का०प्रा ० 279 (प्र) यतः भ्रपने पास उपलब्ध जानकारी के भाधार पर घौर तारीख 23 और 26 प्रप्रैल, 1980 को दोनों गुटों के परामर्श दाताभों और अन्य प्रतिनिधियों को सुनने के पश्चात्, निर्वाचन प्रायोग का यह समाधान हो गया है कि राष्ट्रीय वल जनता पार्टी (सेक्यूलर ) के ऐसे वो प्रतिद्वन्दी समूह अथवा गुट हैं जिन में से हर एक वह वल होने का दावा करता है, ऐसा एक श्री राज मारायण के नेतृत्व वाला समूह अथवा गुट है और दूसरा चो० चरण सिंह के नेतृत्व बाला समूह अथवा गुट है ।
भौर यप्तः , निर्वाचन प्रतीक ( आवरण और आबंटन) पावेश, 1968 के पैरा 15 के अनुसार ( इसके भागे यह 'प्रतीक भादेश ' के रुप में संवभित है) , यह मामला निर्वाचन आयोग द्वारा विनिश्चत किया जाना अपेक्षित है कि ऐसे प्रतिद्वन्दी समूहों अथवा गुटों में से कौन सा समूह अथवा गुट उक्त जनता पार्टी ( सेक्यूलर ) हैं ;
और यतः , प्रतीक आदेश के पैर 15 के अनुसार , उक्त विवाद, बिहार, गुजरात, मध्य प्रदेश, महाराष्ट्र, उड़ीसा, पंजाब, राजस्थान, तमिल- नाडु, भौर उत्तर प्रदेश राज्यों की विधान सभाओं के साधारण निर्वाचनों के प्रयोजनो के लिए 2 मई, 1980 को नाम- निर्देशन पत्त्र को वाखिल करने की प्रक्रिया को समाप्ति जिसका क्रमशः राज्यों के राज्यपालों द्वारा

तारीख 25 अप्रैल, 1980 को लोक प्रतिनिधित्व अधिनियम , 1951 की द्वारा 15 के अधीन अधिसूचना जारी कर पहले ही आहवान किया गया है, से पूर्व विनिश्चित नहीं किया जा सकता है ;
और यतः, निर्वाचन भायोग मानता है कि न्याय भौर ग्याय व्यवहार के हित में , उक्त जनता पार्टी ( सेक्यूलर) के उक्त प्रतिद्वन्दी समूहों अथवा गुटों में से किसी को भी, उक्त साधारण निर्वाचनों के समय उक्त जनता पार्टी ( सेक्यूलर ) का नाम अथवा उस दल के लिए आरक्षित प्रतीक 'क्षेत जोतता हुआ किसान' द्वारा पहले अथवा दूसरे गुट घथवा समूह को लाभ नहीं होना चाहिए ;
घौर यतः निर्वाचन आयोग यह भी मानता है कि स्वतंत्र एवं निष्पक्ष निर्वाचनों के हित में , उक्त प्रतिद्वन्दी समूहों अथवा गुटों को, दोनों में से प्रत्येक के लिए आरक्षित अलग - अलग प्रतीक पर उक्त साधारण निर्वाचन लड़ने के लिए अवसर मिलना चाहिए ;
अतः अब , निर्वाचनों का संचालन नियम , 1961 के नियम 5 और 10, निर्वाचन प्रतीक ( श्रारक्षण और घावंटन) श्रादेश , 1968 के पैरा 3,6,7,8 और 18 के साथ पठित संविधान के अनुच्छेद 324 द्वारा निर्वाचन आयोग को प्रवत्त शक्तियों तथा इस निमित्त उसे समर्थ बनानी वाली अन्य सभी शक्तियों का प्रयोग करते हुए , उक्त पैरा 1 में संदर्भित उक्स जनमा पार्टी ( सेक्यूलर ) के दोनों प्रतिद्वन्दी समूहों अथवा गुटों के बीच विधाद में अन्तिम आदेशों तक, निर्वाचन भायोग एतद्वारा भावेश देता है कि:--
( 1) श्री राजनारायण के नेतृत्व वाले जनता पार्टी ( सेक्यूलर ) के गुट को 'जनता पार्टी (सेक्यूलर)--राजनारायण' और

श्री धरण सिंह के नेतृत्व वाले जनता पार्टी ( सेक्यूलर ) के गुट को 'अनता पार्टी ( सेक्यूलर) चौ० चरण सिंह' के रूप में जाना जाए ;
