का० आ० 880 ( म) केन्द्रीय सरकार , उद्योग (विकास और विनि- यमन) अधिनियम, 1951 की धारा 6 की उपधारा ( 2 ) के साथ पठित धार । 30 की उपधारा ( 2 ) के खण्ड ( क ) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए विकास परिषद् ( प्रक्रिया सम्बन्धी ) नियम, 1952 का कतिपय भौर संशोधन करता चाहती है । जैसा कि उक्त धारा 30 की उपधारा (1) में अपेक्षित है, प्रस्थापित संशोधनों का निम्नलिखित प्रारूप उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जा रहा है, जिनके उससे प्रभावित होने की सम्भावना है । इसके द्वारा सूचना दी जाती है कि उक्त प्रश्प पर इस अधिसूचना के राजपत्र में प्रकासन की तारीख से साठ दिन के अवसान पर या उस के पश्चात् विचार किया जाएगा ।
इस प्रकार विनिविष्ट अवधि से पूर्व नियमों के उक्त प्रारुप की बाबत जो की आक्षेप या सुझाव किसी व्यक्ति से प्राप्त होंगें, केन्द्रीय सरकार उन पर विचार करेगी ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम विकास परिषद् ( प्रक्रिया सम्बन्धी ) दूसरा संशोधन नियम, 1981 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. विकास परिषद् (प्रक्रिया सम्बन्धी ) नियम, 1952 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 2 में,
(1) खण्ड (क) के स्थान पर निम्नलिखत खण्ड रखा जाएगा, अर्थात:--
" (क) 'अध्यक्ष' से इन नियमों के अधीन नियुक्त या निर्वाचित किया गया कोई अध्यक्ष अभिप्रेत है ; "
( 2) खण्ड (ग ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्:-
"( ग) ' सवस्य -सचिव' से किसी विकास परिषद् के सचिव के कृत्यों को करने के लिए केन्द्रीय सरकार द्वारा नियुक्त किया गया अधिकारी अभिप्रेत है; " मौर
( 3) खण्ड ( ङ) का लोप किया आएगा ।
3. उक्त नियमों के नियम 3 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्
" 3. सदस्यों की संख्या प्रत्येक परिषद् में पच्चीत से अनधिक सवस्य होंगें , जिनके अन्तर्गत अध्यक्ष भौर सचिव-सवस्य भी हैं,"
4. उक्त नियमों के नियम 4 के स्थान पर निम्नलिखित नियम रखा जाएगा, भर्थात्:-
" 4. अध्यक्ष ( 1 ) किसी परिषद् का पहला अध्यक्ष केन्द्रीय सरकार द्वारः उस परिषद् के सदस्यों में से नियुक्त किया जाएगा और अपनी नियुक्ति की तारीखा से दो वर्ष की अवधि के लिए पद धारण करेगा और तत्पश्चात् अध्यक्ष या तो केन्द्रीय सरकार द्वारा नाम

