सा० का० नि० 5 ( अ ) -राष्ट्रपति, सविधान के अनुच्छेद 371 -घ के खण्ड ( 1 ) और ( 2 ) द्वारा प्रवत्म शक्तियों का प्रयोग करते हुए, श्राघ्र प्रदेश लोक नियोजन (स्थानीय काडरों का गठन और सीधी भर्ती का विनियमन ) श्रावेश,1975 का और संणोधन करने के लिए निम्नलिखित आवेश करते हैं, अर्थात्: --
1. ( 1 ) इस आदेश का संक्षिप्त नाम श्रध्र प्रदेश लोक नियोजन (स्थानीय काडरो का गठन और मोधी भर्ती का विनियमन) संशोधन आदेश , 1981है ।
( 2) इस श्रादेश में यथा अन्यथा उज्यंधित के सिवाय , यह राजपत्त मे प्रकाशन की तारीख को प्रवृत्त होगा ।
2. आंध्र प्रदेश लांक नियोजन ( स्थानीय काडरों का गठन और सीधी भर्ती का विनियमन ) आदेश, 1975 में ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) पैरा 3 के उप पैरा ( 1 ) के साथ निम्नलिखित परन्तुक जोड़ा जाएगा, अर्थात्
"परन्तु उक्त अवधि के समाप्त हो जाने पर भी, राष्ट्रपति जब कभी यह ऐसा करना समीचीन समझें, प्रादेश द्वारा , राज्य सरकार से यह अपेक्षा कर सकेंगा कि वह राज्य की सिविल सेवाओं में पदों के वर्गों और उसके अधीन सिविल पदो के वर्गों को राज्य के विभिन्न भागों की बाबत विभिन्न स्थानीय काडरों में संगठित करें । "

3. उक्त भादेश के पैरा 5 के उप पैरा ( 2 ) मे,--
(क ) खण्ड ( ख ) के अन्त में "और " शब्द का लोप किया जाएगा;
(ख) खण्ड (ग) के अंत में " और" शब्द अंतःस्थापिन किया जाएगा ;
(ग) खण्ड ( ग) के पश्चात् निम्नलिखित खण्ड जोड़ा जाएगा, अर्थात्
" ( घ) पारस्परिक श्रधार पर किसी स्थानीय काडर से किसी अन्य स्थानीय काडर को किमी व्यक्ति का स्थानान्तरण इस शर्त के अधीन रहते हुए कि इस प्रकार स्थानानरित व्यक्ति को पश्चात्वर्ती काडर में ज्येष्ठता उसके उस काडर में स्थानान्तरण की नारीख के प्रतिनिर्देण से सभनुदेशित की जाएगी " ।
4. उक्त आदेश के पैर 6 में,--
(क) उप पैरा ( 2 ) के खण्ड ( ii ) में " और पुलिम निरीक्षको " शब्दों के स्थान पर "पुलिस निरीक्षकों और माटर यान निःक्षकों" शब्द रखे जाएंगे ;
(ख) उप पैरा ( 4) के खण्ड ( i ) में " मेडक और हैदराबाद जिले" शब्दों के स्थान पर "मेडक , रंगारेड्ड और हैदराबाद जिले" शब्द रखे जाएंगे और ये 15 अगस्त , 1978 से रखे गममझे जाएंगे ।
5. उक्त आदेश के पैरा 8 में,--
(क) उप पैरा ( 3 ) में "और पुलिस निरीक्षक " शब्दों के स्थान पर "पुलिस निरीक्षक और मोटरयान निरीक्षक " शब्द रखे जाएंगे ;

