सा० का० मि० 379 (अ).-संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रवत्त णक्तियों का प्रयोग और नीवहन महानिदेशालय तथा वाणिज्यिक समुद्री विभाग ( श्रेणी-I और श्रेणी- II तकनीकी पव) नियुक्ति नियम, 1968 का अधिसंघन करते हुए राष्ट्रपति नौवहन महानिदेशालय , बम्बई और वाणिज्यिक समुद्री विभागों में श्रेणी 'क' के कुछ तकनीकों पदों पर नियुक्ति का विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्.--
1. संक्षिप्त नाम और श्रारम्भ ( 1 ) इन नियमों को नौवहन महानिदेशालय भौर वाणिज्यिक समुद्री विभाग ( श्रेणा 'क' , तकनीकी पद ) नियुक्ति नियम , 1980 कहा जाए ।
(2) ये नियम राजपत्र में प्रकाशित होने की तारीख से प्रवृत्त हो जायेगे ।
2. प्रयोग-ये नियम इन नियमों के साथ संलग्न अनुसूची के कालम 1 में विनिर्दिष्ट पदों के लिए प्रयुक्त होंगे ।
3. पदो की संख्या , वर्गीकरण और वेतनमान होंगे जो विनिविष्ट है । उक्त पदों की संख्या , वर्गीकरण और वेतनमान उक्त अनुसूर्ण। के कालम 2 से लेकर फालम 4 तक वही 4. भर्ती की पद्धति, श्रायु-सीमा और अन्य अर्हताए इन पदों पर भर्ती करने की पद्धति, आयु सीमा, श्रहंताएं और अन्य संबद्ध विषय ही होंगे जो उक्त अनुसूची के कालम 5 से 14 तक में विनिर्दिष्ट हैं ।
5. निहंताएं . वह व्यक्ति-
( क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीविन है, विवाह किया है , या
(ख) जिमने अपने पति या अपनी पत्नी के जीवित होते हुए किमी व्यक्ति से विवाह कियाड्डो,
उक्त पद पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदिः केन्द्रीय सरकार का समाधान हो जाए कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार मौजूद हैं तो वह किमी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. नियम शिथिल करने की शक्ति जहां केन्द्रीय सरकार को राय हो कि ऐसा करना भावश्यक या समीचीन है, कहां वह , उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपवस्व को किमी वर्ग या प्रत्रर्ग के व्यक्तियों की बाबत , धावेश द्वारा शिथिल कर सकेंगी ।
7. व्यावृति:-- इन नियमों की कोई भी बात ऐसे भारक्षणों, भायु-सीमा में छूट भौर अन्य रियायत्तों पर प्रभाष नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में ममम- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जमजातियो और अन्य विशेष प्रथगों के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।
४. कुछ व्यक्तियो के संबंध में प्रावधान पूर्वोक्त नियमों में जो कुछ विहित है उसके बावजूद प्रत्येक व्यक्ति जो इन नियमों के प्रस्त होने से बहले नौवहन"महानिदेशालय/ वाणिज्यिक समुद्री विभागों में उस पद के बराबर बाले पद पर नियुक्त होते हुए जिसके संबंध में ये नियम प्रयुक्त होते हैं , वह इन नियमों के प्रस्त होने वाली तारीख की और उम्री तारीख से उक्त अनुसूची के कालम-1 विनिदिष्ट पर्व पर रहेगा और ऐसे समवर्ती पदों पर नियुक्ति हुझा वैध समझा লালা ।

( iii) विदेशगामी जहाजों भौर नौतल पर उपकरणों के सर्वेक्षण और निरीक्षण के काम का उत्तरवायित्वपूर्ण हैसियत से करने का 10 वर्षों का अनुभव ।
नोट: भारत में अभ्य- वियों से ( उन अभ्य- थियों को छोड़कर जो अंडमान और निकोबार द्वीप समूह और लक्षद्वीप मैं रहते हैं ) आबेदन- पत्र प्राप्त करने की अन्तिम तारीख आयु- सीमा का निर्धारण करने के लिए प्राधार स्वरूप समझी जाएगी ।
नोट 1 : अगर अभ्यर्थी पूरी तरह अर्हता प्राप्त नहीं मिलते हैं तब संघ लोक सेवा आयोग के विषेक के आधार पर अर्हताओं में छूट दी जा सकती है ।
2. भगर संघ लोक सेवा भावोग किमी दशा में यह समझता है कि मनुसूचित जातियों और अनुसूचित जनजातियो के लिए आरक्षित पदो की रिक्तियों को भरने के लिए इस बगों से ऐसे व्यक्तियों का मिलना संभब नही है जिन्हें अपेक्षित अनुभव प्राप्त है , तब संज लोक सेवा आयोग के विवेक के प्राधार पर अनुभव से संबंधित अहंता ( अर्हताओं) में छूट दी जा सकती है ।

