सा० का ० मि० 254 (अ ) राष्ट्रपति द्वारा जारी की गई निम्न- लिखित उद्घोषणा सर्वसाधारण के सूचनार्थ प्रकाशित की जा रही है।
यतः मुझे, भारत के राष्ट्रपति, नीलम संजीव रेड्डी को केरल के राज्य के राज्यपाल से एक रिपोर्ट प्राप्त हुई है और मुझे प्राप्त इस रिपोर्ट भौर अन्य सूचना पर विचार करने के बाद मेरा समाधान हो गया है कि ऐसी स्थिति उत्पन्न हो गई है कि जिसमें कि केरल राज्य का शासन भारत के संविधान जिसे इसमें इसके पश्चात् " संविधान " कहा गया है के उपबंधों के भनुमार नहीं चलाया जा सकता है;
अतः अब मैं, संविधान के अनुच्छेद 356 द्वारा प्रदत्त शक्तियों का तथा उस निमित्त मुझे समर्थ बनाने वाली अन्य सभी शक्तियो का प्रयोग करमे हुए एतद्वारा उद्घोषणा करता है कि मैं:--
(क) उक्त राज्य की सरकार के सभी कृत्य और उस राज्य के राज्यपाल में निहित या एत्र द्वारा प्रयोक्तव्य सभी पाश्तियां, भारत के राष्ट्रपति के रूप में अपने हाथ में लेता हूं;
(ख ) घोषित करता हूं कि उक्त राज्य के विधान मंडल क। शक्तियां संमद के प्राधिकार द्वारा या अधीन प्रयोक्तव्य होंगी ; श्रीर ( ग) निम्नलिखित आनुषंगिक और परिणामिक उपबंध करता हूं जो इस उद्घोषणा के उद्देश्यों को प्रभावी करने के लिए मुझे आवश्यक या बांछनीय प्रतीत होते हैं, अर्थात्:--
( i) इस उद्घोषणा के उपर्युक्त खंड ( क ) के श्राधार पर अपने हाथ में लिए गए कृत्यों और शक्तियों का प्रयोग करने में, मेरे लिए भारत के राष्ट्रपति के रूप में उम सीमा तक जिस तक मैं ठीक समझें उषत राज्य के राज्यपाल के माध्यम से कार्य करना विधिपूर्ण होगा ;
( ii) उस राज्य के संबंध में संविधान के निम्नलिखित उपबंधाँ के प्रवर्तन को एतद्वार। निलबित किया जाना है, अर्थात्:-
अनुच्छेद 3 के परन्तुक का उतना भाग जितने का मबध राष्ट्रपति द्वारा राज्य के विधान मंडल को निदेषण करने से है;
अनुच्छेव 151 के खंड ( 2 ) का उतना भाग जिनने का संबंध भारत के नियंत्रक -महालेखा परीक्षक द्वारा राज्यपाल को प्रस्तुत की गई रिपोर्ट के राज्य विधान मंडल के समक्ष रखे जाने से है; अमुच्छेव 163 भौर 16-4 ;
अनुच्छेद 166 के खंड ( 3 ) का उतना भाग जिनने का संबंध राज्य राग्यार के कार्यों का मंत्रियो के ब.अ आबंटन में है ; अनुच्छेद 167 और अनुच्छेद 169 के खंड ( 1 ) का उतना भाग जितने का संबंध राज्य की विधान सभा द्वारा संकल्प के पारित किए जाने से है ;

