सा० भा० ति० 259 (अ) केन्द्रीय भरकार, सरकारी बचत पत्न अधिनियम, 1959 ( 1959 का 46) की घाय 12 द्वारा प्रदत शक्तियों भार प्रयोग करते हुए निम्नलिखित नियम बनाती है अर्थात्:--
1. संक्षिप्त नाम, प्रारम्भ और लागू होना :--( 1 ) इन नियमों का संक्षिप्त नाम सामाजिक सुरक्षा नियम, 1982 है ।
(2) ये 1-6-1982 को प्रवृत्त होंगे ।
( 3 ) ये सामाजिक सुरक्षा पक्ष को लागू होंगे ।
2. परिभाषाएं:-इन नियमों में जब तक कि संदर्भ में अन्यथा अपेक्षित न हो
(i ) " अधिनियम " से सरकारी बचत पत्र अधिनियम 1959 (1959 का 46) अभिप्रेत है ;
( ii ) "पक्ष" से सामाजिक सुरक्षा पत्र अभिप्रेत है ;
(iii ) " डाक सर्किल" से महाडाकपाल या निवेशक , सैभिक डाक सेवा के प्रशासनिक प्राधिकार के अधीम श्राने वाले डाकनर अभिप्रेत हैं ;
(iv) " सहकारी सोसाइटी " में सहकारी सोसाइटी अधिनियम, 1912 (1912 का 2) के अधीन या उस समय प्रबूत किसी अन्य विधि के अधीन रजिस्ट्रीकृत या रजिस्ट्रीकृत समझी गई सोसाइटी अभिप्रेत है ;
(v) " निगम" से उस समय प्रवृत किसी विधि द्वारा या उसके अधीन स्थापित निगम अभिप्रेत है किन्तु कंपनी इसके अन्तर्गत नहीं है ;
(vi) "प्ररूप" से इन नियमों से संलग्न कोई प्ररूप अभिप्रेत है ;
(vii ) "सरकारी कंपनी" से कंपनी अधिनियम 1956 ( 1956 का 1), की धारा 617 में यथापरिभाषित कंपनी अभिप्रेत है ;
( viii) " पहचान पर्ची" से ऐसी पहचान पर्ची अभिप्रेत है जो नियम 11 के अधीन किसी पत्न के धारक को दी गई है ;
(ix) "स्थानीय प्राधिकरण" से ऐसा नगर निगम , नगरपालिका समिति, जिला बोर्ड, पत्तन श्रायुक्त निकाय या अन्य प्राधिकरण अभिप्रेत है, जो नगरपालिका या स्थानीय विधि के नियंत्रण या प्रबंध के लिए विधिक रूप से हकवार हूँ या जिसे ऐसा नियंत्रण या प्रबंध सरकार द्वारा न्यस्त किया गया है ;
(x) "पुराना पत्र" से ऐसा पत्र श्रभिप्रेत है जो डाकबर बचत पत्र नियम, 1960 य। राष्ट्रीय बचत पत्र ( प्रथम निर्गम) नियम, 1965 या राष्ट्रीय बचत-पत्र ( चतुर्थ निर्गम) नियम , 1970 या राष्ट्रीय बचत -पद्म (पंचम निर्गम ) नियम, 1973 या राष्ट्रीय बचत वार्षिकी पक्ष नियम , 1976 या राष्ट्रीय बन्नन-पन (षष्ठम निर्गम ) नियम, 1981 या राष्ट्रीय

प्रश्वत-पत्र ( सप्तम निर्गम) नियम 1981 या रराष्ट्रीय विकास बंधपत्र नियम, 1977 के अधीन दिया गया है ,
(xi) " डाकयर" से भारत में ऐसा डाकघर अभिप्रेत है जो बचत बैंक का कार्य कर रहा है ।
3. वे प्रभिधान जिनमें ये पत्न दिए जाएंगे ।
पत्र 500 रु ० श्रीर 1000 रु ० के अभिधानों में जारी किए जाएंगे
4. परिपक्वता अवधि प्रमाणपत्ल की परिपक्वता अवधि नियम 8 के अधीन पत्त जारी किए जाने की तारीख से 10 वर्ष गो ।
