सा० का० ति ० 50 (१ ) केन्द्रीय सरकार आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए गेहूं बेलन आटा मिल ( अनुशापन और नियंत्रण ) आदेश 1957 का निम्नलिखित और संशोधन करती है अर्थात्:--
1. ( 1 ) इस आदेश का संक्षिप्त नाम गेहूं बेलन आटा मिल (अनु- ज्ञापन और नियंत्रण ) संशोधन श्रावेश 1982 *
( 2 ) यह तुरन्त प्रवृत्त होगा ।
2. गेहूं बेलन श्राटा मिल ( भनुज्ञापन और नियंत्रण ) आदेश 1957 में
(1) खण्ड 2 में
(क) उपखंड ( ग ) में " राज्य सरकार " शब्दों के स्थान पर " केन्द्रीय सरकार " शब्दं रखे जाएंगे ;
(ख) उपखंड ( थ ) के पश्चात् निम्मलिखिम उपखंड अतः स्थापित फियां जाएगा "( षष) 'विनिदिष्ट अधिकारी' से इस भावेश के अधीन विनिविष्ट शक्तियों का प्रयोग और कर्तव्यों का पालन करने के लिए राज्य सरकार द्वारा श्म रूप में नियुक्त किया गया अधिकारी अभिप्रेत है । "
(2) खंड 4 में
(क) उपखंड ( 1 ) के स्थान पर निम्नलिखित श्रप्तः स्थापित किया जाएगा अर्थात्:-
" ( 1 ) इस आवेश के अधीन अनुज्ञप्ति के लिए प्रत्येक आवेदन अनु- ज्ञापन प्राधिकारी के समक्ष किया जाएगा और इस आदेश के अधीन अनुज्ञप्ति के नवीकरण के लिए प्रत्येक अावेदन प्ररुप 1 में विनिविष्ट प्राधिकारी के समक्ष किया जाएगा ।"
(ख) उपखंड ( 2 ) की मव ( ग ) में अनुज्ञापन "प्राधिकारी " शब्दों के स्थान पर "विनिर्दिष्ट प्राधिकारी " शब्द रखे जाएगें ।
(3) खंड 5 में
(क) उपखंड ( 1 ) में " अनुज्ञापन प्राधिकारी " शब्दों के स्थान पर "यथास्थिति अनुज्ञापन प्राधिकारी या विनिर्दिष्ट प्राधिकारी" शब्द रखे जाएंगें ;
(ख) उपखंड ( 1 ) के पश्चात् निम्नलिखित परन्तुक अंतः स्थापित किया जाएगा , अर्थात् ---
"परन्तुक यह कि यदि कोई बेलन आाटा मिल बारह मासे से अधिक की अवधि तक बन्द रहती है या मनुज्ञाप्तधारी अनु- ज्ञप्ति की विधिमान्यता की समाप्ति के तीस दिन के भीतर अनुज्ञप्ति का नमीकरण नही करवाता है तो विनिर्दिष्ट प्राधि- कारी अनुज्ञप्ति के नवीकरण के लिए आवेदन पत्र को अपनी मिफारिशों के साथ या अन्यथा अनुज्ञापन प्राधिकारी को अग्रेषित कर देगा " ;

(ग) उपखंड ( 2 ) में "अनुज्ञापन प्राधिकारी " शब्दों के स्थान पर "यथास्थिति अनुज्ञापन प्राधिकारी या विनिर्दिष्ट प्राधिकारी " शब्द रखे जाएंगें ।
(4) खण्ड 10 में
(क) शीर्षक में "अनुज्ञापन प्राधिकारी " शब्दों के पश्चात् "या विनिदिष्ट प्राधिकारी " शब्द अन्तःस्थापित किए जाएगें
(ख) उपखण्ड ( 1 ) में ---
(i) "अनुज्ञापन प्राधिकारी " शब्दों के स्थान पर "यथास्थिति अनु- ज्ञापन प्राधिकारी या वितिविष्ट प्राधिकारी " शब्द रखे जाएगें;
( ii ) परन्तुक में "नहीं दिया जाएगा " शब्दों के पूर्व " विनिर्दिष्ट प्राधिकारी द्वारा " शब्द अंतः स्थापित किए आएंगें ।
(iii) उपखंड ( 2 ) में
" अनुज्ञापन प्राधिकारी " शब्दों के स्थान पर "यथास्थिति अनु- ज्ञापन प्राधिकारी या विनिर्दिष्ट प्राधिकारी " शब्द रखे जाएंगें ।
(5) खण्ड 11 में "अनुज्ञापन प्राधिकारी" उसे अपने आक्षेप प्रस्तुत करने का अवसर देने के पश्चात् अनुशाप्ति को निलम्बित या रद्द कर सकेगा" शब्दों के स्थान पर "अनुज्ञापन प्राधिक। री विनिर्दिष्ट प्राधिकारी से रिपोर्ट प्राप्त करने के पश्चात् उसे अपने झाक्षेप प्रस्तुत करने का अवसर देने के पश्चात् अनु- शप्ति को निलम्बित या रद्द कर सकेगा । शब्द रखे जाएंगें ।
(6) खंड 12 में-
(क) "खंड 5 या खंड 11 या खंड 11क के अधीन अनुशापन प्राधिकारी के आदेश से व्यथित कोई व्यक्ति " शब्दों के स्थान पर "खंड 5 के अधीन विनिर्दिष्ट प्राधिकारी या खंड 5 या खंड 11 या खंड 11 क के अधीन अनुज्ञापन प्राधिकारी के आदेश से व्यथिन कोई व्यक्ति" शब्द रखें जाएगें ;
(ख ) "राज्य सरकार" शब्दों के स्थान पर" " केन्द्रीय सरकार " शब्द रखे जाएगें ,
( 7) अनुसूची के प्रारूप 1 में
"अनुज्ञापन प्राधिकारी " शब्दों के स्थान पर , "अनुज्ञापन प्राधि- कारी /विनिदिष्ट प्राधिकारी " शब्द और तारांक रखे जाएंगें ;
(ख) निम्नलिखित टिप्पण भन्त में जोड़ा जाएगा
टिप्पण: "जो लागू न हो उसे काट दें । "

