सा० फा० ति० 290 ( अ) खाच अपमिश्रण निवारण नियम, 1955 को घौर संशोधन करने के लिए कतिपय नियमों का एक प्रारूप, बाद्य अपमिश्रण निवारण अधिनियम , 1984 ( 1984 का 37) की धारा 23 की उपधारा ( 1 ) द्वारा यथा अपेक्षित्र भारत सरकार के स्वास्थ्य भौर परिवार कल्याण मंत्रालय (स्वास्थ्य विभाग ) की अधिसूचना संख्या सा०का ० ति० 1516 तारीख 24 नवम्बर, 1979 के अधीन भारत के राजपत्र , भाग 2 , खाण्ड 3 , उपखण्ड ( i ) तारीख 22 दिसम्बर , 1979 के पृष्ठ 2967-2970 पर प्रकाशित किया गया था , जिसमें उस तारीख को जिसको उक्त राजपत्र की प्रतियां जिसमें उक्त अधिसूचना प्रकाशित हुई थी, जनता को उपलब्ध करा दी गई थी , 60 दिन को समाप्ति के पूर्व उन सभी व्यक्तियों से भाक्षेप और सुझाव भगि गए थे, जिनके उससे प्रभावित होने की सम्भावना है ।

भौर उक्त राजपत्र की प्रतियाँ 14 जनवरी , 1980 को जनता को उपलब्ध करा दी गई थी;

भौर कन्द्रीय सरकार ने उक्त प्रारूप की बाबत जनता से प्राप्त माक्षेपों भौर सुझावों पर विचार कर लिया है;

मतः, केन्द्रीय सरकार , उक्त अधिनियम की धारा 23 की उपधारा (1) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय खाच म.नक

समिति से पर, मर्श करने के पश्चात् वाद्य भपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए निम्नलिखित नियम बताती है, अर्थात् :--

1. ( 1) लियस इन नियमों का संक्षिप्त नाम बाथ अपमिश्रण निवारण (संशोधन) नियम, 1981 है ।

(2 ) ये जवन में प्रकाशन की तारीख को प्रवृत्त होंगे किन्तु इसके नियम 2 ौ 4 (घ) प्रकाशन की तारीख के छह मास पश्चात् प्रवृत्त होंगे ।

2. बाथ अपमिश्रण निवारण नियम , 1935 के जिसे इसमे इसके पश्चात् उक्त नियम कहा गया है, नियम 49 के उपनियम ( 10 ) के पश्चात् निम्नलिखित उपनियम अंतःस्थानित किए जाएंगे, अर्थात्:--

"( 11) कोई भी व्यक्ति खाद्य में उपयोग के लिए ऐसे लेक्टिक एसिड का विक्रय भारतीय मानक संस्थान के चिह्न के अधीन ही करेगा, अन्यथा नहीं-

(12) भट्टी रीति से तैयार किया गया कत्था, "मट्टी कत्या" के रूप में स्पष्टतया चिह्‌नांकित होगा" ;

3. उक्त नियमों के नियम 50 में,

(क) उपनियम ( 1 क ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात्

" ( 1क) एक या अधिक खाद्य वस्तुभो के लिए और एक है। स्थानीय क्षेत्र में भिन्न भिन्न स्थापना या परिसरों के लिए भी अनुज्ञापन अधिकारी द्वारा एक अनुज्ञापत्र जारी किया जाएगा । "

(ख) उपनियम ( 4 ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात्

"(4 ) यदि खाद्य वस्तुएं एक से अधिक स्थानीय क्षेत्ता में स्थित भिन्न भिन्न परिसरों में विनिमित , भंडारित या प्रदर्शित की जाती हैं तो अलग अलग भावेषन किए जाऐंगे और एक ही स्थानीय क्षेत्र में न भाने वाले ऐसे प्रत्येक परिसर के ब्रारे में अलग अनुज्ञप्ति जारी की जाएगी:

परन्तु फेरी लगाकर बेचने वालों को , जिनके कारणार का कोई विनिर्दिष्ट स्थान नहीं है, अनुज्ञापन प्राधिकारी की अधिकारिता के मंदर किसी विशेष स्थान पर कारधार चलाने के लिए अनुज्ञप्त किया जाएगा । "

4. उक्त नियमों के परिशिष्ट व में,

(क) मद क 11.02.08 में "को अनुपातिक रूप से कम किया जाएगा किन्तु वे" शब्दों का लोप किया जाएगा ।

(ख) मद क 16 01 में, "भार में 40,000 भाग में एक भाग (25 भाग प्रति दस लाख) पोटाशियम प्रायोडेट या भार में 50,000 भाग में एक भाग ( 20 भाग प्रति दस लाख ) पोटाशियम भायोडाइट या समतुल्य प्रायोडीन होगा ।" शब्दों, अंकों और कोष्ठकों के स्थान पर "विनिर्माता स्तर पर भायोडेट तत्व 26.3६ भाग मृति बस लाख के रेज में होंगे और वितरण चेनल में जिसमें खुदरा स्तर भी सम्मिलित है, 15 भाग प्रति दस लाख से कम नहीं होगा । " शब्द और अंक रखे जाएंगे ;

(ग) मब क 19.13 और उससे संबंधित प्रविष्टि के पुष्णातु मिम्न- लिखित अंत स्थापित किया जाएगा, अर्थात्:---

