सा० का०नि० 46 ( अ).-राष्ट्रपति द्वारा जारी की गई निम्नलिखित उद्घोषणा सर्वसाधारण के सूचनार्थ प्रकाशित की जा रही है :
यतः मेरा , भारत के राष्ट्रपति, नीलम संजीव रेड्डी, का समाधान हो गया है कि ऐसी स्थिति उत्पन्न हो गयी है, जिसमें महाराष्ट्र राज्य का शासन भारत के संविधान ( जिसे इसमें इसके पश्चात् "संविधान" कहा गया है) के उपबन्धों के अनुमार नहीं चलाया जा सकता है ;
भतः भय मैं, संविधान के अनुच्छेद 356 द्वारा प्रवत्त शक्तियों का तथा उस निमित्त मुझे समर्थ बनाने वाली अन्य सभी शक्तियों का प्रयोग करते हुए, एतद्वारा उद्घोषणा करता हूं कि मैं
(क ) उक्त राज्य की सरकार के सभी कृत्य और उस राज्य के राज्य- पाल में निहित , तथा उनके द्वारा प्रयोक्तव्य सभी शक्तियां , भारत के राष्ट्रपति के रूप में स्वयं संभालता हूं ;
(ख) घोषित करता हूं कि उक्त राज्य के विधान मंडल की शक्तियां संसद् द्वारा या उसके प्राधिकार के अधीन प्रयोक्तव्य होंगी ; बौर
(ग) निम्नलिखित भानुषंगिक और पारिणामिक उपबन्ध करता हूं जो इस उद्घोषणा के उद्देश्यों को प्रभाबी बनाने के लिए मुझे भावश्यक या वांछनीय प्रतीत होते हैं ; अर्थात्-

(i ) इस उद्घोषणा के उपर्युक्त खंड ( क ) के आधार पर मेरे द्वारा संभाले गए कृत्यों और शक्तियों का प्रयोग करने मैं, मेरे लिए भारत के राष्ट्रपति के रूप में उस सीमा तक जिस तक मैं टीक समझू उक्त राज्य के राज्यपाल के माध्यम से कार्य करना विधिपूर्ण होगा ;
( ii ) उक्त राज्य के संबंध में संविधान के निम्नलिखित उपबन्धों के प्रवर्तन को एतद्वारा निलम्बित किया आता है , अर्थात्ः
अनुच्छेष 3 के परन्तुक का उतना भाग जितने का संबंध राष्ट्रपति द्वारा राज्य के बिधान मंडल को निवेश करने से है ;
अनुच्छेद 151 के सखंड ( 2) का उतना भाग जितने का संबंध भारत के नियंत्रक और महालेखापरीक्षक द्वारा राज्यपाल के समक्ष प्रस्तुत किए गए प्रतिबेदनों को राज्य के विधाम मंडल के समक्ष रखे जाने से है ;
अनुच्छेद 163 मौर 164 ;
अनुच्छेव 166 का खंड ( 3 ) का उतना भाग जितने का संबंध मंत्रियों के बीच राज्य सरकार के काम के भावंटन से है ;
भनुच्छेद 167 ;
अनुच्छेद 169 के खंड ( 1 ) का उतना भाग जितने का संबंध राज्य की विधान सभा द्वारा संकल्प को पारित करने से है ;

अनुच्छेद 174 का. खंड ( 1) और खंड ( 2 ) का उप-खंड (क ) ;
धनुच्छेद 175 से 178 तक ( जिसमें ये धोनों सम्मि लित है);
अनुच्छेद 179 के खंड ( ख) और ( ग) भौर उस अनुच्छेद का प्रथभ परन्तुक ;
अनुच्छेद 180, 181 भौर 182, अमृच्छेद 183 का खंड ( ग) और उसका परन्तुक ;

