का० श्रा० 105 ( श्र) केन्द्रीय सरकार , उद्योग (विकास और विनियमन) अधिनियम, 1931 ( 1951 का 65) की धारा 18 और धारा 25 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए सीमेन्ट नियंत्रण आदेश , 1967 का और मशोवन करने के लिए निम्नलिखित आदेश करती है , अर्थात्
1 ( 1 ) इस आदेश का संक्षिप्त नाम मीमेन्ट नियन्त्रण ( तृतीय सशोधन) आदेश, 1982 है ।
( 2) यह तुग्न्स प्रवृत्त होगा ।
2 सीमेन्ट नियत्रण आदेण , 1967 क ( जिसे इसमे इसके पश्चात् त प्रादेश कहां गया है) खण्ड-2 में पश्चात् उप-खण्ड-1 स्थापित किया जाएगा , अर्थात् अन्त
" 1 के लागू होना
उपर्युक्त आदेश ये उपवन्ध खण्ड-५ न के अतिरिक्त केवल सेवी सीमेन्ट के सबध में ही लागू होगे ।
3 उपर्युक्त आदेश के खण्ड-2 में निम्नलिखित नया उपखण्ड अन्त स्थापित किया जायेगा, अर्थात्--
" ( घ) नवी सीमेन्ट का अभिप्राय किसी सीमेन्ट संयन्त्र की अधि- 'ठापित क्षमता के उस अंश के उत्पादन के सन्दर्भ में है जो केन्द्रीय सरकार द्वारा समय -समय पर सीमेन्ट सयंत्र की अधिष्ठापित क्षमता का 66.6 प्रतिशत से अधिक न निर्धा- रित किया जा सकता हो । "
" ( ड) नान-लेवी सीमेन्ट का श्रभिप्राय किसी सीमेन्ट सयत्र के उत्पादन के उस अण से है जो उपर्युक्त उप-सखण्ड ( छ ) मे उल्लिखित उत्पादन से अधिक हो ।"
4 उपर्युक्त आदेण में खण्ड-४ निम्नलिखित खण्ड द्वारा प्रतिस्थापित किया जायेगा, अर्थात्
" 8. प्रत्येक उत्पादक स्वयं अथवा अपनी ओर से किसी अन्य व्यक्ति के द्वारा--
(क) बाटर प्रूफ ( हाइड्रोफोबिक ) सीमेन्ट 472 00 रु० प्रति मीट्रिक टन की दर से ।
(ब) जल्दी कड़ा हो जाने वाला मीमेन्ट तथा निम्न ताप वाला सीमेन्ट 463.00 रु० प्रति मीट्रिक टन की दर से

