सा०का० ति० 194 (८) केन्द्रीय सरकार, बाट और माप मानक अधिनियम , 1976 ( 1976 का 60) की धारा 83 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाती है, धर्थात्:-

1. संक्षिप्त नाम भौर प्रारम्भ ( 1 ) इन नियमों का नाम भारतीय विधिक माप विज्ञान संस्थान , नियम , 1980 है ।

(2) ये 1 अप्रैल , 1980 को प्रवृत होंगे ।

2. परिभाषाएं. इन नियमो में , जब तक कि संदर्भ से धन्यथा अपेक्षित

न हो,-

(क ) "अधिभियम" से बाट भौर माप मानक अधिनियम, 1976 (1976 का 60) अभिप्रेत है ।

(ब) "समिति" से नियम 8 के अधीन गठित मलाहकार समिति अभिप्रेत है;

(ग) "पाठ्यक्रम" से ऐसे विषयों से सम्बद्ध पाठ्यक्रम अभिप्रेत है जो विनियमों में विनिविष्ट किए जाएं;

(घ) "संस्थान " से भारतीय विधिक माप विज्ञान संस्थान अभिप्रेत है;

(छ) "विधिक माप विज्ञान" से माप विज्ञान का वह पक्ष अभिप्रेत है, जो,

(i) बाट बौर माप इकाइयों, मापमान पद्धतियों और बाट मौर माप उपकरणों से संबंधित है , पौर

( ii ) मापमानों की सुरक्षा भौर यथार्थता की वृष्टि से, जनता की सुरक्षा के लिए तकनीकी अपेक्षाभों और कानूनी उपबन्धों से सम्बद्ध है ।

(च) "प्रधानाचार्य" से संस्थान के प्रधानाचार्य अभिप्रेत है;

(छ) "विनियम" से केन्द्रीय सरकार द्वारा अधिनियम के अधीन बनाए गए विनियम अभिप्रेत हैं ।

3. संस्थान में बढ़ाए जाने वाले पाठ्यक्रम ( 1 ) संस्थान में विधिक माप विज्ञान और ऐसे धन्य विषयों में , जिनकी समिति सिफारिश करे , दीर्घकालिक और अल्पकालिक प्रशिक्षण दिए जाएंगे ।

(2) प्रत्येक वीर्घकालिक प्रशिक्षण और अल्प-कालिक प्रशिक्षण पाठ्यक्रम में थे विषय होंगे जिनकी समिति सिफारिश करे ।

( 3) प्रत्येक वीर्घकालिक प्रशिक्षण पाठ्यक्रम को उतने भागों में विभाजित किया जाएगा जितने से कि प्रशिक्षण के प्रारम्भिक भौर उच्चतर पाठ्यक्रमों को पूरा किया जा सके ।

(4) प्रत्येक दीर्घकालिक प्रशिक्षण पाठ्यक्रम की अवधि बारह मास से भऔर प्रत्येक अल्पकालिक प्रशिक्षण पाठ्यक्रम की अवधि एक भास से , कम नहीं होगी ।

( 5 ) प्रत्येक वीर्घकालिक भौर अल्पकालिक प्रशिक्षण पाठ्यक्रम की वास्तविक अवधि भौर विस्तृत पाठ्यचर्या का अवधारण समिति करेगी ।

( 6) विनिर्दिष्ट प्रयोजनों के लिए ऐसी अवधि के ऐसे पुनश्चर्या पाठ्यक्रम होंगे जिनकी समिति सिफारिश करे ।

4. संस्थान के बाध्यकर कृत्य प्रशिक्षण को सुकर बनाने के लिए

संस्थान-

( क) विधिक माप विज्ञान और ज्ञान के ऐसे क्षेत्रों पर, जिनकी समिति सिफारिश करे ऐसी पुस्तकें, निर्देशिका, हैण्ड बुक, कालिक पत्तिकाएं, अनुदेश पक्तक , टिप्पण , लेख या अन्य दस्तावेज तैयार मुद्रित या प्रकाशित करेगा;

