NOTIFICATIONS
New Delhi, the 3rd March, 1980
S.O. 133(E). -Whereas by the notification of the Government of India in the Ministry of Energy (Department of Coal ) No. S.O. 1813 dated the 19th May, 1979 under sub-section (1) of section 4 of the Coal bearing Areas (Ac- quisition and Development) Act, 1957 (20 of 1957), the Central Government gave notice of its intention to pros- pect for coal in 1920 acres (approximately) or 777 hectares (approximately) of land in the locality specified in the Schedule appended to that notification ;
And whereas, the Central Government is satisfied that coal is obtainable in the whole of the said land. Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the lands measuring 1,470 acres (approximately) or 594.89 hectares (approximately) described in Schedule appended hereto.
Note 1. The plan of the area covered by this notification may be inspected in the office of the Deputy Commis- sioner, Dumka (Bihar) or in the office of the Coal Controller, 1, Council House Street, Calcutta or in the office of the Director (Corporate Planning and Projects), Eastern Coalfields Limited, Sanctoria, Post-Office-Dishergarh, District-Burdwan (West Bengal).
Note 2 : Attention is hereby invited to the provisions of section 8 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957), which provides as follows :—
"8. Objection to Acquisition (1).—Any person interested in any land in respect of which a notification under section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or of any rights in or over such and.
Explanation: —It shall not be an objection whhin the meaning of this section for any person to say that,he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person.
(2) Every objection under sub-section (I) shall be made to the competent authority in writing, and the com- petent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, 124S GI'79-2
350 THE GAZETTE OF INDlA : EXTRAORDINARY [PART II—SEC. 3(ii)]cither make a report in respect, of the land which_has been notified under sub-section(l) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of that Government.
(3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act ".
Note 3 :—The Coal Controller, 1, Council House Street, Calcutta, has been appointed by the Central Government as the competent authority under the Act.

3 64 THE GAZETTE OF INDlA : EXTRAORDINARY [PART II—SEC, 3(ii)]S.O. 134 (E).—Wliiieas by the notification of the Government of India in the Ministry of Energy (Department of Coal) No. S.O. 785 dated the 17th February, 1979 under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957), the Central Government gave notice of its intention to prospect for coal in 12,680 acres (approximately) oi 5,132 hectares (approximately) of lands m the locality specified in the Schedule appended to that notification;
And whereas, the Central Government is satisfied that coal is obtainable in most of the said lands:
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the lands measuring 2,450 acies (approximately) or 991.48 hectares (approximately ) desciibcd in the Schedule appended hereto,
Note'l .—The plan of the area covered by this notification may be inspected in the office of the Deputy Commis- sioner, Dumka (Bihar), or in the office of the Coal Controllei, 1, Council House Street, Calcutta or i.i the office of the Director (Corporate Planning and Piojccts), Eastern Coalfields Limited, Sanctoria, Post Office—Dishergarh, District Burdwan (West Bengal).
Note 2.—Attention is hereby invited to the provisions of section 8 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957), which provides as follows :—
8.(1) Any person interested in any land in respect of which a notification under section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land oi of any rights in or over such land.
Explanation : It shall not be a , objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the p oduction of coal and that such operations should not be undertaken by the Central Government or by any other person.
(2) Every objection undct sub-section (1) shall be made to the competent authority in writing, and the compe- tent authority shall give the objectoi an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as it thinks necessaiy, cither make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of right in or over such land, to the Central Government, containing his recommendations of the objections, together with the record of the proceedings held by him, for the decision of that Government.
(3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land, were acquired under this Act.
Note 3 : The Coal Controller, 1, Council House Street, Calcutta has been appointed by the Central Govern- ment as the competent authority under the Act.
