F No. 2/55/80-EI—Attention is invited to the Ministry of Commerce Export Tiade Control Public Notice No 47- E1C(PN)/80 dutcd the 28(h Tuly, 1980, nccoiding to which 25 pet cent annual level of quota for the export ot iabucs, and/ or made up items made ftom Cotton, Woo) and Mm made Fibres to USA, E E C, mcmbci countties, Norway, Tinlind Austua and C mad i has been earmaiked for allotment on the basis1 of Past Perfoira inuc' and the quota for the the piupose has to bo determined on the basis ol actual exports maJe during the bare penod viz , 1978, 1979 and January-September, ]980 on an iverage of exports of tins penod For this pur- pose, expoitv made dunng Tanuaty September 1980 will be treated ns exports for the full year The deteimmation of the quotas on the basis of Past Performance' will be done by by the CCT&E Udyog Bhawan, New Delhi
2 The intending exporters of fabrics and made-up items of Cotton Wool and Mnn Made Fibres who desne to apply for allotment of quota on the btsis of 'Past Peifonnanco' should submit lhrir ipplications fin Anne\ure I to this Publ/c Notice) alongwith. all other prescribed documents/information )o as to reach the office of the Chief Controller of Imports and ExportN Udyoij Rhivan New Delhi, by the 30th of Octobei, 1985 at the latest The applications leceived in the iffice of the CCF&E after the prescribed last date will be mmmaniv rejected and no correspondence hi this icgard will be entertained
3 The applications should bo accompanied by the following
locumcnts —
(i) Bill of I admg/Airway Bill/Shipping Bill—Original or an attested copy.
'ii) Invoices duly attested by the Bank, in original or a
copy thereof, with the following endorsement —

4 The application fee should be deposited in any Branch of the Central Bank of India who is authorised to receives IfC/ETC deposits In the absence of a Branch ol Central Bank of India in the distnu whcie the applicant lesides, the application fee t in be i emitted through a Bank Diaft (The detailed proceduie is given in the Hand Book of Import- Export Procedures 1980-81)
5 Whereas consolidated applications in the form given in Annexuie-I may be made in respect of all categories/groups, countries for which allotment of quota is claimed, the state- ment of exports duly certified by the Chartered Accountant (Annexure-II) should be prepared sepaiatcly for each category/ group/country for which quota is claimed The details of exports furnished should be supported by relevant documents viz, Shipping Bill/Airway Bill/Bill of Lading, Invoice etc and the particulars of these documents should also be indicated in the statement Separate Annexure 11 should be made for wool and woollen /Cotton /Man Made Fibres- for each cate- gory/counby
6 An exporter need submt details of past performance only for such country/category/formation foi which he is chiming quota foi past performance
7 Export of samples do not qualify for allotment of quotn, such experts should not be included in the statement of exports
8 The applications and the accompanying documents as specified in P in 3 above should bt compli tc in all lespects Incomplete applications will bo summanly tejectcd and no coirespondentc in this regard will be entertained

10 The basic quoti will be detetmmed by dividing the r evpoits during the basic pcnod 1978 1979 and 1980 by three In case the applicant exporter does not hive exports during all the tfuee segmens cf the basic penoa his exports in any two years or in any one year of this period will be divisible by two or one to rtrnve at the basic average exports during the basic period
11 The exporters can be called upon at any time before or ifter the allocation of annual quota to furnish any other infoimntion or documents requiied by the Government and if the lequued lnfojmation/documcnts aie not furnished lm mediately the applications will be liable to be rejected
12 Attention of the exporters is speciflf ally lmitcd to the declaration incorporated in the 'titcmenl of exports (Anne- xure Tl) accoiding to which the information to be piven in tho statement should be true and correct It is to be clearly understood that any quota granted on the basis of infoi mation and the supporting documents will be liable for cancellation, in addition to any other penal action that may be taken in this behalf, if H is found that any part of the information furnished is incorrect, false, fraudulent or misleading
