with provisions as contained in Rule 16 of the RULES as framed under the Metro Railway (Construction of Works) Act 1978 .
It is further notified for information of the owners /persons having control over the building , that the Competent Authority as pre- scribed under the Metro Railway (Construction of Works ) Act , 1978 has his office located at Second floor of the Mackinnon Mackenzie Building , 16, Strand Road , Calcutta - 700 001.

फा०ग्रा० 36 ( अ). चूंकि केन्द्रीय सरकार की यह राय है कि कलकत्ता में मेट्रो रेलवे का निर्माण करने के लिए नीचे अनुसूची में यथार्वाणत इमारतों जो मेट्रो संरेखण से 10 मीटर से अनधिक की दूरी के भीतर है, मीचे अनुसूची में यथाणित परिवर्तन करना आवश्यक है, अतः धारा 21 ( 1 ) ( क) के अंतर्गत प्राप्त शक्ति का प्रयोग करते हुए एतद्वारा यह निदेश दिया जाता है कि ऐसे मालिक/व्यक्ति जिनके पाम नीचे अनुसूची में यथाणित इमारत का नियंत्रण हो , वे इस अधि- सूचना के प्रकाशन की तारीख से तीन महीने के भीतर ऐसी इमारत को गिरा दें अथवा उसमें नीचे अनुसूची में विये गये ब्यौरे के अनुसार परिवर्तन कर दें ।
इम संबंध में ऐसे मालिकों/व्यक्तियों, जिनके पास इमारत का नियंत्रण हो, का ध्यान मेट्रो रेलवे ( निर्माण कार्यों का निर्माण) अधिनियम , 1978की धारा 22 की ओर भी आकृष्ट किया जाता है । इसके अधीन दिये गये निदेश का अनुपालन है न होने पर मेट्रो रेलवे ( निर्माण कार्यों का निर्माण ) अधिनियम, 1978 के अंतर्गत बनाये गये नियमों के नियम 16 में दिये गये उपबन्धों के साथ-साथ अधिनियम की धारा 36 के उपबंध भी लागू होंगे ।
ऐसे मालिकों/व्यक्तियों, जिनके पास इमारत का नियंत्रण हो, के सूचनार्थ यह प्रागे और अधिसूचित किया जाता है कि मेट्रो रेलवे ( निर्माण कार्यों का निर्माण ) अधिनियम, 1978 के अन्तर्गत यथाविनिदिष्ट सक्षम प्राधिकारी का कार्यालय मैकिनान मैकेन्जी बिल्डिंग, 16 स्ट्रैण्ड रोड , फलकत्ता-700001 की दूसरी मंजिल में स्थित है ।
