का ० आ ० 839 (अ) केन्द्रीय सरकार की , मैसर्स काशीराम टी इंडस्ट्रीज लिमिटेड , पी-11 , न्यू हावड़ा एप्रोच रोड , कलकत्ता-1 के स्वामित्वाधीन दार्जिलिंग जिला के कलिपोंग सबठडिवीजन में स्थित, सामाबिगोंग टी एस्टेट नामक चाय एकक की बाबत , यह राय है कि-
( 1 ) पांच वर्ष की अवधि में , अर्थात् 1974 से 1978 की अवधि में , उक्त घाय एकक को 1974 से लगातार चार वर्ष तक हानि हुई है;
( 2 ) वर्ष 1974 से 1978 के दौरान इम चाय एकक की औसत उपज, जिले की औसत उपज से पच्चीस प्रतिशत ( 25 % ) कम रही है ;
( 3 ) चाय एकक का प्रबन्ध ऐसे ढंग से किया जा रहा है जो चाय उद्योग तथा लोकहित के लिए बहुत अपायकर है ।

अतः अब केन्द्रीय सरकार , चाय अधिनियम, 1953 ( 1953 का 29 ) की धारा 16 -ख की उपधारा ( 1 ) द्वारा प्रवत्त एशक्तियों का प्रयोग करते हुए और भारत सरकार के बाणिज्य और नागरिक पूर्ति मंत्रालय की अधिसूचना सं ० 725 (अ ) , तारीख 14 नवम्बर, 1979 को भधिक्रान्त करते हुए उक्त चाय एकक के मामलो का पूर्ण और व्यापक अन्वेषण करने के प्रयोजन के लिए व्यक्तियों का एक निकाय नियुक्त करती है, जिसमें निम्नलिखित होगे :-
(1 ) श्री एस० एस ० नन्दकील्यार , निदेशक , चाय विकास , चाय बोर्ड ।
( 2) श्री एम ० विश्वास , वित्तीय सलाहकार और मुख्य लेखा अधिकारी , चाय बोर्ड ।
( 3 ) श्री बी०एल ० विश्वास , उप -सचिव , वाणिज्य भौर उद्योग विभाग , पश्चिमी बंगाल सरकार , कलकत्ता ।
(4) श्री ए ० के ० रायचौधरी , उप -सलाहकार ( विस ) , लोक उद्यम म्यूरो , मयूर , भवन, कलकत्ता
( 5) श्री एम ० एम ० शाह , संयुक्त निदेशक ( लेखा ) , कार्यालय प्रादेशिक निदेशक , कंपनी विधि बोर्ड , कलकत्ता ।
2. व्यक्तियों का उक्त निकाय , इम आवेश के राजपत्र में प्रकाशन की तारीख से नम्बे दिन की अवधि के भीतर, अपनी रिपोर्ट केन्द्रीय सरकार को प्रस्तुत करेगा ।

ORDER
New Delhi , the 3rd October , 1980
S.O. 839 ( E ) .- Whereas the Central Government is of opinion that in respect of the tea unit known as Sambeong Tea Estate in Kalimpong Sub -division of Darjeeling district , owned by M / s . Kashiram Tea Industries Ltd. , P - 11 , New Howrah Approach Road , Calcutta - 1 , that-
( i ) out of the period of five years , 1974-78 , the tea unit has made losses consecutively for four years from 1974;
( ii) the average yield of the tea unit during the years 1974 to 1978 has been lower than the district average yield by twenty five per cent (25 %);
(iii) the tea unit is being managed in a manner highly detrimental to the tea industry and to public interest ;
Now , therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 16B of the Tea Act , 1953 ( 29 of 1953 ) and in supersession of the Order of the Government of India in the Ministry of Commerce and Civil Supplies No. 725 (E ) , dated the 14th November , 1979 , the Central Government hereby appoints . for the purpose of making a full and complete investigation into the affairs of the said tea unit , a body of persons consisting of-

2. Shri S. Biswas , Financial Adviser & Chief Accounts Officer , Tea Board .

4. Shri A. K. Roychowdhury , Deputy Adviser ( Finance ) , Bureau of Public Enterprises , Mayur Bhawan , New Delhi .
5. Shri M. L. Sah , Joint Director (Accounts ) , Office of the Regional Director Company Law Board , Calcutta .
2. The said body of person strall submit its report to the Central Govern- ment within a period of ninety days from the date of publication of this Order in the Official Gazette .