NOTIFICATION
New Delhi, the 3rd December, 1981 ( 2) अध्यक्ष, भारत सरकार के, उद्योग मंत्रालय (औद्योगिक विकास विभाग) के सचिव को सम्बन्धित पत्त्र द्वारा और उसकी एक प्रति सम्बद्ध विकास परिषद् के सदस्य सचिव को भेज कर अपने पद से त्यागपक्ष दे सकेगा ।
S.0 880 (E) . The following draft of certain rules further to amend the Development Councils ( Procedural) Rules , 1952, which the Central Government proposes to make in exercise of the power conferred by clause ( a ) of sub- section (2) of section 30, read with sub-section ( 2 ) of section 6 , of the Industries ( Development and Regulation) Act , 1951 (65 of 1951 ), are hereby published as required by sub - section ( 1 ) of the said section 30, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration on or after the expiry of a period of sixty days from the date of publi- cation of this notification in the Official Gazette .
(3 ) अध्यक्ष, के पद से ऐसे त्यागपत्र देने से हुई रिक्ति केन्द्रीय सरकार द्वारा , परिषद् के किसी अन्य सदस्य की अध्यक्ष के रुप में नियुक्ति करके भरी जाएगी भौर इस प्रकार नियुक्त अध्यक्ष उतने समय तक पद धारण करेगा जितने समय तक वह अध्यक्ष जिसका स्थान वह भरता है , यदि उसने त्यागपत्त्र न दिया होता तो पद धारण करने का हकदार होता । "
Any objections or suggestions which may be received from any person in respect of the said draft before the expiry of the period so specified will be taken into consideration by the Central Government .
DRAFT RULES
5. उक्त नियमों के नियम 10 के उप-नियम ( 2 ) और उपनियंम ( 4) में, "अध्यक्ष या अध्यक्ष की अनुपस्थिति में उपाध्यक्ष " शब्दों के स्थान पर , जहां कहीं भी वे आते हैं, "अध्यक्ष " शम्य रखा जाएगा ।
6. उक्त नियमों के नियम 12 में,
1. (1) These Rules may be called the Development Councils (Procedural) Second Amendment Rules , 1981 .
(2) They shall come into force on the date of their final publication in the official Gazette .
(i) उपनियम ( 1 ) में, " अध्यक्ष या अध्यक्ष की अनुपस्थिति में उपाध्यक्ष" शब्दों के स्थान पर "अध्यक्ष " शब्द रखा जाएगा ;
2. In rule 2 of the Development Councils (Procedural) Rules , 1952 (hereinafter referred to as the said rules ) ,一 (ii) उपनियम ( 3 ) में, " या उपाध्यक्ष की, जहां बैठक की अध्यक्षता, उपाध्यक्ष कर रहा है" शब्दों का लीप किया जाएगा ।
(i ) for clause ( a) , the following clause shall be sub- stituted, namely :-
7. उक्त नियमों के नियम 13 में, -
'(a) "Chairman " means a Chairman appointed or elect- ed under these rules ;"
(i) उप नियम ( ii) के स्थान पर निम्नलिखित उपनियम रखा जाएगा अर्थात्:-
(ii) for clause (c) , the following clause shall be sub- stituted , namely :-
'(c) "Member- Secretary" means the officer appointed by the Central Government to carry on the func- tions of the Secretary to a Development Council ;' and
" ( 1 ) परिषद् की बैठक की अध्यक्षता अध्यक्ष भौर उसकी अनु- पस्थिति में, उपस्थित सदस्य अपने में से एक को अध्यक्ष निर्वाचित कर लेंगें ; "
( iil) clause (e) shall be omitted.
( ii ) उपनियम ( 4) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात्: --
3. For rule 3 of the said rules, the following rule shall be substituted, namely :--
"3. Number of members .- Every Council shall consist of not more than twenty five members including the Chairman and the Member-Secretary." " ( 4) परिषद् के प्रत्येक सवस्य का एक मत होमा भौर परिषद् द्वारा विभिश्चय किए जाने वाले किसी प्रश्न पर मतों के बरा बर होने की दशा में अध्यक्षता करने वाले अध्यक्ष या उपाध्यक्ष का मंत निर्णायक मत होगा ।" ।
4. For jule 4 of the said rules , the following rule shall be substituted, namely :-
8. उक्त नियमों के नियम 15 के उपनियम ( 1 ) मैं "या उपाध्यक्ष" शब्दों का जहां कहीं भी ने आते हैं, लोप किया जाएगा ।
"4. Chairman,-( 1 ) The first Chairman of a Council shall be appointed by the Central Government from amongst the members of that Council and shall hold office for a period of two years from the date of his appointment, and thereafter the Chairman shall be either nominated by the Central Government or elected by members of that Council as may be decided by the Central Government on each occasion.

(2) The Chairman may resign his office by a letter ad- dressed to the Secretary to the Government of India, Ministry of Industry (Department of Industrial Development) with a copy endorsed to the Member- Secretaryto the Development Council concerned.

(3) The vacancy caused in the office of the Chairman by such resignation shall be filled by appointment by the Central Government of another member of the Council as Chairman , and the Chairman o appointed shall hold office for so long as the Chair- mán whose place he fills would have been entitled to hold the office, had he not resigned." .

(ii) for sub- rule ( 4) , the following sub- rule shall be substituted, namely : -
5. In rule 10 of the said rules , in sub- rule (2) and sub- rule (4), for the words "the Chairman or, in the absence of the Chairman , Vice -Chairman " , wherever they occur, the word "Chairman" shall be substituted.
6. In rule 12 of the said rules,-
"(4) Each member of a Council shall have one vote and if there shall be an equality of votes on any question to be decided by a Council , the Chair- man or the member presiding shall have a casting vote.".
( i) in sub - rule (1 ) , for the words " Chairman or, in the absence of the Chairman , the Vice -Chairman" , the word "Chairman" shall be substituted:
8. In rule 15 of the said rules , in sub -rule ( 1) , the words "or Vice-Chairman ", wherever they occur , shall be omitted.
( ii) in sub - rule (3 ) , the words " or where the Vice- Chairman is presiding over the meeting , of the Vice- Chairman" shall be omitted.
Note -Principal rules published vide notification No. S.R.O. 359 , dated the 19th February, 1953 , Gazette of India, Extraordinary , 1953 , Part II - Section 3 , dated the 19th Septem- ber , 1953 , pages 467-469 .
7. In rule 13 of the said rules,-
( 1) for sub -rule ( 1 ) , the following sub- rule shall be substituted , namely :-
Subsequently amended by notification No. S.O. 42 (E ) , dated the 21st January , 1981 , Gazette of India, Extraordinary, 1981, Part- II - Section 3 (ii ) , dated the 21st January, 1981 pages 94 and 95.
"(1) The Chairman shall preside over the meetings of Council and in his absence the members present shall elect a Chairman from amongst themselves .";