(ख) अपने परिसर के भीतर ऐसे उपकरण लगाएगा और ऐसी प्रयोगशालाएं चलाएगा जो प्रधानाचार्य की राय में उसके कृत्यों के सम्यक् निर्वहन के लिए भावस्यक हैं ;

(ग ) पूर्व स्नातकों या स्नातकोत्तर या बोनों की तरह के विद्यार्थियों को विधिक माप विज्ञान और ज्ञान की सम्बद्ध शाखाओं में आरम्भिक शिक्षा देने के लिए विश्वविद्यालयों , इंजीनियरी और तकनीकी महाविद्यालयों को बढ़ावा देने के लिए स्कीमें बताएगा और उन्हें लागू करेगा;

(घ ) विधिक माप विज्ञान से संबंधित विधियों को समुचित रूप से लागू करने में अत्यन्त सहायक संस्थागत , विधिक भौर प्रशास निक कार्य प्रणाली को ध्यान में रखते हुए , अध्ययन के लिए स्कीमें बनाएगा;

(ङ) भारत में या विदेश में स्थित ऐसे किसी अभिकरण या संगठन से संबंध स्थापित करेगा और सहयोग बनाए रखेगा, जिसकी विधिक माप विज्ञान में प्रशिक्षण वेने में उपयोगी भूमिका है,

( च) विधिक माप विज्ञान और ज्ञान की सम्वद्ध शाखाभों में प्रध्ययन और अनुसंधान को प्रोत्साहित करने के लिए एक पुस्तकालय स्थापित करेगा और उसे चालू रखेगा ।

5. संस्थान के अन्य कृत्य. संस्थान,-

(क) निर्देशन स्तर की मानक प्रयोगशाला के रूप में माप विज्ञान प्रयोगशाला,

(ख) प्रतिमानों के अनुमोदनार्थ एक प्रयोगशाला, श्रौर

(ग) उद्योगों को माप- विज्ञान संबंधी सुविधाएं उपलब्ध कराने वाली

प्रयोगशाला,

के रूप में कृत्य करेगा ।

6. संस्थान में प्रवेश पाने के पात्र व्यक्तियों की महुँताएं: कोई भी व्यक्ति तब तक संस्थान में प्रवेश नहीं प्राप्त कर सकेगा जब तक कि वह निम्नलिखित किसी एक की अपेक्षाभों की पूर्ति नहीं करता है--

(क ) वह केन्द्रीय सरकार का किसी राज्य सरकार द्वारा अपने विधिक माप विज्ञान से सम्बद्ध विभाग में नियोजित किया गया है और या तो उसके पास-

(1) विज्ञान (जिसमें भौतिकी एक विषय है ) , प्रौद्योगिकी या इंजीनियरी में उपाधि हो , या

( 2) इंजीनियरी में डिप्लोमा हो,

और वह जिस सकार में नियोजित है उसके द्वारा संस्थान में प्रशिक्षण के लिए प्रायोजित किया गया है:

परन्तु कला में उपाधि रखने वाला इस प्रकार नियोजित व्यक्ति भी उस सरकार द्वारा प्रायोजित किया जा सकता है जिसके द्वारा यह इस

प्रकार नियोजित किया गया है किन्तु यह तब जब उस व्यक्ति को उस सरकार द्वारा इन नियमों के प्रारम्भ से पूर्व नियोजित किया गया है भौर उसने विधिक माप विज्ञान में कम से कम दो वर्ष का अनुभव प्राप्त कर लिया है :

परन्तु यह और कि यवि राज्य सरकार द्वारा नियोजित कोई व्यक्ति उस सरकार द्वारा प्रायोजित किया जाता है तो केन्द्रीय सरकार, जब उसका यह विचार हो कि इस प्रकार प्रायोजित व्यक्ति प्रशिक्षण पाठ्यक्रम पूरा करने के लिए अन्यथा उपयुक्त है , शैक्षिक अर्हताएं शिथिल कर सकती है ।