5. पत्त्रों के क्रय के लिए प्रक्रिया भोर रातें कोई व्यक्ति या तो स्वयं लघु बचत योजना के किसी प्राधिकृत अभिकर्ता के माध्यम से प्ररूप 1 में ( जो सभी डाकघरों में मुफ्त मिलता है) आवेवन 1-6-1982 को या उसके पश्चात् किसी डाकघर में प्रस्तुत करके, निम्नलिखित शर्तों के अधीन रहते हुए पत्त्र क्रय कर सकता है, अर्थात्:-
(क) भावेवक, किसी डाकघर में श्राना भावेदन प्रस्तुत करने के समथ , 18 वर्ष से कम श्रायु का घौर 45 वर्ष से अधिक प्राबू का नहीं होगा ।
स्पष्टीकरण:
इस खंड के प्रयोजन के लिए , आवेदक की जन्म की तारीख का उल्लेख कारने वाले निम्नलिखित दस्तावेजों में से किसी भी एक को आय के सबूत के रूप में स्वीकार किया जाएगा, प्रर्थात्
(i ) संबद्ध स्थानीय प्राधिकारी द्वारा जारी किया गया जन्म का
प्रमाण पत्र ;
( ii ) मैट्रिकुलेशन प्रमाणपत्त्र या उसका समतुल्य ;
( iii ) किती मान्यता प्राप्त विद्यालय , महाविद्यालय या अन्य शैक्षिक संस्था द्वारा जारी किया गया प्रमाणनत्र ,
( iv ) बपतिस्मा प्रमाण पत्र ;
(v) जीवन बीमा पालिसी या जीवन बीमा प्रीमियम की पहलो रसीव जहां उसमें दर्शायी गई जन्म की तारीख भारतीय जीवन ीमा निगम या डाक जीवन बोमा प्राधिकारियों द्वारा स्वीकार की गई है या या उक्त निगम या प्राधिकारियों द्वारा जारी किया गया कोई पत्र ;
( vi ) नियांजक द्वार। रखा गया सेवा श्रभिदेव, परन्तु यह तब जब कि नियोजक द्वारा जन्म की तारीख स्वीकार कर ली गई है ;
(ख) प्रावेदक का स्वास्थ्य अच्छा होगा और आवेदन को तारीख से पूर्ववर्ती तीन वर्ष की अवधि के दौरान वह दमा , न्युभोनिया, खून की उल्टी, यक्ष्मा , उच्च और निम्न रक्न चाप, रूमेटी ज्वर, मधुमेह, पीलिया गर्दै के किसी टांग , प्रास्टेट ग्रन्थि या मूत्र मंत्र, पक्षाषात, उन्मत्तता , अपस्मार किसी भी प्रकार के दौरे या तांत्रिका विकार या मस्तिष्क या तंत्रिकातंत्र के किसी अन्य रोग कैंसर, कुष्ठरोग, गठिया ह्यूमर या तिज रोग से पीड़ित ता नही रहा है या ऐसी कोई शल्य क्रियश नहीं कराई है जिसके परिणाम स्वरूप श्रावेदक को दस विन से अधिक के लिए अस्पताल में रहना प हो ;
(ग) जहा किसी भी समय भावेदक के जीवन के बीमा का प्रस्ताय भारतीय जीवन बीमा निगम को या डाक जीवन बीमा स्कीम के अधीन किया गया है वहां ऐसा प्रस्ताव उक्त निगम द्वारा या उक्त स्कीम के अधीन अस्वीकार नही किया गया है ;
(घ) प्ररूप 1 में आवेदन सभी प्रकार से पूरा होगा और उसके साथ उक्त प्ररूप में यथाविनिर्दिष्ट दस्तावेज लगाए जाएंगे और उस पर आवेदक के हस्ताक्षर यायवि वह निरक्षर है तो उसके भंगूठे का चिल्ल होगा जो किसी प्राधिकृत व्यक्ति को उपस्थिति में उसके द्वारा लगाया

