सा०का० नि० 57 ( प्र) -खाद्य अपमिश्रण निवारण नियम, 1953 का और संशोधन करने के लिए नियमों का एक प्रारूप खाद्य अपमिश्रण निवारण अधिनियम, 1954 (1954 का 37) जिसे इसमें आगे उक्त अधिनियम कहा गया है , धारा 23 की उपधारा ( 1 ) द्वारा यथा अपेक्षित भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय (स्वास्थ्य विभाग ) की अधिसूचना सं ० सा० का ० नि ० 1191 तारीमा 3 नवम्बर , 1980 के साथ भारत के राजपत्र भाग 2, खंड 3 उपखंड ( i ) तारीख 15 नम्बर , 1980 पृष्ठ 2393-2395 पर प्रकाशित किया गया था जिसमें उस राजपत्त की प्रतिया जिसमें उक्त अधिसूचनः प्रकाशित हुई थी जनता को उपलब्ध करा देने की तारीख से 90 दिन की अवधि की समाप्ति के पूर्व उन सभी व्यक्तियों से झाक्षेप और सुझाव मांगे गए थे , जिनके उससे प्रभावित होने की संभावना है ;
भौर उक्त राजपत्र 15 नवम्बर 1980 को जनता को उपलब्ध करा विया गया था । और केन्द्रीय सरकार ने उक्त प्रारूप की बाबत प्राप्त आक्षेपों और सुझावों पर विचार कर लिया है ;
अतः केन्द्रीय सरकार उक्त अधिनियम की धारा 23 की उपधारा (1) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए केन्द्रीय खाद्य मानक

समिति से परामर्श करने के पश्चात् खाद्य प्रपमिश्रण निवारण नियम 1955 का और संशोधन करने के लिए निम्नलिखित निवन बनाती है , अर्था
नियम
1. ( 1) इन नियमों का संक्षिप्त नाम खाद्य प्रपमिश्रण निवारण (द्वितीय संशोधन ) नियम, 1982 है ।
( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे सिवाय नियम 2 और 3 के जो प्रकाशन की तारीख के छह मास के पश्चात् प्रवृत्त होंगे ।
2. खाद्य अपमिश्रण निवारण नियम, 1955 ( जिने इसमें इसके पश्चात् उक्त नियम कहा गया है ) उपनियम ( फ) के पश्वात् निम्नलिखित परतः- स्थापित किया जाएगा, अर्थात्:-
"( ब) सुखाए गए ग्लूकोज सिरप के प्रत्येक पैकेज पर जिसमें सल्फर- स। इम।क्साइड 40 भाग प्रति वस लाख से अधिक हो" निम्न- लिखित लेबल लगा होगा, अर्थात्ः-
सुखाया हुआ ग्लूकोज सिरप केवन शर्करा मिष्ठान उपयोग के लिए
3. उक्त नियमों के नियम 49 के उपनियम ( 12 ) के पश्चात् निम्नलिखित अन्तःस्थापित किया जाएगा, अर्थात्:-
"( 13) सुख्खाया गया ग्लूकोज सिरप जिसमें सल्फरडाइयाक्साइड 40 भाग प्रति दस लाख से अधिक हो , केवल ऐसे पैकेज में

