In exercise of the powers conferred by sub- section (3 ) of scction 1 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Central Government hereby specifies the 1st day of April , 1980 as the date on and from which the provision of the said Act shall apply to the major port of New Mangalore.

सा०का ० नि० 135 ( अ) केन्द्रीय सरकार , महापणन न्याम अधिनियम, 1963 की धारा 2 के खण्ड ( थ ) द्वारा प्रवन्न शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि उक्त अधिनियम के प्रयोजन के लिए न्यू मंगलोर 1336 GI/ 79
पोर्ट की सीमाएं वही होंगी जो भारत के राजपत्र , प्रभाधारण भाग II खण्ड 3 (1 ) , दिनांक 4 मई , 1974 में प्रकाशित भारत सरकार के नौवहन और परिवहन मंत्रालय ( परिवहन पक्ष ) की अधिसूचना स० सा ० का ० नि ० 211( ई) , दिनांक 4 मई, 1974 में निश्चित की गयी हैं ।

In exercise of the powers conferred by clause (q) of section 2 of the Major Port Trusts Act , 1963 (38 of 1963 ) , the Central Government hereby declares that the limits of the Port of New Mangalare for the purposes of the said Act shall be the same as defined vide Government ofIndia , Ministry of Shipping and Transport ( Transport Wing ) notification No. G.S.R. 211 ( E) , dated the 4th May, 1974 , published in the Gazette of India , Extraordinary, Part II - Sec- tion 3 ( i) , dated the 4th May , 1974 .

In exercise of the powers conferred by sub-section ( 1) of section 4 of the Major Port Trusts Act , 1963 ( 38 of 1963 ) , the Central Government hereby consti- tutes, in respect of the major port of New Mangalore , the first Board of Trustees , with effect from the first day of April, 1980, and appoints the following persons as the Chair- man and Trustees respectively of the said Board of Trustees , namely :-

In exercise of the powers conferred by sub - section ( 1) of section 7 and sub - section ( 1 ) of Section 36 of the Indian Ports Act , 1908 ( 15 of 1908 ) , and in super- session of the notification of the Government of India in the Ministry of Shipping and Transport (Transport Wing); No. G. S. R. 210 (E) , dated the 4th May, 1974 the Central Government hereby appoints the Board of Trustees of the Port of New Mangalore to be the Conservator of the Port of New Mangalore and to receive all dues , fees or other charges authorised to be taken at the Port of New Mangalore by or under the said Act, and , subject to the control of the Cent- ral Government, to expend the receipts on any of the objects authorised by the said Act .