(ख) उप-पैरा ( 5) के नीचे दी गई सारणी में, स्तंभ ( 1 ) में प्रविष्टि VI के सानने "हैदराबाद ( हैदरावाद नभर को अःवजित करते हुए ) " शब्दों के स्थान पर " रंगा रेड्रिड (ऐसे क्षेत्रों को अपवर्जित करते हुए जो हैदराबाद नगर के हैं) " शब्द रखे जाएंगे और वे 15 अगस्त, 1978 से रखे गए समझे जाएंगे ।
6. उक्त आदेश के पैरा 9 के परन्तुः में,
"किसी अन्य स्थानीय काडर में" गब्दों के स्थान पर " यथास्थिति किसी अन्य स्थानीय काडर में या किसी अन्य स्थानीय प्राधिकरण के अधीन" शब्द रखे जाएंगे ।
7. उक्त प्रादेश के पैरा 13 के स्थान पर निम्नलिखित पैरा रखा
जाएगा, अर्थात्: --
"13.-- कतिपय नियुक्तियों और प्रोन्नतियों का अनहोना --
यथास्थिति, इस बांदेग या पैरा 3 के परन्तुक के अनुसरण में किए गए किसी आदेश के आरंभ के पश्चात् और इस आदेश या पैस 3 के परन्तुक के अनुसरण में दिए गए किसी श्रादेश के उज्ववों या अर्थान किसी स्थानीय काडर का संगठन किए जाने के पूर्व किसी ऐसे पद पर, जिसका ऐसे काडर में सम्मिलित हिश जाना अपेक्षित है, की भई कोई नियुक्ति या प्रोन्नति अनंतिम होगी और ऐसे संगठन के पश्चात् बारह माम का अवधि के भीतर इस आदेश के उपबंधों के ग्रनुसार उसका गुर्वावलोकन थार पुनःगमायोजन किया जाएगा ।
स्पष्टीकरण: इन पैस के प्रयोजनों के लिए कोई स्थानीय काडर पैरा 4 के अधीन उसे आवंटिन व्यक्तियो से संगठिन किया। हुय। समझ जाएगा । "
8. उक्न आदेश को द्वितीय अनुनूची में,--
(क) "जोन " के सामने की प्रविष्टि में "श्रीकाकुलम और विशाखापत्तनम जिले" शब्दशे के स्थान पर " श्रीकाकुलम, विजिया- नगरम और विशाखापत्तनम जिले" शब्द रखे यौर वे 1 जून , 1979 से रखे गए भरुने जाएंगे ।
(ख) "जोन VI" के सामने को प्रविष्टि में "हैदराबाद" शब्द के पश्चात् " रंगा रेड्डि" शब्द अंतःस्थापित किए जाएंगे और वे 15 अगस्त, 1978 से अंतःस्थापित किए गए नमने जाएंगे ।
9. उक्त आदेश को तृतीय अनुसूची में,--
(क) क्रम सं ० 17 और उससे संबधित प्रविष्टियों के पश्चात् निम्न- लिखित क्रम सं ० और प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात्: --

(ख) क्रम सं ० 23 के सामने स्तंभ ( 2) में की प्रविष्टियों में, "राजपत्रित विद्यालय निरीक्षक" शब्दों के स्थान पर "उप शिक्षा अधिकारी " शब्द रखे जाएंगे ;
(ग) क्रम सं० 26 के सामने स्तंभ ( 2 ) में की प्रविष्टि के स्थान पर, "प्राध्यापक, सरकारी शिक्षण महाविद्यालय और मरकारी व्यापक शिक्षण महाविद्यालय" प्रविष्टि रखी जाएगी ;
(घ) क्रम सं० 27 के सामने , स्तंभ ( 2 ) में की प्रविष्टि के स्थान पर, "परिषद् शिक्षा अधिकारी " प्रविष्टि रखी जाएगी ;
(ङ) क्रम सं ० 36 के सामने स्तंभ ( 2 ) में की प्रविष्टि के स्थान पर "सहायक निदेशक , उद्योग जिसमें तकनीकी अधिकारी ( ग्रामीण उद्योग परियोजना) : योजना और सर्वेक्षण अधिकरण ( ग्रामीण उद्योन परियोजना ) और तकनीकी अधिकारी ( 5 लाख को काम कार्यक्रम) के पद भी सम्मिलित हैं, " प्रविष्टि रखी जाएगी ;
(च) क्रम. सं ० 37, 38 और 39 और उनसे संबंधित प्रविष्टियों का लोप किया जाएगा ;

