फा० आ० 797 ( अ) केन्द्रीय सरकार, श्रावश्यक वस्तु मधि- निय, 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अपना यह समाधान हो जाने पर कि घरेलू विद्युन मा- धिन्त्रो का विभिर्माण, भण्डारण विक्रय और वितरण का विनियमन करने के लिए ऐसा करना आवश्यक भौर समीचीन है, निम्मलिखित आदेश करती है, अर्थात्
1. संक्षिप्त नाम, विस्तार भौर प्रारम्भ ( 1 ) इस आवेश का संक्षिप्त नाम घरेलू विद्युत माधित्र (क्वालिटी नियंत्रण ) आदेश , 1981 है ।
( 2 ) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।
2. लागू होना यह आदेश ऐसे साधिस्रों की बामन जो भारतीय मानक संस्था ( प्रमाण चिन्ह) अधिनियम, 1952 के अधीन जारी की गई विधिमान्य अनुज्ञप्ति के अधीन मा० सा० स ० चिम्द से चिन्हांकित है , बरेलू विद्युत साधित्तो के विनिर्माताओ को लागू नही होगा ।

3. परिभाषाएं : इस आदेश में, जब तक कि संवर्भ से अन्यथा अपेक्षित न हो
(क) " अधिनियम" से आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10) श्रभिप्रेत है;
(ब) "समुचित प्राधिकारी " से उद्योग निवेशक , नागरिक पूर्ति निदेशक की प्रास्थिति का कोई अधिकारी या इम आदेश के उपबंधों को कार्याम्बित करने के लिए राज्य सरकार द्वारा नियुक्त किया गया समतुल्य प्रास्थिति का कोई अधिकारी अभिप्रेत है ;
(ग) भरेलू विद्युत साधित्तों के संबंध में " व्यवहारी " से अभिप्रेत है यह व्यक्ति जो, या बह फर्म या हिन्दू अविभक्त कुटुम्ब जो प्रत्यक्ष रूप से या अन्यथा, किसी ऐसे साधित का क्रय करने उसका विक्रय करने प्रदाय करने या वितरण करने का कारबार बाहे वह नकद या आस्थगित संवाय के लिए हो या कमीशन , पारिश्रमिक या अश्य मूल्यबान प्रतिफल के लिए हो, चलाता है;
( घ) "घरेलू विद्युत साधित " से अनुसूची के स्तंभ ( 2 ) में विनिविष्ट विद्युत साधिल अभिप्रेत है ;
(ड) घरेलू बिद्युत साधित्तों के संबंध में "विनिर्माता " से अभिप्रेत है वह व्यक्ति जो, या बह फर्म या हिन्दू धविभक्त कुटुम्ब जो, ऐसे किसी साथिन का उत्पादन करता है, बनाता है समंजन

करता है या विनिर्माण करता है और उसके अन्तर्गत ऐसा व्यक्ति या फर्म या हिन्दू अविभक्त कुटुम्ब भी है जो, यथा- स्थिति, ऐसे व्यक्ति या फर्म या हिन्दू अविभक्त कुटुम्ब द्वारा ऐसे विद्युत साधितों का उत्पादन करने , बनाने ,समंजन करने या निर्माण करने का दावा करता है ;
(च) "अनुसूची" से इस आवेश से उपाबद्व अनुसूची अभिप्रेत है;
( छ) अनुसूची के स्तम्भ ( 2 ) में उल्लिखित किसी घरेलू विद्युत
साधित के संबंध में " विनिर्दिष्ट मानक " से उक्त अनुसूची के स्तम्भ ( 3 ) की तत्स्थानी प्रविष्टि में यथा विनिविष्ट मानक अभिप्रेत हैं और इसके अन्तर्गत उक्त साधित के संबंध में समय समय पर भारतीय मानक संस्था द्वारा प्रकाशित मानक भी हैं ,
(ज) "राज्य सरकार " के अन्तर्गत संघ राज्य क्षेत्र प्रशासन भी है ;
4. ऐसे घरेलू विद्युत साधित्तों के विनिर्माण विक्रय आवि का प्रनिषेद्ध जो विनिविष्ट मानक के नहीं हैं:-
( i) कोई भी व्यक्ति स्वयं या उसकी ओर से कार्य करते हुए किसी व्यक्ति द्वारा ऐसे घरेलू विद्युत साधित का विनिर्माण विक्रय के लिए भण्डारण, विक्रय या वितरण नहीं करेगा । जो वि- मिविष्ट मानक के अनुरूप नहीं है ।