( 2 ) उच्च प्रशक्ति वाला सामान्य पोर्टलैंड सीमेन्ट विशिष्ट सं० भाई० एस०-8112-1976 के अनुरुप 463.00 प्रति मीट्रिक टन की दर से और प्रति वर्ग सेमी० या उसके अंश पर 100 किलोग्राम की कम्प्रेसिष शक्ति होने पर 20 रुपये प्रति मीट्रिक टन की अति- रिक्त राशि ।
(ग) सामान्य पोर्टलैंड सीमेन्ट तथा पोर्टलैंड स्लैग सीमेंट 440.00 रुपये प्रति मीट्रिक टन की वर से
(घ) पोर्टलैंड पोजलाना सीमेंट और चिनाई सीमेन्ट 425.00 भपये प्रति मीट्रिक टन की वर मे ।
गन्तब्य रेलवे स्टेशन तक निःशुष्क तथा उस पर उत्पादन शुल्क को भुगतान करके बेचेगा ।
बशर्ते कि पैक किये हुए सीमेन्ट के मामले में इस खण्ड में निर्दिष्ट वह मूल्य भी जोड़ा जाएगा जो केन्द्रीय सरकार द्वारा जूट के बोरों अथवा अन्य कन्टेनरों के संबंध में निश्चित किये गये हों तथा इसमें नये और काम में आने वाले जूट के पुराने बोरों तथा इस प्रकार के अम्य कन्टेनरों का प्रयोग करने के लिए निश्चित प्रभार भी सम्मिलित होंगे 1
यह और भी कि जूट के बोरों में पैकिंग करने के मामले में निर्माता काम में लाये जाने योग्य पुराने बोरों का केन्द्र सरकार द्वारा समय-समय पर निर्दिष्ट सीमा से अधिक इस्तेमाल नही करेगा ।
यह भी कि केन्द्रीय सरकार संभरण तथा निपटान महा निवेशकते माध्यम से अथवा भारत से बाहर निर्यात करने के लिये बेची जाने वाली सीमेन्ट के मूल्य में छूट कटौती या कमीशन की अनुमति भी दे सकती है ।
बशर्ते कि यह भी कि इस खण्ड का कुष्ठ भी मिनी सीमेन्ट संयत्ता में निर्मित सीमेन्ट पर लागू नही होगा" ।
5. उपर्युक्त श्रादेश में खण्ड-8 में व्याख्या स०-2 निम्नलिखित से प्रतिस्थापित की जा सकती है, अर्थात्: -
"व्याख्या 2--शंकाओं के निवारण के लिये एतद्वारा घोषणा की जाती है कि उप-खण्ड ( ग) में उल्लिखित "सामान्य पोर्टलैंड सीमेन्ट" में सफेद सीमेन्ट से अन्यथा निर्मित रंगीन सीमेन्ट सम्मिलित है " ।
6. खण्ड-9 , उप-खण्ड ( 2 ) को निम्नलिखित उप-खण्ड से प्रतिस्थापित किया आएगा , अर्थात्:--
" ( ii ) विक्रय तथा वितरण व्यय जिनकी गणना 4.00 ५० प्रति मीट्रिक टन की दर से की गई है" ।
7. उपर्युक्त आदेश में खण्ड-9 में विद्यमान उपबन्धो के स्थान पर निम्नलिखित परन्तुक रखा जायेगा , अथतिः-
बशर्ते कि निर्माता द्वारा सबसे सस्ते परिवहन मार्ग के द्वारा दिये गये भाड़े अथना किसी अन्य ऐसे परिवहन द्वारा जिसका उल्लेख केन्द्रीय सरकार द्वारा उपखण्ड ( 4 ) में किया गया हो, इस प्रकार के सौदों के लिये किसी भी ऐसे प्रकार के परिवहन के सम्बन्ध में किये गये भाड़े की प्रतिपूर्ति नियंत्रक द्वारा सीमेन्ट बिनियमन लेखे में से जैसा कि खण्ड- II में उल्लिखित है, निर्माता को प्रतिपूर्ति की जायेगी ।
8. उपर्युक्त श्रादेश में खण्ड -9 के पश्चात् खण्ड-9क के रूप में निम्मिलिखित जोड़ा जायेगा अर्थात:--
" 9फ. प्रत्येक निर्माता नाम-लेबी सीमेन्ट के उत्पावत के सम्बन्ध में जिस महीने इस प्रकार का उत्पावन होता है , उस मास की समाप्ति के एक महीने के अन्दर उस उत्पादन के 9.00 रुपये प्रति मीट्रिक टन की वर से सीमेन्ट विनियमन लेख में गशि का भुगतान करेगा। "
9. उपर्युक्त आत्रेण मे खण्ड-II मे उप-खण्ड-1 में "खण्ड-१ " के अन्तर्गत शब्दों के स्थान पर निम्नलिखित शब्द रखे जायेगेंः "खण्ड-9 और खण्ड-9क"
10. उपर्युक्त श्रादेश में अनुसूची के स्थान पर निम्नलिखित अन सूची रखी जायेगी, अर्थात्

टिप्पण: -
( 1) गीघ्र भख्त होने वाले सीमेन्ट तथा निम्न साप वाले सीमेन्ट के मामले में 12.00 रुपये प्रति मीट्रिक टन का अतिरिक्त मूल्य और वाटर प्रूफ (हाइड्रोंफोबिक ) सीमेन्ट के मामले में उल्लिखित उपर्युक्त मूल्यो में 21.00 रुपये प्रति मीट्रिक टन का अतिरिक्त मूल्य जोड़ा जाएगा ।
( 1क) ऐसी उच्च शक्ति वाले माधारण पोर्टलैण्ड भीमेन्ट की दशा में जो विनिर्देश स ० आाई एम०-8118-1976 के अनुरुप हो, 12.00 रुपये प्रति मीट्रिक टन की अतिरिक्त कीमत, में विनिर्दिष्ट कीमत के माथ जोड़ी जा सकेंगी 100 किलोग्राम प्रति वर्ग सेमी० या उसके भाग को सम्पीडन शक्ति में प्रत्येक वृद्धि के लिए 20.00 रु ० प्रति मीट्रिक टन की अतिरिक्त रकम भी उस दशा में जोड़ी जा सकेगी जब उक्स यिनिर्देश पर संपीडन शक्ति में ऐसी कोई वृद्धि होती है ।
( 2) सीमेन्ट कारपोरेशन आाफ्इंडिया बोकाजन एकक और मावमुलुच चेरी सीमेन्ट लिमिटेड , चेरापूजी तथा सीमेन्ट कारपोरेशन ग्राफ् इन्डिया राजबन सीमेन्ट वर्क्स अनुसूची में विये गये मूल्य के अतिरिक्त 79.10 रु ० तथा 142.96 रु० प्रति मीट्रिक टन के अतिरिक्त साधारण मूल्य पाने के पात्र होंगें । क्रमशः 114.34 रु ०

ORDER
New Delhi , the 28th February, 1982
S.O. 105(E) .In exercise of the powers conferred by Sec- tion 18G and Section 25 of the Industries (Development and Regulation) Act, 1951 (65 of 1951) , the Central Government hereby makes the following Order further to amend the Cement Control Order , 1967 , namely :-
1. ( i ) This Order may be called the "Cement Control (3rd Amendment) Order, 1982 .
(ii) It shall come into force with immediate effect .