विक्रय किया जाएगा जिम पर नियम 42 के उपनियम ( ब ) में विनिर्दिष्ट लेबल लगा हो । "
4. उक्त नियमों के परिशिष्ट "खा" में-
( i) मव क07-04 के स्थान पर निम्नलिखित रखा जाएगा अर्थात्ः- "क07-04" भाइस लोलो या खाध बर्फ से जमाया गया ऐसा बर्फ उत्पाव अभिप्रेत है जिसमें भार में 0.5 प्रतिशत से अनधिक अनुशात सुरुचिकारक , बीसी, सिरप फल , रस , कोको, सिट्रिक अम्ल स्थायीकारक या पायसीकारक हो सकते हैं । इसमें कोई कृत्रिम मीठाका रक नहीं होगा ।
( ii ) इस प्रकार प्रतिस्थापित मद क07-04 के पश्चात् निम्नलिखित अन्तःस्थापित किया जाएगा , अर्थात्:-
"मद क 07-04-01- भाइसकैंडी से ऐसा जमाया हुआा बर्फ उत्पाद . अभिप्रेत है जिसमें 0-5 प्रतिशत से अनधिक अनुज्ञात सुरुचिकारक, चीनी सिरप , फल, फलरस , वृढ फल , कोको, सिट्रिकथम्ल स्थायीकारक या पायसीकारक हो सकते हैं । इसमें चीनी , भार के अनुसार 10 प्रतिशत से कम नहीं होगी । इसमें कोई कृलिम मीठाकारक नहीं होगा । "
( iii ) मव फ० 07-05 भौर क० 07-08 में विद्यमान प्रविष्टियों के पश्चात् निम्नलिखित मस्त में जोड़ा जाएगा, अर्थात्:--
" यदि सोडियम बाइकार्बोनेट का प्रयोग निर्मलीकरण के प्रयोजन के लिए किया जाता है तो यह खाद्य श्रेणी का होगा ।"
(iv) मद क० 07-10 के पश्चात् निम्नलिखित नई मद अन्तःस्थापित की आएगी मर्थात्:--
क० 07-11-- सुखाया हुमा ग्लूकोज सिरप से सफेद से मखनिया सफेद रंग वाली मोटे या बारीक चूर्ण के रूप में ऐसी सामग्री अभिप्रेत है जो स्थाव में मीठी सुबास में समिश्र भौर थोड़ी आर्द्रताग्राही हो वह किण्वत फफूंदी पड़ने के लक्षणों गंदगी या किसी अन्य बाह्री पदार्थ या अतिरिक्त मीठा करने वाले या सुरुचि कर्मक से रहित होगी । उसमें कोई अतिरिक्त प्रा कृतिफ या कोलतार खाद्य रंग भी नहीं होगा । वह निम्नलिखित मानकों के अनुरूप होगी:--
भार में 93-0 प्रतिशत से अन्यून (i) कुल ठोस तत्व
भार में 20-0 प्रतिशत से भन्यून (ii) अपचायी शर्करा तत्व
भार में 1-0 प्रतिशत से श्रनधिक (iii) सल्फेटेड भस्म
40 भाग प्रति दस लाख से अनधिक (iv) सल्फरह। इआक्साइड
"यदि उत्पादक ऐसे मिष्ठानों ( कन्फेक्शनरी ) के विनिर्माण के लिए प्रयुक्त किए जाने के लिए आ। शयित है जिसे नियम 4 ( ब ) के अधीन विनि- विष्ट लेबल के अधीन विक्रय किया जाना है तो सल्फरडाइआक्साइड 150 भाग प्रति वस लाख से श्रनधिक होगा । "
( v) मद कं ० 08-01 में उपपैरा ( 5) के खंड ( 1) में " श्रऔर यह भार में 3-0 प्रतिशत से अन्यून होगीं " शब्दों और ग्रंकों के स्थान पर "और यह भारत में 3-0 प्रतिशत से अन्यून और 7-0 प्रतिशत से अनधिक होगी" शब्द और अंक रखे जाएंगे ।
(vi ) मद क० 14 झौर क० 14.01 में दोनों मदों के खंड (क) में "50-0 से 8-0 प्रतिशट् " प्रविष्टि के स्थान पर निम्नलिखित रखा आएगा , अर्थात्
"5.0 से 8.0 प्रतिशत शुल्क भार के भ्राधार पर । "
( vii ) मद क ० 14 के खंड ( ग) में " 1-0 प्रतिशन से अधिक नहीं होगी" प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी , धर्थान्-
"शुष्क भार के आधार पर 1-0 प्रतिशत से अधिक नहीं होगी"

(viii) मव क०14-01 के खंड ( ग) में " 1.2 प्रतिशत से अधिक नह होगी" प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी आयेगी,
अर्थात्: --
"शुष्क भार के श्राधार पर 1.2 प्रतिशत से अधिक नहीं होगी । "
( ix) मद क० 14 और 14.01 बोनों मवों के खंड ( ४० ) में "के भो के रूप में अभिव्यक्ति 1.0 प्रतिशत से कम और 2.2 प्रतिशत से अधिक नहीं होगी " प्रविष्टि के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्ः
"के श्रओ के रूप में अभिव्यक्त शुष्क भार के ग्राधार पर 1.0 प्रतिशत से कम और 2.2 प्रतिशत से अधिक नहीं होगी ।"