अनुच्छेद 188 का उतना भाग जितने का संबंध विधान सभा के उपाध्यक्ष के बेलनों और भत्तों से है ;
अनुच्छेद 188 का उसना भाग जितने का संबंध विधान सभा के सदस्य से है ;
अनुच्छेद 189, 193 और 194 ;
भनुच्छेद 195 का उसना भाग जितने का संबंध विधान सभा के सदस्यों के वेतनों धौर भलों से है ;
अनुच्छेद 196 से 198 तक (जिसमें ये दोनों सम्मि- लिस हैं);
अमुण्ठेष 199 के खंड ( 3) और ( 4) ;
अनुम्ग्वेद 202 के खंड ( 3 ) का उतना भाग जिसने का संबंध विधान सभा के उपाध्यक्ष के बेतनों और भक्तों से है ,
अमुच्छेद 208 से 211 तक्ष ( जिसमें ये दोनों सम्मिलित हैं):
अनुच्छेद 213 के खंड ( 1 ) का परन्तुक और खंर ( 3 ) का परन्तुक; और
अनुश्रूष 323 के खंड ( 2) का उतना भाग जिलने का संबंध शापन सहित रिपोर्ट के राज्य के विधान मंडल के मध्क्ष रखे जाने से हैं ;
(iii) उक्त राज्य की विधान सभा एतद्वारा भंग की जाती है;
(iv) संविधान में राज्यपाल के प्रति किसी निदेश का अर्थ उस राज्य के संबंध में राष्ट्रपति के प्रति निदेश लगाया जाएगा और उसमें राज्य के विधान मंडल या विधान मभा के प्रति किसी निरेश का, जहां तक उसका संबंध उभके कृत्यों और उसकी शक्तियों से है, अर्थ, अब तक कि संदर्भ द्वारा अन्यथा अपेक्षित न हो, संसद् के प्रनि निदेश लगाया जाएगा और विशिष्टतया अनुच्छेष 213 में राज्यपाल और राज्य के विधान मंडल या उसके मधनों के प्रति निदेश का अर्थ क्रमशः राष्ट्र- पनि और प्रमद् या उराके सदमों के प्रति निदेश लगाया जाएगा :
परन्तु इसमें की कोई बात अमुच्छेद 153 , अनुच्छेव 155 से लेकर अनुच्छेद 159 तक ( जिसमें ये दोनों सम्मिलित हैं) ; अनुच्छेद 299 और अनुज्छेव 361 नथा द्वितीय अनुमुत्री के पैरा 1 में लेकर पैरा 4 तक ( जिसमें ये दोनों सम्मिलित हैं) के उपगन्धों पर प्रभाव नहीं डालेगी भौर न राष्ट्रपति को उस खंड के उपखंड ( 1 ) के अधीन उस सीमा तक जहां तक तह ठीक समझे उक्त राज्य के राज्यपाल के माध्यम से कार्य करने से निवारित करेगी ।
(v) संविधान में राज्य के विष्ठास मंडल के या उसके द्वारा बभाए गए अधिनियमों या विधियों के प्रति किसी निवेश का ऐसे अर्थ लगाया जाएगा मानो वह उन अधिनियमों और विधियों को भी समाविष्ट करता है जो इस उद्घोषणा

के आधार पर संसव द्वारा या राष्ट्रपति या संविधान के अमुच्छेव 357 के खंड ( 1 ) के उपखंड ( क) में निदिष्ट अन्य प्राधिकारी द्वारा राज्य के विधाम मंडल की शक्तियों का प्रयोग करते हुए बनाए गए हैं और बम्बई सामान्य खंड अधिनियम, 1904 ( 1904 का बम्बई अधिनियम 1 ) जैसा कि बह महाराष्ट्र राज्य में प्रवृत है और सामान्य खंड अधिनियम, 1897 ( 1897 का 10) का उतना भाग जितना राज्य की विधियों पर लाग है ऐसे किसी अधिनियम या विधि के बारे में इस प्रकार प्रभावी होगा मानो यह उस राज्य के विधान मंडल का अधिनियम हो ।

NOTIFICATION
New Delhi , the 17th February , 1980
G.S.R. 46( E ) . The following Proclamation by the Presi- dent is published for general information :
Whereas , I , Neelam Sanjiva Reddy, President of India, am satisfied that a situation has arisen in which the Govern- ment of Maharashtra cannot be carried on in accordance with the provisions of the Constitution of India ( hereinafter referred to as " the Constitution" ) ;
Now, therefore , in exercise of the powers conferred by article 356 of the Constitution and of all other powers en- abling me in that behalf , I hereby proclaim that I-
(a) assume to myself as President of India all functions of the Government of the said State and all powers vested in or exercisable by the Governor of that State:
(b) declare that the powers of the Legislature of the said State shall be exercisable by or under the authority of Parliament : sind
(c) make the following incidental and consequential pro- visions which appear to me to be necessary or desirable for giving effect to the objects of this Proclamation , namely :-
(i) in the exercise of the functions and powers assumed to myself by virtue of clause ( a) of this Procla- mation as aforesaid . it shall be lawful for me as President of India to act to such extent as I think fit through the Governor of the said State :
( ii) the oneration of the following provisions of the Constitution in relation to that State is hereby suspended , namely :-
so much of the proviso to article 3 as relates to the reference by the President to the Legisla- ture of the State ;
so much of clause (2) of article 151 as relates to the laying before the Legislature of the State of the report submitted to the Governor by the Comptroller and Auditor- General of India :
articles 163 and 164 ;
so much of clause (3 ) of article 166 as relates to the allocation among the Ministers of the busi- ness of the Government of the State :

