सं० 6 (8 ) / 82--2-- सार्वजनिक सूचना संख्या 18- ई टी सी (पी एन) / 80 , दिनांक 17 मई, 1980 को कंडिका 8 और सार्वजनिक सूचना सं ० 30 ई टी सी (पो एन) / 80 , दिनांक 21 जून , 1980 की कंडिका 2 ( 2 ) की ओर ध्यान दिलाया जाता है जिसके अनुसार प्राइवेट पार्टियों (खान के स्वामियों ) के लिए यह श्रावश्यक है कि वे खनिज तथा धातु व्यापार निगम की मानक संविदात्मक शर्तों श्रावि के आधार पर संविदा करें ।

(2 ) एवं ( 5) में 2. यह निश्चय किया गया है कि खान स्वामियों द्वारा 5000 मो० टन से अधिक के बैराइट्स पाउडर के निर्यात की स्वीकृति अभी उपयोग में आ रहे मानक संविदा प्रपत्र के आधार पर न्यूनतम निर्यात मूल्य प्रक्रिया के अधीन क्रमशः निम्ननिखित खण्ड निहित छूट के अर्ध न दे जाग्र्ग :
( 1 ) खानस्वामियों का यह विकल्प होगा कि वे चाहे तो विशिष्ट मात्रा का या विशिष्टि मात्रा में 10 प्रनिशन और जोड कर या उसमें से, घटा कर निर्यात करें ,
( 2 ) खानस्वामियों को बैराइट्म पाउडर के ओ ० सी ० एम ० ए ० ए ० पी ० आई० दोनों ग्रेड के निर्यात के लिए अनुमति दी जा सकती है :
( 3 ) बैग में वैराइट्स के मामले में 750 मे 1000 मी० टन की लदान गारन्टी को अनुमति प्रदान करने के लिए लदान गारन्टी की शर्तों को संशोधित किया जा मकता है ;
( 4 ) प्रत्येक प्रेषण के साथ 1/2 प्रतिशत बैग मुफ्त में संभरण करने की शर्त को हटाया जा सकता है ।
3. यह भी निश्चय किया गया है कि खान स्वामी इस गर्त के अधीन व्यागत तथा भाड़ा के आधार पर संविदा कर सकते हैं कि वसूल की जाने वालो विदेशी मुद्रा भारतीय पत्तन/ मद्रास के जहाज पर निःशुल्क मूल्य के अनुसार ममय - समय पर घोषित त्यूनतम मूल्य से कम न हो ।
4. वर्तमान मानक प्रपत्र निम्नलिखित मामलों में लागू नहीं होगा:--

(क ) उन अन्तर्राष्ट्रीय निविदाओं के मामले में जहां न्यूनतम निर्यात मूल्य निर्धारण पूरा कर दिया जाता है; और
( ख) उन संविदाओं के मामले में जिनमें 5000 मी ० टन से कम का केवल एक लदान हो बशर्ते कि न्यूनतम निर्यात मूल्य निर्धारण पूरा कर दिया जाता है ।

Subject :-Export of Barytes .
File No. 6/ 8 / 82 - EII .-Attention is invited to paragraph 8 of Public Notice No. 18 - ETC ( PN ) / 80 dated the 17th May , 1980 , and paragraph 2 ( ii) of Public Notice No. 30 - ETC ( PN ) / 80 dated the 21st June , 1980 , according to which the private parties ( the mine owners ) are requiredto enter into contract on MMTC's Standard Contractual terms etc.
It has been decided that export of barytes powder above 5,000 MTs . by mine-owners will be allowed subject to the floor price mechanism on the भारत का राजपत्र असाधारण

basis of the Standard Contract Forms currently in use subject to the following relaxations in clauses ( 1 ) , ( 2 ) and ( 5 ) respectively :-
( i ) Mine - owners will have the option of exporting either a specific quantity or a specific quantity plus or minus 10 % ;
( ii ) Minc - owners may be permitted to . export both OCMA /API grades of barytes powder ;
(iii ) Loading guarantee condition may be amended to permit loading guarantees of 750 to 1000 MT in case of bagged barytes ;
( iv) Condition of supplying half- a -percent empty bags free of charge with each consignment may be waived .
3. It has also been decided that the mine - owners can enter into C& F con- tracts subject to the condition that the effecive foreign exchange realisation is not less than the minimum floor prices announced from time to time in terms of FOB Indian Port /Madras .
4. The present standard form would not be applicable in the following cases :-
(a) In the case of international tenders , where the MEP stipulation is fully met ; and
(b ) For contracts involving single shipments of less than 5,000 MT provided the MEP stipulation is fulfilled .
