डा०मा० 892 ( प्र) -माक खानों में नियोजित कर्मचारियों के प्रवदों को संवेयः मजदूरी की म्यूनतम दरों के पुनरीक्षण के लिए कुछ प्रस्थापनाएं , ब्यूनसभ मजबूरी अधिनियम , 1948 ( 1948 का 11 ) की नाच 5 की उपधारा ( 1 ) के खंड ( ख) की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए, जिनके उनसे प्रभाबित होंगे की संभावना थी, भारत सरकार के श्रम मंत्रालय की अधिसूचना सं ० का०पा० 427 (日) तारीख 10 जून, 1981 के अधीन , भारत के राजपत्र असाधारण भाग 2. खंड 3, उपखंड (ii) तारीख 10 जून , 1981 के पृष्ठ 723-24 पर प्रकाशित की गई थीं । उक्त व्यक्तियों से उक्त अधिसूचना के राजपत में प्रकालत की तारीख से दो मास की अवधि के प्रवसात तक श्राक्षेप और सुझाथ मांगे गए थे ;
और उक्त राजपत्र 10 जून, 1981 को जनता को उपलब्ध करा कियागया था ;
भौर केन्द्रीय सरकार ने उक्त प्रस्थापनार्थों के संबंध में प्राप्त प्राक्षेपों कौर सुझावों पर विचार कर लिया है ;
अतः, केद्रीय सरकार, न्यूनतम मजदूरी अधिनियम, 1948 ( 1948 का 11 ) की धारा 4 की उपधारा ( 1 ) के खंड ( iii ) और धारा 8 को उपधारा ( 2 ) के साथ पठित , धारा 3 की उपधारा ( 1 ) के खंड (ख) द्वारा प्रवतः शक्तियों का प्रयोग करते हुए और भारत सरकार के श्रम

मंत्रालय की अधिसूचना सं० का० मा० 790 (भ) तारीख 15 सितम्बर , 1980 को अधिक्रान्त करते हुए तथा सलाहकार बोर्ड से परामर्श करते के पश्चात अत्रक बानों के नियोजन में नियोजित ऐसे कर्मचारियों के प्रबंगों को, जो इससे उपाबद्ध अनुसूची के स्तम्भ ( 1) को तत्स्यानी प्रविष्ठि में विनिविष्ट हैं, संदेय मजदूरी की म्यूनतम वरें उक्त अनुसूची के स्तम्भ ( 2) में विनिविष्ट रूप में पुनरीक्षित करती है और मिदेश देती है कि यह अधिसूचना राजपत्र में प्रकाशित की तारीख को प्रवृत्त होगी ।

स्पष्टीकरण:--
इस अधिसूचना के प्रयोजन के लिए,--
1. इस अधिसूचना द्वारा पुनरीक्षित न्यूनतम वरें सर्वसम्मिलित दरें हैं, जिनमें प्राधारी पर, जीवन निर्वाह भत्ता, आवश्यक वस्तुभों के रियायती बर पर किए गए प्रदायों का, यदि कोई हों, नकदी मूल्य सम्मिलित है तथा साप्ताहिक विश्राम के लिए देय भजदूरी भी सम्मिलित है ।
2. मजदूरी की न्यूनतम दरें ठेकेदारों द्वारा नियोजित कर्मचारियों को
भी लागू है ।
3. जहां संभिवा या करार पर प्राधारित या अन्यथा मजदूरी की विद्यमान वरें इस अधिसूचना द्वारा पुनरीक्षित वरों से उच्चतर है वहां इस अधिसूचना के प्रयोजनों के लिए ऐसी उच्चतर वरें संरक्षित की जाएंगी और में न्यूनतम मजदूरी की दरें मानी जाएंगी ।
4. (क ) "अकुमाल कार्य" से वह कार्य अभिप्रेत है जिसमें कार्य की बहुत थोड़ी कुशलता भनुभव अपेक्षित करने वाली अथवा कुछ भी कुशलता या अनुभव अपेक्षित करने वाली साधारण क्रियाएं सम्मिलित है ;
(क) "भर्यकुशल कार्य" से बह कार्य अभिप्रेत है, जिसमें कार्य के अनुभव से अजित कुछ मात्रा में कुशलता या सक्षमता सम्मिलित है और ओ कमाल कर्मचारी के पर्यवेक्षण या मार्ग वर्णन के अधीन किए जाने योग्य है और इसके अन्तर्गत अकुशल पर्यवेक्षी कार्य भी भाता है ;
(ग) "कुशल कार्य" से वह कार्य अभिप्रेत है जिसमें कार्य के अनुभव से अथवा शिक्ष के रूप में या किसी तकनीकी या व्यावसायिक संस्थामें प्रशिक्षण के माध्यम से अर्जित कुशलता या सक्षमता अपेक्षित है और जिसके पालन में स्वप्रेरणा और विवेकबुद्धि भावश्यक है ।
5. भठारह वर्ष से कम भायु के तरुण व्यक्तियों को मौर असमर्थ व्यक्तियों को वेय मजबूरी की म्यूनतम वरें समुचित प्रवर्ग के वयस्क कर्म- कारों को संवेय वरों का क्रमशः 80 प्रतिशत भौर 100 प्रतिशत होगी ।