सा० का० नि० 138 ( श्र) नव मंगलोर पत्तन त्यास ( बोर्ड-अधिवेशन- प्रक्रिया) नियम , 1979 का प्रारूप महा पत्तन न्याम अधिनियम , 1963 (1963 का 38) की धारा 122 की उपधारा ( 2 ) द्वारा यया अपेक्षित रूप से भारत सरकार, नौवहन और परिवहन मंत्रालय ( परिवहन पक्ष) की अधि- सूचना मंख्या सा ० को ० नि ० 1502, तारीख 29 नवम्बर, 1979 के अधीन भारत के राजपत्र, भाग II, खण्ड 3 , उपखण्ड ( ⅰ ) , तारीख 15 दिसम्बर, 1979 के पृष्ठ 2936-37 पर प्रकाशित किया गया था, जिसमें उक्त अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से पैंतालीम दिन की अवधि की समाप्ति तक उन सभी व्यक्तियों से टिप्पणी और सुझाव मांगे गए थे, जिनके उससे प्रभावित होने की संभावना है,
और उक्त राजपक्ष की प्रतियां 24 दिसम्बर , 1979 की जनता को उपलब्धकरा दी गयी थीं,
और केन्द्रीय सरकार ने उक्त प्रारूप की बाबत प्राप्त टिप्पणियों और सुझावों पर विचार कर लिया है ,
धनः अब केन्द्रीय सरकार , उक्त अधिनियम की धारा 122 की उपधारा ( 1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित नियम बनाती है, अर्थात्:--
1. संक्षिप्त नाम, प्रारूप और लागू होना ( 1 ) इन नियमों का नाम नव मंगलौर पत्तन-न्यास ( बोर्ड-अधिवेशन-प्रक्रिया) नियम, 1980 है ।
(2) ये 1 अप्रैल , 1980 को प्रवृत्त होंगे ।
( 3) ये महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38) को धारा 16 के उपबन्धों के अधीन रहते हुए , नव मंगलोर पत्तन के न्यास बोर्ड के अधिवेशनों में किए जाने वाले कामकाज को लागू होंगे ।
2. अधिवेशनों की प्रावृत्ति ( 1) बोर्ड का, नियम 3 में निर्दिष्ट विशेष अधिवेशन से भित्र अधिवेशन, प्रत्येक मास' में कम से कम एक बार होगा । (2 ) बोर्ड समय-समय पर अपने अधिवेशन की तारीख भौर समय अन-
धारित करेगा:
परन्तु जहां बोर्ड किसी कारणवश ऐसा करने में असमर्थ है वहां, उसके लिए जो कारण हैं, उन्हें लेखाबद्ध करके, अध्यक्ष ऐसा कर सकेगा ।
( 3 ) बोर्ड का अधिवेशन नय मंगलोर पत्तन के परिसर में होगा ।
3. विशेष अधिवेशनों का बुलाया जाना-अध्यक्ष, या उसकी मनु- पस्थिति में उपाध्यक्ष , यदि वह नियुक्त किया गया है, जब कभी आवश्यक समझे, विशेष अधिवेशन बुला सकेगा और कम से कम तीन म्यासियों के लिखित अनुरोध पर वह ऐसा करेगा ।
4. कार्यसूची श्रावि का परिचालम बोर्ड के किसी अधिवेशन के लिए कार्यसूची और उसके ज्ञापन टिप्पण यदि कोई है, अधिवेणन की तारीख से कम से कम तीन दिन पूर्व न्यामियों को भेज दिया जाएगा ।

