NOTIFICATIONS

New Delhi, the 5th November, 1980

S.O, No. 879(E).—In exercise of the powers conferred by sub-section (1) of Section 29B of the Industries (Develop- ment and Regulation) Act, 1951, the Central Government hereby makes the following further amendments in the noti- fication of the Government of India in the late Ministry of Industrial Development (Department of Industrial Develop- ment} No. SO. 98(E)/IDRA/29B/73/l, dated the 16th February, 1973, namely :—

(1) The entries at Serial numbers 9, 10, 11 and 13

in Schedule V shall bo deleted.

(2) The following entries shall be added to Schedule V

after the entry '16 Tubular Poles' :

"17 Steel Structurals" "18 Sheet Metal Components."2. In pursuance of sub-section (2) of section 29B of the said Act, the Central Government hereby specifies a period of six months from the date of publication of this notification (1653) 914 GI/80

ai the period after the expiry of which no owner of, any industrial undertaking which was exempted from the operation of clause (d) of sub-section (1) of section 13 of tbe said Aqt shall carry on the business of such undertaking except under and in accordance with a licence itsatd in thfe behalf by the Central (Jovemment and in the case of State Government except under and in accordance with the previous permission of the Central Government.

S.O. 88IKE) In exercise of the powers conferred by sub- section (1) of Section 29B of the Industries (Development and Regulation) Act, 1951 (65 of 1951), the Central Gov- ernment hereby makes tihe following further amendments in the notification of the Government of India in the lntc Ministry oi Industrial Development (Department of Indus- trial Development) No. S.O. 98(E)/IDRA/29B/73/l, dated the Wth February, 1973, namely :—

In the said notification, in item 3, for clause (c) relating to "Foreign Exchange Limits", lihe following clause shall be substituted namely :—

"(c) Proposed investment does not require foreign ex- change per year either for the import of raw mate- rials (other than steel and aluminium), or for parts and components (after three years of coming into production), exceeding 15 per cent of the ex-fac- tory value of the, annual production or vrpto a ceiling of Rs. 40 lakhs for raw materials and parts and components, whichever is less :

Provided that—

(i) the value of the raw materials and components which are on Open General Licence and which form an essential input for manufacture of arti- cles shall NOT be taken into account in compu- ting the foreign exchange limits specified above :

(ii) in respect of raw materials which are not on Open General Licence but which are partly available within the country and partly to be imDorted, the raw materials mentioned in Sche- dule VI may be treated as "wholly Imported" Jor the DUrpoRr of computing the toreign ex- change admissible.