( 2) उमत 'जनता पार्टी ( सेक्यूलर) -राजनारायण' और 'जनता पार्टी ( सेक्यूलर )-चौ० चरण सिंह' को केवल बिहार , गुजरात मध्य प्रदेश , महाराष्ट्र, उड़ीसा, पंजाब , राजस्थान, तमिलनाडु , और उत्तर प्रदेश राज्यों की विधान सभाओं के साधारण निर्वाचनों के प्रयोजनों के लिए जो अब प्रर्गात पर हैं , दलो के रूप में तदर्थ आधार पर मान्यता दी जाए :
( 3) केवल उक्त मौ राज्यों में उक्त ' जनता पार्टी ( सेक्यूलर) - राजनारायण' के लिए ' माइकिल ' प्रतीक और उक्त 'जनता पार्टी (सेक्यूलर )-चौ० चरण सिंह' के लिए 'स्त्री ' प्रतीक मार्गक्षत किया जाए ।
2. निर्वाचन आयोग , निर्वाचन प्रतीक ( आरक्षण और प्रायंटन) आदेश , 1968 के पैरा 17 के उप -पैरा ( 1 ) के खंड ( क) और ( घ) तथा उप-पैरा ( 2 ) के अनुसरण में, एतद्वारा श्रागे यह निदेश देता है कि भारत के राजपत्न , असाधारण , भाग II , खंड 3 ( ii ) , भारीख 28 सितम्बर, 1979 में का०आ ० 557 ( अ ) के रूप में प्राणिन और समय -समय पर यथा संशोधिन , इमकी तारीख 28 सितम्बर , 1979 की श्रधिसूचना सं० 56/79 में निम्नलिखित संशोधन किए जाएं, श्रर्थात्--
(1) विद्यमान प्रविष्टि ' 6 ' जनना पार्टी (सेक्युलर ) खेत जोतता हुआ किसान' के स्थान पर , निम्नलिखित प्रविष्टियां ग्वी जाएंगी--
" 6 , जनता पार्टी ( सेक्यूलर ) राजनारायण माइकिल*
7, जनता पार्टी ( ( सेक्यूलर) चौ० चरणसिंह-स्त्री *
*तारीख 25 अप्रैल , 1980 को आह्वान किए गए विधान सभाभों के निर्वाचनों की कालावधि के लिए बिहार, गुजरात, मध्य प्रदेश , महाराष्ट्र, उड़ीसा पंजाब, राजस्थान, तमिलनाडु और उत्तर प्रदेश राज्यों में आरक्षित ।
( II) उक्त अधिसूचना से संलग्न सारणी 4 में-
(1) मद सं० 3-बिहार के सामने , स्तम्भ 2 के नीचे, ' 2. साइकिल' नौर '28. स्त्री' प्रविष्टियां हटाई जाएंगी भौर 3 से 27 तक की विद्यमान प्रविष्टियां 2 से 26 तक के रुप में पुनः संख्याकिंत की जाएंगी और 29 से 52 तक की प्रविष्टियां 27 से 50 तक के रूप में पुनः संख्यांकित की जाएंगी ।
(2) मद सं० 4 गुजरात के सामने , स्तम्भ 2 के नीचे, ' 1. साइकिल' प्रविष्टि हटाई जाएगी और 2 से 15 तक की विद्यमान प्रविष्टियां 1 से 14 तक के रूप में पुनः संख्यांकित की जाएंगी ;
(3) मद सं० 10, मध्य प्रदेश के सामने, स्तम्भ 2 के नीचे , " 1. साइकिल" और " 52. स्त्री " प्रविष्टियां हटाई जाएंगी और 2 से 51 तक की विद्यमान प्रविष्टिया 1 से 50 तक के रूप में पुनः संख्यांकित की जाएंगी ;
(4) मव सं० 11. महाराष्ट्र के सामने, स्तम्भ 2 के नीचे, " 2 . साइकिल" और " 48. स्त्री" प्रविष्टियां हटाई जाएंगी और 3 से 47 तक की विद्यमान प्रविष्टियां 2 से 46 तक के रुप में पुनः संख्यांकित की जाएंगी ;
(5) मद सं ० 15. उड़ीसा के मामने, स्तम्भ 2 के नीचे, " 2. साइकिल" प्रविष्टि हटाई जाएगी और 3 से 13 तक की विद्यमान , प्रविष्टियां 2 से 13 तक के रूप में पुनः संख्यांकित की जाएंगी ;
(6) मद सं० 16. पंजाब के सामने, स्तम्भ 2 के नीचे, " 1 .