Now, thterefore , in exercise of the powers conferred by sub-section ( 1 ) of section 122 of the said Act , the Central Government hereby makes the following rules , namely :-
परन्तु विशेष अधिवेशन की दणा में ऐसी कार्यसूची भौर टिप्पण का ज्ञापन, अधिवेशन के तारीख से कम से कम एक दिन पूर्व परिचालित किए जायेगे ।
1. Short title, commencement and application: ( 1) these rules may be called the New Mangalore Port Trust ( Proce- dure at Board Mectings) Rules , 1980 .
(2) They shall come into force on the 1st day of April , 1980 .
(3) They shall, subject to the provisions of section 16 of the Major Port Trusts Act , 1963 (38 of 1963 ) , apply to the bussiness transacted at the meetings of the Board of Trustees for the Port of New Mangalore .
5. उन मदों पर विचार- विमर्श और कार्य सूची में सम्मिलित नही है:-अध्यक्ष या उमको अनुपस्थिति में उपाध्यक्ष , यदि वह नियुक्त किया गया है , स्ववियेकानुसार बोर्ड के अधिवेशनों में, जिसमें विशेष अधिवेणन भी सम्मिलित है, किसी अधिवेशन में विचार-विमर्श के लिए कार्यसूची में सम्मिलित नही की गयी किसी मद को , उम दणा में सम्मिलित कर सकेगा जब वह उसकी राय में पर्याप्त महत्व की है या अति आवश्यक है अथवा दोनों ही है और जब उसे किसी पश्चातवर्ती अधिवेशन में बोर्ड के विचारार्थ छोड़ा न जा सकता हो ।
2. Frequency of Meetings :-( 1 ) meeting of the Board , other than a special meeting referred to in rule 3 , shall be held at least once in every month .
(2) The Board shall, from time to time, determine the date and time of its meeting .
6. मतदान-र्याद किसी प्रश्न पर मतदान की मांग की जाती है तो मत देने वाले न्यासियों के नाम तथा उनके भन्नों की प्रकृति, अधि- वेशन के सभापति द्वारा अभिलिखित की जाएगी ।
Provided that where the Board is unable to do so for any reason, the Chairman may do so, for reasons to be recorded in writing.
(3 ) A meeting of the Board shall be held at the premises of the port of New Mangalore .
स्पष्टीकरण-इस नियम और नियम 7 और 8 के प्रयोजनों के लिए सभापति पद से, अध्यक्ष या उनकी अनुपस्थिति में उपाध्यक्ष, यदि वह नियुक्त किया गया है, और दोनों की अनुपस्िित में उपस्थित म्यासियों में से उनके द्वारा चुना गया कोई व्यक्ति, अभिप्रेत है ।
3. Calling of Special Meetings . The Chairman or , in his absence, the Deputy Chairman, if appointed , may whenever he thinks fit and shall upon the written request of not less than three Trustees , call a special meeting of the Board .
4. Circulation of agenda etc. Agenda and notes of memorandum thereon, if any , for any meeting of the Board shall be circulated to the Trustees at least three daysbefore the date of the meeting;
7. अधिवेशन का कार्यवृत्त ( 1 ) मोर्ड के प्रत्येक अधिवेशन की कार्यवाहियों का कार्यवृष्ण ऐमी पुस्तक में अधिलिखित किया जाएगा जिसकी व्यवस्था बोर्ड ने इस प्रयोजन के लिए की है और उस पर, यथा साध्य शीघ्र ऐसे अधिवेशन का मभापति हस्ताक्षर करेगा और वह कार्यालय के समय के दौरान किसी भी न्यामी के निरीक्षण के लिए उपलब्ध रहेगा ।
Provided that in the case of a special meeting , such agenda and notes or memoranda shall be circulated at least one day before the date of meeting .
(2 ) कार्यवृत्त उसके ऐसे भाग को छोड़कर जिमके लिए अध्यक्ष या उसकी अनुपस्थिति में उपाध्यक्ष, यदि वह नियुक्त किया गया है, किसी विशिष्ट मामले में निर्देश दे, बोर्ड के कार्यालय में , कार्यालय के समय के दौरान जनता के निरीक्षण के लिए उपलब्ध रहेगा ।
( 3 ) प्रत्येक प्रधिवेशन में उपस्थिति न्यासियों के नाम कार्यवृत्त पुस्तक में अधिलिखित किए जायेंगे ।
5. Discussion of items not included in the agenda:-The Chairman or in his absence , the Deputy Chirman , if appointed, may at his discretion , include for discussion at any of the meetings of the Board , including a special meeting , any item not included in the agenda , if the same is , in his opi- nion , of sufficient importance of urgency or both and cannot be held over for the consideration of the Board at any subsequent meeting .
6. Poll: If a poll is demanded on any question, the names of the Trustecs voting and the nature of their votes shall be recorded by the President of the meeting .
Explanation: For the purposes of this rule and rules 7 and 8 , the expression " President " shall mean the Chairman , or in his absence the Deputy Chairman if appointed , and in the absence of both , any person chosen by the Trustees pre- sent from among themselves .
8. अधिवेशन का स्थगन-श्रधिवेणन का सभापति , अधिवेशन में उपस्थित न्यासियों की सहमति से अधिवेशन किसी ऐसी पश्चातवर्ती तारीख तक के लिए स्थगीत कर सकेगा जिसके बारे में या तो उम अधि- वेशन में श्रोषणा कर दी जाएगी , और अधिवेशन में अनुपस्थित न्यामियों की श्रागामी अधिवेशन की तारीख से कम से कम तीन दिन पूर्व उसकी सूचना भेज दी जाएगी , या आगामी अधिवेणन की तारीख से कम से कम तीन दिन पूर्व न्यामियों को संसूचित कर दिया जाएगा ।

