ORDER

New Delhi, the 26th December, 1981S.O. 914(E)|18AA|IDRA|81.—Whereas by the Order of the Government of India in the late Ministry of Industrial Deve- lopment (Department of Industrial Development) No. S.O. 445(E)|18AA|IDRA|72, dated the 23rd June, 1972 the manage- ment of the whole of the industrial undertaking known as the Andhra Scientific Company Limited, Machilipatnam had been taken over by the authorised person mentioned in the said order for a period of five yean upto and inclusive of the 26th June, 1977 and the said order is continued to have effect for a further period of four and half years upto and inclusive of the 26th December, 1981 by the orders of the Government of India in the Ministry of Industry (Department of Industrial Development) No. S.O. 407(E), dated the 22nd (1585) 1120 GI/81

And, whereas, the Central Government is of opinion that it is expedient in the public interest that the management of the said industrial undertaking should continue for a further period of six months;

Now, therefore, in exercise of the powers conferred by sub- section (2) of section 18AA read with the proviso to sub- section (2) of section 18A of the Industries (Development and Regulation) Act, 1951 (65 of 1951), the Central Government hereby directs that the said Order shall continue to have effect for a further period of six months upto and inclusive of the 26th June. 1982.

Government of India in the late Ministry of Industrial Develop- ment (Department of Industrial Development) No, S.O. 445 (E)/18AA/IDRA/72, dated the 23rd June, 1972 published in the Gazette of India Extraordinary Part II Sectioa 3, Sub- section (ii), dated the 27th June, 1972, the management of the whole of the industrial undertaking known as the Andhra Scientific Company Limited, Machilipatnum (hereinafter refer- red to as the said industrial undertaking) had been taken over under section 18AA of the Industries (Development & Regulation) Act, 1951 (65 of 1951), for a period of five years commencing from the 27th Jans, 1972 uplo and inclusive of the 26th June, 1977 ;

And whereas the duration of the said Older was further extended from time to lime upto and inclusive of ihe 26th June, 1982;

And whereas by the Order of the Government of India in Ihe late Ministry of Industrial Development (Department of Industrial Development) No. .S.O. 624(E)/l8FB/IDRA/72, dated the 25th September, 1972 (hereinafter referred to as the said Order), the Central Government, in exercise of the powers confened by clause (b) of sub-section (1) of section 18FB of the Industries (Development and Regulation) Act, 1951 (65 of 1951), declared that the operation •>( all the con- tracts, assurances of property, agreements, settlements, awards, standing orders of other instruments in force to which the said industrial undertaking was a party or which may be applicable to it immediately before the publication of the said Order In the Official Gazette shall remain suspended upto the 24th September, 1973, and that nil the riahts, pri: vileges, obligations and liabilities accruing or arising there- under before the said date •shall remain suspended ujito the 24th September, 1973;

And whereas the duration ofj the said order was further ex- tended from tirre to time upto and Inclusive of the 26th December, 1981;

And whereas the Central Government is satisfied that it is necessary so to do in the interest of the general public with a view to pi eventing fall in the volume of production in the scheduled industry, namely the scientific instruments industry;

Now, therefore, in exercise of the powers conferred by clause (b) of sub-section (1) read with sub-section (2) of sec- tion 18FB of the Industries (Development and Regulation) Act, 1951, the Central Government hereby declares that the opera- tion of all the contacts. Assurances of property, agreements, settlemente, awards standing orders or other instruments in force to which the said industrial undertaking waa a party or which may be applicable to it immediately before the 25th September, 1972, shall remain suspended and that all the rights, privileges, obligations and liabilities accruing or arising thereunder before the said date shall remain suspended.

This order shall remain in force from the date of its pub- lication in ths Official Gazette upto and inclusive of the 26th June, 1982.