( ii) विक्रय के लिए प्रस्तावित या अभिवशित या विक्रीत प्रत्येक घरेलू विद्युत साधित्त में , यथास्थिति, साधिन पर और जहां ऐसा संभव नहीं है उसके पैकेज पर, विनिर्माता का नाम और पता, सहज दृश्य रूप में विया होगा और जहां उपर्युक्त पद्धतियों में से कोई भी व्यवहार्य नहीं है वहां उसके साथ उस प्राशय का प्रमाणपत्र या लेबल होगा और यह घोषणा भी होगी कि साधित विनिदिष्ठ मानना के अनुरूप हैं :
परन्तु इस खंड की कोई भी बात ऐसे घरेलू विद्युत साधित को लागू नहीं होगी जो निर्यात के लिए आशयित है यदि वह ऐसे सा- घिन के क्रय के लिए किसी फर्म की संविदा में. विदेशी क्रेता द्वारा विनिर्दिष्ट किसी अन्य मानक के अनुरूप है जब तक कि वह निर्यात ( क्वालिटी निर्माण भौर निरीक्षण) अधिनियम , 1964 के उपबंधों के जहां भी वे लागू हों, अनुरूप है ।
5. विनिर्माताधों की प्रमाणीकरण: ( i) कोई भी स्वयं याउसकी ओर से कार्य करते हुए किसी व्यक्ति द्वारा , यदि वह पहले से ही विनिर्माता है, किसी घरेलू विद्युत माधित का तब तक विनिर्माण नहीं करता रहेगा जब तक कि उसने तीम मास की अवधि के भीतर उक्त साधित्र के लिए उस राज्य के , जिसमें वह साधित्त का विनिर्माण करता है, समुचित प्राधिकारी से विनिर्माता का प्रमाणपत्र अभिप्राप्त नही कर लिया है ।
( ii) कोई भी व्यक्ति , इसके पश्चात् स्वयं या उसकी ओर से किसी व्यक्ति द्वारा किसी घरेलू विद्युत साधित का विनिर्माण तब तक नहीं करेगा जब तक कि उसने उक्त साधित के लिए उस राज्य के, जिसमें वह साधित का विनिर्माण करने का प्रस्ताव करता है, समुचित प्राधिकारी से विनिर्माता का प्रमाणपत्र नहीं प्राप्त कर लिया है ।
(iii ) समुचित प्राधिकारी किसी भी समय, अच्छे और पयःप्त कारणों से जिन्हें लेखबद्ध किया जाए , एक या अधिक साधितों के लिए विनिर्माता का प्रमाणपत्र प्रतिसंहृत कर सकता है :
परन्तु ऐसा विनिर्माता जिसका प्रमाणपत्र इम प्रकार प्रतिसंहुन किया गया है, ऐसे प्रतिसंहरण के विरुद्ध खण्ड 14 में विनिविष्ट रीति में अपील कर सकता है । विनिर्माता , मथा स्थिति, विनिर्माता के प्रमाणपत्र के प्रतिसंहरण के पश्चात् या ऐसे प्रतिसंहरण के विरुद्ध की गई अपील के अस्वीकृत किए जाने के पश्चात् उस घरेलू बिद्युत साधित का, जिसके लिए इस प्रकार प्रतिसंहृत विनिर्माता प्रमाणपत्र जारी किया गया था , विनिर्माण करना सुरन्त समाप्त कर देगा ।

6. भण्डारण, विक्रय और वितरण का प्रतिषेध कोई भी व्यक्ति रवयं या उसकी ओर से कार्य करते हुए किसने व्यक्ति द्वारा ऐसे किसी घरेलू विद्युत साधित्र का विक्रय के लिए भण्डारण, विक्रय या वितरण नही करेगा, जो किसी ऐसे व्यवित द्वारा विनिर्मित नहीं किया गया है जिसने खंड 5 के अधीन विमिर्माता का प्रमाणपत्र या राज्य सरकार द्वारा इस निमित्त नियत की गई तारीख के पश्चात् भारतीय मानक संस्था प्रमाणन चिन्ह अनुज्ञप्ति अभिप्राप्त कर ली है ।
7. जानकारी श्रादि मंगाने की शक्ति समुचित प्राधिकारी इम भावेश का अनुपालभ सुनिश्चित करने के विश्धार से
(क) किसी घरेलू विद्यत साधित्र के विनिर्माण करने , विक्रय के लिए भण्डार करने विक्रय या वितरण में लगे किसी व्यक्ति से यह अपेक्षा कर सकेगा कि वह उसे ऐसी जानकारी दे जैसा वह किसी घरेलू विद्युत साधिन के विनिर्माण करने , विक्रय के लिए भण्डार करने , विक्रय या वितरण के सम्बन्ध में आवश्यक समझे या जैसा वह इस आदेश के क्रियान्वयन के लिए आवश्यक समझे या किसी व्यक्ति से किसी घरेलू विद्युत साधित्र के नमूने या किसी घरेलू विद्युत साधिन्न के संघटक देने की अपेक्षा कर सकेगा ;