(छ) क्रम सं ० 48 के सामने, स्तंभ 2 में को प्रविष्टि के स्थान पर "श्रम अधिकारी " प्रविष्टि रखी जाएगी ।
व्याख्यात्मक ज्ञापन
पैराग्राफ 4( ख ) , 5 ( ख) ओर ४( ख ) द्वारा किए गए संशोधन, 15 अनस्त, 1978 से हैदराबाद जिले के रंगा रेड्डि और हदराबाद जिलों में पुनर्गठन के परिग मस्वरून हैं ओर इनलिए उतो त.रोख से पूर्व- व्य.प्ति प्रभाव दिया जाना है । इसी प्रक.र, पैराग्राफ 8 ( क ) द्वारा किया गया संशांवर 1-6-1979 से विजिनानम् जिना नामक नए जिले के निर्माण स्वरूप है, जिसका गठन श्रीकाकुलम जिले और विशाखापत्तनम जिले के क्षेत्रों से किया गया है और इसलिए इसे उत्तो तागेख से पूर्वव्याप्ति प्रभाव दिया जाना है । प्रमाणित किया जाता है कि पूर्वोक्त संगोवनों को पूर्वव्याप्ति प्रभाव से लागू किए जाने से किसी के हितों पर प्रतिकूल प्रभाव नहीं पड़ेगा ।

MINISTRY OF HOME AFFAIRS
ORDER
New Delhi , the 1st January , 1981
G.S.R. 5 ( E) . In exercise of the powers conferred by causes ( 1 ) and (2 ) of article 371D of the Constitution , the President hereby makes the following Order further to amend the Andhra Pradesh Public Employment ( Organisation of Local Cadres and Regulation of Direct Recruitment ) Order , 1975, namely :-
1. (1) This Order may be called the Andhra Pradesh Public Employment ( Organisation of Local Cadres and Regu- lation of Direct Recruitment) Amendment Order , 1981 .
(2) Save as otherwise provided in this Order, it shall come into force on the date of its publication in the Official Gazette.
2. In the Andhra Pradesh Public Employment ( Organisation ofLocal Cadres and Regulation of Direct Recruitment ) Order , 1975 (hereinafter referred to as the said Order) , in paragraph 3 , to sub -paragraph ( 1 ) , the following proviso shall be added , namely :-
"Provided that, notwithstanding the expiration of the said period, the President may by order , require the State Govern- ment, whenever he considers it expedient so to do , to organise any classes of posts in the civil services of, and classes of civil posts under, the State into different local cadres for different parts of the State."
3. In paragraph 5 of the said Order , in sub -paragraph (2)-
(a) the word " and" at the end of clause (b ) shall be omitted;
(b) the word " and" shall be inserted at the end of clause ( c) ; and
(c) after clause ( c) , the following clause shall be added, namely :-
"(d) the transfer of a person from one local cadre to another local cadre on a reciprocal basis , sub- ject to the condition that the person so transferred shall be assigned seniority in the latter cadre with reference to the date of his transfer to that cadre."
4. In paragraph 6 of the said Order,-
(a) in clause ( ii ) of sub - paragraph ( 2 ) , for the words "and Inspectors of Police" , the words " Inspectors of Police and Motor Vehicles Inspectors" shall be substituted;
(b) in clause ( i ) of sub - paragraph (4 ) , for the words "the districts of Medak and Hyderabad " , the words भारत का राजपत्र असाधारण

