सा० का ० नि० 272 ( अ) केन्द्रीय सरकार, भारतीय पत्तन अधिनियम, 1908 ( 1908 का 15) की धारा 34 के साथ पठित धारा 33 की उप-धारा ( 1 ) द्वारा प्रवल शक्तियों का प्रयोग करते हुए निवेश करती है कि राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से साठ दिन के अवसान के पश्चात् ठीक आगामी तारीख से विशाखापत्तनम पत्तन पर पत्तन- शुल्क से सम्बन्द्ध भारत सरकार के मौ -परिवहन और परिवहन मंत्रालय (परिवहन खण्ड) की अधिसूचना संख्या-सा० का० नि ० 933 ( अ ) तारीख 20 दिसम्बर , 1976 में निम्नलिखित और संशोधन किए जाएंगे , अर्थात्ः- उक्त अधिसूचना की पत्तन- शुल्क की अनुसूची में,-
(क) मद "क्ष. बन्वरशाह के शेष भाग में प्रवेश करने वाले जलयान" और उससे संबंधित प्रविष्टियों के स्थान पर निम्मलिखित मव और प्रविष्टियां रखी जाएंगी , अर्थात्:-

प्रवेश करने वाले जलयान
1. विदेशी जलयान
3.20 शुष्क 30 दिन में एक बार संदेय है ।

3.20 शुल्क 30 दिन में एक बार संदेय है ।
(ख) पाल जलयान
3.20 शुल्क 60 दिन में एक बार संदेय है । "
(ख) टिप्पण 4, टिप्पण 5 और टिप्पण 6 के स्थान पर निम्नलिखित टिप्पण रखे जाएंगे , अर्थात्:--
"टिप्पण 4- अधिकतम 1500 टन तक के स्थोरा को उतारने या लादने के लिये बन्दरगाह के शेष भाग में पहुंचने वाले जलयानों पर अनुसूची में विनिर्दिष्ट दरों की बजाए प्रति टन 2.10 रुपये की दर से पत्तन शुल्क प्रभारित किया जाएगा ।
टिप्पण 5--शेष बन्दरगाह में तटवर्ती जलयानों के लिये, यथास्थिति अनुसूची मेंविनिविष्ट दरों का दो तिहाई या जो टिप्पण 4 में विनिर्दिष्ट है वह उद्गृहीत किया जाएगा ।
टिप्पण 6- बैलास्ट में प्रवेश करने वाले जलयानों पर, जो यात्री नहीं ले जाते हैं, अन्यथा लागू वरों का तीन चौथाई प्रभारित किया जाएगा ।
टिप्पण 7--पत्तन में प्रवेश करने वाला कोई जलयान, जो वहां से स्थोरा या यात्री उतारता या लावता नहीं है ( उस दशा के सिवाय जब ऐसा उतारना या पुनः लावना मरम्मत के प्रयोजन के लिये धावश्यक है) पत्तन- शुल्क के प्राधे का संवाय करेगा ।

टिप्पण 8 डेक स्थोरा को तटीय स्टीमरों की बाबत पत्तन और मार्ग नयन फीस के निर्धारण से छूट दी जाएगी , किन्तु उसे निर्धारण के प्रयोजन के लिए तब सम्मिलित किया जाएगा , जब और यदि स्थोरा विदेशी स्टीमरों की बाबत डेक पर ले जाया जाता है ।
टिप्पण 9-अन्य पत्तनों के जलयाग पत्तन-शुल्क के संवाय से छूट प्राप्त होंगे । "

NOTIFICATION
New Delhi , the 20th May 1980
G. S. R. 272 (E) .- In exercise of the powers conferred by sub -section ( 1 ) of section 33 , read with section 34 of the Indian Ports Act , 1908 ( 15 of 1908 ) , the Central Government hereby directs that with effect from the day following the ex- piration of the sixty days from the date of publication of this notification in the Official Gazette , the following further amend- ments shall be made in the notification of the Government of India in the Ministry of Shipping and Transport ( Transport Wing) No. GSR 933 (E ) , dated the 20th December, 1976, relating to the levy of port-dues at the Port of Visakhapatnam , namely:
In the Schedule of Port Dues to the said notification,
(a) for item "B. Vessels entering the rest of the Harbour : " and the entries relating thereto, the following item and entries shall be substituted, namely :-