कल " प्रविष्टि हटाई जाएगी और मात्रि 2 से 22 तक की विद्यमान प्रवि ष्टियां 1 से 21 तक के रूप में पुनः संख्यांकित की जाएंगी ;
( 7) मद सं ० 17. राजस्थान के सामने, स्तम्भ 2 के नीचे , " 1.- साइकिल " प्रविष्टि हटाई जाएगी और 2 से 21 तक की गिद्यमान प्रविष्टियो 1 से 23 तक के रूप में पुन संख्यांकित की जाएंगी ;
(8) मद सं ० 19 - तमिलनाडु , के मामने, स्तम्भ 2 के नीचे, साइकिल' प्रविष्टि हटाई जाएगी और 3 से 21 तक की विद्यमान प्रविष्टियां 2 से 20 तक के रूप में पुनः संख्यांकिम की जाएंगी, और
(9) मद सं० 21--उत्तर प्रदेश के सामने, स्तम्भ 2 के नीचे , ' 2. साइकिल' प्रविष्टि हटाई जाएगी और 3 से 27 तक की विद्यमान प्रविष्टियां 2 से 26 तक के रूप में पुनः संख्याकित की जाएंगी ।

ELECTION COMMISSION OF INDIA NOTIFICATION
New Delhi , the 26th April , 1980
S.O. 279(E). Whereas the Election Commission is satisfied , on information in its possession and after hear- ing the coursels and other representatives for both the groups on 23rd and 26th April, 1980 , that there are two rival sections or groups of the Janata Party ( Secular ) , a National Party, each of whom claims to be that party , one such section or group being led by Shri Raj Narain and the other being led by Ch . Chararr Singh;
And whereas the matter requires to be decided by the Commission in terms of paragraph 15 of the Election Sym- bols (Reservation and Allotment ) Order , 1968 ( hereinafter referred to as the ' Symbol Orders ' ) as to which of such rival sections or groups is the said Janata Party ( Secular ) :
And whereas the above dispute in terms of paragraph 15 of the Symbols Order cannot be decided before the process of nominations closes on the 2nd May, 1980 for the pur- poses of the general elections to the Legislative Assemblies of the States of Bihar , Gujarat , Madhya Pradesh , Maha- rashtra , Orissa , Punjab , Rajasthan , Tamil Nadu and Uttar Pradesh which have already been called by the Governors of the respective States on the 25th April , 1980 by issuance of Notification under section 15 of the Representation of the People Act, 1951 ;
And whereas the Commission considers that in the interest of justice and fair -play none of the above said rival groups or sections of the said Janata Party ( Secular ) should have an advantage over the other group or section at the said general elections by using the name of the said Janata Party (Secular) or the symbol ' Farmer Ploughing the Field ( Khet Jotata Hua Kisan ) ' reserved for that party ;
And whereas the Commission further considers that in the interest of free and fair elections both the above said rival sections or groups should have the opportunity of contesting the above said general elections on separate symbols re- served for each of them;
Now, therefore , in exercise of the powers conferred on the Election Commission by article 324 of the Constitution read with rules 5 and 10 of the Conduct of Elections Rules , 1961, paragraphs 3 , 6, 7 , 8 and 18 of the Flection Sym- bols (Reservation and Allotment ) Order , 1968 and all other powers enabling it in this behalf , pending final orders in the dispute between the two rival sections or groups of the said Janata Party ( Secular ) referred to in paragraph 1 above , the Election Commission hereby orders that :-
(i) the group of the Jarrata Party ( Secular) led by Shri Raj Narain be known as 'Janata Party ( Secu- lar) Raj Sarain ' and that other group of the Janata Party (Secular) led by Ch . Charan Singh be known as 'Janata Party ( Secular )-Ch . Charar Singh' ;
( ii) the said 'Janata Party ( Secular ) Raj Narain ' and 'Janata Party ( Secular )-Ch . Charan Singh ' be granted ad hoc recognition as Parties for the only [भाग II-खण्ड 3 ( ii ) ]

purpose of general election to the Legislative Assemblics of the States of Bihar , Gajarat , Madhya Pradesh , Maharashtra , Orissa , Punjab , Rajasthan , Tamil Nadu and Uttar Pradesh, now in progress ;
( iii) the symbol ' Bicycle ' be reserved for the said 'Janata Party ( Secular ) -Raj Narain' and the symbol 'Woman' be reserved for the said ' Janata party (Secular ) Ch . Charan Singh' only in the said nine States.