(ख) किसी घरेलू विद्युत माधिन के विनिर्माण करने, विक्रय के लिए भण्डार करने , विक्रय या वितरण में लगे किसी व्यक्ति द्वारा रखी गई या उसकी या उसके कब्जे या नियंत्रण के अधीन की किम्हीं पुस्तकों या अन्य वस्तावेजों या किसी घरेलू माधित्त या किमी घरेलू विद्युत साधित्र के संघटको का निरीक्षण कर सकेगा या करवा सकेगा ;
(ग) खण्ड 12 के अधीन प्राधिकृत किसी अधिकारी से किसी परिसर में प्रवेश और तलाशी करवा सकेगा और किसी धरेलू विद्युत साधिप्त का, जिसके बारे मे उसके पास विश्वाम करने का कारण है कि इस आदेश का उल्लंघन हुआ है या वह विनिर्विष्ट मानक का नही है, अभिग्रहण कर सकेगा;
(घ) तलाशी और अभिग्रहण को संबंधित दण्ड प्रक्रिया संहिता , 1973 (1973 का 2) की धारा 100 के उपबंध , जहां तक संभम हो इस खंड के अधीन तलाशी और अभिग्रहण को लागू होंगे ।
8. नमूनों का परीक्षण जहां समुचित प्राधिकारी की यह गय है कि यह अभिनिश्चित करने के लिए ऐमा करना आवश्यक है कि कोई घरेलू विद्युत उपस्कर विनिर्दिष्ट मामक का है या नही, वहां वह ऐसे विद्युत माधित्र के विनिर्माण करने , विक्रय के लिए भंडार करने विक्रय या वितरण लगे किसी व्यक्ति से, उस ( साधित्त्र ) के तीन नमूने ले सकेगा जिनमें से यथास्थिति, एक परीक्षण के लिए होगा एक मुहबन्द किया जाएगा और समुचित प्राधिकारी के पास रखा जाएगा एक विनिर्माता या व्यवहारी के पास छोड़ दिया जायगा ।
( ii) सभी सीमों नमूने ऐसे विद्युत साधित्र के विनिर्माण , विक्रय के लिए मंजूर करने या वितरण में इस प्रकार लगे हुए व्यक्ति या उसके प्राधिकृत प्रतिनिधि की उपस्थिति में मुहरयश्व किए जाएंगें । इस प्रकार लिए गए नमूनों की बाबत ऐसे व्यक्ति को ऐसे प्ररूप में , जो समुचित प्रा- धिकारी विनिदिष्ट करे , एक रसीद दी जाएगी और समुचित प्राधिकारी उस व्यक्ति को, यदि नमूने विनिर्दिष्ट मानक के अनुरूप होंगे विद्युत साधित्त की कीमत का संदाय करेगा या अम्यथा नमूने समपहृत कर लिए जाएंगे ।
(iii) जहां समुचित प्राधिकारी उपनियम ( i) के अधीन घरेलू विद्युत साधित का कोई ममुना लेता है वहां वह, यह सुनिश्चित करने के लिए कि नमूना विनिर्दिष्ट मानक के अनुरूप है या नहीं उसे परीक्षण के लिए, भारतीय मानक संस्था द्वारा अनुमोदित किसी प्रयोगशाला की सुरन्त परिवत्त करेगा । परीक्षण प्रभारों का संदाय , समुचित प्राधिकारी द्वारा किया जाएगा ।

अभिग्रहण की शक्तियो का प्रयोग करने के लिए समुचित प्राधिकारी द्वारा प्राधिकृत नही किया जाएगा ।
( IV.) सनुचिन प्राधिकारी , प्रत्येक मामले में यह सुनिश्चित करने के लिए कि साधित्त्र विनिर्दिष्ट मानक के अनुरूप है या नही, यह अवधारित करेगा कि किपी विशिष्टि साधित्त्र को बाबत कौन से परीक्षण किए जाने चाहिए । प्रत्येक विनिर्माता के हर प्रकार के साधित्त्रो की बाबत इस प्रकार किए गए परीक्षणो और उनके परिणामो का समुचित प्राधिकारी द्वारा निरतर अभिलेख रखा जाएगा
