का०० 298 (अ) के यमग्नर का यह प्रन'नाता है कि वाणिजिक त्राग्ना के उचिन वितरण प्रोग उचिमन पर उपलब्ध करने के लिए ऐपा करनागाश्हे ,
अन , केन्द्रीय सरकार उद्योग ( विपत्म जोर जिनिवगन) अधिनियम, 1951 ( 1951 का 65 ) को बारा 18८ द्वारा प्रदन जत्रियो का प्रत्राय करते हुए, निम्नलिखित गदेण दारतो , अर्थात्
1 मक्षिप्त नाम, विस्तार प्रौर प्रारम्भ ( 1) मदेश सक्षिप्त नाम वाणिज्यिक वाहन ( पुन विनर १२ निवन्धन) प्रादज 1051 है ।
2) रपका विस्तार सपूजन पर ।
(3) यह 9 अप्रैल, 1981 को प्रवृत्त हागा ।
2. परिगपाएइम आदेश में जब तक कि नदर्भ से अन्यया अपेक्षित-
(२) वाणिज्यिक वाहन" गे, अनुसूची के स्तम्भ ( 1 ) में विनिर्दिष्ट वर्णन । काई पोटर वाहन अभिप्रेत हे जिसका विनिर्माण या समज। भारत किया गया है या जिमका विनिर्माण भारत में श्रायातिर यागनपातित तथा नागन भाग्न मे विनिर्मित सघटको से भारत मे किया गया है और इसके अन्तर्गत ऐसे वर्णन का प्रत्येक मोटर वाहन है, चाहे उमका नाम ट्रक चैसिम , बम चैसिस, तीन पहिए की या चार पहिए की गाडी है अथवा चाहे कोई अन्य नाम है ;
(ख) "नियवक" मे, ऐमा व्यक्ति श्रभिप्रेन है जिने केन्द्रीय मरकार न, इस आदश क प्रयाजन व लिए वाणिज्यिक वाहन नियन्त्रक क रूप में नियुक्त किया है,
(ग) किस्सी सथ राज्य क्षेत्र के मवन्ध मे ' गज्य नयार" मे, उमका प्रशासक यभित हे ,
(प) ' अनुसूर्च " मे इस आपदग में उनावद्ध अनुपको अभिनेत है ।
3 वाणिज्यिक जना का पुन विश्व प्रदि न किया जाना ( 1 ) इन प्रदेश के प्रारम्भ वा बसेको काई के जिलने कार्ड वाणिज्यिक वाहन , उन रागख से जय नर वाणिज्यिक के रूप में , उसका प्रथम स्थ, चाहे स्वत्र किन है या उन्ही ओर से किना अन्य व्यक्ति द्वारा किया गत्र हे प्रोर व कमरग प्रारम्भ के पूर्व या पञ्वान् किरः गरड दो वर्ष का मनरुपूत्र नियत्रक के निखिन अनुज्ञापत्र के निर्वन्वनो ओर शत्रो के अधीन और उनके अनुमार हो किमी व्यविन का विरुर करेगा या विक्रय का प्रध्यापन। करेगा या उपके कब्जे के अरण मबधी कोई सञ्चवडर करेगा अपना नहीं । यदि अनुज्ञापत्र मजूर नहीं । हे वा निश्वक लेवे एक के क रंग मन्त्रद्र व्यवेश को ससूचित करेगा ।

( 2) उपखण्ड ( 1 ) के अधीन अनुज्ञापत मजूर या इवार करत ममत्र नियत्रक , यथास्थिति, प्रस्थापित विनय या सत्यवहार से सर्वान्धत परिस्ि तियो ओर इस आदेश द्वारा प्रश्न किए जान वाल प्रयोजनो का ध्यान मे रखेगा ।
( 3) उपखण्ड ( 1 ) के अनुज्ञायव मे गार करने के नियक के आदेश से व्यथित कोई व्यक्ति ऐसी तारीख से जिनको ऐसा इन्य। उसे ससूचित किया जाता है 30 दिन के भीतर सरकार को अपीन कर