अनुच्छेद 174 का खंड ( 1) और खंड ( 2 ) का उपखंड ( क ) ; अनुच्छेद 175 से 178 तक जिममें ये दोनो सम्मिलित है , अनुच्छेद 179 का खंड (ख ) और ( ग) और उस अनुच्छेद का प्रथम परन्तुक्क और अनुच्छेद 180 और 181;
अनुच्छेद 186 का उतना भाग जिनने का सबध विधान सभा के उपाध्यक्ष के संबलमों और भत्तों से है; अमुच्छेद 188 , 189 , 193 , 194 , 195 तथा 196 ; अनुच्छेद 198 और अनुच्छेद 199 क। खंड ( 3 ) और खखंड ( 4 ) ;
अनुच्छेद 202 के खंड ( 3 ) का उतना भाग जितने का संबंध विधान सभा के उपाध्यक्ष के संबलमों ओर भनों से है; अनुच्छेद 208 से 211 तक जिसमें यह दोनों मम्मिलित है ; अनुच्छेद 213 के खंड ( 1 ) का परन्तुक और खंड ( ३ ) का परन्तुक; और
अनुच्छेद 323 के सखंड ( 2 ) का उतना भाग जितने का संबंध शापन सहित रिपोर्ट को राज्य के विधान मंडल के समक्ष रखे जाने से है।
(iii) संविधान में राज्यपाल के प्रति किसी निदेश क। श्रर्थ उस राज्य के संबंध में राष्ट्रपति के प्रति निदेश लगाय । जाएगा और उसमें राज्य के विधान मंडल या विधान सभा के प्रति किसी निवेण का, जहां तक उनका संबंध उसके कृत्यों और उसकी शक्तियों से है, अर्थ जब तक किसंदर्भ मे अन्यथा अपेक्षित नहीं , संसद के प्रति निदेश लगाया जाएग, और विशिष्टतया अनुच्छेद 213 में राज्यपाल और राज्य के विधान मंडल या विधान सभा के प्रति निदेश का अर्थ क्रमशः राष्ट्रपति और संमद या उसके सदनों के प्रति निवेश लगाया जाएगा;
परन्तु इममें कोई बात अनुच्छेद 153 , अनुच्छेव 155 से लेकर, मनुच्छेद 159 तक जिसमें ये दोनों भी सम्मिलित हैं, अमुच्छेद 299 और अनुच्छेय 361 तथा द्वितीय अनुसूची के पैरा 1 से 4 तक जिसमें ये दोनों भी सम्मिलित हैं के उपबंधों पर प्रभाव नहीं डालेगी और न राष्ट्रपति को इस खंड के उपखंड ( 1 ) के अधीन उम सीमा तक जहाँ तक वह ठीक समझे उक्त राज्य के राज्यपाल के माध्यम से कार्य करने से निवारित करेगी ;
( iv) संविधान में राज्य के विधान मंडल के या एतद्वारा बनाए गए अधिनियमों या विधियों के प्रति किसी निर्देश का ऐसे अर्थ लगाया जाएगा मानो उसके अंतर्गत इम उद्घोषणा के आधार पर संसद द्वा १ ये। राष्ट्रपति या संविधान के अनुच्छेद 357 के खखंड ( 1 ) के उपखंड (क) और केरल राज्य में यथा प्रवृत्त केरल निवभिन तथा साधारण खंड अधिनियम 1125 ( 1125 का अधि- नियम 7 ) में निविष्ट अन्य प्राधिकारी द्वारा राज्य के बिधान मंडल की शक्तियों का प्रयोग करते हुए बनाए गए अधिनियमों या विधियों के प्रति निवेश है , और साधारण खंड अधिनियम 1897 ( 1897 के दसवें) का उतना भाग जितना राज्य विधियों पर लागू है; ऐसे किसी अधिनियम या विधि के बारे में ऐसे प्रभावी होगा मानो यह उस राज्य विधान मडल का अधिनियम हो।

MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi , the 17th March , 1982 G.S.R. ( 254) (E) -The following proclamationby the Presi- dent is published for general information ;-
Whereas , I , Ncelam Sanjiva Reddy , President of India , have received a report from the Governor of the State of Kerala and after considering the report and other information received by me, I am satisfied that a situation has arisen in which the Government of Kerala cannot be carried on in accordance with the provisions of the Constitution of India (hereinafter referred to as "the Constitution " ) ;
Now, therefore , in exercise of the powers conferred by article 356 of the Constitution and of all other powers enabling me in that behalf, I hereby proclaim that I
(a) assume to myself as President of India all functions of the Government of the said State and all powers vested in or exercisable by the Governor of that State ;
(b) declare that the powers of the Legislature of the said State shall be exercisable by or under the authority of Parliament; and
(c) make the following incidental and consequential provi- sions which appear to me to be necessary or desirable for giving effect to the objects of this Proclamation , namely:-
(i) in the exercise of the functions and powers assumed to myself by virtue of clause ( a ) of this Proclama- tion as aforesaid , it shall be lawful for me as Presi- dent of India to act to such extent as I think fit through the Governor of the said State;
( ii ) the operation of the following provisions of the Constitution in relation to that State is hereby sus- pended, namely :-
so much of the proviso to article 3 as relates to the reference by the President to the Legislature of the State;
so much of clause (2) of article 151 as relates to the laying before the Legislature of the State of the reports submitted to the Governor by the Comptroller & Auditor-General of India ; articles 163 and 164 ;
so much of clause (3 ) of article 166 as relates to the allocation among the Ministers of the business of the Government of the State;
article 167 and so much of clause ( 1 ) of article 169 as relates to the passing of a resolution by the Legisla- tive Assembly of a State ;
174; clause( 1) , and sub -clause ( a ) of clause ( 2) , of article
articles 175 to 178 (both inclusive ) ; clauses ( b) and ( c ) of article 179 and the first pro- viso to that article and articles 180 and 181 ;
so much of article 186 as relates to the salaries and allowances of the Deputy Speaker of the Legislative Assembly; articles 188 , 189, 193 , 194, 195 and 196; article 198 and clauses (3 ) and (4) of article 199 ;

so much of clause ( 2) of article 323 as relates to the laying of the report with a memorandum before the Legislature of the State;
(iii ) any reference in the Constitution to the Governor shall in relation to the said State be construed as a reference to the President , and any reference therein to the Legisla- ture of the State or the Houses thereof shall , in so far as it relates to the functions and powers thereof, be construed, unless the context otherwise requires , as a reference to Parliament , and , in particular , the references in article 213 to the Governor and to the Legislature of the State or the House thereof shall be construed as references to the President and to Parliament or the Houses thereof respectively ;
Provided that nothing herein shall affect the pro- visions of article 153 , articles 155 to 159 ( both inclusive ) article 299 and article 361 and paragraphs 1 to 4 (both inclusive ) ) of the Second Schedule or prevent the Presi- dent from acting under sub- clause ( i ) of this clause to such extent as he thinks fit through the Governor of the said State;
( iv) any reference in the Constitution to Acts or laws of or made by the Legislature of the State shall be construed as including a reference to Acts or laws made , in exercise of the powers of the Legisla- ture of the State , by Parliament by virtue of this Proclamation , or by the President or other authority referred to in sub- clause (a ) of clause ( 1 ) of ar.icle 357 of the Constitution , and the Interpretation and General Clauses Act , 1125 (Act VII of 1125 ) as in force in the State of Kerala , and so much of the General Clauses Act, 1897 ( 10 of 1897) as applies to State laws , shall have effect in relation to any such Act or law as if it were an Act of the Legisla- ture of the State .

भारत के संविधान के अनुच्छेद 356 के अधीन मेरे द्वारा भाऊ मार्च, 1982के सत्तरहवें दिन जारी की गई उद्द्घोषणा के खंड ( १ ) के उप- खड ( 1 ) का अनुसरण करते हुए मैं एतद्धारा निर्देश देशा है कि केरल राज्य सरकार के सभी कृत्य और सावधान के अर्ध.न या उस राज्य में प्रवृत्त किया विधि के अधीन उम राज्य के रज्यपाल में निहित या प्रयोवनच्य मभः शक्तियों, जिनको राष्ट्रपति ने उक्त उद्घोषणा के न्यूड ( क ) के आधार पर अपने हाथ में ले लिया है, राष्ट्रपति के अर्ध.क्षण निर्देशन और नियन्त्रण के अध्याधीन रहते हुए, उक्त २.ज्य के २ ,ज्यपाल द्वारा भी प्रयेोक्तःर होंगा ।

G.S.R. 255 (E)-The following Order by the President is published or general information :-
In pursuance of sub- clause ( i) of clause (c) of the Proclama- tion issued on this the 17th March, 1982 ,by me under article 356 of the Constitution of India , I hereby direct that all the functions of the Government of the State of Kerala and all the powers vested in or exercisable by the Governor of that State under the Constitution or under any law in force in that State, which have been assumed by the Presidentby virtue of clause (a) of the said Proclamation , shall , subject to the superintendence direction and control of the President , be exercisable also by the Governor of the said State .
