फा०ओ० 134 (अ) / 18 कक/श्री० वि ० वि ००/ 81. कैन्द्रीय सरकार ने भारत के भूतपूर्व श्रौद्योगिक विकास मंत्रालय के आवेश सं० का ० आ० 542(अ)/ 18 कक श्री० वि० वि० अ ०/ 74, तारीख 13 सितम्बर, 1974 द्वारा अमृतसर गूंगर मिल्स कम्पनी लिमिटेड , अमृतमर नामक औद्योगिक उपक्रम के एकं कारखाने अमृतमर आयल वर्क्स, अमृतसर का 12 सितम्बर, 1979 तक की, जिसमे यह नारीख भी सम्मिलित है, पांच वर्ष की अवधि के लिए प्रबन्धग्रहण करने के लिए प्रवन्ध बोर्ड नामक एक व्यक्ति निकाय को प्राधि- कृत किया था।
और भारन नरकार के उद्योग मंत्रालय के आदेश स ० का ० आ ० 454( श्र) तारीख 18 जुलाई, 1974 द्वारा 12 सितम्बर , 1979 तक की जिसमें यह नारीख भी सम्मिलित है, अवधि के लिए उक्स प्रबंध बंड का म्थान ए नए प्रबंध बोर्ड ने ले लिया था ;
आर भारत सरकार के उद्योग मंत्रालय के आदेश स ० का० श्रा ० 525 (अ) / 1 श्कद/श्रऔ०वि ० वि ०००/ 79 तारीख 11 सितम्बर , 1979 द्वारा नारीख 13 मितम्बर , 1974 और 18 जुलाई , 1978 के उक्त दोनो आदेशो की अवधि 12 सितम्बर, 1981 तक जिसमें यह तारीख भी गम्मिलित है, बढ़ा दी गई थी ,
और भारत सरकार के उद्योग मंत्रालय के आदेश स ० का ०ग्रा० 695 (अ) / 18 कक औ ० वि ० वि०८०/ 81 , नारीख 11 सितम्बर, 1981 द्वारा 13 सितम्बर , 1974 और 18 जुलाई, 1978 के उक्त दोनो आदेशों की अवधि 12 मार्च , 1982 तक जिसमें यह तारीख भी सम्मिलित है, बढ़ा दी गई थी ;

और केन्द्रीय सरकार की यह राय है कि लोकेहित में यह समीचीन है कि तारीख 13 मिप्लम्बर, 1974 और 18 जुलाई 1978 के उक्त दोनों श्रवेश छह मास की और अवधि तक प्रभावी बने रहे ।
अतः केन्द्रीय सरकार , उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65) की धारा 18कक ही उपधारा ( 2 ) द्वारा प्रवत शक्तियो का प्रयोग करते हुए, निदेश देती है कि नारीख 13 सितम्बर , 1974 और 18 जुलाई , 1978 के उक्त बोनों आदेश 12 सितम्बर , 1982 तक की, जिसमें यह तारीख भी सम्मिलित है, और अवधि के लिये प्रभावी बने रहेंगें ।

S.O. 134( E ) /18ΛΑ/IDRA/81.-Whereas by the Order of the Government of India in the late Ministry of Industrial Development No. S.O. 542(E ) / 18AA /IDRA/74 , dated the 13th September, 1974 , the Central Government had authori- sed a body of persons known as the Board of Management , to take over the management of Amritsar Oil Works , Amrit- sar, a factory of the industrial undertaking known as Amrit- sar Sugar Mills Co.Ltd. , Amritsar , for a period of five years upto and inclusive of the 12th September, 1979 ;
And, whereas, by the Order of the Government of India in the Ministry of Industry No. S.O. 454 (E) , dated the 18th July, 1978 , the said Board of Management was replaced by a new Board of Management for a period upto and inclusive of the 12th September , 1979 ;
And , whereas , by the Order of the Government of India in the Ministry of Industry No. S.O. 525(E)/18AA/IDRA/ 79, dated the 11th September, 1979, the period of the said Orders dated the 13th September, 1974, and the 18th July,

