आ. अ. ৪৪ ( ম) : जबकि भारत के निर्बाचन आयोग से. , अपनी तारीख 20 जून , 1981 की अधिसूचना द्वारा , उत्तर प्रदेश राज्य के 2 - गढ़बाल संसदीय निर्वाचन क्षेत्र से हुए उप- निर्वाचन को रद्द कर दिया था , जिसका कि कार्यक्रम निर्वाचन आयोग के तारीख 6 मई , 1981 की अधिसूचना सं. 100/उ . प्र. लो. स. /4/80 (2) द्वारा अभिसूचित किया गया था ।
और जबकि 29 सितम्बर , 1981 की एक परिवर्ती अधिसूचना सं . 100/ ज. प्र.-लो. स. /4/80 (2) द्वारा , आयोग ने पूनः मतदान की तारीत 22 नव- म्बर , 1991 तथा 30 नवम्बर , 1981 वह तारीख जिसके पूर्व उक्त निर्वाचन समाप्त कर दिया जाएगा , निश्चित की थी ।

और जबकि अपने तारीख 14 नवम्बर , 1981 के आदेश में बताए गए कारणवंश , आयोग ने पुनः मतदान की उपरोक्त तारीख को रद्द कर दिया है ।
अब , इसलिए , संविधान के अनुच्छेद 324 और लोक प्रतिनिधित्व गधि- नियम , 1951 की धारा 153 को उक्त अधिनियम की धारा 30 के साथ पढ़ते हुए तथा उस बारे में उसे समर्थ बनाने वाली अन्य सभी शक्तियों का प्रयोग करते हुए , निर्वाचन आयोग एलद्वारा पुनः मतदान की निश्चित तारीख 22 नव- म्बर , 1981 को रद्द करता है और यह निदे देता है कि इस निर्वाचन क्षेत्र के सभी मतदान केन्द्रों पर नया मतदान , उसके द्वारा निकट भविष्य में निश्चित की गई तारीख को , होगा और इस हेतु अपनी तारीख 6 मई , 1981 की संशोधित की गई अधिसूचना संख्या 100/उ . प्र. लो. स./4/80 (2) में निम्नलिखित संशोधन करता है ;
विद्यमान खण्ड ( घ) और (ङ) के स्थान पर निम्नलिखित सण्ड रखा
जाएगा , अर्थात् : -
" (घ) वह तारीख जिसके पूर्व निर्वाचन समाप्त कर दिया जाएगा" ।

NOTIFICATION
Now Delhi , the 21st November , 1981
Ο.Ν. 86( E ) .-Whereas the Election Commission of India, by its notifica tion dated the 20th June 1981 , had cancelled the poll taken at the bye-cloction from 2 -Garhwal Parliamentary Constituency in the State of Uttar Pradesh the programme for which had been notified by the Election Commission in it notification No. 100 UP - HP ( 4/80(2 ) , dated the 6th May , 1981 ;
And whereas , by a subsequent notification No. 100 / UP - HP/4/80(2 ) dated 29th September 1981 , the Commission fixed the 22nd November 1981 as the date of repoll and 30th November 1981 as the date before which the said election shall be completed;
And whereas for the reasons stated in its order dated the 14th November 1981 , the Commission has cancelled the aforesaid date of repoli :

Now, therefore , in exercise of its powers tinder article 324 of the Consti- tution, section 153 of the Representation of the People Act, 1951 read with section 30 of that Act and all other powers enabling it in that behalf , the Election Commission hereby cancels the date of repoil fixed on the 22nd November 1981 and directs that a fresh poll shall be taken at all the polling stations in the constituency on a date to be fixed by it in due course and for this purpose makes the following amendments in its notification No. 100 / UP - HP / 4/ 80(2 ) , dated the 6th May 1981 , as amended;
For the existing clauses (d) and ( e) , the following clause shall be substitut namely,
"(d) the 30th June, 1982 (Wednesday) , as the date before which the Elec- tion shallbe completed" .