2. In the Cement Control Order , 1967 ( hereinafter referred to as the said Order) , after clause 1 , a new clause 1A shall be inserted , namely :-
" 1A . APPLICABILITY .-- The provisions of the said Order except clause 9A thereof shall apply only in relation to levy cement . "
3. In the said Order , in clause 2, the following shall be inserted as new sub - clauses , namely :-
"(d) Levy cement, means that part of production of ce- ment with referenct to the installed capacity of a cement plant as may be determined by the Central Government , from time to time , not being more than 66.6 per cent of the installed capacity of the cement plant ."
"(e) Non- levy cement means that part of production of a cement plant which is in excess of the production mentioned in sub - clause ( d) . "
4. In the said Order clause 8 shall be substituted by the following clause , namely :-
"8. Every producer shall , himself , or by any person on his behalf, sell :-
(a) water proof ( hydrophobic ) cement at Rs . 472.00 per metric tonne.
(b) rapid hardening cement and low heat cement at Rs. 463.00 metric tonne .
(b)( 1 ) high strength ordinary portland cement con- forming to specification No. IS - 8112-1976 at Rs . 463.00 per metric tonne and additional amount of Rs . 20 per metric tonne for every increase in the compressive strength of 100 kg . per sq . cm or part thereof .
(c) ordinary portland cement and portland slag cement at Rs . 440.00 per metric tonne .
(d) portland pozzolana sement and masoni v cement at Rs . 425.00 per metric tonne.

Provided that in the case of packed cement there shall be added to the price referred to in this clause such charges as may be fixed by the Central Gov- ernment in respect of packing in jute bags or in anv other containers , and different charges may be fixed for the use of new and serviceable secondhand jute bags and for the use of such other containers .
Provided further that in the case of packing of cement in jute bags the producer shall not use ser- viceable secondhand jute bags in excess of the limit specified by the Central Government from time to time.
Provided also that the Central Government mav allow rebate, discount or commission in the price of cement sold to the Government through the Directorate General of Supplies and Disposals or intended for export out of India.
Provided further that nothing in this clause shall apply to cement produced in a mini cement plant ."
5. In the said Order , in clause 8 explanation No. 11 may be substituted by the following , namely:-
"Explanation II . For the removal of doubts , it is hereby declared that the expression " ordinary portland ce ment " referred to in sub - clause (c) includes coloured cement made otherwise than from white cement . "

6. In clause 9 sub -clause ( ii ) may be substituted by the Jollowing sub- clause , namely :-
"( ii ) selling and distribution expenses calculated at the rate of Rs . 4.00 per tonne .
7. In the said Order under clause 9 of the existing pro- usos shallbe substituted by the following proviso , namely: -
"Provided that the expenditure incurred by the producer on freight by the cheapest mode of transport or where any other mode of transport has been speci- fied by the Central Government under clause (4) , by such mode of transport in respect of such trans- actions shall be reimbursed to the producer by the Controller from out of the Cement Regulation Ac- count referred to in Clause 11 , "
8. In the said Order , after clause 9 , the following shall be inserted as clause 9A, namely :--
" 9A . Every producer shall , in respect of the production of non- levy cement, pay to the Cement Regulation Account an amount at the rate of Rupees nine per metric tonne of such production , within one month of the close of the month in which such production takes place."
9. In the said Order , in clause 11, the following words shallbe substituted for the words " under clause 9 ", appearing in sub- clause ( i ) namely :
"under Clauses 9 and 9A."
10. In the said Order schedule may be substituted by the following schedule . namely

Note:
(1) In the case of rapid hardening cement and low heat coment an additional price of Rs . 12 per tonne and in the case of water proof (hydrophobic) cement, an additional price of Rs . 21 per tonne may be added to the price specifled above .
(1)( a) In , the case of High strength ordinary portland cement conforming to specification No. IS : 8118 1976 an addi- tional price of Rs . 12 per metric tonne may be added and an additional amount of Rs . 20 per metric tonne for every in- crease in the compressive strength of 100 kg. per sq . cm . or part thereof may also be added wherever there is such an increase in the compressive strength over the said specifica- tion.
(2) Cement Corporation of India, Bokajan unit, Mawmu- luch Cherra Cement Limited Cherrapunji and Cement Cor- poration of India, Rajaban cement works will be eligible in addition to the price given in the schedule to an additional etention price of Rs . 114 34. Rs . 79.10 and Rs . 142.96 per metric tonne respectively.