a 7. Minutes of the meeting: ( 1 ) Minutes of the proceed- ings at each meeting of the Board shall be recorded in book to be provided by the Board for the purpose, which shall be signed as soon as practicable by the President of such meeting and shall be open to inspection by any Trustee during office hours .
(2) Minutes of the proceedings except such portion thereof as the Chairman , or in his absence the Deputy Chairman , if appointed, may direct in any particular case , shall also be open to the inspection of the public at the office of the Board during office hours .
(3) The names of the Trustees present at each meeting shall be recorded in the minutes book .
G.S.R. 138 (E) .-Whereas the draft of the New Manga- lore Port Trust ( Procedure at Board Meetings) Rules , 1979 , was published as required by sub - section (2 ) of section 122 of the Major Port Trusts Act , 1963 ( 38 of 1963) , at pages 2936 and 2937 of the Gazette of India , Part II Section 3 , Sub- section ( i) dated the 15th Dec. , 79 under the notification of the Government of India, in the Ministry of Shipping and Transport ( Transport Wing) , No. G. S. R. 1502 , dated the 29th November , 1979, inviting objections and suggestions from all persons likely to be affected thereby before the ex- piry of a period of forty- five days from the date of publica- tion of the said notification in the Official Gazette .
And whereas the copies of the said Gazette were made available to the public on the 24th December , 1979;
8. Adjournment of meeting: The President of a meeting may with the consent of the Trustees present in the meeting adjourn it to a later date , which date shall either be announced at the meeting in which case intimation would be sentto the Trustees absent at the meeting at least three days in advance , or communicated to the Trustees at least three days before the date of the meeting.
And whreas no objections or suggestions have been recei- ved from the public before the expiry of the period afore- said;

(न्यासियो की फीस और भत्तों का संदाय ) , नियम 1979 का प्रास्त्प महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 122 की उपधारा ( 2 ) द्वारा यथा-अपेक्षित श्प में भारत सरकार के नौवहन और परिवहन मंत्रालय ( परिवहन पद. ) की अधिसूचना संख्या मा०का ० नि ० 1501, तारीख 29 नवम्बर, 1979 के अधीन भारत सरकार के राजपक्ष, भाग 2 , खण्ड 3, उपखण्ड ( 1 ) नारीख 15 दिसम्बर , 1979 के पृष्ठ 2935 पर प्रकाशित किया गया था, जिसमें उक्त अधिसूचना के राजपत्त में प्रकाणित होने की तारीख से पैतालीम दिन की अवधि की समाप्ति तक उन सभी व्यक्तियों की टिप्पणी और सुझाव मांगे गए थे जिनके उससे प्रभावित होने की संभावना है,
और उक्त राजपत्र की प्रतियां 24 दिसम्बर , 1979 को जनता को उपलब्ध करा दी गयी थी,
और केन्द्रीय सरकार ने उक्त प्रात्य की बाबत प्राप्त टिप्पणियां और मुझावों पर विचार कर लिया है ,
अतः , अब केन्द्रीय सरकार , उक्त अधिमियम की धारा 122 की उपधारा ( 1 ) द्वारा प्रदन शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाती है, अर्थात:-
1. संक्षिप्त नाम , प्रारूप और लागू होना ( 1 ) इन नियमों का नाम नव मंगलोर पत्तन न्यासी-बोर्ड ( न्यासियों की फीस और भत्तों का संदाय) नियम 1980 है ।
(2) ये 1 अप्रैल, 1980 को प्रवृत्त होंगे ।
( 3) ये महापत्तनस न्या अधिनियम, 1963 ( 1963 का 38) की धारा 16 के उपबंधों के अधीन रहते हुए , नव मंगलोर पत्तन के न्यास बोर्ड के अधिवेशनों में विए जाने वाले कामकाज को लागू होंगे ।
2. संदेय फीम-अध्यक्ष , उपाध्यक्ष, यदि वह नियुक्त किया गया है, या ऐसे किसी अन्य न्यासी को छोड़कर जो सरकारी सेवक है , बोर्ड का प्रत्येक न्यासी निम्नलिखित फीस का हकदार होगा-
( 1 ) बोर्ड के प्रत्येक साधारण या विशेष अधिवेशन में उपस्थित होने के लिए, पच्चीस रुपए ।
परन्तु किसी कैलेण्डर मास के दौरान हुए अधिवेशनों की बाबत किसी न्यासी को संदेय फीस की कुल रकम, किसी भी दशा में एक सौ पचाम रुपए से अधिक नहीं होगी ।
( 2) बोर्ड के साधारण या विशेष अधिवेशन के अनुक्रम में या उमकी तैयारी में उसी दिन होने वाले, समिति के किसी अधिवेशन से भिन्न, किसी समिति के प्रत्येक अधिवेशन में उपस्थिति के लिए , पन्द्रह रुपाए ।
टिप्पण: बोर्ड था उसकी समिति के किमी अधिवेशन में उपस्थित म्यासी, इसी प्रयोजन के लिए रखी गयी पुस्तक या रजिस्टर में अपने हस्ताक्षर करेगा ।
3. यात्रा भत्तों का संदाय ( 1 ) बोर्ड या उमकी समितियों में से
किसी अधिवेशन में उपस्थित होने के लिए बाहर से आने वाले ऐसे सभी न्यासी जो सरकारी सेवक नहीं है, नियम 2 के अधीन संदेय फीस के अतिरिक्त, उस दर पर यात्रा भत्ता पाने के हकदार होगे जिस पर केन्द्रीय मरकार के अधिकारियों का उच्चतम वर्ग प्राप्त करता है, किन्तु वे कोई दैनिक भत्ता पाने के हकदार नहीं होंगे ।
( 2) ऐसा म्याम , जो सरकारी सेवक है भौर जो बोर्ड या उसकी समितियों में से किसी के अधिवेणन में उपस्थित होता है , उसे लागू होने वाले सेवा नियमों के उपबंधों के अनुसार यात्रा भत्ता भौर दैनिक भत्ता पाने का हकदार होगी ।
4. ऐसे न्यासियों को कतिपय भत्तों का संदाय जो लोकसभा या राज्य विभान मण्डल के सदस्य हैं नियम 2 और 3 में किसी