MINISTRY OF AGRICULTURE (Department of Food ) ORDER
New Delhi , the 6th February , 1982
G.S.R. 50(E) . In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955), the Central Government hereby makes the following Order further to amend the Wheat Roller Flour Mills ( Licens- ing and Control) Order, 1957 , namely :-
1. ( 1 ) This Order may be called the Wheat Roller Flour Mills ( Licensing and Control ) Amendment Order , 1982. *
(2) It shall come into force at once .
2. In the Wheat Roller Flour Mills ( Licensing and Control) Order, 1957 .
(1) in clause 2,-
(a) in sub - clause ( c) , for the words " State Government" , the words "Central Government " shall be substitu- ted ;
(b ) after sub- clause ( d) , the following sub - clause shall be substituted , namely :-
"(dd) ' specified authority' means an officer appointed as such by the State Government to exercise the powers and perform the duties specified under thisOrder ;
(2) in clause 4,-
(a) for sub -clause ( 1 ) , the following shall be substituted , namely :-
"(1) Every application for a licence under this Order shall be made to the licensing authority and every application for renewal of a licence under this Order shall be made to the specified authority, in Form I. "
(b) in sub - clause (2) , in item ( c ) , for the words " Licens- ing authority" the words " specified authority " shall be substituted,
(3) in clause 5,-
( a) in sub - clause ( 1 ) , after the words , "Licensing authority " the words, "or as the case may be, the specified authority" shall be inserted .

(b) after sub - clause ( 1 ) , the following proviso shall be inserted , namely
the "Provided that if a roller flour mill remains closed for a period excceding twelve months or licensee does not get the licence renewed within thirty days of the expiry of the validity of the licence, the specified authority shall forward the application for renewal of the licence to the licensing authority with its recommendations otherwise" ; ог
(c) in sub- clause (2), after the words " licensing authority " , the words "or as the case may be, the specified authority" shall be inserted .
(4) in clause 10,-
(a) in the "Heading" after the words " licensing authority" the words " and specified authority " shall be inserted ;
(b) in sub -clause ( 1) ,-
(i) after the words " Licensing authority " the words" , "or as the case may be , the specified authority " shall be inserted ;
( ii) in the proviso after the words " shall be issued " the words " by the specified authority " shall be inser- ted;
(iii) in sub - clause ( 2 ) after the words " Licensing autho- rity" the words " or as the case may be , the speci- fied authority" shall be inserted ;
(5) in clause 11 , for the words " licensing authority may,", the words " the licensing authority may, after receipt of the report from the specified authority , " shall be substituted .
(6) in clause 12,-
(a) after the words "by an order of the words " the specified authority under clause 5 or of" shall be inserted ;
(b) for the words " State Government " the words " Central Government" shall be substituted .
(7) in the Schedule , in Form I,-
(a) for the words 'Licensing Authority", the words and asterisk "Licensing Authority * /Specified Authority * " shall be substituted ;
(b) the following note shall be added at the end :- "*Note : Strike out whichever is not applicable. " Foot Note :
The Wheat Roller Flour Mills ( Licensing and Control) Order, 1957 , was published under the Notification of the Government of India in the erstwhile Ministry of Food and Agriculture (Department of Food), No. S.R.O. 2861 dated the 9th September , 1957. This Order has been amended from time to time by Notification Nos . :-