13. सूचना देने की बाध्यता कोई भी विनिर्माता या व्यवहारी , इस आदेश के उपबधो से बचने के आशय मे, खड 7 के अधीन उसते विधिपूर्वक मागी गई सूचना देने से इकार नही करेगा या ऐते व्यक्ति द्वारा रखे गए या ऐसे व्यक्ति के कञ्जे में या नित्रवण मे किती बहो या दस्तावेज याकिसो घरेलूविद्युत साधित को न दिखाएगा, न नष्ट करेगा , न विकृत करेगा और न विरूपित करेगा ।
14 अपील (1) समुचित प्राधिकारी के क्रिमी विनिश्चय से व्य- थित कोई विनिर्माता या व्यवहारी, ऐसे विनिश्चय की ससूचना देने वाले आदेश की प्राप्ति की तारीख से 30 दिन के भीतर अपील प्राधिकारी को, जो राज्य सरकार अधिसूचित करे, लिखित रूप मे अपील कर सकेगा:
परन्तु यदि विनिर्माता उस राज्य से जिसमे किसी व्यवहारी से नमूना लिया गया है, भिन्न राज्य का है तो नमूना लेने वाला समुचित प्राधिकारी विनिर्माता से सीधे पत्न-व्यवहार नही करेगा कितु परीक्षण रिपोर्ट उस राज्य के, जिसमे विनिर्माता रजिस्ट्रीकृत है ममुचित प्राधिकारी को ससूचित करेगा और पश्चात्वर्ती प्राधिकारी , विनिर्माता को इस आदेश के उपबंधो के श्रनुनार आवश्यक निर्देश देगा ।
परन्तु अपील प्राधिकारी पूर्वोक्त अवधि के अवसान के पश्चात् भी कोई अपील स्वीकार कर सकता है यदि उसका यह समाधान हो जाता है कि समय के भीतर अपील फाइल करने से अपीलार्थी पर्याप्त कारणो से निवारित हो गया था ।
(V) उन-खट ( III ) मे निर्दिष्ट प्रयोगशाला का भारमाधक प्राधि कारी , यह अवधारित करने के लिए कि नमूना विनिर्दिष्ट मानक के अनुरूप है या नही, आवश्यक परीक्षण करेगा या कराएगा और परीक्षण की रिपोर्ट तीन प्रतियो मे ऐसे प्ररूप मे, जो समुचित प्राधिकारी विनिर्दिष्ट करे, परीक्षण के लिए नमूना भेजने वाले प्राधिकारी को भेजेगा ।
( II) उपखंड ( I) के अधीन अपील की प्राप्ति पर, अपील प्राधिकारी , अपीलार्थी को सुनवाई का अवसर देने के पश्चात्, ऐसा आदेश पारित कर सकेगा जो वह ठीक समझे ।
(VI ) यदि आवश्यक हो ता परीक्षण-प्रयोगशाला समुचित प्राधिकारी के पास उपलब्ध दूसरा नमूना मगा सकेगा या विनिर्माता अथवा व्यवहारी अपने पास छोडे गए नमूना पर परीक्षण के लिए कह सकेगा और परीक्षण, विनिर्माता या व्यवहारी या उसके प्राधि- कृत प्रतिनिधि और एक सप्रेक्षक की उपस्थिति में किया जा सकेगा ।
15. शास्ति कोई भी व्यक्ति, जो इस आदेश के किन्हो अबंधों का या विनिर्माता प्रमाणपत्त्र के किसी निबधन और शर्तों का उल्लघन करेगा , या उनके अधीन किए गए किसी निदेश या अध्यपेक्षा को पूरा करने में अभफल रहेगा , तो वह दडनीय होगा और वह सपत्ति, जिनको बाबत ऐसा उल्लघन हुआ है, आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10) की धारा 7 के अधीन समपहृत की जाने का दायी होगो ।
16. निरसन घरेलू विद्युत साधित्त (क्वालिटी नियत्रण) आदेश , 1976, सिवाय वहा तक के जहा तक कोई कार्रवाई पहने हो की जा चुकी है, इसके द्वारा निरसित किया जाता है ।

घरेलू विद्युत साधित्त 9 ऐसे क्सिी घरेलू विद्युत सावित्त के व्ययन का प्रतिशेष करने की शक्ति जो विनिर्दिष्ट मानक के अनुरूप नही है ( 1) जहा खड 8 के उपखड ( 5 ) के अधीन प्राप्त परीक्षण रिपोर्ट के आधार पर सनुचित प्राधिकारी का यह समाधान हो जाता है कि कोई घरेलू विजुन साधित्र विनिदिष्ट मानक का नही हे और उन की त्रुटि दूर की जा सकती है वहा ऐसे साधित्त्र के विनिर्माण, विक्रय के लिए भडार करने, विक्रय या वितरण मे लगे व्यक्ति को उस त्रुटि के दूर करने के लिए और जबतक मनुचिन प्राधिकारी द्वारा ऐमा करने के लिए प्राधिकृत न किया जाए ऐने साधित्रो का व्ययन न करने का निदेश दे सकेगा ।