यान के होते हुए भी, कोई न्यासी, जां लोक सभा या किसी राज्य विधान मण्डल का सदस्य भी है, संमद ( निरहंता निवारण ) अधिनियम, 1959 (1959 का 10) की धारा 3 के खण्ड ( क) में क्या परिभाषित प्रतिकारात्मक भले से या यथास्थिति, ऐसे किसी अन्य भत्ते से यदि कोई है, जो किसी राज्य विधान मंडल का सदस्य राज्य में तन्ममय प्रवृत्त निरर्हता निवारण संबंधी किसी विधि के अधीन ऐसी निरर्हता उपगत किए बिना, प्राप्त करता है, भिन्न किमी फीम का हकदार नही होगा ।

G.S.R. 139(E) .-Whereas the draft of the Board of Trus- ices of the Port of New Mangalore ( Payment of Fees and Allowances to Trustees) Rules , 1979 , was published as re- quired by sub - section (2) of section 122 of the Major Port Trusts Act, 1963 (38 of 1963 ) , at page 2935 of the Gazette of India, part II Section 3 sub - section ( i) dated the 15th Decem- ber , 1979 , under the notification of the Government of India in the Ministry of Shipping and Transport (Transport Wing ) , No. G. S. R. 1501 , dated the 29th November , 1979 , inviting objections and suggestions from all persons likely to be affec- ted thereby before the expiry of a period of forty -five days from the date of publication of the said notification in the Official Gazette ;
And whereas the copies of the said Gazette were made available to the public on the 24th December , 1979 ;
And whcreas no objections or suggestions have been received from the public before the expiry of the period aforesaid;
Now, therefore, in exercise of the powers conferred by sub- section ( 1 ) of section 122 of the said Act, the Central Gov- ernment hereby makes the following rules , namely :-
1. Short title , commencement and application .( 1 ) These rules may be called the Board of Trustees of the Port of New Mangalore ( Payment of Fees and Allowances to Trus- tees) Rules, 1980 .
(2) They shall come into force on the 1st day of April , 1980.
(3 ) They shall , subject to the provisions of section 18 of the Major Port Trusts Act , 1963 ( 38 of 1963 ) , apply to the Board of Trustees for the Port of New Mangalore and also to the Committees thereof.
2. Fees payable . Every Trustee of the Board other than the Chairman , the Deputy Chairman when appointed , or any other Trustee who is a servant of the Government, shall be entitled to a fee of-
( i) rupces twenty -five for attendance at each ordinary or special mecting of the Board ;
Provided that the aggregate amount of fecs payable to any Trustee in respect of the meetings held during any calendar month shall not exceed rupees one hundred and fifty ;
( ii) rupees fifteen for attendance at each meeting of any Committee, other than the meeting of the Com- mittee held on the same day in continuation preparatory to an ordinary or special meeting of the Board. or
Note : A Trustee present at or for any meeting of the Board or Committee thereof shall sign his name in a book or register to be kept for the purpose .
3. Payment of travelling allowance.( 1 ) All outstation Trustees other than those who are Government servants , at- tending any meeting of the Board or of any of its Committees shall , in addition to such fee as is payable under rule 2 , be entitled to receive travelling allowance on the scale applica- ble to the highest class of officers of the Central Government , but shall not be entitled to receive any daily allowance .
(2) A Trustee who is a Government servant and who attends any mecting of the Board or of any of its Commit- tees shall be entitled to receive travelling allowance and daily allowance in accordance with the provisions of the service rules applicable to him .
4. Payment of certain allowances to a Trustee who is a member of Parliament or of the Legislature of a State-Not- withstanding anything contained in rules 2 and 3 , a Trustee 203