परन्तु सरकर यदि उमर ममानान ह । जाता है, कि मर्ग लार्ची के पास उक्त अवश्व के भीतर अत्र प्रस्तुत न करने का पयः तुक था तो वह उक्न 30 दिन की अवधि की समाप्ति के पश्चात् भी अपील ग्रहण, वर सक्ती हे ।
4 जानवारी प्राप्त वरन की शक्तिपद नियनव के पाम यह विश्वास १ ग्न का कारण है कि किन वाणिज्यिक वाहन का खण्ड 3 के उपखण्ड ( 1 ) में निर्दिष्ट दा वर्ष की अवाव की ममाप्नि से पूर्व वित्र्य किया गया है या उसके कब्जे वा अन्नरण किया गया है तो वह उम व्यक्ति मे, जिसने उस प्रकार विाय किया है या कब्जे का अन्तरणक्यिा हे ऐसे विनय या ऐसे कब्जे वे अन्तरण मत्रन्धी सव्यवहार के बारे में, उस व्यक्ति के नाम महित जिमको म पनार वाहन का विक्रय किया गया हे या उसका कब्जाअतरित किया गया है , ऐसे विर्णािष्टया देन की अपेक्षा कर सकेगा जैनी त्यित्रक ठीक समझे ।

((Department of Heavy Industry ) ORDER
New Delhi , the 9th April , 1981
S.O. 298 ( E) Whereas 11 appers to the Central Govern-
ment that it is necessary so to do for securing the equitable distribution and availability at fair puce of commercial veh cles ; Now , therefore , in exercise of the powers conferred by section 18G of the Industries ( Development and Regulation) Act, 1951 ( 65 of 1951 ) , the Central Government hereby makes the following Order , namely
1. Short title , extent and commencement
(1) This order may be called the Commercial Vehicles (Restriction on Re - sale) Order , 1981
(2) It extends to the whole of India
(3) It shall come into force on the 9th day of April . 1981 . 2 Defi nuoης In this Order , inless the context otherwise requires-
(1) "Commercial Vehicles " means a motor vehicle of any desc iption specined in column ( 1 ) of the Schedule , manufactured or assembled in India , or manufactured in India from components imported into India or partly imported and partly manufactured in India, and includes every such description of motor vehicles whether called a truck chassis , bus chassis , three- wheeler , four- wheeler 01 by any other name ,
(2) " Controller " means a person appointed by the Govern- ment to be the Controller of Commercial Vehicles for the purpose of this Order ,
(3) "Government of a state " , in relation to a Union Terri- tory. means the Administrator thereof ,
(4) " Schedule " means the Schedule annexed to this Order .
3. Commercial Vehicles not to be resold , etc ( 1 ) On andfrom the commencement of this Order , no person shall , before the expiry of two years from the date when a commercial vehicles was first purchased as a new commercial vehicles , whether purchased by him or by any person on his behalf and whether purchased before or after such commencement , sell or offer to sell , or enter into any transaction involving the transfer or poss- ession of the commercial vehicle to any other person except under and in accordance with the terms and conditions of a permit, in writing , from the Controller who shall , where a permit is not granted , communicate to the person concerned the reasons for such refusal .
(2) In granting or refusing a permit under sub - clause ( 1 ) , the Concolher sha I have regard to the circumstances relating to the proposed sale or transaction , as the case may be , and to the purposes to be served by this Order
(3 ) Any person aggrieved by the refusal of the controller to grant a permit under sub - clause ( 1 ) may , within 30 days from the date on which the such refusal is communicated to him, prefer an appeal to the Government ;

Provided that the Government may entertain the appeal after the expiry of the said period of 30 days if it is satisfied that the appellant had sufficient cause for not preferring the appeal within the period aforesaid .
4. Power to obtain Inlorination , I the Controllon, has rea- son to believe that a new commercial vehicle has been sold or its possession has been transfened before the expny of the period of two years referred to in sub - clause ( 1 ) of clause 3 , he may require the person , who has so sold or transfered its possession, to furnish the particulars relating to such sale or transaction involving such transfer or possession as the Controller may deem fit, including the name of the person to whom the vehicle was so sold or its possession transferred .
