का०आ० 291 ( प्र ) निर्वाचन भायोग ने अपने तारीख 24 अप्रैल, 1980 के आदेश द्वारा जनता पार्टी के लिए मारक्षित प्रतीक ' वक्र में हलधर (चकः हलधर ) ' को , उक्त जनता पार्टी के दो प्रतिद्वन्दी गुटों- एक श्री अटल बिहारी वाजपयी के नेतृत्व वाला गुट और दूसरा श्री चन्द्रशेखर के नेतृत्व वाला गुट, के बीच विवाद में इसके अन्तिम निर्णय होने तक जाम किया था ;
और श्री रामकृष्ण हेगड़े द्वारा निर्वाचन आयोग के तारीख 24 अप्रैल, 1980 के उपर्युक्त भावेश के विरुद्ध उच्चतम न्यायालय के सम्मुख अपील (1980 का सं० 4885) करने की विशेष इजाजत के लिए अर्जी वाखिल की गई थी ;
और उच्चतम न्यायालय ने अपने तारीख 29 अप्रैल , 1980 के आदेश द्वारा उपर्युक्त अपील करने की विशेष भर्जी में निर्वाचन भ्रायोग को यह निदेश दिया कि उक्त संदर्भित विवाद के लम्बित रहने तक उक्त अर्जीदारों के गुट को, निर्वाचन प्रतीक ( भ्रारक्षण और प्राबंटन ) प्रवेश, 1968 के पैरा 7 के अर्थ के अन्तर्गत आगामी निर्वाचनों के प्रयोजन के लिए, राष्ट्रीय दल के रूप में मान्यता दे दी जाए और तुरन्त आवेदन-पत्त्र प्राप्त होने पर उक्त गुट के लिए एक प्रतीक श्राबंटित कर दिया जाए ;
भौर उक्त श्रर्जीदार श्री रामकृष्ण हेगड़े ने अपने तारीख 29 अप्रैल, 1980 के पत्त्र में यह कहा है कि उक्त संदर्भित जनता पार्टी में विवाद के लम्बित रहने तक, भर्जीदार के दल को, ' जनता पार्टी ( जेपी )' के रूप में घोषित किया जाए और उन्होंने श्रागे अपने दल के प्रतीक ' छाता' के चुनाव को प्रथम अधिमान के रूप में अंकित किया है ;
अतः भव, उच्चतम न्यायालय के उक्त आदेश के अनुसरण में, और निर्वाचनों का संचालन नियम , 1961 के नियम 5 और 10 निर्वाचन प्रतीक ( प्रारक्षण और भाबंटन ) आवेश , 1968 के 3,6,7,8 और 18 के साथ पठित संविधान के अनुच्छेद 324 द्वारा उसे प्रदत्त शक्तियों तथा इस निमित्त उसे समर्थ बनाने वाली अन्य सभी का प्रयोग करते हुए , निर्वा चन भायोग एतद्वारा यह निवेश देता है कि नौ राज्य विधान सभाओं के भागामी निर्वाचनों के प्रयोजन के लिए-
( 1) श्री चन्द्रशेखर के नेतृत्व वाले जनता पार्टी के गुट को जनता पार्टी ( जेपी ) के नाम के अन्तर्गत एक राष्ट्रीय दल के रूप में तवर्थ मान्यता दी जाए ;
( 2) उक्त जनता पार्टी ( जेपी ) के लिए 'छाता ' प्रतीक भारक्षित किया जाए ; तथा
(3) ऐसे सभी राज्यों की मुक्त प्रतीकों की सूचियों में से उक्त- 'छाता' प्रतीक हटा दिया जाए जहां उक्त सूचियों में ऐसे सम्मि लित हैं ;

निर्वाचन प्रायोग, निर्वाचन प्रतीक ( आरक्षण भौर भ्राबंटन) आवेश, 1968 के पैरा 17 के उप-पैरा ( 1 ) के खण्ड ( क) और ( घ ) तथा उप-परा ( 2 ) के अनुसरण में, एतद्वारा भागे यह निदेश देता है कि भारत के राजपत्र, भसाधारण , भाग-2 , खण्ड 3 ( ii ) , तारीख 28 सितम्बर , 1979 में का ०धा० 557 (थ ) के रूप में प्रकाणित और समय- समय पर यथा संशोधित , इसकी तारीख 28 सितम्बर , 1979 की अधि- सूचना सं ० 56/79 में निम्नलिखित संशोधन किए जाएं, भर्थातू-
छানা"
I. निम्नलिखित प्रविष्टि मम्मिलित की जाएगी : " 8. जनता पार्टी (जेपी)
II. उक्त अधिसूचना से संलग्न सारणी 4 में-
( 1) मद सं० 2 असम के सामने, स्तम्भ 2 के नीचे , " 18. छाता" प्रविष्टि हटाई जाएगी और 19 की विद्यमान प्रविष्टि 18 के रूप में पुनः संख्यांकित की जाएगी ;
(2) मद सं० 3. बिहार के सामने, स्तम्भ 2 के नीचे, " 26 . छामा" प्रविष्टि हटाई जाएगी और 27 से 50 तक की विद्यमान प्रविष्टियां 26 से 49 तक के रूप में पुनः संख्यांकित की जाएंगी ;
(3) मद सं० ४. कर्नाटक के सामने , स्तम्भ 2 के नीचे , " 25. छाप्ता" प्रविष्टि हटाई जाएगी ;
(4) मद सं० 9. केरल के सामने, स्तम्भ 2 के नीचे , " 17. छाता" प्रविष्टि हटाई जाएगी ;
