फा०क्षा० 232 (श्र) / 18 / श्राई ० डी० मार० ए० / ४०-भारत सरकार के उद्योग मंत्रालय ( श्रौद्योगिक विकास विभाग ) के आदेश सं० का० মা० 192(अ) / 18-जख/, आई डी भार ए/ 79 ; तारीख 31 मार्च, 1979 ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) द्वारा केन्द्रीय सरकार ने उद्योग (विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 चख की उपधारा ( 1 ) के खण्ड ( ख) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , घोषणा की थी कि उक्त श्रावेश के जारी होने की तारीक से ठीक पूर्व प्रवृत्त सभी संविदाओं, सम्पति के हस्तान्तरण पल्लों, करारों , व्यवस्थापनों, पंचाटों, स्थायी श्रादेशों या अन्य लिखितों का (उससे भिन्न जो बैंकों और वित्तीय संस्थानों के प्रतिभूत वायित्वों से संबंधित हैं ) , जिसका मैसर्स महादेव टैक्सटाइल मिल्म, हुबली, कर्नाटक नामक औद्योगिक एक पक्षकार है या जो ऐसे औद्योगिक उपक्रम को लागू हो सकती है, प्रवर्तन ऐसी तारीख से एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख से पूर्व तद्धीन प्रोभूत या उद्‌भूत होने वाली बाध्यताएं और वायित्व उक्त अवधि तक निलम्बित रहेंगे; सभी और केन्द्रीय सरकार का समाधान हो गया है कि उक्त आवेश की अस्तित्वावधि एक वर्ष तक और बढ़ा दी जामी चाहिए ;

अतः, केन्द्रीय सरकार, उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65) की धारा 18 वय की उपधारा ( 2 ) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त भादेश की अस्तित्वावधि 30 मार्च, 1981 तक , जिसमें यह तारीख भी सम्मिलित है, और बढ़ाती है ।

New Delhi , the 31st March, 1980

S.O. 232 (E ) /18FB /IDRA/80 . Whereas by the Order of the Government of India in the Ministry of Industry ( De- partment of Industrial Development) No. S.O. 192( E) / 18FB / IDRA/ 79 , dated the 31st March , 1979 (hereinafter referred to as the said Order) , the Central Government , in exercise of the powers conferredby clause (b) of sub - section ( 1 ) of section 18FB of the Industries ( Development and Regulation) Act , 1951 (65 of 1951 ) , declared that the operation of all contracts , assurances of property, agreements , settlements , awards , standing orders or other instruments in force imme- diately before the date of issue of the said Order ( other than

those relating to secured liabilities to bank and financial institutions ) to which the industrial undertaking known as Messrs Mahadeva Textile Mills , Hubli, Karnataka , is a party or which may be applicable to the said industrial undertaking shall remain suspended for a period of one year from such date and that all obligations and liabilities accruing or arising thereunder before the said date shall remain suspended for the said period ;

And whereas the Central Government is satisfied that the duration of said Order should be extended for a further period of one year ;

Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) read with sub -section (2) , of section 18FB of the Industries ( Development and Regulation) Act , 1951 ( 65 of 1951 ), the Central Government hereby extends the duration of the said Order for a further period upto and inclusive of the 30th March , 1981 .

फिर भी उक्त उपक्रम तुलन पत्त और लाभ तथा हानि का लेखा सामान्य ऋप में तैयार करेगा और उन्हें कानूनी विवरणियों के साथ कम्पनी रजिस्ट्रार के पास फाइल करेगा ।

धारा 217

इस धारा के उपबन्ध उक्त श्रौद्योगिक-उप- क्रम को उस सीमा तक लागू नही होगे जिम सीमा तक कि बोर्ड की रिपोर्ट वार्षिक साधारण अधिवेशन के समक्ष रखेजाने के लिए अपेक्षित न हो ।

धारा 224 भौर 225

इन धाराओं के उपबन्ध उक्त मौद्योगिक उपक्रम को इस शर्त के अधीन रहते हुए लागू नहीं होगे कि लेखापरीक्षक केन्द्रीय सरकार द्वारा नियुक्त किए जाएंगे ।

धारा 293( 1) (घ)

प्रा०का ० 233 ( प्र). केन्द्रीय सरकार , उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65) की धारा 18 क द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के उद्योग मंत्रालय ( श्रौद्योगिक विकास विभाग) के आदेश सं० का०आ० 325 (श्र ) तारीख 18 मई, 1978 में सिम्तलिखित संशोधन करती है, अर्थात्-

उक्त श्रादेश में " मत्रस्य ( अंशकालिक ) ", शीर्ष के निचे प्रावृष्टि 5 का लोप किया जाएगा ।

इस उपधारा के उपबन्ध उक्त औद्योगिक उपक्रम को उन शर्तों के अधीन रहने हुए लागू नहीं होंगे , जिन्हें सरकार समय-समय पर अधिरोपित करे ।