(ख) वह भारत से बाहर किसी देश में विधिक माप विज्ञान से संबंधित किसी विभाग में नियोजित है और उसके पास ऐसी कोई उपाधि या डिप्लोमा है जो खण्ड ( क ) में विनिविष्ट उपाधि या डिप्लोमा के समतुल्य है , और वह उस वेश की सरकार द्वारा , जिसमें वह नियोजित है, प्रायोजित किया गया है :

परन्तु भारत से बाहर किसी देश में नियोजित व्यक्ति के मामले में , जो उस देश की सरकार द्वारा प्रायोजित किया गया है , केन्द्रीय सरकार, जब उसका यह विचार हो कि इस प्रकार प्रायोजित व्यक्ति प्रशिक्षण पाठ्यक्रम पूरा करने के लिए अन्यथा उपयुक्त है , शैक्षिक अर्हताएं शिथिल कर सकती है;

(ग) वह किसी प्रौद्योगिक एकक में नियोजित है और उसने भौद्यो- गिक प्रशिक्षण संस्थान द्वारा ली गई परीक्षा या उसके समतुल्य परीक्षा उत्तीर्ण की है अथवा उसके पास खण्ड ( क) में विनि- विष्ट उपाधि या डिप्लोमा है भौर वह उम श्रौद्योगिक एकक द्वारा प्रयोजित किया गया है जिसमें वह इस प्रकार नियोजित है ।

7. संस्थान में प्रवेश के विनियम- संस्थान द्वारा चलाये जा रहे विभिन्न पाठ्यक्रमों के लिये वाखिला, निदेशक के पूर्वानुमोदन से प्रधानाचार्य, पात्र अभ्यर्थियों को देगा ।

8. सलाह‌कार समितिः-( 1) केन्द्रीय सरकार संस्थान के कृत्यों और विकास के संबंध में उसे सलाह देने के लिये या संस्थान के ऐसे मामलों के संबंध में जो यह सरकार समिति को निवेशित करना भावश्यक समझे, सलाह देने के लिये एक सलाह‌कार समिति का गठन करेगी ।

( 2) समिति में निम्नलिखित व्यक्ति होंगें, अर्थात्:-

( क) भारत सरकार में विधिक माप विज्ञान निवेशालय के भारसाधक मंत्रालय का सचिव या उसका नाम निर्देशिती, जो संयुक्त सचिव की पंक्ति से नीचे का अधिकारी नहीं है, अध्यक्ष होगा ;

(ख) मास्टर भारत सरकार टकसाल या उसका नाम निर्देशिती ;

(ग) विज्ञान भौर प्रौद्योगिकी विभाग का प्रतिनिधित्व करने वाला एक व्यक्ति , जो उस विभाग के प्रधान द्वारा नामनिर्दिष्ट किया जायगा ;

(य) विधि, न्याय और कम्पनी कार्य मंत्रालय का प्रतिनिधित्व करने बाला एक व्यक्ति, जो उस मंत्रालय द्वारा नाम निविष्ट किया जायगा ;

(ङ) निवेशक; राष्ट्रीय भौतिक प्रयोगशाला, नई दिल्ली या उसका नामनिर्देशिती ;

(च ) माप संबंधी उपकरण का बिनिर्माण करने वाले उद्योग का प्रतिनिधित्व करने वाला एक व्यक्ति, जो निदेशक द्वारा नामनिविष्ट किया जायगा ;

( छ) केन्द्रीय सरकार द्वारा नामनिर्दिष्ट अधिक से अधिक छह व्यक्ति, जिनमें से-

( i) वैज्ञामिक शिक्षा या तकनीकी मामलों के संबंध में शाम रखने वाले व्यक्तियों में से अधिक से अधिक दो व्यक्ति नामनिर्दिष्ट किए जाएंगे ;