(5) मद सं० 10. मध्य प्रदेश के सामने, स्तम्भ 2 के नीचे , " 33. छाना" प्रविष्टि हटाई जाएगी और 34 से 50 तक की विद्यमान प्रविष्टियां 33 से 49 तक के रूप में पुनः संख्यां- किन की जाएंगी ;
(6) मद सं० 11. महाराष्ट्र के सामने, स्तम्भ 2 के नीचे , "46. छाता" प्रविष्टि हटाई जाएगी ;
(7) मद सं० 12. मणिपुर के सामने, स्सम्ण 2 के नीचे, " 12 . छाना" प्रविष्टि हटाई जाएगी ;
(8) मद सं० 16. पंजा के सामने स्तम्भ 2 के नीचे, " 21 . छाता," प्रविष्टि हटाई आएगी ;
(9) मब सं ० 17. राजस्थान के सामने , स्तम्भ 2 के नीचे , " 19. छाता" प्रविष्टि हटाई जाएगी भौर 20 से 23 तक की विद्यमान प्रविष्टियां19 से 22 तक के रूप में पुनः संख्यांकित की जाएंगी ;
(10) मब सं० 18. सिक्किम के सामने , स्तम्भ 2 के नीचे , " 15 . छाता" प्रविष्टि हटाई जाएगी ;
(11) मब सं० 21. उत्तर प्रदेश के सामने , स्तम्ब 3 के नीचे , " 26 . छाता" प्रविष्टि हटाई जाएगी ;
(12) मज सं० 24. अरुणाचल प्रदेश के सामने , " 19. काता" प्रविष्ठि हटाई जाएगी ;
(13) मब सं० 26. चण्डीगढ़ के सामने , स्तम्ब 2 के नीचे , " 21 . छाता" प्रविष्टि हटाई जाएगी और 22 से 35 तक की विश्व- मान प्रविष्टियां 21 से 34 तक के रूप में पुनः संख्यांकित की जाएंगी ;
(14) मब सं० 27. विल्ली के सामने , स्तम्भ 2 के मीचे , " 26 . छाता" प्रविष्टि हटाई जाएगी भौर 27 की बिद्यमान प्रविष्टि 26 के रूप में पुनः संख्यांकित की जाएगी ;
(15) मद सं० 28. गोवा, दमण और दीव के सामने , स्तम्भ 2 के नीचे, " 20. छाता" प्रविष्टि हटाई जाएगी ; और

ELECTION COMMISSION OF INDIA
New Delhi , the 30th April , 1980
S.O. 291 (E).-Whereas the Election Commission , by its Order dated the 24th April, 1980, had frozen the symbol 'Haldhar within Wheel ( Chakra Haldhar ) ' reserved for the Janata Party, pending its final decision in the dispute between the two rival groups of the said Janata Party, one led by Shri Atal Bihari Vajpayee and the other led by Shri Chandra- shekhar :
And whereas a Petition for Special Leave to Appeal ( No. 4885 of 1980) was filed before the Supreme Court of India by Shri Ramakrishna Hegde against the aforesaid Order dated the 24th April , 1980 of the Commission ;
And whereas the Supreme Court by its Order dated the 29th April , 1980 in the aforesaid Special Leave Petition directed the Commission that pending the dispute referred to above the said petitioner's group be recognised as a National Party, for the purpose of forthcoming elections , within the meaning of paragraph 7 of Election Symbols (Reservation and Allotment ) Order , 1968 and a symbol be allotted for the said group on an application forthwith;
And whereas the said petitioner Shri Ramakrishna Hegde has stated in his letter dated 29th April , 1980 that, pending the dispute in the Janata Party referred to above , the Peti- tioner's Partybe called as the ' Janata Party ( JP ) ' and has further indicated the choice of the symbol 'Umbrella ' as being the first preference of his party ;
Now, therefore , in pursuance of the said Order of the Supreme Court and in exercise of its powers conferred on itby article 324 of the Constitution , read with rules 5 and 10 of the Conduct of Elections Rules , 1961 , paragraph 3 , 6, 7 , 8and 18 of the Election Symbols (Reservation and Allotment ) Order, 1968 and all other powers enabling it in that behalf, the Election Commission hereby directs , that for the purpose of the ensuing elections to the Nine State Assemblies-