धारा 169 और 294

S.O. 233(E) . In exercise of the powers conferred by Sec- tion 18A of the Industries ( Development and Regulation) Act, 1951 (65 of 1951 ) , the Central Government hereby makes the following amendment in the Order of the Government of India in the Ministry of Industry (Department of Indus- trial Development) No. S.O. 325 (E) dated the 18th May , 1978 , namely:---

In the said QOrder, under the heading ' Members ( Part- time)' , entry 5B shall be omitted,

का०ग्रा० 234 ( प्र) /18 अ/ भाई को भार ए/ 80--केन्द्रीय सरकार ने , भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकाम विभाग ) के आदेश सं ० का ०था ० 618 ( अ)/ 18 कक/ आई डी भार ए/ 79, तारीख 31 अक्तूबर, 1979 द्वारा सचिव , बंद और रुग्ण उद्योग विभाग पश्चिमी बंगाल सरकार, कलकत्ता को सम्पूर्ण औद्योगिक उपक्रम अर्थात श्री सरस्वती प्रेस लिमिटेड , कलकत्ता का प्रबन्ध उसमें विनिर्दिष्ट अवधि के लिए ग्रहण करने के लिए प्राधिकृत किया है ।

इन धाराओं के उपबन्ध उक्त श्रौद्योगिक उपक्रम को लागू नहीं होंगे ।

S.O. 234( E)/18E/IDRA/80.-Whereas , by the Order of the Government of India in the Ministry of Industry (Department of Industrial Development) No. S. 0,618 (E) /18AA/IDRA/79, dated the 31st October , 1979, the Central Government has authorised Secretary , Closed and Sick Industries Department , Government of West Bengal , Calcutta , to take over the manage- ment of the whole of the industrial undertaking viz . , Sree Saras- wati Press Limited, Caloutta, for the period specified therein;

Now, therefore , in exercise of the powers conferred by sub- section ( 2 ) of section 18E of the Industries ( Development and Regulation) Act , 1951 , (65 of 1951 ) , the Central Government hereby specifies , in the Schedule annexed hereto , the exceptions , restrictions and limitations subject to which the Companies Act , 1956 ( 1 of 1956 ) , shall continue to apply to the said industrial undertaking in the same manner as it applied thereto before the issue of the order under section 18AA of the aforesaid Act . Provisions of the

भतः , श्रम, केन्द्रीय सरकार , उद्योग ( विकास और विनियमन ) अधि- नियम, 1951 (1951 का 65 ) की धारा 18 क की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए इससे उपाबद्ध अनुसूची में ऐसे अपवावों, निर्बंधनों भौर परिसीमाओं को विनिविष्ट करती है जिनके अधीन रहते हुए कम्पनी अधिनियम, 1956 ( 1956 का 1 ) उक्त औद्योगिक उपक्रम को उसी रीति में लागू होता रहेगा जैसी वह पूर्वोक्त अधिनियम की धारा 18कक के अधीन आदेश जारी किए जाने के पूर्व उसे लागू था ।

अनुसूची

ऐसे अपवाद, निबंधन , परिसीमाएं कम्पनी अधिनियम, 1956

के उपबन्ध

जिनके अधीन रहते हुए स्तम्भ ( 1)

में वर्णित उपबन्ध उपक्रम को लागू होंगे ।

धारा 166 और 210( 1)

हुए लागू नहीं होंगे कि यद्यपि कम्पनी

इन धाराओं के उपबन्ध उक्त प्रौद्योगिक उपक्रम को इस शर्त के अधीन रहते का तुलम पत्र भौर लाभ तथा हानि का लेखा वार्षिक साधारण अधिवेशन

के समक्ष रखने की घावश्यकता नहीं है

Exceptions , restrictions , limitations

Companies Act , 1956 subject which the provisions mention- ed in column ( 1 ) shall apply to the undertaking .

Sections 166 and 210( 1 ) Provisions of these sections shall not apply to the said industrial under- taking, subject to the condition that while the balance sheet and profit and loss account of the Company need not be placed before the annual general meeting, it shall , however, prepare Balance Sheet and Profit and Loss Account as usual and file them with the Registrar of Companies along with Statutory returns .

Section 217

Provisions of this section shall not apply to the said industrial undertaking to the extent that the Board's report is not required to be placed before the general meeting .

Sections 224 and 225 Provisions of these sections shall not apply to the said industrial undertaking subject to the condition that auditors shall be appointed by the Central Government .

Section 293 ( 1 )( d)

Provisions of this sub - section shall not apply to the said industrial under- taking subject to such conditions thatGovernment may inmpose from time to time .

Sections 169 and 294 Provisions of these sections shall not apply to the said industrial under- taking.