"B. Vessels entering the rest of the Harbour :
1. Foreign Vessels
3.20 The due is payable once in 30 days
2. Coasting Vessels:
(a) Steamers
3.20 The due is payable once in 30 days
(b) Sailing Vessels
3.20 The due is payable once in60 days" ;
(b) for Note 4 , Note 5 and Note 6 , the following Notes shall be substituted , namely :-
"NOTE 4. Vessels arriving in the rest of the harbour to dis- charge or load cargo upto a maximum of 1500 Tons shall be charged port-dues at the rate of Rs . 2.10 per ton instead of the rates specified in the Schedule ,
NOTE 5. For coasting vessels in the rest of the harbour 2/ 3rd of the rates specified in the Schedule or specified in Note 4 , as the case may be , shall be levied .
NOTE 6. Vessel entering in ballast and not carrying passenger shall be charged at 3/ 4th of the rates otherwise app- licable .
NOTE 7. A vessel entering the Port but not discharging or taking in any cargo or passengers therein (with the exception of such unshipment and re - shipment as may be necessary for purpose of repair ) shall pay half port-dues .
NOTE 8. Deck Cargo will be exempted from assessment of Port and pilotage dues in respect of Coastal Stea- mers , while it will be included for the purpose of assessment when and if cargo is carried on deck in respect of Foreign Steamers .
NOTE 9. Vessels belonging to other ports shall be exempted from payment of port dues .

सा० फा ० ति० 273 ( भ) केन्द्रीय सरकार , भारतीय पत्तन अधिनियम , 1908की धारा 35 की उप-धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विशाखापत्तनम मार्गनयन तथा अन्य सेवा ( फीस ) आदेश , 1976 में निम्नलिखित मौर संशोधन करती है , भर्थात्:-
1. संक्षिप्त नाम और प्रारंभ-
( 1 ) इस आदेश का संक्षिप्त नाम विशाखापत्तनम मार्गनयन तथा भ्रश्य सेवाएं (फीस ) संशोधन आवेश, 1980 है ।
( 2) यह सुरंत प्रवृत्त होगा ।
2. विशाखापत्तनम मार्गनयन तथा सेवाएं ( फीस) आदेश , 1976 में, -
(क) खण्ड 3 में,
(1) उप-खण्ड ( 1) , ( 2 ) और ( 3 ) के स्थान पर निम्नलिखित उप-खण्ड रखे जाएंगे, अर्थात्:--
"( 1) जलयान के रोके रखने की फीस--
यदि कोई जलयान पायलट जेक फहराने के एक घंटे के पश्चात् प्रस्थान करने के लिये तैयार नहीं है तो उसे रोकने के प्रभार निम्नानुसार उद्गृहीत किए जाएंगे--]
(क) पहला घंटा
निःशुल्क
(ख ) दूसरा आधा षण्टा
2460.50 रुपये (i) जलयान जो 1500 टन या उससे कम के स्थौरा को धरता- उठाता है ।
( ii) जलयान जो 1500 टन से अधिक स्थोग को धरता- उठाता है ।
29.60 रुपए
(ग) उसके पश्चात्-
(i) जलयान जो 1500 टन या
उससे कम के स्थोरा को धरता- उठाता
है ।
4,921.00 रुपये प्रति घंटा या उसके एक भाग के लिए ।
(ii) जलयान जो 1500 टन से अधिक के स्थोश को धरता- उठाता है ।
5,920,00 रुपये प्रति घंटा या उसके एक भाग केलिये ।
( 2) यदि कोई जलयान ' एस' ध्वज के फहाए जाने के एक घंटे के भीतर स्थानांतरण के लिए तैयार नहीं है तो उसे रोकने के प्रभार निम्नानुसार उद्गुहीत किए जाएंगे--
निः शुल्क
(क) पहला घंटा
(ख) दूसरा प्राधा घंटा-
(i) जलयाम जो 1500 टन या उससे कम के स्थोरा को धरता- उठाता है ।

