का० आ० 84 ( अ ) न्यूनतम मजदूरी अधिमियम 1948 ( 1948 मी 11 ) की धारा 4 की उपधारा ( 1 ) के खण्ड (111 ) के साथ पठित धारा 3 की उपधारा ( 1 ) के खण्ड ( क ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए, केन्द्रीय सरकार ने इससे उपाबद्ध अमुसूची के स्तम्भ 2 में विनिर्दिष्ट मजबूरी की न्यूनतम दरो को जो उक्त अनुसूची के स्तम्भ 1 की तत्स्थानी प्रविष्टिो में बिनिविष्ट कुलफैम ब्रानो में उसके नियोजन मे नियोजित प्रवर्ग के कर्मचारियो को संवेय है, नियत करने के लिए निम्नलिखित प्रस्ताव बनाए हैं जो उक्त अधिनियम की धार। 5 की उपधाग ( 1 ) के खण्ड ( ख) की अपेक्षानुसार उन सभी व्यक्तियो की जानकारी के लिए प्रकाशित किए जा रहे है, जिनके उससे प्रभावित होने की सभाषना है और यह सूचना वी जाती है कि उक्त प्रस्तावो पर उम तारीख से, जिभ को यह अधिसूचना राजपत्र में प्रकाशित होती है , दो माम की समाप्ति के पश्चात् विचार किया जाएगा ।
ऊपर विनिर्दिष्ट अर्बाध की ममाप्ति से पूर्व उक्त प्रस्तावो की बाबत जो भी आक्षेप या मुझाव किमी व्यक्ति से प्राप्त होगे, केन्द्रीय सरकार उन पर विचार करेगी ।

स्पष्टीकरण -इस अधिसूचना के प्रयोजन के लिए-
1. इम अधिसूचना द्वारा नियत न्यूनतम दरें सर्वसम्मिलित दरें हैं और इसमें साप्ताहिक विश्राम के लिए देय मजदूरी भी सम्मिलित है ।
2. इस अधिसूचना द्वारा नियत मजवी की न्यूनतम वरें ठेकेदारो द्वारा नियोजित कर्मचारियों को भी लाग हैं ।
3 अठारह वर्ष से कम आयु के और नि. शक्ल व्यक्तियों को देय मजबूरी को न्यूनलम वरें ममुचित प्रवर्ग के कर्मकारों के लिए इम अधिसूचना द्वारा नियत दरों का क्रमण: 80 प्रतिशत और 70 प्रतिशत होगी ।
1 ( क) " अकुशल कार्य" से वह कार्य अभिप्रेत है जिसमे बहुत थोड़ी या कुष्ठ भी कुशलता का कार्य या अनुभव अपेक्षित न करने वाली माघोरण क्रियाएं सम्मिलित हैं,
(ख) " अर्द्धकुशल कार्य " से वह कार्य अभिप्रेत है, जिसमें कार्य के अनुभव से अजित कुछ मात्रा में कमालता या मक्षमता सम्मिलित भौर जो कुशल कर्मचारी के पर्यवेक्षण या मार्गदर्शन के अधीन किए जाने योग्य है और इसके अन्तर्गत धकुशल पर्यवेक्षी कार्य भी आता है,
( ग) "कुशल कार्य" से वह कार्य अभिप्रेत है जिसमें कार्य के अनुभव से अथवा शिक्षु के रूप में या किसी तकनीकी या व्यावसायिक संस्था में प्रशिक्षण के माध्यम से अर्जित कुणलता या सक्षमता श्रपेक्षित है जिसके पालन में स्वप्रेरणा और विवेकद्धि प्रावश्यक है ,
5. जहां किसी क्षेत्र में मजदूरी की विद्यमान दरें इस अधिसूचना द्वारा नियत वरों से निम्नतर है वहां विसी उभंवर दरें इस अधिसूचना के प्रयोज- वार्ष ऐसे कर्मचारी के लिए मजबुरी की न्यूनतम दरें समझी जाएंगी ।

NOTIFICATION
Now Delhi , the 2nd February , 1981
S.O. 84( E) :-The following proposals made by the Central Government in exercise of the powers conferred by Clause ( a ) of sub - section ( 1 ) of section 3 , read with Clause ( iii ) of sub- section ( 1 ) of section 4 of the Minimum Wages Act , 1948 (11 of 1948) for fixing the minimum rates of wages as specified in Column 2 of the Schedule annexed hereto , payable to the categories of the employees employed in employment in Wolfiu m Mines as specified in the corresponding entrics in Column 1 cf the said Schedule , are herd by published as required by Clause (b) of sub- section ( 1 ) of section 5 of the said Act for information ofall persons likely to be affected thereby and notice is hereby given that the said proposals will be taken into consideration after the expiry of 2 months from the date of publication of the notification in the Official Gazette .
Any objection or suggestion which may be received from any person with respect to the said proposals before the expiry of the period specified above will be considered by the Central Government .

Explanation :-For the purpose of this notification-
( 1 ) the minimum rates of wages are all inclusive rates and include also the wage payable for the weekly day of rest;
(2) the minimum rates of wages are applicable to employees employed by contractors also ;
(3) the minimum rates of wages payable to young persons below 18 years of age and for disabled persons shall be 80% and 70 % respectively of the rates fixed by this notification for adult workers of the appropriate category ;
(4) ( a) " Unskilled work " means work which involes simple operations requiring little or no skill or experience of the job ;
(b) " Semi - skilled work " means work which involves some dogree of skill or competence acquired through experience of the job and which is capable of being performed under the super-

vision or guidance of a skilled employce and includes un- supervisory work ;
(c) " Skilled work " means work which involves skill or com- killed petence acquired through experience of the job or through training as an apprentice or in a technical or vocational institute and the performance of which calls for initiative and judge- ment;
(5) Where in any arca , the minimum 1ates of wages fixed by this notification are lower than the prevailing tates of wages of any employee , the higher wages shall be treated as the minimum rates of wages applicable for the purpose of this notification to such employce .