जाएगा और उक्त प्ररूप में अन्तविष्ट घोषणाओं में, जैसा उसमें, अन्यथा निविष्ट है उसके सिवाय , किसी भी रति में कोई परिवर्धन विलोपन या उपान्तरण नहीं किया जाएगा ।
स्पष्टकरण : इम बंद के प्रयोजन के लिए "प्राधिकृत व्यक्ति" मे उस डाकघर का जिसमें आवेदन प्रस्तुत किया जाता है , डावाल या महा निदेशक अवतार द्वारा डाकबर का इस निमित्त प्राधिकृत कोई अन्य पदधारी या लघु बचत स्कीम का कोई प्राधिकृत श्रमिकर्ता श्रभिप्रेन है ;
(ङ) आवेदन के साथ आवेदित पक्ष के अंकित मूल्य का मंदाय किया जाएगा ;
(च) श्रावेवक इन नियमों के अधीन पहले ही क्रय किए गए किसी अन्य पत्त्र के ब्यौरे भी देगा ।
6. पत्र धारण करने की मोमा कोई भी व्यक्ति मिनी भी समय ऐसे सर्वांल अंकित मूल्य के जो 5000 १० ' से अधिक है, पत्तों का क्रय नहीं करेणा या उन्हें धारण नहीं करेगा । स्पष्टीकरण इस नियम के प्रयोजन के लिए
(क) किसी व्यक्ति द्वारा परिपश्यत। श्रवधि से परे धृत किसी पत्त्र को छोड़ दिया जाएगा ।
(ख) नियम 13 के अधीन ऐसे व्यक्ति द्वारा गिरवी रखे गए पत्र को गणमा में लिया जाएगा ।
7. बैध निविदा पत्न के क्रय के लिए संदाय निम्नलिखित रीतियों में से किसी में किसी डाकघर में किया जा सकेगा, अर्थात्:-
(1) नकव ;
(2) चैक, अवायगी आदेश या मथि वेय ड्राफ्ट ;
( 3 ) डाकघर बचत बैंक खाते से प्रत्याश्रण के लिए पासबुक सहित प्रत्याहरण प्ररूप , जो सम्यक रूप से हस्ताक्षरित है ;
(4) उस पुगने परिपक्व पत्त्र का अभ्यपर्ण, जो निम्नलिखित रूप में सम्यक रूप से उन्मोचित किया गया है "नए पत्त्र के जारी करने के संवाय प्राप्त हुभा
संलग्न श्रावेदन देखिए । "
8. पत्त्रों का जारी किया जाना ( 1) नियम 7 के अधीन संवाय करने पर उसके सिवाए , जहां संदाय चैक , अदायगी आवेण या मांगवेय ड्राफ्ट द्वारा किया जाता है , प्रसामान्यतः पत्त्र तत्काल जारी किया जाएगा और ऐसे पत्न की तारीख ऐसे संशय की तारीख होगी ।
( 2 ) जहां पत्त क्रय करने के लिए संदाय बैंक, अदायगी आदेश या मांग देय ड्राफ्ट के द्वारा किया जाता है वहां यथास्थिति , चैक, श्रादायगी - श्रावेश या मांग देय ड्राफ्ट के भागमों के बसूल होने से पूर्व ऐसा पत्र जारी नही किया जाएगा भीर ऐसे पत्र की तारीख , यथास्थिति, जैक , अदायगी आवेण या मांग वेय ड्राफ्ट के भुनाने की तारीख होगी ।
( 3 ) यदि किसी कारण से पत्त तत्काल जारी नहीं किया जा सकता है तो क्रेता को ऐसी अनंतिम रसीद दी जाएगी जो बाद में पक्ष में बदली जा सकेगी और ऐसे पत्र की तारीख बह होगी जो , यथास्थिति, उपनियम ( 1 ) या उपनियम ( 2 ) में विनिदिष्ट है ।