who is also a member of Parliament or of the Legislature of a State , shall not be entitled to any fees other than the compensatory allowance as defined in clause ( a) of section 2 of the Parliament ( Prevention of Disqualification ) Act , 1959 (10 of 1959) or , as the case may be , other than the allowance , if any, which a member of the Legislature of the State may, under any law for the time being in force in the State relating to the prevention of disqualification for membership of the State Legislature , receive without incurring such dis- qualification.

सा०फा० नि० 140 ( अ) केन्द्रीय सरकार , महापत्तन न्यास अधि- नियम, 1963 ( 1963 का 38 ) की धारा 28 ौर 134 के साथ पठित धारा 126 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित प्रथम विनियम बनाती है, अर्थात्ः-
1. संक्षिप्त नाम भौर प्रारम्भ ( 1 ) इन विनियमों का नाम नव मंगलोर पत्तन न्यास (नियमों का अनुकूलन ) विनियम, 1980 है ।
(2) ये 1 अप्रैल, 1980 को प्रवृत्त होंगे ।
2. लागू होनाःये नव मंगलोर पत्तन त्यास को लागू होंगे ।
3. परिभाषाएं-इन विनियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -
(क ) " अधिनियम " से महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) अभिप्रेत है,
(ख) "मियत दिन" से वह तारीख अभिप्रेत है जिसको अधिनियम मव मंगलोर पत्तन का लागू किया जाता है, अर्थात् 1 अप्रैल , 1980
( ग) "बोर्ड" का वही अर्थ होगा जो उमे अधिनियम में दिया गया है,
(घ) "विद्यमान नियम और आदेश से" पत्तन के प्रशासन के संबंध में नियत दिन के पूर्व प्रवृत्त विभिन्न अधिनियमों और नियमों के अधीन बनाए गए नियम और आदेश अभिप्रेत हैं,
(ङ) "पत्लम" से नब मंगलोर पत्तम अभिप्रेत है ,
4. विद्यमान नियमो का जारी बना रहना विद्यमान नियम और आवेश तथा निम्नलिस्थित विषयों के सबंध में नियत दिन को या उसके पश्चात उनमें किए गए पश्चातवर्ती संशोधन, उस सीमा तक, जहा तक वे अधिनियम या उसके अधीन बनाए गए किन्हीं विनियमों के उपबंधों मे असंगत नहीं है, और जब तक वे बोर्डद्वारा परिवर्तित, निरमित य संशो धित मही किए जाने, इस प्रकार प्रवृत्त रहेंगे मानो वे केन्द्रीय सरकार द्वारा अधिनियम के अधीन बनाए गए थे , अर्थात्ः-
(1) अधिनियम की धारा 28 के अधीन विनिविष्ट विषय , और
( ।।) अधिनियम की धारा 123 के खण्ड ( ख) भौर खण्ड ( ङ) से
( क) तक में विनिविष्ट विषय:
परन्तु विद्यमान नियमों और आदेशों में पूर्वोक्त कोई संशोधन, जो किसी कर्मचारी के लिए फायदाप्रव नहीं है ऐसे कर्मचारी को तब तक लागू नहीं किया जाएगा जब तक बोर्ड केन्द्रीय सरकार की पूर्व मंजूरी प्राप्त नहीं कर लेता ।
5. रसीद का प्रारूप-प्रधिनियम की धारा 42 की उपधारा ( 2 ) के अनुमरण में दी जाने वाली रसीव , यथासाध्य , इन विनियमों के परिशिष्ट में विए गए प्ररूप में होगी ।
6. सूचना की अवधि-अधिनियम की धारा 42 की उपधारा ( 2) के अधीन हानि या नुकसान की सूचना वेने की अवधि, अधिनियम की धारा 42 की उपधारा ( 2) के अधीन ऐसे माल के भारसाधन की तारीख से पूरे सात कार्य विवस की होगी ।
7. उत्तरवायित्व की अवधि निर्यात के लिए प्राशयित माल की नाबत, बोर्ड , द्वारा, माल के भारसाधन की तारीख से पूरे तीस कार्य विवम और अन्य माल की आबत , बोर्ड द्वारा माल के भारसाधन की तारीख से पूरे सात कार्य दिवस को अवधि के पश्चात् अधिनियम की धारा 43 के अधीन बोर्ड का कोई उत्तरदायित्व नहीं होगा ।
स्पष्टीकरण--इम विनियम या विनियम 6 में निर्दिष्ट पूरे कार्य दिवसों की अवधि की गणना करने में भाल के भारसाधन दिन को हिसाब में नही लिया आएगा ।