"क 16.13 -- मसालेदार घुटनी ममाले द्वार जटमी जैसे मिर्च की चटनी का जत्पावन किसी उपयुक्त किस्म के मसालो में एक या अधिक को मिलाकर प्राप्त की जाएगी । ऐसे मसाले स्वास्थ्यप्रष होंगे भरेर ब्याबहा रिक कुप से सुसरी या कीड़ो के प्रकोप से मुक्त होंगे । जो पदार्थ मिलाए जा सकते हैं , वह हैं- मसाले ताजे या सूबे, चीनी, नमक, सिरका , एसिटिक अम्ल, सिट्रिक अम्ल , य्यूकेरिक अम्ल, टार्टरिक अभ्स, इमली का गुदा या सारक्कृत इमली, मेंलिक अम्ल , प्याज , लहसुन , सुवास कारक, प्रनुज्ञात परिरक्षक , अनुशात स्थायिकारक और पायसी कारर्क । इसमें भुनी चीनीं (कैरामेल) भी हो सकती है किन्तु उसमें कोई कोलतार खाद्य रंग नही ब्राँगे । इसमे थोड़ी मात्रा में सम्जी, फलों का गुषा या उस भी हो सकता

एसिटिक अम्ल के रूप में कुल अम्लता 1.0 प्रतिशत से कम मष्हीं होगी और कुल बुझनशील ठोस पवार्थ भार में 10.00 प्रतिशत से कम नहीं होगे ।""

(स) मद क-21 के अंत में निम्नश्चिणित परन्तुक जोड़ा जाएगा , अर्थात्:--

परम्तु भट्टी कत्था की दशां मै, शुष्क धाधार पर तनु हाइड्रोक्लोरिक भ्रम्स में भूलनमीिल राया 1.6 प्रतिशत से अधिक नहीं होगी । भट्टी करथा को उसी तरह विल्हांकित किया जाएगा जैसा नियम 49 के उप- नियम 11 में अपेक्षित है ।

MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health) NOTIFICATION

New Delhi , the 13th April , 1981

G.S.R. 290 (E) . Whereas certain draft rules further to amend the Prevention of Food Adulteration Rules , 1955 , were published as required by sub- section ( 1 ) of section 23 of the Prevention of Food Adulteration Act, 1954 (37 of 1954) with the notification of Government of India in the Ministry of Health and Family Welfare ( Department of Health) No. G.S.R. 15 16, dated the 24th November , 1979 at pages 2967 to 2975 of the Gazette of India , Part II , section 3 , sub - section ( i ) , dated the 22nd December, 1979 for inviting objections and sugges- tions from all persons likely to be affected thereby before the expiry of 60 days from the date on which the copies of the Official Gazette in which the said notification was published, were made available to the public;

And whereas the copies of the said gazette were made avall- able to the public on 14th January, 1980 ;

And whereas the objections and suggestions received from the public on the said draft rules have been considered by the Central Government .

Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) of the section 23 of the said Act, the Central Government after consultation with the Central Committee for Food Standards , hereby makes thhe following rules further to amend the Prevention of Food Adulteration Rules , 1955 , namely: -

RULES

1. ( i) These rules may be called the Prevention of Food Adulteration ( II Amendment ) Rules , 1981 .

(ii) They shall come into force on the date of their publica- tion in the Official Gazette excent rules 2 and 4 (d) which shall come into force six months after the date of the publication .

2. In the Prevention of Food Adulteration Rules, 1955 hereinafter referred to as the said rules, in rule 49 , after sub- rule ( 10) the following sub- rules shall be inserted, namely :-

(11) No person shall sell lactic acid for use in food except under Indian Standards Institution Marks .

(12) The Katha prepared by Bhatti method shall be con- spicuously marked as Thatti Katha" .

3. In rule 50 of the said rules :-

(a) in sub-rule ( I -A) , after the words " more articles of food" the following shall be inserted namely

"and also for different establishments or premises in the same local ' area."

(b) for sub-rule (4) , the following sub-rule be substituted, namely :

"(4) If the articles of food are manufactured , stored or exhibited for sale at different premises 'situated in more thair one local area, sebarate appli- cations shall be made and a separate licence shall be issued in respect of such premises not falling within the same local area :

Provided that the itinerant vendors who have no specified place of business , shall be licensed to conduct business in a particular area within the jurisdiction the licensing authority .

4. In Appendix B to the said rules ,

(a) in item A. 11.02.08 , in the first paragraph the words 'may be proportionately reduced but" appearing to- wards its end shall be omitted ;

(b) in item A.15.07 , for the words, figures , brackets and letters "one part to 40,000 parts (25 ppm) by weight of potassium jodate or one pert to 50,000 parts (20 ppm) by weight of potassium iodide ог equivalent iodine" , the words , figures and letters "the potassium iodate content shall be in the range of 25-35 ppm at manufacturers level and shall not be 657

less than 15 ppm in distribution channel including retail level" shall be substituted;

"A.16.13-Spices based sauce. Spices based sauce like chillies sauce shall be the product de- rived from any suitable variety of spices ог condiments , singly or in combination . Such spices shall be wholesome and practically free from fungal or insect attack . The only subs- tance that may be added are , spices- fresh or dried, sugar, salt, vinegar , acetic acid, citric acid, fumaric acid , onion, garlic , flavouring agents , per- mitted preservatives , permitted stablizers and emul siflers . It may contain caramel , but shall not contain any coaltar food colour . It may also

contain small quantities of vegetable , fruit pulp or juice.

The total acidity in terms of acetic acid shall not be less than 1.0 per cent and total soluble solids shall not be less than 10.0 per cent by weight. "

(d) in item A 21 , the following proviso shall be added at the end, namely -

"Provided that in case of Bhatti Katha, the ash inso- luble in dilute hydrochloric acid on dry basis shall not be more than 1.5 per cent . The Bhatti Katha be marked as required in sub -rule ( 12) of rule 49,"