9. पुराने पत्त के आगमों के बदले में पत्त्र पुराने पत्र का ऐमा धारक , जो उस पत्त्र के भुनाने का हकदार है, प्ररूप 1 में इन नियमों के अधीन पत्न के जारी किए जाने के लिए आवेदन कर सकेगा और ऐसे श्रावेदन की प्राप्ति पर आवेदक को इन नियमों के अधीन पत्त्र जारी किया जाएगा भौर जारी करने की तारीख वह होगी , जिसको सम्यक्तः उन्मोचित पुराना पक्ष प्रस्तुत किया जाता है ।

10. अनियमित वृत्तियां ( 1 ) इन नियमों के उल्लंथन में क्रय या अर्जित किए गए किसी पन्त्र को धारक द्वारा यथाशीघ्र भुनाया जाएगा जैसे ही इन नियमों के उल्लंघन में धूलि के तथ्य के बारे में उसे पता चलता है और इन नियमों में उसलंघन में किसी धूति पर कोई ब्याज नहीं दिया जाएगा ।
11. पहचान पर्ची ( 1 ) यदि किसी पन्न के धारक द्वारा उस
डाकघर में, जहां पत्त्र रजिस्ट्रीकृत है, किमी भी समय पहचान पर्ची जारी फरने के लिए निवेदन धारक की पहचान पर्ची, उसके द्वारा उम पर जारी की जाएगी । किया जाता है, तो ऐसे हस्ताक्षर करने के पश्चात
(2) पत्ता के अन्तिम उन्मोचन के ममय पहचान पर्ची अभ्यपित की जाएगी या उमके खो जाने पर ऐसे स्त्रो जाने के बारे में डाकघर महानिर्देशक द्वारा अधिकथित प्ररूप में डाकघर को घोषणा वी जाएगी ।
12. एक डाक घर से दूसरे डाकघर को अन्तिरण ( 1) कोई
पत्र, किसी ऐसे डाक घर से , जहां वह रजिस्ट्रीकृत है , किसी अन्य डाकघर को, डाकतार महानिदेशक द्वारा अधिकथित प्ररूप में धारक द्वारा दोनों डाकघरों में से किसी डाकघर में आवेदन करने पर अन्तरित किया आ सकेगा ।
परन्तु जहां कोई व्यक्ति एक से अधिक पत्र धारण करता है और उनकी परिपक्वता अवधि समाप्त नहीं हुई है वहां ऐसे सभी पन्न एक ही डाक सर्किल के क्रिमी डाकघर या किन्हीं डाकघरों में रजिस्ट्रीकृत किए जायेंगे ।
13. पत्त्र का गिरवी रखा जाना उम कार्यालय का डाकपाल जहां पत्र रजिस्ट्रीकृत है
(क ) भारत के राष्ट्रपति या राज्य के राज्यपाल के पास उसकी शामकीय हैमियन में,
(ख) भारतीय रिजर्व बैंक या किमी अनुसूचित बैंक या सहकारी मोमायटी जिसके अन्तर्गत महकारी बैंक भी हैं,
(ग ) किसी निगम या सरकारी कम्पनी के पाम; और
(घ ) किसी स्थानीय प्राधिकरण के पाम ;
देगा: प्रतिभूमि के प्प में गिरवी रखने के लिए पत्र के अन्तरण की अनुशा
परन्तु यह तब अब कि ऐसे अन्तरण के लिए पत्र के धारक और गिरवीदार द्वारा महानिदेशक , डाक तार द्वारा अधिकथित के प्ररूप में आवेदन किया जाना है ।
( 2 ) जब उपनियम ( 1 ) के अधीन किमी पत्र का अन्तरण किया जाता है तो ऐसे कार्यालयों का डाकपाल जहां पत्त्र रजिस्ट्रीकृत है पत्र पर निम्नलिखित पृष्ठांकंन करेगा, अर्थातः
को अंतरित" "प्रतिभूमि के रूप में
( 3) इन नियमों में जैसा श्रन्यथा उपबन्धित है उस के मिवाय , इम नियम के अधीन किमी पत्र के गिरवीदार के बारे में तब तक यह समझा जाएगा कि वह पत्र का धारक है जब तक कि उसका पुनः अन्तरण उपनियम ( 4 ) के अधीन नहीं हो जाता है ।