( ii) राज्य सरकारों द्वारा चारों क्षेलों में से प्रत्येक के लिये नामनिर्दिष्ट एक एक प्रतिनिधि । नामनिर्देशन का अत्रि- कार क्षेत्र के प्रत्येक राज्य को वर्णानुक्रम में चक्रानुक्रम के अनुसार प्राप्त होगा ।

स्पष्टीकरण-खण्ड ( छ) के प्रयोजनार्थ , ' क्षेत्र' से ऐसे राज्य अभिप्रेत

है जो सहायक निदेशक , विधिक माप विज्ञान द्वारा संपर्क के प्रयोजनार्थ एक समूह में रखे गए हैं ।

( ज) संस्थान में ठीक पूर्ववर्ती वर्ष में प्रशिक्षण प्राप्त करने वाले प्रशिक्षणार्थियों के बैच में सर्वाधिक अंक प्राप्त करने वाला प्रशिक्षणार्थी, किन्तु ऐसे प्रशिक्षणार्थी केवल एक वर्ष के लिये समिति का सदस्य रहेगा और उक्त भवधि के अवसान पर, उक्त प्रणिक्षणार्थी पद रिक्त कर देगा भौर तब उसके ठीक पश्चातवर्ती वर्ष में सर्वाधिक अंक प्राप्त करने वाला प्रशिक्षणार्थी इस प्रकार रिक्त किया गया स्थान ले लेगा और यही क्रम चलता रहेगा ;

( झ) निवेशक, विधिक माप विज्ञान, पर्दैन,

( अ ) महानिदेशक, भारतीय मानक संस्थान, नई दिल्ली या उसका नामनिर्देशिती ;

( ट) संस्थान का प्रधानाचार्य , पवेन, जो समिति का संयोजक होगा ।

( 3) यदि समिति की राय है कि संस्थान के हित में किसी व्यक्ति का उससे सहयोग आवश्यक है तो वह अधिक से अधिक दो ऐसे व्यक्तियों को अपने सदस्य के रूप में सह्योजित कर सकती है और इस प्रकार सह योजित व्यक्ति, इन नियमों के प्रयोजनों के लिये समिति के सदस्य समझे जाएगें भौर उनके वही अधिकार और विशेषधिकार होंगें जो समिति के किसी अन्य सदस्य के हैं ।

(4) समिति अपनी प्रक्रिया, जिसमें इसके अधिवेशनों में गणपूर्ति भी है, को स्वयम विनियमित करेगी और वर्ष में कम से कम एक बार ऐसे स्थान पर और ऐसे समय पर जो यह ठीक समझे अधिवेशन करेगी ।

(5 ) समिति के अधिवेशन में उपस्थित होने के लिये सदस्यों के यात्रा भत्ते तथा अन्य व्यय , यथास्थिति, केन्द्रीय सरकार या राज्य सरकारों द्वारा बनाए गए ऐसे नियमों द्वारा विनिर्यामत होंगें जो ऐसे विषयों की बाबत तत्समय प्रवृत्त है भौर उस प्राधिकारी द्वारा बहन किए जाएंगे जिसकी ओर से या जिसके भनुरोध पर सम्बद्ध अधिवेशन में हाजिर होता है ।

(6) उप नियम ( 2 ) में यथाउपबंधित के सिवाय , समिति के सदस्यों का कार्यकाल तीन वर्ष होगा:

परन्तु किसी सदस्य को, इस नियम के अधीन उसे नामनिर्दिष्ट करने के लिय सक्षम प्राधिकारी , उतनी ही धवधि के लिये पुनः नामनिर्दिष्ट कर सकता है:

परन्तु यह और कि यदि समिति के सदस्यों का कार्यकाल समाप्त हो जाने के उपरांत उसका पुर्नगठन नहीं किया जाता है तो उसके सदस्यों का कार्यकाल तब तक के लिये विस्तारित हो जायगा जब तक समिति को इस नियम के अधीन पुर्नगठित नहीं किया जाता है ।

( 7) समिति ऐसे कार्यकारी समूह गठित कर सकती है, जो वह, उन्हें सौंपे गए विषयों पर विचार करने के लिये , ठीक समझे ।