ORDER
New Delhi , the 12th November , 1981
S.O. 797 (E) . In exercise of the powers conferred by sec- tion 3 of the Essential Commodities Act, 1955 (10 of 1955) , the Central Government, being of the opinion that it is neces- sary and expedient so to do for regulating the manufacture , store, sale and distribute the household electrical appliances hereby makes the follwoing order , namely :-
1. Short title , extent and commencement :-( 1 ) this order may be called the Household Electrical Appliances (Quality Control) Order, 1981 .
(2) It shall come into force on the date of its publication in the official Gazette .
2. Application :--It shall not apply to the manufacturers of household electrical appliances in respect of such appli ances which are marked with ISI Mark under a valid licence issued under the ISI (Certification Marks ) Act , 1952 .
3. Definitions : In this order , unless the context otherwise requires-
(a) "Act " means the Essential Commodities Act, 1955 (10 of 1955).
(b) "Appropriate Authority " means apy officer of the rank of Director of Industries, Director of Civil Supplies or any officer of equivalent rank appointed by the State Governmentto implement the provisions of this order ;
(c) "dealer" in relation to bousehold electrical appliances means a person who , or a firm or a Hindu undivided family which , carries on, directly or otherwise , the business of buying , selling , supplying or distributing any such appliance , whether in cash or for deferred payment or for commission , remuneration or other valuable consideration;
(d) "household electrical appliances " means the electri- cal appliances specified in column (2) of the Schedule;
(e) "manufacturer" in relation to household electrical appliances means a person who , or a firm or a Hindu undivided family which , produces , makcs , assembles or manufactures any such appliances and includes a person who or a firm or Hindu undivided family which claims such appliances to be produced, made , assembled or manufactured by such person or firm or Hindu undivided family , as the case may be;
(f) " Schedule " means the Schedule annexed to this order भारत का राजपत्र असाधारण

(g) "specified standard" in relation to a household electri- cal appliance mentioned in column (2) of the Schedule means the standard as specified in the corresponding entry in cloumn ( 3 ) of the said Schedule and includes the standard published by the Indian Standard Institution from time to time in relation to that appliance;
(h) "State Government " includes a Union Territory Admi nistration .