G.S.R. 140( E) . In exercise of the powers conferred by section 126 , read with sections 28 and 134, of the Major PortTrusts Act, 1963 ( 38 of 1963 ) , the Central Government hereby makes the following first regulations , namely :
( 1 ) These regulations 1. Short title and commencement . may be called the New Mangalore Port Trust (Adaptation ofRules) Regulations , 1980 .
(2) They shall come into force on the first day of April , 1980.
2. Application. They shall apply to the Port Trust of New Mangalore .
3. Definitions . In these regulations , unless the context otherwise requires ,-
(a) " Act" means the Major Port Trusts Act, 1963 (38 of 1963 ) ;
(b) "appointed day" means the date on which the Act ismade applicable to the Port of New Mangalore that is , first day of April , 1980 .
(c) " Board" shall have the meaning assignedto it in the Act ;
and in (d) " existing rules and orders " means the rules orders made under the various Acts and rules force prior to the appointed day in connection with the administration of the Port :
( e) " Port " means the Port of New Mangalore .
4. Existing Rules to Continue . Existing rules and orders and subsequent amendments thereto made on or after the appointed day relating to the following matters shall, to the extent they are not inconsistent with the provisions of the

Act or any regulations made thereunder , and until they are altered, repealed or amended by the Board, continue in force as if they were made by the Central Government under the Act , namely
(i ) matters specified under section 28 of the Act and
( ii ) matters specified in clause (b) and clauses (e) to (n) of section 123 of the Act :
Provided that any amendment aforesaid to the existing rules and orders , not advantageous to an employee , shall not be made applicable to such employee unless the Board ob- tains the previous sanction of the Central Government .
5. Form of Receipt . The receipt to be given in pursuance of sub - section ( 2 ) of section 42 of the Act shall , as far as practicable, be in the form set out in Appendix to these re- gulations.
of 6. Period of Notice . The period within which notice of loss or damage shall be given under sub - section ( 2 ) section 43 of the Act shall be seven clear working days from the date of taking charge of such goods by the Board under sub-section ( 2 ) of section 42 of the Act.
7. Period of Responsibility . No responsibility shall attach to the Board under section 43 of the act after a period of thirty clear working days from the date of taking charge of the goods by the Board in respect of goods meant for export , and seven clear working days from the date of taking charge of the goods by the Board in respect of other goods-
Explanation . In computing the period of clear working lays referred to in this regulation or regulation 6. account shall not be taken of the day of taking charge of the goods .