(ग) उसके पश्चात्
(i) जलयान जो 1500 टन या उससे कम के स्थोरा को धरना- उठाता है । 4,921.00 रुपये प्रति घंटा या उसके एक भाग के लिए।
(ii) जलयान जो 1500 टन से अधिक के स्थोरा को धरता- उठाता है ।
5,920.00 रुपए प्रति घंटा याउसके एक भाग के लिए ।
(क)विदेशी व्यापार में लगे जलयानों के लिए 1618.80 रुपये प्रति जलयान न्यूनतम प्रभार सहित शुद्ध रजिस्ट्रीकृत टनभार के प्रति 100 टन पर 323.80 रुपये जिसमें एक या अधिक टगों के साथ नाव खिचाई ( टोवेज ) , यान मार्ग नयन , मूरिंग करने, पुनः पूरिग करने और मुरिंग खोलने से संबंधित संक्रिया संबंधित है, किन्तु इस शर्त के अधीन कि जहां पत्तन परिरक्षक की राय हो कि ऐसा करना आवश्यक है वहां तीसरे टग के उपयोग के लिये प्रतिघंटा या उसके एक भाग के लिये 3,145.00 रुपये उद्महीत किया जाएगा।
(3 ) यवि कोई जलयान पायलट के जलयान पर सवार हो जाने के प्राधे घंटे के भीतर प्रवेश करने के लिये तैयार नहीं है तो उसे रोकने के प्रभार निम्नानुसार उङ्ग्रहीत किए जाएंगे-
निःशुल्क
(क) पहला घंटा
(ख) दूसरा भाधारा घंटा

(i) जलयान जो 1500 टन या उससे कम के स्थोरा को धरता- उठाता है ।
2,960,00 रुपये
(ii) जलयान जो 1500 टन से अधिक के स्थोरा को धरता- उठाता है ।
(ग ) उसके पश्चात्--
(i) जलयान जो 1500 टन या उससे कम के स्थोरा को धरता उठाता है । 4,921,00 रुपये प्रति घंटा या उसके एक भाग के लिये ।
(ख) तटीय व्यापार में लगे जलयानों के लिये 1,248.80 रुपये प्रति जलयान न्यूनतम प्रभार सहित शुद्ध रजिस्ट्रीक्कन टन भार के प्रति 100 टन पर 249.80 रुपये जिसमें एक या दो टगों के उपयोग से नाव खिचाई (टोवेज) और मूरिंग करने , पुनः मूरिंग करने और मूरिंग खोलने संबंधी संक्रिया से संम्वन्धित प्रभार भी सम्मिलित है, किन्तु इस शर्त के के अधीन कि जहां पत्तन परिरक्षक की यह राय हो कि ऐसा करना आवश्यक है वहां तीसरे टग के लिये प्रतिघंटा या उसके भाग के लिये 3,145.00 कंपये उद्महीत किया जाएगा ।
( 2) ऐसे जलयान जो 1500 टन से अधिक स्थोरा को धरते-उठाते हैं ।
( ii ) जलयान जो 1500 टन से अधिक के स्थोरा को धरता- उठाता है ।
5,920.00 रुपये प्रति घंटा या उसके एक भाग के लिए ।
(ii) उपखण्ड ( 4) में " 4000.00 रुपये और " 4,800.00 रुपये शब्दोंऔर अंकों के स्थान पर " 7,400.00 रुपये" और 8,880.00 रुपये शब्द पौर अंक रखे जाएंगे ।
(iii) उपखण्ड ( 5 ) में " 105.00 रुपए" और " 125.00 रुपए" शब्दों भौर अंकों के स्थान पर " 194.25 रुपये" और " 231.25 रुपये" शब्द
और अंक रखे जाएंगे ।
(ख) अनुसूची में "ख बन्दरगाह के शेष भाग में प्रवेश करने वाले जलयान " शीर्ष और उसके अधीन प्रविष्टियों के स्थान पर निम्नलिखित शीर्ष और प्रविष्टियां
रखी जाएंगी , अर्थात्
( क) विवेशी व्यापार में लगे हुए जलयानों के लिये 1942.50 रुपये प्रति जलयान न्यूनतम प्रभार सहित शुद्ध रजिस्ट्रीकृत टन भार के प्रति 100 टन पर 388.50 रुपये जिसमें एक या दो टगों के साथ नाव- खिचाई (टोवेज) भौर यान मार्ग नयन, मूरिंग करने, पुनः मूरिंग करने और मूरिंग खोलने से संबंधित संक्रिया के प्रभार भी हैं, किन्तु इस शर्त के अधीन कि जहां पत्तन परिरक्षक के राय हो कि ऐसा करना आवश्यक है वहां तीसरे टंग के लिये उपयोग के लिये एक घंटा या उसके भाग के लिये 3,774.00 रुपये उध्ग्रहीत किया जाएगा ।