(4) उपनियम ( 2 ) के अधीन अंतरित पक्ष को गिरवीदार के लिखित प्राधिकार पर, प्राधिकृत डाकपाल की लिखित रूप में पूर्व मंजूरी से पुनः अन्तरित किया जा सकेगा और जब ऐसा पुनः अन्तरण किया जाता है तब ऐसे कार्यालय का, जहां पत्र रजिस्ट्रीकृत है डाकपाल , पत्त्र पर निम्नलिखित पृष्ठांकन करेगा प्रथति-
का पुनः अंर्ताग्म " ।
टिप्पण 1-भारत सरकार का ऐसा राजपक्षित अधिकारी जो राष्ट्रपति या राज्य के राज्यपाल की ओर में उपनियम ( 1 ) के अधीन प्रतिभूमि के रूप में पश्न स्वीकार करता है या उपनियम ( 4 ) के अधीन गिरवी का निर्मोमन करता है , यह प्रमाणित करेगा कि वह भारत के राष्ट्रपति, राज्य के राज्यपाल की श्रार से लिखित या विलेख निष्पादित करने के लिए संविधान के अनुच्छेव 299 के अधीन सम्यक रूप से प्राधिकृत है और उसे इस प्रकार प्राधिकृत करने वाली सरकार की अधिसूचना के संत्रांक और तारीख की विशिष्टियां भी देगा ।
टिम्पण 2 यथास्थिति भारतीय रिजर्व बैंक या किसी अनुसूचित बैंक या किसी सहकारी सोसायटी का, जिसके अन्तर्गत सहकारी बैंक भी है, किसी निगम का किसी सरकारी कंपनी या किसी स्थानीय प्राधिकरण का ऐसा अधिकारी जो संबंधित संस्था की ओर से उपनियम ( 1) के अधीन प्रतिभूर्भात के रूप पत्र स्वीकार करता है या उपनियम ( 4) के अधीन गिरवी का निर्मोचन करता है तारीख महित अपने हस्ताक्षर और कार्यालय की मुद्रा के अधीन यह प्रमाणित करेगा कि वह उक्त संस्था के अनुच्छेदों के अधीन उसकी ओर से ऐसी लिखित या विलेख निष्पादित करने के लिए सम्यक रूप से प्राधिकृत है ।
(5) जहां किसी पत्र पर उपनियम ( 2 ) और ( 4) के अधीन किए गए अनेक पुष्ठांकनों के परिणामस्वरूप उम पत्र पर उसी प्रकार का अतिरिक्त पृष्ठांन करने के लिए कोई स्थान शेष नही रहता है, वहां ऐसे पत्र के बदले में रजिस्ट्रीकरण के कार्यालय के डाकपाल द्वारा एक नया पत्त्र जारी किया जा सकेगा ।
(6) उपनियम ( 6 ) के अधीन जारी किए गए किसी नए पत्त्र को इन नियमों के सभी प्रयोजनों के लिए उम पश्न के समतुल्य समझा जाएगा जिनके बदले में वह जारी किया गया है ।
14. खो गए या नष्ट हो गए पत्त्र का प्रतिस्थापन ( 1 ) यदि कोई पत्र ब्रो जाना है चोरी हो जाता है , नष्ट हो जाना है , विकृत हो जाता है या विरूपित हो जाता है तो उसका हकवार व्यक्ति , उम प्राकघर को, जहां पत्र रजिस्ट्रीकृत है या किसी अन्य डाकघर को , जिस वशा में आवेदन उम डाकघर को, जहां पत्न रजिस्ट्रीकृत है, भेज दिया जाएगा, पत्त्र की दूसरी प्रति किए जाने के लिए आवेदन कर सकेगा ।
(2) ऐसे प्रत्येक भावेदन के साथ निम्नलिखित होंगे , अर्थान.-
