का . मा. 95(अ )/ 18८ स आई ही आर ए/ 81 :-भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग) के अरदेश में का आ . 105 (अ) / 18 - चल/ आईडीआरए / 78 , तारीख 17 फरवरी , 1978 ( जिसे इसमें इसके पश्चात उक्त आदेश काहा गया है / द्वारा कंन्द्रीय सरकार ने , उद्योग ( विकास और विनियम ) अधि- नियम , 1951 ( 1951 क 65) की धारा 18- चस्व की उपधारा ( 1) के खंड ( ख) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , घोषणा की थी कि इस आवेश के जारी होने 1329 G1 / 80

की तारीख से ठीक पूर्व प्रवृत्त सभी संविदातें , सम्पत्ति के हस्तांतरण पत्रों , करारों , व्यवस्थापनों , पंचाटो , स्थायी आदेशों या अन्य लिखितों का ( उनसे भिन्न , जो बैंकों और वित्तीय संस्थाओं के प्रतिभूत दायित्वों से सम्बन्धित है) , जिनका कि मैसर्स इन्दौर टेक्सटाइल्स लिमिटेड , उज्जैन , मध्य प्रदेश नामक औद्योगिक उपक्रम एक पक्षकार है या जो उक्त औद्योगिक उपक्रम या कम्पनी को लागू हो सकते हैं , प्रवर्तन उस तरीख से एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख से पूर्व तीन प्रोद्भूत होने वाले सभी अधिकार , विशेषाधिकार , बाध्यताएं और दायित्व उक्त अवधि के लिए निलम्बित रहेंगे ;
और उक्त आदेश की अस्तित्वावधि 16 फरवरी , 1981 तक , जिसमे यह तारीख भी सम्मिलित है , बढ़ा की गई थी ;
और केन्द्रीय सरकार का समाधान हो गया है कि उक्त आदेश की अस्तित्वावधि एक वर्ष की अवधि के लिए और बढ़ा दी जानी चाहिए ;
अतः , अब , केन्द्रीय सरकार , उद्योग ( विकास और विनियम) अधिनियम , 1951 ( 1951 का 65) की धारा 18 - चल की उपधारा ( 2 ) के साथ पठित , उपधारा (1) के खण्ड ( ख) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त आवेश की अस्तित्वावधि 16 फरवरी , 1982 तक , जिसमें यह तारीख भी सम्मिलित हैं , बढ़ाती है ।

ORDER
New Delhi , the 13th February , 1981
S.O. 95 (E ) /18FB/IDRA/81.-Whereas by the Order of the Government of India in the Ministry of Industry (Department of Industrial Development) No. S.O. 105 (E ) / 18FB / IDRA / 78 , dated the 17th February , 1978 (hereinafter referred to as the said Order) , the Central Government , in exercise of the powers conferred by clause ( b ) of sub- section ( 1 ) of section 18 FB of the Indus- tries (Development and Regulation) Act , 1951 ( 65 of 1951 ) , declared that the operation of all contracts , assurances of property , agreements , settlements , awards , standing orders or other instruments in force immediately before the date of issue of this Order ( other than those relating to secured liabilities to banks and financial institutions ) to which the industrial undertaking known as Messrs Indore Textiles Limited , Ujjain , Madhya Pradesh is a party or which may be applicable to the said industrial undertaking or company shall remain sus- pended for a period of one year from such date and that all the rights , privi- leges , obligations , and liabilities accruing or arising thereunder before the said date shall remain suspended for the said post ;

And whereas the duration of the said Order was extended upto and in- clusive of the 16th Februaгу , 1981 ;
And whereas the Central Government is satisfied that the duration of the said Order should be extended for a further period of one year ;
Now, therefore , in excrcise of the powers conferred by clause ( b ) of sub- section ( 1 ) , read with sub - section ( 2 ) , of section 18 FB of the Industries (Deve- lopment and Regulation) Act , 1951 ( 65 of 1951 ) , the Central Government hereby extends the duration of the said Order upto and inclusive of the 16th February , 1982 .