"the districts of Medak , Ranga Reddy and Hydera- bad" shall be substituted , and shall be deemed to have been substituted with effect from the 15th day of August, 1978 .
5. In paragraph 8 of the said Order ,-
(a) in sub -paragraph ( 3 ) , for the words "and Inspectors of Police" the words " Inspectors of Police and Motor Vehicles Inspectors " shall be substituted;
(b) in the Table appearing below sub - paragraph ( 5 ) , in column 1 , against entry VI , for the words "Districts of Hyderabad (excluding city of Hyderabad ) " the words "Districts of Ranga Reddy ( excluding such areas as form part of the city of Hyderabad ) ' shall be substituted , and shall be deemed to have been substituted with effect from the 15th day August, 1978 . of
6. In paragraph 9 of the said Order , in the proviso , for the words " in any other local cadre " , the words " in any other local cadre or under any other local authority , as the case may be " shall be substituted .
7. For paragraph 13 of the said Order , the following para- graph shall be substituted, namely :-
"13. Certain appointments and promotions to be provi- sional . Any appointment or promotion made after the commencement of this Order or any order made in pursuance of the proviso to paragraph 3, as the case may be, and before any local cadre has been organised under the provisions of this Order or any Order made in pursuance of the proviso to para- graph 3 , to any post which is required to be in- cluded in such cadre shall be provisional and shall , within a period of twelve months after such orga- nisation, be reviewed and readjusted in accordance with the provisions of this Order .
Explanation . For the purposes of this paragraph , any local cadre shall be deemed to be organised, with the allotment of persons to it under para- graph 4. "
8. In the Second Schedule to the said Order ,-
( a) in the entry against " Zone I" , for the words " Sri- kakulam and Visakhapatnam Districts " , the words "Srikakulam , Vizianagaram and Visakhapatnam Districts " , shall be substituted , and shall be deemed to have been substituted with effect from 1st day of June, 1979 .
(b) in the entry against "Zone VI " , after the word "Hyderabad" the words " Ranga Reddy " shall be

inserted , and shall be deemed to have been inserted with effect from the 15th day of August , 1978 .
9. In the Third Schedule to the said Order,-
-Do-" (a) after serial No. 17 and entries relating thereto the following serial No. and entries shall be inserted, namely :- (1) (2) "17-A . Motor Vehicles Inspectors (3)
(b) in the entries against serial No. 23 , in column ( 2 ) , for the words "Gazetted Inspectors of Schools" , the words "Deputy Educational Officers " shall be cubsti- tuted ;
(c) for the entry against serial No. 26 , in column ( 2 ) , the entry "Lecturers , Government Colleges of Edu- cation and Government Colleges of Comprehensive Education" shall be substituted;
(d) for the entry against serial No. 27 , in column ( 2) , the entry "Parishad Educational Officers " shall be substituted;
(e) for the entry against serial No. 36, in column (2 ) , the entry "Assistant Directors of Industries , in- cluding the posts of Technical Officers ( Rural In- dustries Project) , Planning -cum- Survey Officers (RIP) and Technical Officers , ( Half a Million Jobs Programmes ) " shall be substituted;
(f) serial Nos . 37, 38 and 39 and the entries relating thereto shall be omitted;
(g) for the entry against serial No. 48, in column ( 2) , the entry " Labour Officers" shall be substituted .
EXPLANATORY MEMORANDUM
The amendments made by paragraphs 4 ( b ) , 5 ( b ) and 8 (b) are as a consequence of the reconstitution of Hydera- bad District into Ranga Reddy and Hyderabad Districts with effect from the 15th August , 1978 and hence are sought to be given retrospective effect from that date . Similarly the amendment made by paragraph 8( a ) follows the formation of a new District by name Vizianagaram District out of the territories comprised in Srikakulam District and Visakhapat- nam District with effect from 1-6-1979 and hence is sought to be given retrospective effect from that date . It is certified that the interests of no one would be prejudicially affected by reason of giving retrospective operation to the aforesaid amendments .