( 1 ) उप नावीय सलाहकार जो इस ग्रेड में नियमित रूप से तीन वर्षों तक सेवा कर चुका हो।
(i ) प्रध्यक्ष/सवस्य/संत्र लोक सेवा भायोग-- अध्यक्ष
पदोन्नति , सीधी भर्ती चौर इन नियमों में कोई भी संशोधन/ किसी भी प्रकार को छूट देते समय संघ लोक सेवा आयोग से परामर्श किया जाना ।
( ii ) सचिव, नौवहन और परिवहन मंत्रालय सदस्य
( iii ) नौवहन महानिदेशक सदस्य
(2) उक्त ( 1 ) के न हो सकते पर उप माबीय सलाहकार जो उप नावीय मलाहकार और नाबीय सर्वेक्षक ग्रेडों में दोंनों को मिला नियमित रूप से 10 वर्षों तक सेवा कर चुका हो ।
(iv) नौवहन के प्रभारी संयुक्त सचिव-- मदस्य
वर्ग 'ना' विभागीय पदोन्नति ममिति:
(स्थायी करण पर विचार करने के लिए)
(i) सचिव, नौवहन और परिवहन मंत्रालय-- अध्यक्ष

मोट: स्थायीकरण करने की कार्यवाही संघ लोक सेबा आयोग को अनुमोदन के लिए भेजी जाएगी । अगर किसी भांति यह संघ लोक सेवा आयोग द्वारा अनुमोषित नहीं होती है तब विभागीय पदोन्नति समिति की बैठक नये सिरेसे होगी जिसकी अध्यक्षता संत्र लोक सेवा आयोग के अध्यक्ष या कोई एक सवस्म करेंगा ।

नोट : भारत में अभ्य- थियों से ( उन अभ्य- थियों को छोड़कर जो अंडमान और निकोबार द्वीप समूह और लक्षद्वीप में रहते है) आवेदन पत्त्र प्राप्त करने अन्तिम नारीख प्रायु सीमा का निर्धारण करने के लिए भ्राधार स्वरूप समझी जाएगी ।
नोट 1: -- अगर अभ्यर्थी पूरी तरह अहंता प्राप्त नही मिलने हैं तब संघ लाक सेवा आयोग के विवेक के आधार पर अर्हताओं में छूट दी जा मकती है ।

(ii ) उक्त ( i ) के न हो सकने पर उप मुख्य सर्वेक्षक जो उप मुख्य सर्वेक्षक और इंजीनियर और पोत सवें क्षक ग्रेडों को एक साथ मिलाकर नियमित रूप से 10 वर्षों तक मेवा कर खुफा हो ।
नोट: स्थायीकरण करने की कार्यवाही संघ लोक सेवा आयोग को अनुमोदन के लिए भेजी जाएगी ।

( iii ) विदेशगामी जहाजों और जहाज पर उपकरणों के सर्वेक्षण और निरीक्षण के काभ को उत्तरदायित्वपूर्ण हैसियत से करने का 8 वर्षों का अनुभव ।
नोट: भारत में अभ्य- थियो से ( उन अभ्य- थियो को छोड़कर जो अंडमान और निकोबार द्वीप समूह और लक्षद्वीप में रहते है ) आवेदन पत्न प्राप्त करने की अंतिम तारीख आय- मीमा का निर्धारण करने के आधार स्वरूप समझी जाएगी ।

NOTIFICATION
(2) They shall come inte force on the date of their publication in the Official Gazette .
New Delhi , the 24th June, 1980
2. Application. These rules shall applyto the posts speci- fied in column ( 1 ) of the Schedule annexed to these rules .
3. Number of posts, classification and scales of pay.- The number of the said posts , their classification and scales of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule .
G.S.R. 379 (E) . In exercise of the powers conferred by the proviso to article 309 of the Constitution and in super- session of the Directorate General of Shipping and Mercantile Marine Departments ( Class I and Class II Technical Posts ) Recruitment Rules , 1968 , the President hereby makes the following rules regulating the method of recruitment to certain Group 'A' Technical posts in the Directorate General Shipping. Bombay and Mercantile Marine Departments, namely :- of
4. Method of recruitment , age limit and other qualifica- tions. The method of recruitment , age limit , qualifications and other matters relating to the said posts shall be as specified in columns 5 to 14 of the Schedule aforesaid.
5. Disqualification. No person .
1. Short title and commencement. ( 1 ) These rules may be called the Directorate General of Shipping and Mercantile 649 अस.भारण

(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living , has entered into or contracted a marriage with any person .
shall be eligible for appointment to any of the said posts :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rulc.
6. Power to relax. Where the Central Government is of opinion that it is necessary or expedient so to co , it may. by order , for reasons to be recorded in writing, and in con- sultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any clause or category of persons .
7. Saving . Nothing in these rules shall affect reservations, ralaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .
8. Special provision relating to certain persons. Notwith- standing anything contained in the foregoing rules , every person who , immediately before the commencement of these rules , holds a post in the Directorates General of Shipping and Mercantile Marine Departments corresponding to a post to which these rules apply , shall , on and from such com- mencement , hold a corresponding post specified in column 1 of the said schedule and shall be demand to have been ap- pointed to such corresponding post .
