का. आ. 190 (अ) केन्द्रीय सरकार , उद्योग (विकास और विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 29 ख की उपधारा ( 1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उन सभी औद्योगिक उपक्रमों को जो उक्त अधि- नियम के अधीन रजिस्ट्रीकृत है या जिनकी बाबत उक्त अधिनियम के अधीन अनु- ज्ञप्ति या अनुज्ञा जारी की गई है , उक्त अधिनियम की धारा 13 की उपधारा ( 1) के 1459 GI/ 80

खण्ड (घ) और उसके अधीन बनाए गए नियमों के प्रवर्तन से , निम्नलिखित शतो के अधीन रहते हुए , छूट बेती है , अर्थात:
(1) यह कि यथास्थिति , रजिस्ट्रीकृत या अनुशप्त या अनुज्ञात भारिता से अधिक समस्त उत्पादन का निर्यात किया आता है ;
(2 ) यह कि औद्योगिक उपक्रम केवल निर्यात के लिए ऐसे उत्पादन के प्रयोजनार्थ देशी या आयातित अतिरिक्त मशीनरी नहीं समाएगा:
परन्तु जहां ऐसा उत्पादन अनुज्ञप्त या रजिस्ट्रीकृत या अनुशात धारिता से अधिक किया जाता है और उसका निर्यात किया जाता है , यहां ऐसा भारत सरकार के उद्द्योग मंत्रालय (औद्योगिक विकास विभाग) की अधिसूचना सं . का . आ. 98 (अ.)/उ. वि. वि. आ./29 /73/1 , तारीख 16 फरवरी , 1973 की मनुसूची 1 में विनिर्दिष्ट उत्पाद की बाबत नहीं किया जाएगा ।
2. इस अधिसूचना में अंतर्विष्ट उपबंध भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास विभाग ) की अधिसूचना सं. का . आ . 98 (अ)/उ . वि. वि. आ. / 29 ख/ 73 /1 , तारीख 16 फरवरी , 1973 में अंतर्विष्ट उपबंधों के अतिरिक्त होगे न कि उनके अल्पीकरण में , सिवाए इसके कि वर्तमान अधिसूचना द्वारा दी गई छूट , उक्त अधिसूचना सं . का . आ. 98 (अ. )/उ . वि. वि. आ./29 / 73/1, तारीख 16 फरवरी , 1973 की मद (3 ) के अधीन दूसरे परन्तुक में विनिर्दिष्ट अवस्थिति संबंधी मजबूरियों के होने पर भी उपल्भ्य होगी ।

NOTIFICATION
New Delhi , the 17th March , 1981
S.O. 190(E ) . In exercise of the powers conferred by sub -section ( 1) of section 29B of the Industries (Development and Regulation ) Act , 1951 (65 of 1951 ) , the Central Government hereby exempts from the operation of clause (d) of sub-section ( 1 ) of section 13 of the said Act and the rules made thereunder , all industrial undertakings registered under the said Act or in respect of which a licence or permission has been issued under the said Act , subject to the following conditions , namely :
(1) that the entire production in excess of registered or licensed or per- mitted capacity, as the case may be , is exported;

(ii) that the industrial undertaking shall not instal additional machinery, Indigenous or imported , only for the purpose of such production for export :
Provided that where such production in excess of licensed or registered or permitted capacity be undertaken and is exported , it shall not be undertaken in respect of a product specified in Schedule I to the notification of the Government of India in the Ministry of Industry ( Department of Industrial Development) No. S.O. 98 (E) / IDRA /29B / 73 / 1 , dated the 16th February , 1973 .
2. The provisions contained in this notification shall be in addition to and not in derogation of the provisions contained in the notification of the Govern- ment of India in the Ministry of Industry (Department of Industrial Develop- ment) No. S.O. 98 ( E) / IDRA/ 29B / 73 / 1 , dated the 16th February , 1973 , ex- cept that the exemption granted by the present notification shall be available notwithstanding the locational constraints specified in the second proviso under item (3) of the said notification No SO . 98 ( E ) / IDRA / 29B / 73 / 1 , dated the 16th February , 1973 .