article 167 ;
so much of clause ( 1 ) of article 169 as relates to the passing of a resolution by the Legislative Ass- embly of a State ;
clause (1) and sub -clause (a) of clause ( 2 ) of article 174;
articles 175 to 178 (both inclusive) ;
clauses (b ) and ( c) of article 179 and the first pro- viso to that article ;
articles 180 , 181 and 182 , clause (c) of article 183 and the proviso thereto ;
article 185;
so much of article 186 as relates to the salaries and allowances of the Deputy Speaker of the Legis- lative Assembly;
so much of article 188 as relates to a member of the Legislative Assembly ;
articles 189 , 193 and 194 ;
so much of article 195 as relates to the salaries and of the Legislative allowances Assembly; of Members
articles 196 to 198 (both inclusive) ;
clauses (3 ) and (4) of article 199 ;
so much of clause (3 ) of article 202 23 relates to the salaries and allowances of the Deputy Speaker of the Legislative Assembly ;
articles 208 to 211 (both Inclusive) ;
the proviso to clause ( 1) and the proviso to clause (3) of article 213 ; and
so much of clause ( 2) of article 323 as relates to the laying of the report with a memorandum before the Legislature of the State ;
(iii) the Legislative Assembly of the said State is hereby dissolved ;
(iv) any reference in the Constitution to the Governor shall in relation to the said State be construed as a reference to the President , and any reference therein to the Legislature of the State or the Houses thereof shall , in so far as it relates to the functions and powers thereof, be construed unless the context otherwise requires , as a refer- ence to Parliament , and , in particular , references in article 213 to the Governor and to the I.egis- lature of the State or the Houses thereof shall be construed as references to the President and to Parliament or to the Houses thereof respecti- vely:
Provided that nothing herein shall affect the provisions of article 153; article 155 to 159 (both inclu- sive) ; article 299 and article 361 and paragraphs 1 to 4 (both inclusive) of the Second Schedule or prevent the President from acting under sub- clause ( i) of this clause to such extent as he thinks fit through the Governor of the said State ;
the (v) any reference in the Constitution to Acts or laws of or made by the Legislature of the State shall be construed as including a reference to Acts or laws made , in exercise of the powers of Legislature of the State , by Parliament by virtue of this Proclamation , or by the President or other authority referred to in sub - clause ( a) of clause (1) of article 357 of the Constitution and the Bombay General Clouses Act , 1904 (Bombay Act 1 of 1904) as in force in the State of Maharashtra . and so much of the General Clauses Act. 1897 (10 of 1897 ) , as applies to State laws , shall have

effect in relation to any such Act or law as if it were an Act of the Legislature of the State.

भारत के संविधान के अनुच्छेद 356 के अधीन मेरे द्वारा आाज फरवरी , 1980 के 17 वें दिन जारी की गई उद्घोषणा के खंड ( ग ) के उपखंड ( i) का अनुसरण करते हुए , मैं एतद्वारा निदेश देता हूं कि महाराष्ट्र राज्य सरकार के सभी कृत्य और संविधान के अधीम या उस राज्य में प्रवृत्त किसी विधि के अधीन उस राज्य के राज्यपाल में निहित या उसके द्वारा प्रयोक्तव्य सभी शक्तियां , जिनको राष्ट्रपति ने उक्त उद्घोषणा के खंड (क) के प्राधार पर स्वंय संभाल लिया है, राष्ट्रपति के अधीक्षण , निवेशन और नियंत्रण के अध्यधीन रहते हुए, उक्त राज्य के राज्यपाल द्वारा भी प्रयोक्तव्य होंगी ।

G.S.R. 47(E) . The following Order by the President is published for general information :
In pursuance of sub -clause ( i ) of clause (c) of the Procla- mation issued on this the 17th day of February, 1980 by me under article 356 of the Constitution of India , I hereby direct that all the functions of the Government of the State of Maharashtra and all the powers vested in or exercisable by the Governor of that State under the Constitution or under any law in force in that State, which have been assumed by the President by virtue of clause ( a) of the said Proclamation, shall , subject to the superintendence, direction and control of the President, be exercisable also by the Governor of the said State.