( 8) प्रधानाचार्य ऐसे प्रत्येक कार्यकारी समूह का संयोजक होगा भौर ऐसे प्रत्येक कार्यकारी समूह का पदेन सवस्थ होगा ।

(9) प्रधानाचार्य समिति को और समिति द्वारा गठित किसी कार्य- कारी, समूह को , सचिवालीय सहायता उपलब्ध कराएगा ।

(10) समिति का मानिर्दिष्ट कोई सदस्य, अध्यक्ष को सम्बोधित पत्त द्वारा अपनी सदस्यता से त्यागपत्र दे सकता है और त्यागपत्र स्वीकृत हो जाने पर, ऐसे व्यक्ति का स्थित हो जायगा ।

(11) समिति में त्यागपत्र के कारण या अन्यथा होने वाली रिक्ति, इस नियम में विनिविष्ट रीति से भरी जायगी और ऐसी रिक्ति भरने के लिए नामनिदिष्ट व्यक्ति , उप नियम ( 2) में भ्रन्यथा उपबन्धित के सिवाय, उस सवस्य के, जिसके स्थान पर उसे इस प्रकार नामनिर्दिष्ट किया जाता है, शेष कार्य काल तक पद धारण करेगा ।

(12) समिति की कोई कार्यवाही मात्र इस कारण अविधिमाश्य नहीं होगी कि उसमें कोई पव रिक्त है या उसके गठन में कोई खुटि है ।

9. संस्थान की प्रमाणपत्र, डिप्लोमा भाधि अनुवत्त करने की शक्तिः

( 1 ) संस्थान में सफलतापूर्वक प्रशिक्षण पूरा करने वाले व्यक्तियों को संस्थान, ऐसे प्रवीणता प्रमाणपत्र या डिप्लोमा या मानदेय प्रदान कर सकेगा, जिसकी समिति सिफारिश करे ।

(2) संस्थान ऐसे व्यक्तियों को भौर ऐसी वरों पर मानदेय का संवाय कर सकता है जिसकी समिति सिफारिश करे ।

10. फीस संस्थान,-

( क) मानक निर्देशन प्रयोगशाला के रूप में की गई सेवा,

(ख) प्रतिमानों के अनुमोवनार्थ प्रयोगशाला के रूप में कार्यकरण,

(ग) उद्योगों को माप विज्ञान संबंधी सुविधाएं उपलब्ध कराने के लिये समुचित नियमों में विनिविष्ट रूप में फीस प्रभारित कर सकेगा और संस्थान , विभिन्न सेवाओं के लिये विभिन्न वरों पर फीस प्रभारित कर सकेगा ।

MINISTRY OF COMMERCE AND CIVIL SUPPLIES (Department of Civil Supplies) NOTIFICATION New Delhi , the 1st April, 1980

G.S.R. 194 (E) . In exercise of the powers conferred by section 83 of the Standards of Weights and Measures Act, 1976 (60 of 1976 ) , the Central Government hereby makes the following rules , namely :-

1. Short title and comencementi ( 1 ) These rules may be

called the Indian Institute of Legal Metrology Rules , 1980 . (2) They shall come into force on the 1st day of April , 1980 .

2. Definitions . In these rules , unless he context other- wise requires,--

(a) "Act" means the Standards of Weights and Measures Act, 1976 (60 of 1976 ) ;

(b ) " Committee " means the Advisory Committee con- stittuted under rule 8 ;

(d) "Institute" means the Indian Institute of Legal Met- rology;

(e) "legal metrology " means that part of metrology which-

(i ) relates to units of weights and measures , methods of measurement, and weighing and measuring instru- ments, and [PART II SEC. 3 ( 1) ] THE GAZETTE OF INDIA EXTRAORDINARY

(( ii) a diploma in engineering,

and has been sponsored for training at the Institute by the Government by which he is so employed :

(ii) is concerned with the technical requirements and statutory provisions to safeguard the public from the point of view of security and accuracy measurements ; of

(f) "Principal" means the Principal of the Institute,

(g) " regulations " means the regulations made by Central Government under the Act. the

Provided that a person so employed holding a degree in Arts may also be sponsored by the Government by which he is so employed, if such person having been employed by that Government before the commencement of these rules , has acquired experience in legal metrology for a period of not less than two years :

3. Courses tobe imparted at the Institute. ( 1 ) There shall be imparted at the Institute , long- term and short - term training in legal metrology and such other subjects as may be recom- mended by the Committee .