G.S.R. 57 (E) .-Whereas certain draft rules further to amend the Prevention of Food Adulteration Rules , 1955, were pub- Jished as required by sub-section ( 1 ) of section 23 of the Prevention of Food Adulteration Act, 1954 (37 of 1954 hereinafter referred as said Act with the notification of the Government of India in the Ministry of Health and Family Welfare (Department of Health) No. G.S.R. 1191 , dated 3rd November , 1980 at pages 2393-2395 in the Gazette of India , Part II Section 3 Sub- section ( i ) dated the 15th Nov- ember, 1980 inviting objections and suggestions from all persons likely to be affected thereby before the expiry of 90 days from the date on which the copies of the Officia Gazette in which the said notification was published, were made available to the public;
And whereas the copies of the said Gazette were made available to the public on, 15th November , 1980 ;
And whereas the objections and suggestions received from public on the draft rules have been considered by the Central Government ;
Now, therefore , in exercise of the powers conferred by sub-section ( 1) of section 23 of the said Act, the Central Government, after consultation with Central Committee for Food Standards , hereby makes the following rules further to amend the Prevention of Food Adulteration Rules , 1955, 1955, namely :
RULES
1. ( 1 ) These rules may be called the Prevention of Food Adulteration (Second Amendment) Rules , 1982 .
(2) They shall come into force on the date of their publi cation in the Official Gazette , except rules 2 and 3 which shall come into force after six months from the date of publication .
2. In rule 42 of the Prevention of Food Adulteration Rules , 1955 (hereinafter referred as the said rules ) , after sub- rule (V), the following shall be inserted, namely:
"(W) Every package of the Dried Glucose Syimp con . taining sulphurdioxide exceeding 40 ppm. " shall bear the following label , namely :-
DRIED GLUCOSE SYRUP
FOR USE IN SUGAR CONFECTIONERY OILY

3. In rule 49 of the said rules , after sub - rule ( 12) , the fol- lowing shall be inserted , namely :
"(13) Dried Glucose Syrup containing sulphur-dioxide exceeding 40 ppm, shall be sold only in a package which shall bear the label as specified in sub -rule (W) of rule 42." 123

4. In appendix B of the said rules ,
(i ) for item A, 07.04 , the following shall be substituted, namely :-
"Α . 07.04 " ICE LOLLIES OR EDIBLE ICES" means the frozen ice produce which may contain the permitted flavours , sugar , syrup , fruit , fruit juices, cocoa, citric acid , stabilizers or emulsifiers not excceding 0.5 per cent by weight . It shall not con- tain an artificial sweetner . "
( ii) After item A, 07.04, so substituted the following items shall be inserted , namely :-
"A. 07.04 ICE CANDY means the frozen ice pro- duce which may contain permitted flavour , fruit , juices , nuts , cocoa , citric acid , stabilizers or emul- sifiers not exceeding 0.5 per cent . It shall contain sugar not less than 10 per cent by weight . It shall not contain any artificial sweetner ."
(iii) in item A. 07.5 and A. 07.08 , after the existing en- tries , the following shall be added in the end, name- ly:-
"Sodium bicarbonate , if used , for clarification pur- poses, shall be of Food Grade Quality. "
(iv) after item A. 07.10 , the following new item shall be inserted, namely :-
A. 07.11 DRIED GLUCOSE SYRUP means the material in the form of course or fine white to creamish white powder , sweet to taste , bland in flavour and somewhat hygroscopic . It shall be free from fermentation, evidence of mould growth, dirt or other extraneous matter , or added sweeten- ing or flavouring agent.
It shall also not contain any added natural or coaltar food colour . It shall conform to the following standards :-
(a) Total solid content:
Not less than 93.0 per cent by wt .
(b) Reducing sugar content:
Not less than 20.0 per cent by wt.
(c) Sulphated ash :
Not more than 1.0 per cent by wt.
(d) Sulphur dioxide :
Not more than 40 ppm "Sulphurdioxide may be pre- sent in an amount not ex- ceeding 150 ppm if the pro- duct is intended for menu- facture of confectionery to be sold under a label as speci- filed under rule 42( W) ." ;
(v) in item A. 08.01 , in sub- paragraph ( 5) in clause ( i) for the words and figures and " shall be not less than 3.0 per cent by weight " , the words and fig- ures " and shall be not less than 3.0 per cent and not more than 7.0 per cent by weight " shall be substituted;
(vi) in item A. 14, and A. 14.01 , in clause (a) of both items for the entry " 50.0 to 8.0 per cent " , the fol- lowing shall be substituted , namely :-
"5.0 to 8.0 per cent by weight on dry basis."
(vii) in item A. 14 in clause (c) , for the entry "Not more than 1.0 per cent" the following entry shall be sub- stituted, namely :-
"Not more than 1.0 per cent by weight on dry basis";
(viii) in item A. 14.01 , in clause ( c), for the entry "Not more than 1.2 per cent" the following entry shall be substituted, namely :-
"Not more than 1.2 per cent by weight on dry basis" ;
(ix) in items A. 14 and 14.01 in clause ( e) of both items , for the entry " Not less than 1.0 per cent and not more than 2.2 per cent expressed as K₂O" , the fol- lowing shall be substituted, namely :-
"Not less than 1.0 per cent and not more than 2.2 per cent expressed as K₂O on dry basis " .