"ख- बन्दरगाह के शेयभाग में प्रवेश करने वाले जलयान
पाल जलयानों के सिवाय सभी यंत्र नोदित जलयान जो विदेशी व्यापार
1. मेंलगे हैं और जिनका शुद्ध रजिस्ट्री- कृत टनभार 500 टन से अधिक है,
(1) जलयान जो 1500 टन या उससे कम स्थोरा को धरते-
( ख) तटीय व्यापार में लगे हुए जल- यानों के लिये 1,480.00 रुपये प्रति जलयान न्यूनतम प्रभार सहित शुद्ध रजिस्ट्रीकृत टनभार के प्रति 100 टन पर 296.00 रुपये जिनमें से एक या दो टगों के साथ-नाव- खिचाई (टोवेज) और यान मार्ग नयन मूरिंग करने , पुनः मूरिंग करने , और भूरिंग खोलने से THE GAZETTE OF INDIA EXTRAORDINARY

संबंधित सक्रिया के प्रभार भी है, किन्तु द्दवस शर्त के अधीन कि जहां पत्तन परि-रक्षक की राय हो कि ऐसा करना आवश्यक है वहां तीसरे टंग के उपयोग के लिये एक घंटा या उसके भाग के लिये 3,774.00 रुपये उद्ग्रहीत किया जाएगा ।
2. मद 1 में विनिर्दिष्ट जनयानी मे भिन्न जलयान जब पायलट की सेवा का वास्तविक उपयोग किया जाए ।

G. S. R. 373 ( E) .-In exercise of the powers conferred by sub-section ( 1 ) of section 35 of the Indian Ports Act , 1908 (15 of 1908) , the Central Government hereby makes the follo- wing order further to amend the Port of Visakhapatnam Pilotage and Other Services (Fees) Order, 1976 , namely:-
1. Short title and Commencement-
(1) This order may be called the Port of Visakhapatnam Pilotage and Other Services ( Fees) Amendment Order 1980 .
(2) It shall come into force at once .
2. In the Port of Visakhapatnam Pilotage and Other Ser- vices (Fees ) Order , 1976 ,
(a) in clause 3 ,
(i) for sub - clauses (1 ) , (2) and (3 ) , the following sub-clauses shall be substituted , namely:-
"(1) Detention Fees-If a vessel is not ready to sall within one hour of hoisting the Pilot Jack , deten- tion charges shall be levled as under :

(a) First hour
(b) Next half- an-hour-
(i) Vessels handling cargo of Rs . 2,460.50 1500 tonnes or less .
Rs . 2,960.00 ( ii) Vessels handling cargo of above 1500 tonnes
(c) There after-
(i ) Vessels handling cargo of 1500 tonnes or less
Rs . 4,921.00 per hour or part thereof.
(it) Vessels handling cargo of above 1500 tonnes
Rs . 5,920.00 per hour or part thereof.
(2) If a vessel is not ready to shift within one hour of hoisting ' S' flag , detention charges shall be levied as under:-
(a) First hour

(ii) in sub - clause (4) , for the abbreviations and figures "Rs . 1,000.00 " and " Rs . 4,800.00 " , the abbreviations and figures " Rs . 7,400.00 " and " Rs . 8,880.00 , " shall , respectively , be substituted;
(iii) in sub - clause (5) , for the abbreviations and figures "Rs . 105.00 " and " Rs . 125.00 ", the abbreviations and figures " Rs . 194.25 " and " Rs . 231.25 " shall respectively , be substituted;
(b) in the Schedule , for the heading "B. Vessels entering the rest of the Harbour " and the entries thereunder , the following heading and entries shall be substituted , namely:-

"B. Vessels entering the rest of the Harbour
1. All mechanically propelled vessels
engaged in foreign trade except sailing vessels not exceeding 500 tonnes of net registered tonnage :
( 1) Vessels handling cargo of 1500 tonnes or less
( a) Rs . 323.80 per hun- dred tons of Net Re- gistered Tonnage with the minimum charge of Rs. 1,618.80 per vessel engaged in foreign trade inclusive of towage , pilotage, mooring , re - mooring and unmooring opera- tion charges with the use of one or two tugs , but subject to levy of Rs . 3,145.00 per hour or part thereof for use of a third tug where the conservator of the Port is of the opinion that its use is necessary .
(b) Rs . 249.80 per hun- dred tons of Net Re- gistered Tonnage with 533

2. Vessels other than specified at item 1 when services of pilot is actually made use of.