1978 , was extended upto and inclusive of the 12th September , 1981 ;
And, whereas, by the Order of the Government of India in the Ministry of Industry No. S.O. 695 ( E) / 18AA / IDRA / 81 , dated the 11th September , 1981, the period of the said two Orders dated the 13th September , 1974 , and the 18th July, 1978 , was extended upto and inclusive of the 12th March , 1982 ;
And, whereas , the Central Government is of opinion that it is expedient in the public interest that the said two Orders dated the 13th September , 1974. and the 18th July , 1978 , respectively, should continue to have effect for a further period of six months ;
Now, therefore , in exercise of the powers conferred by sub -section (2 ) of section 18AA of the Industries (Develop- ment and Regulation) Act , 1951 (65 of 1951 ) , the Central Government hereby directs that the said two Orders dated the 13th September , 1974 , and the 18th July , 1978 , continue to have effect for a further period upto and inclusive of the 12th September, 1982 .
जनपत्यपूर्ण उनके अधीन प्रोद्भूत या उद्भूत होने वाले सभी अधिकार , विशेषाधिकार , वाध्यताएं , और दायित्व 1 अक्तूवर , 1975 प्राश्न्न होने वाला एक वर्ष की अवधि के लिए
उद्योग मंत्राय (जीद्योगिव त्रिकाम विभाग ) के भादेश सं ० का ० आ० ७८८ ( ग्र) , तारीख 11 सितम्बर , 1981 द्वारा 1 अक्तूबर , 1975 से उन आदेन की कागजधि 12 मार्च , 1982 तक, जिसमें यह तारीख भी सा पलित है, के लिये तढ़ा दी गई है;
और केन्द्रीय सरकार का यह समाधान हो गया है कि तारीख 1 अक्तूबर, 1975 के उक्त श्रादेश की कालावधि 12 सितम्बर, 1982 तक, जिसमें यह तारीख भी सम्मिलित है, के लिए बढ़ा दी जानी चाहिए ,

आदेश
का०आ ० 135 (अ)/ 18चख/ औ ० वि० वि० अ० . भारत सरकार के भूतपूर्व औद्योगकि विकास मंत्रालय के आदेश सं ० का०आ ० 542(अ)/ 18कक/ओ ० वि०वि ० अ०/ 74, तारीख 13 सितम्बर , 1974 द्वारा यह प्राधिकृत किया गया था कि अमृतसर शूगर मिल्स कम्पनी लिमिटेड, अमृतसर नामक औद्यागिक उपक्रम ( जिमसे इसमें इसके पश्चात् उक्त उपक्रम कहा गया है ) , जहां तक कि उसका संबंध, अमृतसर आयल वर्क्स, अमृतसर नामक कारखाने ( जिसे इसमें इसके पश्चात् उक्त कारखाना कहा गया है ) से है, का प्रबंध 13 सितम्बर, 1974 से प्रारम्भ होने वाली पांच वर्ष की अवधि के लिए प्रबंध वोर्ड नामक व्यक्ति निकाय द्वारा उद्योग (विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65) की धारा 18कक के अधीन ग्रहण किया जाए ;
और भारत सरकार के उद्योग मंत्रालय के आदेश सं ० 454 ( अ) , तारीख 18 जुलाई, 1978 द्वारा 12 सितम्बर, 1979 तक कि जिसमें यह तारीख भी सम्मिलित है, अवधि के लिये उक्त व्यक्ति निकाय का स्थान एक नए निकाय ने ले लिया था ;
और भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग) के आदेशों द्वारा 13 सितम्बर, 1974 और 18 जुलाई, 1978 के उक्त दोनों आदेश 12 मार्च, 1982 तक की अवधि, जिसमें यह तारीख भी सम्मिलित है, के लिए प्रभावी है ;
और केन्द्रीय सरकार ने भारत सरकार के भूतपूर्व उद्योग और नाग- रिक पूर्ति मंत्रालय ( औद्योगिक विकास विभाग ) के आदेश सं ० का ० आ० 566 (अ ) , तारीख 1 अक्तूबर, 1975 ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है) द्वारा उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65) की धारा 18चख की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा की थीकिः-
(क ) 1 अक्तूबर, 1975 के उक्त आदेश की अनुसूची में विनिर्दिष्ट यथास्थिति, अधिनियमितियां , या उनके भाग , उक्त उपक्रम को, जहां तक उसका संबंध उक्त कारखाने से है , लागू नहीं होंगें, और
(ख) सभी प्रवृत्त संविदाओं, सम्पत्ति के हस्तान्तरण-पत्नों, करारों, व्यवस्थापनों , पंचाटों, स्थायी आदेशों, या लिखतों का ( उनको छोड़कर जो बैंकों और वित्तीय संस्थाओं के प्रतिभूत दायित्वों से संबंधित हैं) प्रवर्तन जिनका उक्त औद्योगिक उपक्रम एक पक्षकार है और जहां तक कि वे उक्त कारखाने से संबंधित हैं या जो 1 अक्तूबर , 1975 के उक्त आदेश के राजपत्न में प्रकाशन की तारीख से ठीक पूर्व उसे लागू हो सकते हैं, और अतः केन्द्रीय सरकार, उद्योग ( विकास और विनियमन) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18चख की उपधारा ( 2 ) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तारीख 1 अक्तूबर, 1975 के उक्त आदेश की कालावधि 12 सितम्बर , 1982 तक, जिसमें यह तारीख भी सम्मिलित है , की और अवधि के लिए बढ़ाती है ।