Provided further that where any other person employed by the State Government is sponsored by that Government, the Central Government may relax the educational qualifications if the person so sponsored is considered by the Central Govern- mert to be otherwise suitable for undergoing the course of training;

(2) Each long- term training course and each short-term training course shall consisti of such subjects as may be recom- mended by the Committee.

(3) Each long- term training course may be divided into such number of parts as would erable that course to be used for imparting preliminary and advanced courses of training.

(b) that he is employed in a country outside India in any department dealing with legal metrology and holds a degree or diploma which is equivalent to a degree or diploma specified in clause (a ) , and has been sponsored by the Government of the country in which he is so employed :

(4) The duration of each long- term training course shall not be less than twelve months and the duration of each short- term training course shall not be less than one month.

(5) The actual duration and the detailed curriculum of every long-term and every short - term training course shall be determined by the Committee .

Provided that in the case of a person employed in a country outside India, who is sponsored by the Government of that country, the Central Government may relax the educational qualifications if the person so sponsored is considered by the Central Government to be otherwise suitable for undergoing the course of training ;

(6) There shall be such refresher courses for specific pur- poses and for such duration as the Committee may recom- mend.

4. Obligatory functions of the Institute. With a view to facilitation training , the Institute shall-

(c) that he is employed in an industrial unit and has passed the examination conducted by an Industrial Training Institute or an equivalent examination , or holds a degree or diploma specified in clause (a) , and has been sponsored by the industrial urlt in which he is so employed.

7. Regulation of admissions to the Institute. The admis- sion to the various courses run by the Institute shall be made by the Principal , from amongst the legible candidates, with the previous approval of the Director .

(a) prepare, print or publish such books , manuals , handbooks , periodicals , instruction sheets , notes, papers or other documents on legal metrology and other branches of knowledge as may be recommended by the Committee;

(b) instal in its premises such equipment and maintain such laboratories as may , in the opinion of the Principal, be necessary for the proper discharge of its functions;

8. Advisory Committee. ( 1 ) The Central Government may constitute an Advisory Committee for advising it in relation to the functions and development of the Institute or in re lation to such other matters concerning the Institute as that Government may consider necessary to refer to the Committee.

(2) The Committee shall consist of the following persons , namely :

(c) prepare and implement schemes to stimulate univer- sities, engineering and technical colleges to impart basic education in legal metrology and allied bran- ches of knowldge to under-graduate , graduato, students , or both; ог post-

(a) the Secretary to the Government of India in the Ministry in charge of the Directorate of Legal Metrology or his nominee , not being an officer below the rank of a Joint Secretary , who shall be the Chair- man;

(d) prepare schemes for studies with regard to the ins- titutional , legal and administrative framework most conductive to the proper implementation of the law relating to legal metrology;

(b) Master, India Government Mint, Bombay, or hia nominee;

(e) establish relations and co-operation with any other agency or organisation , whether in India or outside, which may have a useful function in relation to train- ing in legal metrology .

(d) one person representing the Ministry of Law, Justice and Company Affairs , to be nominated by that Ministry;

(f) establish and maintain a library to encourage study of, and research in, legal metrology and allied bran- ches of knowledge .

