THE MONOPOLIES AND RESTRICTIVE TRADE PRACTICES (AMENDMENT) ORDINANCE, 1982

No. 14 OF 1980

Promulgated by the President in the Thirty-first Year of the Republic of India.

An Ordinance further to amend the Monopolies and Restrictive Trade Practices Act, 1969.

WHEREAS Parliament is not in session and the President is satisfied that circumstances exist which render it necessary for him to take immediate action;

Now, THEREFORE, in exercise of the powers conferred by clause (1) of article 123 of the Constitution, the President is pleased to promulgate the following Ordinance :—

1. (I) This Ordinance may be called the Monopolies and Restrictive Trade Practices (Amendment) Ordinance, 1980.

(2) It shall come into force at once.

Short title and com. mence- ment.

Amend. 3. In section 2 of the principal A c t- ment Of section 2.

(0 in clauso (d), after Explanation VI, the following Explanation

shall be inserted, namely:—.

"Explanation VII.—Where goods of dny description, produced in India by an, undertaking have been exported to % pottntry outside India, then the goods s> exported shall not be taken into account in computing for the purposes of this clause—1

(0 the total g6o3s of tKat description that arc produced

in India by that undertaking; or

(ii) the total goods 6f that description that are produced, supplied or distributed in India or any siibstantial part thereof.";

(") in clause (/), after Explanation IV, the following Explanation

shall be inserted, namely:—

"Explanation K—Where goods of any description produced in India by an undertaking have been exported to a country outside Iridia, then the goods so exported shall not be taken into account in computing for the purposes of this clause—

(i) the total goods of that description that are produced

in India by that undertaking; or

(ii) the total goods of that description that are produced, supplied or distributed in India or any substantial part thereof.".