4. Prohibition of manufacture , sale, etc. of household electrical appliances which are not of the specified standard- (i ) No person shall himself or by any person acting on his behalfmanufacture , store for sale , shall or distribute any house- hold electrical appliance which does not conformto the specі- fied standard .
(ii ) Every household electrical appliance offered or exposed for sale or sold shall bear conspicuously on the appliance and where it is not possible on the package as the case may be , the name and address of the manufacturer and where none of the above modes is practicable it shallbe accompanied by a certificate or label to that effect and also a declaration that the appliance conforms to the specified standard .
Provided that nothing in this clause shall apply to any house- hold electrical appliance which is intended for export if it con- forms to any other standard specified by the foreign buyer in afirm contract for the purchase of such appliance so long as it is in conformity with the provisions of the Export ( Quality Control and Inspection) Act 1963 wherever applicable .
5. Certification of manufacturers ( i ) No person shall himself or by any person acting on his behalf if he is already a manufacturer continue to manufacture any household electrical appliance unless he has obtained a Manufacturer's Certificate for the said appliance from the Appropriate Authority of the State in which he manufactures the appliance within a period of three months .
(ii) No person shall hercafter himself or by any person on his behalf manufacture any household electrical appliance unless he has obtained a Manufacturer's Certificate for the said appliance from the Appropriate Authority of the State in which he proposes to manufacture the appliance .
(iii ) The Appropriate Authority may at any time revoke a Manufacturer's Certificate for any one or more of the ap- pliances for good and sufficient reasons to be recorded in writing.
Provided that the manufacturer whose certificate has been so revoked may prefer an appeal against such revocation in the manner specified in clause 14. After the revocation of the Manufacturer's Certificate or as the case maybe after rejection of the appeal against such revocation the manufacturer shall forthwith cease to manufacture the household electrical appli- ance for which the Manufacturer's Certifcate so revoked had been issued .
6. Prohibition of storage sale anddistribution :-No person shall himself or by any person acting on his behalf store for sale sell or distribute any household electrical appliance which has not been manufactured by a person who has obtained Manufacturer's Certificate under clause 5 or an Indian Standards Institution Certification Mark Licence after the date appointed in this behalf by the State Government .

7. Power to call for information etc : The Appropriate Authority may with a view to socuring compliance with this order-
(a) require any person engaged in the manufacture storage for sale, sale or distribution of any household electri- cal appliance to give such information as it deems necessary in relation to the manufacture storage for salo , sale or distribution of any household electrical appliance for the implementation of this order or re- quire any such person to furmish to it samples of any household clectrical appliance or any component of any household clectrical appliance;
b) inspect or cause to be inspected any books or other documents or any household electrical appliance or the components of any household electrical appliance kept by or belonging to or in the possession or under the control of any person engaged in the manufacture storage for sale , sale or distribution of any household electrical appliance ;
(c) cause an officer authorised under clause 12 to enter and search any promises and seize any household electrical applianco in respect of which it has reason to believe that a contravention of this order has been committed or the said appliance is not of the specified standard;
(d the provisions of section 100 of the Code of Criminal Procedure 1973 (2 of 1974) relating to search and seizure shall so far as may be apply to searches and seizure under this clause.
8. Testing of samples :-( i ) Where the Appropriate Autho- rity is of the opinion that it is necessary so to do for the purpose of ascertaining whether any household electrical appliance is of the specified standard it may take from any person engaged in the manufacture storage for sale , sale or distribution of any such electrical appliance three samples thereof-one to be tested , one to be scaled and kept with the Appropriate Authority and one to be left with the manufacturer or the dealer as the case may be .
(ii) All the three samples shall be sealed in the presence of the person so engaged in the manufacture, storage for the sale or distribution of such electrical appliance or his authorised representative . A receipt in such form as may be specified by Appropriate Authority shall be given to such person in res- pect of the samples so taken and the price of the electrical appli- ance shall be paid by the Appropriate Authority to such person if the samples conform to the specilied standard otherwise the samples shall be forfeited.
