का० ग्रा० 187 ( २) न्यूनतम मजदूरी अधिनियम, 1948 ( 1948 का 11 ) की धारा 4 की उपधारा ( 1 ) के खण्ड ( iii ) के साथ पठित धारा 3 की उपधारा ( 1 ) के खण्ड ( ख ) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार ने इससे उपाबद्ध भनुसूची के स्तम्भ ( 2 ) में विनिविष्ट मजदूरी की न्यूनतम दरों को जो उक्त अनुसूची के स्तम्भ (1 ) की तत्स्थानी प्रविष्टियों में विनिविष्ट जिप्सम भौर बैराइट्स कामों मैं उसके नियोजन में नियोजित प्रवर्गों के कर्मचारियों को संवेय है, पुनरीक्षित करने के लिये निम्मलिखित प्रस्ताव बनाये हैं जो उक्त अधिनियम की धारा की उपधारा ( 1 ) के खण्ड ( ख) की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिये प्रकाशित किये जा रहे हैं, जिनके उससे प्रभावित होने की संभावना है और यह सूचना दी जाती है कि उक्त प्रस्तावों पर राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से दो मास के अवसान पर या उस के पश्चात् विचार किया जायेगा ।
ऊपर विनिर्दिष्ट अवधि के भवसान से पूर्व उक्त प्रस्तावों की बाबत जो भी आपत्ति या सुझाव किसी व्यक्ति से प्राप्त होंगे, केन्द्रीय सरकार उन पर विचार करेगी ।

स्पष्टीकरण:--

1. इस अधिसूचना द्वारा नियत भजदूरी की न्यूनतम दरें मर्वम्मिलित दरें हैं जिनमें आधारी दर , जीवन निर्वाह भत्ता, श्रावश्यक वस्तुओं के रियायती दर पर किये गये प्रदायों , यदि कोई हों, का नकदी मूल्य सम्मिलित है तथा साप्ताहिक विश्राम के दिन के लिये श्रेय , मजदूरी भी सम्मिलित है ।
2. इस अधिसूचना द्वारा नियत मजदूरी की न्यूनतम करे ठेकेदारों द्वारा नियोजित कर्मचारियों को भी लागू हैं !

3. भठारह वर्ष से कम आयु के और असमर्थ व्यक्तियों को देय मजदूरी की न्यूनतम वरें समुचित प्रवर्ग के व्यस्थ कर्मकारों के लिये इस अधिसूचना द्वारा नियत दरों की क्रमणः 30 प्रतिशत और 70 प्रतिशत होगी ।
4. इम अधिसूचना के प्रयोजनों के लिये ; --
(क) " अकुशल कार्य" से वह कार्य अभिप्रेत है जिसमें बहुत थोडी या कुछ भी कुशलता का कार्य या अनुभव अपेक्षित न करने वाली साधारण क्रियायें सम्मिलित हैं,
(ख) " अर्द्धकुशल कार्य" से वह कार्य अभिप्रेत है, जिसमें कार्य के धनुभव से भजित कुछ मात्रा में कुशलता या सक्षमता सम्मिलित है और जो कुशल कर्मचारी के पर्यवेक्षण या मार्ग दर्शन के अधीन किए जाने योग्य हैं और इसके अन्तर्गत अकुणन पर्यवेक्षी कार्य भी आता है ,
(ग) " कुशल कार्य" से वह कार्य अभिप्रेत है जिसमें कार्य के अनुभव से प्रथवा शिक्षु के रूप में या किसी तकनीकी वा व्यावसायिक संस्था में प्रशिक्षण के माध्यम से अजित कुशलता या मक्षमता अपेक्षित है और जिसके पालन में स्वप्रेरणा और विवेकवृद्धि श्रयश्यक है।

5. जी संचिवा या करार पर श्राधारित मजदूरी की विद्यमान दरें इस अधिसूचना द्वारा नियत दरों से उच्चतर हैं वहां ऐसी उच्चतर वरें अधिसूचना के प्रयोजनार्थ न्यूनतम मजदूरी की दरें समझी जायेगी ।

S.O. 187 (E )-The following proposals made by the Central Government in exercise of the powers conferred by clause (b) of sub- section (1 ) of section 3 , read with clause ( iii ) of sub - sce- tion (1 ) of section 4 of the Minimum Wages Act, 1948 ( 11 of 1948) for revising the minimum rates of wages as specified in column (2) of the Schedule annexed hereto payable to the cate- gories of employees employed in employments in gypsum and barytes mines as specified in the corresponding entries in column (1) of the said Schedule , are hereby published , as required by clause (b) of sub - section (1 ) of section 5 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said proposals will be taken into consi- deration on or after the expiry of 2 months from the date of publication of this notification in the Official Gazette .

Explanations :-
1. The minimum rates of wages fixed by this notification areall inclusive rates including the basic rate, the cost of living allowance and cash value of the concessional supply, if any, of essential commodities , and include also the wages payable for the weekly day of rest .
2. The minimum rates of wages fixed by this notification are applicable to employees engaged by contractor also .
3. The minimum rates of wages payable to young persons below 18 years of age and disabled persons shallbe 80% and 70% respectively of the rates fixed by this notification for adult workers of the appropriate category.
4. For the purpose of this notification, ---
(a) "unskilled work " means work which involves simple operations requiring little or no skill or experience on the job;
(b) " semi -skilled work" means work which involves some degree of skills or competence acquired through ex- perience on the job and which is capable of being per- formed under the supervision or guidance of a skilled employee, and includes unskilled supervisory work ;
(c) " skilled work " means work which involves skill or competence acquired through experience on the job or through training as an apprentice or in a technical or vocational institute and the performance of which calls for initiative and judgement.
5. Where the existing rates of wages based on contract or agreement are higher than the rates fixed by this notification, the higher rates shall be treated as minimum rates of wages for the purpose of this notification .