ORDER
S.O. 135(E) /18FB/ IDEA. Whereas by the Orde, of the Government of India in the late Ministry of Industrial Deve- lopment No. S.O. 542( E) / 18AA/IDRA/ 74 , dated the 13th September , 1974 , the management of the Industrial under- taking known as Amritsar Sugar Mills Company Limited, Amritsar (hereinafe , referred to as the said undertaking) in so far as it relates to the factory known as Amritsar Oil Works , Amritsar ( hereinafter referred to as the said factory ) was authorised to be taken over by a body of persons known as the Board of Management under section 18AA of the Industries (Development and Regulation) Act , 1951 (65 of 1951) for a period of five years commencing from the 13th September , 1974 ;
And, whereas, by the Order of the Government of India in the Ministry of Industry No. S.O. 454( E) , dated the 18th July, 1978 , the said body of persons was replaced by a new body for a period upto and inclusive of the 12th September , 1979 ;
And, whereas , by the Orders of the Government of India in the Ministry of Industry ( Department of Industrial Deve- lopment) the said two Orders dated the 13th September, 1974 and the 18th July , 1978 continued to have effect for a period upto and inclusive of the 12th March , 1982 ;
And, whereas , by the Order of the Government of India in the late Ministry of Industry and Civil Supplies (Depart- ment of Industrial Development) No. 566( E) , dated the 1st October , 1975 (hereinafter referred to as the said Order) , the Central Government , in exericse of the powers conferred by sub - section (1) of section 18FB of the Industries (Develop- ment and Regulation) Act , 1951 ( 65 of 1951 ) , declared that-
(a) the enactments , or portions thereof, as the case may be, specified in the Schedule to the said Order dated the 1st October , 1975, shall not apply to the said undertaking in so far as it relates to the said factory, and
(b) the operation of all contracts , assurances of property, agreements , settlements , awards , standing orders or other instruments in force (other than those relating to secured liabilities to banks and financial institu- tions) to which the said industrial undertaking is a party in so far as they related to the said factory , or which may be applicable to it immediately before the date of publication of the said Order dated the 1st October, 1975 in the Official Gazette and all the rights , privileges , obligations and liabilities 231

acciuing or arising thereunder before the said date shall remain suspended for a period of one year commencing from the 1st October , 1975 ;
And , whereas, by the Order of the Government of India in the Ministry of Industry ( Department of Industrial Deve- lopment) No. S.O. 696 ( E) , dated the 11th September , 1981 , the duration of the said Onder dated the 1st October , 1975 , was extended upto and inclusive of the 12th March , 1982 ;
And, whereas , the Central Government is satisfied that the duration of the said Ordet dated the 1st October , 1975, should be extended by a further period upto and inclusive of the 12th September, 1982 ;
Now, therefore , in exercise of the powers confcired by sub- section ( 1) read with sub - section (2) of section 18FB of the Industries (Development and Regulation) Act, 1951 (65 of 1951) , the Central Government hereby extends the duration of the said Order dated the 1st October , 1975 , for a further period upto and inclusive of the 12th September, 1982 .