(iii ) Where the Appropilate Authority has taken any sample of household electrical appliance under sub -clause ( i ) it shall deliver the same forthwith for testing to any laboratory approved by the Indian Standards Institution to ascertain whether the sample is of the specified standard . The testing charges will be paid by the Appropriate Authority .
( iv) The Appropriate Authority may decide in each case what tests should be performed by a laboratory in respect of a particular appliance in order to ascertain whether the appliance conforms to the specified standard. A continuous record of the tests so performed and the results thereof in respect of each type of appliance of each manufacturer shall be maintained by the Appropriate Authority :
Provided that if the manufacturer belongs to a State diffe- rent from the State in which a sample has been drawn from a dealer the Appropriate Authority drawing the sample will OF

not communicate directly with the manufacturer but till communicate the test report to the Appropriate Authority of the State wherein the manufacturer is registered and the latter Authority will give necessary directions to the manu- facturer in accordance with the provisions of this Order.
(v) The officer in charge of the laboratory referred to in sub - clause (iii ) shall carry out or cause to be carried out tests necessary to determine whether the sample conforms to the specified standard and give a report on the result of the tests in triplicate to the authority sending the sample for test in such form as may be specified by the Appropriate Authority.
(vi) Ifnecessary the testing laboratory may call for the second sample available with the Appropriate Authority; or the manu- facturer of the dealer may ask for a test on the sample left with him and the test may be carried out in the presence of the manufacturer or dealer or his authorised representative and an observer .
9. Power to prohibit disposal of any household clectrical appliance not conforming to specified standard: ( i ) where theAppropriate Authority is satisfied on the basis of a test report received under sub -clause (v ) of clause 8 that any household electrical appliance is not of the specified standard and the defect can be removed he may direct the person engaged in the manufacture storage for sale sale or distribution of suuh app- liance to remove the defect and not to dispose of such appli- ances until authorised by the Appropriate Authority to do so .
(ii) Where the Appropriate Authority is satisfied that the defect in the appliance cannot be removed , he may direct the person engaged in the manufacture , storage for sale , sale or distribution of such appliance to withdraw forthwith the appliance from the market .
10. Power to issue direction to manufactures and dealers- The Appropriate Autority may issue such directions to manu- facturers and dealers , consistent with the provisions of this Order , as may be necessary in carrying out the purposes of this Order .
11. Compliance of directions -Every person engaged in the manufacture , storage for sale , sale or distribution of any house- hold electrical appliance , to whom any direction is issued under this order shall comply with such direction .
12. Delegation of power- The Appropriate Authomy my, by general or special order in writing , authorise any officer to exercise on its behalf all or any of its functions under this Order ; Provided that no officer who is not of a Gazetted rank shall be authorised by the Appropriate Authority to exercise the powers of search and seizure under paragraph ( c ) of sub - clause ( 1 ) of clause 7.
13. Obligation to furnish information No manufacturer or dealer shall with intent to evade the provisions of this Order refuse to give any information law fully demanded from him under clause 7 or conceal , destroy, mutilate or deface any books or documents or any household electrical appliance kept by such person or in the possession or control of such person .

the appellant was preventedby sufficient cause from filing the appeal in time .
(ii ) Onreceipt of the appeal under sub - clause (i) , the Appellate Authority may, after giving the appellant an opportunity of being heard , pass such order as it may deem fit .
15. Ponalty-Any person who contravenes any of the pro- visions of this Order or of the terms and conditions of the Manufacturer's Certificate , or fails to carry out any direction or requisition made thereunder shall be punishable and the property in respect of which the order has been contravened , shall be liable to forefeiture under section 7 of the Essential Commodities Act , 1955 ( 10 of 1955) .
16. Repeal The Household Electrical Appliances ( Quality Control ) Order , 1976 is hereby repcaled , save in so far as any action already taken .

14. Appeal--( 1 ) Any manufacturer or dealer aggrievedby any decision of the Appropriate Authority may appeal in writing to the Appeleate Authority , as may be notified by the State Government concerned , within 30 days from the date of receipt by him of the copy of the Order communicating such decision :
Provided that the Appcleate Authority may admit any appeal after the expiry of the period aforesaid if it is satisfied that