5. Other functions of the Institute.-The Institute shall also function as

(f) one person representing the industry manufacturing metrological equipment, to be nominated by the Director:

(a) a metrological laboratory of the level of a reference standard laboratory;

(b) a laboratory for the approval of models ; and

(8) not more than six persons , to be nominated by the Central Government, out of whom

(i) not more than two shall be nominated from amongst persons having knowledge in relation to scientific education or technical matters ;

6. Qualifications of persons to be eligible for admission in the Institute. No person shall be admitted to the Institute unless ho satisfies the requirements of any one of the follow- ing clauses , namely :--

(ii) one representative, to be nominated by the Governments of the States in each of the four Regions and the right to nominate sha'l accrue by rotation to each State in the Region ding to the alphabatical order. accor- (a) that he is employed by the Central or any State Government in any Department dealing with Legal Metrology and either holds

(1) a degree in Science ( with Physics as one of the subjects) , technology or engineering , or

Explanation :-For the purposes of clause (g) , "Region " means such of the States as have been grouped together for the purpose of carrying on liaison work by an Assistant Director of Legal Metrology.

(h) the trainee securing the highest marks in the aggre- gate from out of the batch of trainees who had undergone training in the Institute in the immediately previous year , such trainee shall be a member of the Committee for a period of one year only and on the expiry of the said period , the trainee afore- said shall vacate bris office , and thereupon the trainee securing the highest marks during the year immediately following, shall take place of the trainee who has so vacated his office , and so on ;

( i) Director of Legal Metrology, ex-officio ;

(1) Director General , Indian Standards Institution , New Delhi or his nominee ;

(k) the Principal of the Institute , ex - officio, who shall be the convener of the Committee ;

(3) The Committee may, if it is of opinion that the associa- tion with it of any person is necessary in the interests of the Instituto, co- opt , not more than two persons as its members and the persons so co- opted shall be deemed , for the pригрозев of these rules , to be the members of the Committee and shall have the same rights and privileges as are enjoyed by any other memebr of the Committee.

(4) The Committee shall regulate its own procedure. including the quorum at its meetings , and shall meet at least once in each year at such place and at such time as it may think fit,

(5) The travelling and other expreses of the mem- bers of the Committee for attending any meeting thereof shall be regulated in accordance with such rules , made by the Central Government or, as the case may be , the State Government , which are in force for the time being , in relation to such matters and shall be borne by the authority on whose behalf or at whose instance , the member concerned isattending the meeting .

(6) Save as otherwise provided in sub - rule (2) , the term of office of the members of the Committee shall be three years :

Provided that a member may be renominated for a like period by the authority competent to nominate him under this rule :

Provided further that if the Committee is not reconsti- tuted after the expiry of the term of office of its members , the term of office of its members shall stand extended until the Committee is duly reconsti- tuted under this rule .

(7) The Committee may constitute such working groups as it may think fit to consider such matters as may be entrusted to such working groups .

(8) The Principal shall be the convener of each working group and shall be an ex - oflcio member of each such working group.

(9) The Principal shall provide secretarial assistance to the Committee and also to any working group constituted by the Committee .

(10) A nominated member of the Committee may resign his membership by addressing a letter to the Chairman and on the resignation being accepted, the office of such member shall fall vacant .

( 11) Any vacancy in the Committee caused by the resigna- tion or otherwise shall be filled up in the manner specified in this rule and the person nominated to fill such vacancy shall , save as otherwise provided in sub- rule (2), hold office for the remainder of the term of office of the member in whose place he is so nominated.

(12) No proceeding of the Committee shali be invalid merely by reason of the existence of any vacancy therein or any defect in the constitution thereof .

9. Power of Institute to grant certificates , diplomas. ( 1 ) The Institute may award such certificate of proficiency or dip- loma or honorarium to the person who has successfully com- pleted the training at the Institute , as the Committee may recommend .

(2) The Institute may make payment of honorarium to such persons and at such rates as may be recommended by the Committee .

10. Fees . The Institute may charge fees at the rate spe- cified in the appropriate rules for-

(a) services rendered laboratory ; by it as a reference standard

(b) functioning models; and as a laboratory for the approval of

(c) rendering metrological facilities to the industries , and fees may be charged at different rates for different services rendered by the Institute.