2. In pursuance of clauses ( a ) and ( d ) of sub - para ( 1) and sub- para ( 2 ) of paragraph 17 of the Election Symbols (Reservation and Allotment ) Order, 1968 , the Commission hereby further directs that the following amendments shall be made to its notification No. 5679 dated 28th September , 1979 published as S.O. 557 ( E ) in the Gazette of India , Extraordinary , Part II, Section 3 ( ii ) dated 28th September , 1979 , and as amended from time to time , namely
In TABLE 1 appended to the said, Notification
I. For the existing entry " 6. Janata Party ( Secular ) .... ... Farmer ploughing the Field (Khet Jotata Hua Kisan) " the following entries shall be sudbstituted
Bicycle* Raj Narain . "6. Janata Party ( Secular )
7. Janata Party ( Secular )
Woman* Ch . Charan Singh .
* Reserved in the States of Bihar , Gujarat, Madhya Pradesh , Maharashtra , Orissa , Punjab , Rajasthan , Tamil Nadu and Uttar Pradesh for the duration of the elections to legislative Assemblies called on the 25th April , 1980. "
II . Ir TABLE 4 appended to the said Notification
( i ) against item No. 3. Bihar , under column 2. the entries " 2. Bicycle " and " 28. Woman" shall be deleted and the existing entries 3 to 27 shall be renumbered as 2 to 26 and entries 29 to 52 shall be renumbered as 27 to 50 ;
(ii) against item No. 4. Gujarat , under column 2 , the entry " 1. Bicycle" shall be deleted and the existing entries 2 to 15 shall be renumbered as 1 to 14;
( iii) against items No. 10. Madhya Pradesh , under column 2 , the entries " 1. Bicycle" and " 52 . Woman" shall be deleted and the existing entries 2 to 51 shall be renumbered as 1 to 50 ;
(iv) against item No. 11. Maharashtra, under column 2, the entries " 2. Bicycle" and "48. Woman " shall be deleted and the existing entries 3 to 47 shall be renumbered as 2 to 46 ;
(v) against item No. 15. Orissa , under column 2 , the entry " 2. Bicycle " shall be deleted and the exist- ing entries 3 to 13 shall be renumbered as 2 to 12;
(vi ) against item No. 16. Punjab , under column 2, the entry " 1. Bicycle " shall be deleted asd the exist- ing entries 2 to 22 shall be renumbered as 1 to 21;
(vii) against item No. 17. Rajasthan under column 2, the entry " 1. Bicycle " shall be deleted and the existingexisting entries 2 to 24 shall be renumbered as 23;
(viii ) against item No. 19. Tamil Nadu , under column 2, the entry " 2. Bicycle " shall be deleted and the existing entries 3 to 21 shall be renumbered as 2 to 20 ; and
( ix) against item No. 21. Uttar Pradesh , under column 2, the entry "2. Bicycle " shall be deleted and the existing entries 3 to 27 shall be renumbered as 2 to 26 .
