का. आ . 582 (अ) केन्द्रीय सरकार की , असम के कामरूप जिले में स्थित
बरद्वार चाय सम्पदा नामक एकक की बामत , जिसका रजिस्ट्रीकृत कार्यालय 19 ,
सर्कुलर गार्डेन रीच रोड , कलकत्ता 23 में है , यह राय है कि :-
(क) चाय एकक की वर्ष 1974-1978 के दौरान चाय की औसत उपज ,
जिला उपज के 25 प्रतिशत से कम रही है ; और

(ख) चाय एकक का प्रबन्ध ऐसी रीति से किया जा रहा है जो चाथ उद्योग और लोक हित के लिए हानिकारक है ;
अतः , केन्द्रीय सरकार , जाय अधिनियम , 1953 ( 1953 का 29) की धारा 10-ख की उपधारा ( 1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त आाय एकक के कार्य का पूर्णतः अन्वेषण करने के प्रयोजन के लिए एक निकाय की नियुक्ति करती है जिसमें निम्नलिखित व्यक्ति होंगे , अर्थात् : -
(1) श्री एस . एस . नन्दक्योल्यार , निदेशक चाय विकास , चाय बोर्ड कलकत्ता ।
(2) श्री ए . दत्त , ज्येष्ठ लेखा अधिकारी और कार्यकारी वित्तीय सलाहकार और मुख्य लेखा अधिकारी , प्नाय बोर्ड , कलकत्ता ।
(3) श्री ए . बरुआ , सचिव , उद्योग विभाग , भारत सरकार , गौहाटी , असम ।
(4) श्री ए . के. राय बौधरी , उप - सलाहकार (वित्त) , ब्यूरो आफ पब्लिक एंटरप्राइजेज , मयूर भवन , नई दिल्ली ।
(5) श्री एम . एल . शाह , संयुक्त निवेशक (लेखा) , प्रादेशिक निदेशक का कार्यालय , कम्पनी ला बोर्ड, कलकता ।
उक्त निकाय , इस आदेश के राजपत्र में प्रकाशन की तारीख से 90 दिन की अवधि के भीतर , केन्द्रीय सरकार को अपनी रिपोर्ट देगा ।

S.O. 582 (E) .-Whereas the Central Government is of opinion in respect of the tea unit known as Barduar Tea Estate , situated in the District Kamrup of Assam and having its registered Office at 19 , Circular Garden Reach Road, Calcutta- 23 , that :-
(a) the average yield of the tea unit during the years 1974-1978 has been lower than the District yield by twenty five per cent ; and
(b) the tea unit is being managed in a manner highly detrimental to the tea industry and to public interest .

Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 16B of the Tea Act , 1953 ( 29 of 1953 ) , the Central Government hereby appoints for the purpose of making a full and complete investigation into the affairs of the said unit , a body of persons consisting of :
(1 ) Shri S. S. Nandkeolyar , Director of Tea Development , Tea Board , Calcutta .
( 2 ) Shri A. Dutta , Senior Accounts Officer & Acting Financial Adviser and Chief Accounts Officer , Ten Board , Calcutta .
( 3 ) Shri A. Barua , Secretary to the Government of Assam , Industries Department , Gauhati , Assam .
( 4) Shri A. K. Roychowdhury , Deputy Adviser ( Finance ) , Bureau of Public Enterprises , Mayur Bhavan , New Delhi ,
(5) Shri M. L. Sah , Joint Director ( Accounts ) , Office of the Regional Director , Company Law Board , Calcutta .
The said body shall submit its report to the Central Government within a period of 90 days from the date of publication of this order in the official Gazette .