( i) the group of the Janata Party led by Shri Chandra- shekhar be recognised ad hoc as a National Party under the name of Janata Party ( JP) ;
(ii) the symbol ' Umbrella' be reserved for the said Janata Party ( JP ) ; and
( iii) the said symbol ' Umbrella' be omitted from the liste of free symbols from all States where it is so in- cluded in the said list .
2. In pursuance of clauses ( a) and ( d ) of sub - para ( 1 ) and sub - para (2 ) of paragraph 17 of the Election Symbols (Reservation and Allotment ) Order, 1968 , the Commission hereby further directs that the following amendments shall be made to its notification No. 56/79 dated 28th September , 1979 published as S.O. 557 (E) in the Gazette of India , Extraordinary Part II, Section 3 ( ii ) dated 28th September , 1979 , and as amended from time to time, namely-
In TABLE 1 appended to the said notification-
I. The following entry shall be included :
"8. Janata Party ( JP ) .... Umbrella " .
II. In TABLE 4 appended to the said notification-
( i) against item No. 2. Assam, under column 2 , the entry " 18. Umbrella" shall be deleted and the existing entry 19 shall be renumbered as 18;

(ii) against item No. 3 Bihar , under column 2 , the entry "26. Umbrella" shall be deleted and the existing entries 27 to 50 shall be renumbered as 26 to 49 ;
(iii) against item No. 8. Karnataka, under column 2 , the entry "25. Umbrella" shallbe deleted ;
(iv) against item No. 9. Kerala , under column 2, the entry " 17. Umbrella " shall be deleted ;
(v) against item No. 10. Madhya Pradesh , under column 2, the entry " 33. Umbrella " shall be de- leted and the existing entries 34 to 50 shall be renumbered as 33 to 49 ;
(vi) against item No. 11. Maharashtra , under column 2, the entry " 46. Umbrella " shall be deleted ;
(vii ) against item No. 12. Manipur , under column 2, the entry " 12. Umbrella " shall be deleted ;
(viii) against item No. 16. Punjab , under column 2, the entry "21. Umbrella" shall be deleted;
(ix) against item No. 17. Rajasthan , under column 2. the entry " 19. Umbrella" shall be deleted and the existing entries 20 to 23, shall be renumbered as 19 to 22;
(x) against item No. 18. Sikkim , under column 2 , the entry " 15. Umbrella" shall be deleted ;
(xi) against item No. 21. Uttar Pradesh, under column 2, the entry " 26. Umbrella" shall be deleted ;
(xii) against item No. 24. Arunachal Pradesh , under column 2 , the entry " 19. Umbrella" shall be de- leted;
(xiii) against item No. 25. Chandigarh , under column 2 , the entry "21. Umbrella" shall be deleted and the existing entries 22 to 35 shall be renumbered as 21 to 34;
(xiv) against item No. 27. Delhi , under column 2 , the entry "26. Umbrella" shall be deleted and the existing entry 27 shall be renumbered as 26 ;
(xv) against item No. 28. Goa , Daman and Diu , under column 2, the entry " 20. Umbrella " shall be de- leted; and
(xvi) against item No. 30. Mizoram , under column 2 , the entry " 17. Umbrella " shallbe deleted.