NOTIFICATION
New Delhi , the 8th December , 1981
S.O. 892 (E) . Whereas certain proposals to revise the mini- mum rates of wages payable to the categories of employees employed in mica mines were published as required by clause (b) of sub-section ( 1) of section 5 of the Minimum Wages Act 1948 ( 11 of 1948 ) at pages 723-724 of the Gazette of India, Extra , ordinary Part II, Section 3, Sub -section (ii), dated 10th June, 1981 under the notification of the Government of India in the Ministry of Labour number S. O. 427(E) dated the 10th June , 1981 for information of and inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of two months from the date of publication of the said notification in the Official Gazette;
And whereas the said Gazette was made available to the public on the 10th June, 1981 .
And whereas the objections and suggestions received on the said proposals have been considered by the Central Govern- ment;
Now, therefore , in exercise of the powers conferred by clause (b) of sub - section (i) of section 3 read with clause ( iii) ofsub- section (1) of section 4 and sub - section (2) of section 5 of the Minimum Wages Act, 1948 ( 11 of 1948) and in super- session of notification of the Government of India in the Ministry ofLabour number S. O. 790(E) dated the 15th September, 1980 the Central Government , after consulting the Advisory Board , revises the minimum rates of wages as specified in column (2) of the Schedule annexed hereto payable to the categories of employees employed in employments in mica mines as specified in the corresponding entries in column (1 ) of the said Schedule and directs that this notification shall come into force on the date of its publication in the Official Gazette .

Clerical :
Accountant , Typist/ Steno , Clerk , Rs . 11.75 Compounder, Store keeper/In- charge, Shift incharge, Time koe- per, Cashier, Creche attendant, Supervisor, any other categories by whatever name called which are of clerical nature .
Explanation :-For the purpose of this notification ,-
(1) the minimum rates of wages revised are all inclusive rates of wages and include the basic rate, the cost of living allowance and the cash value of concessional supply, if any, in respect of supplies of essential commodities and also the wages payable for the weekly day of rests;

(2) the minimum rates ofwages are applicable to employees engaged by contractors also;
(3) where the prevailing rates of wages based on contract or agreement or otherwise are higher than the rates specified above, the higher rates would be protected and treated as minimum wages;
(4) (a) " Unskilled work" is one which involves simple operations requiring little or no skill or experience on the job;
(b) " Semi-skilled work " is one which involves some degree of skill or competence acquired through experience on the job and which is capable of being performed under the supervision or guidance of a skilled employee and includes unskilled supervisory work;
(c) "Skilled work " is one which involves skill or competence acquired through experience on the job or through training as an apprentice or in a technical or vocational institute and the performance ofwhich calls for initiative and judgement .
(5) The minimum rates of wages for young persons below 18 years of age and for disabled persons shall be 80% and 100% respectively of the rates fixed by this noti- fication for adult workers of the appropriate category .