(क) विशिष्टियां दर्शित करने वाला विवरण, जैसे कि पत्त्र का संख्यांक, रकम और तारीख तथा वे परिस्थितियां जिनमें ऐसी हानि , चोरी विनाश, विकृति या विरूपण हुआ है,
( ख) पहचान पीं, यदि कोई हो ।
(3) यदि उस डाकघर के, जहां पत्र रजिस्ट्रीकृत है, भार माधक अधिकारी का पत्र खो जाने, चोरी , विनाश , विकृति या विश्पण के बारे में समाधान हो जाना है , तो वह पत्त्र की दूसरी प्रति सब जारी करेगा जब भावेदक एक या अधिक अनुमोदित प्रतिभूतियों या बैंक, गारण्टी सहित डाकतार महानिदेशक द्वारा अधिकथित प्ररूप में एक क्षतिपूरि बन्धपत्र दे देता है ।
परन्तु यह कि जहां खो गए, बोरी हुए, नष्ट हुाए , विकृत हुए या विरुपित हुए पत्त्र का अंकित मूल्य 500 रु ० है वहां पत्त्र या पत्नों की दूसरी प्रमि ऐमी प्रतिभूति या गारन्टी के बिना एक क्षतिपूति बम्धपत्र देने पर आवेदक को जारी की जा सकेगी ।
परन्तु यह और कि जहां ऐसा आवेदन ऐसे पत्र के बारे में किया जाता है जो विद्युत या विरूपित है , तो चाहे वह किलने ही अंकित मूल्य का है वहां पत्त्र की दूमरी प्रति ऐसे किसी क्षतिपूर्ति बम्धपत्र प्रतिभृति या गारन्टी में बिना मत्र जारी की जा सकेगी, जब विकृत या विरूपित पश्न और पहचान पत्री, यदि कोई हो का अभ्यःण किया जाता है और पत्र की पहचान मूल रूप से जारी किए गए पत्र के रूप में की जा सकती है ।

(4) उपनियम ( 3 ) के अधीन जारी की गई पत्त की दूसरी प्रति को इम नियमों के सभी प्रयोजनों के लिए मूल पत्त के समतुल्य माना जाएगा सिवाय इसके कि इसे उस बाकधर से, जिसमें ऐसे पत्र का रजिस्ट्रीकरण हुआ है, भिन्न किसी डाकघर में पूर्व सत्यापन के बिना भुनाया नहीं जा सकेगा ।
15. नामनिर्देशन: ( 1 ) उपनियम ( 2 ) से ( 4) के उपबंधो के अधीन
रहते हुए, पत्र का धारक, पक्ष क्रय करते हुए समय -समय प्ररूप 1 में भाषश्यक विशिष्टियों भर कर ऐसे किसी व्यक्ति या किन्हीं व्यक्तियों को माम निर्दिष्ट कर सकेगा जो धारक की मृत्यु की दशा में पक्ष और उस पर शोध्य रकम के संदाय के हकदार होंगे । यदि पत्र क्रय करते समय ऐसा कोई नामनिर्देशन नहीं किया जाता है तो धारक, पत्त क्रय करने के पश्चात किसी भी समय , किन्तु उसके परिपक्व होने के पूर्व, उस डाकघर के जहां पत्त्र रजिस्ट्रीकृत है, डाकपास को प्ररूप 2 में एक आबेदन करके नाम निर्देशन कर सकेगा ।
( 2 ) इस नियम के अधीन पत्त के धारक द्वारा किए गए नाम निर्देशन को, उस डाकघर के जहां वह रजिस्ट्रीकृत है डाकपाल को पत्त्र सहित प्ररूप 3 में भावेवन करके रद्द या परिवर्तित किया जा सकेगा ।
(3) विभिन्न तारीखों पर रजिस्ट्रीकृत किए गए पक्षों की बाबत नाम निर्देशन के लिए या किसी नाम निर्देशन के रकरण या किसी , माम निर्देशन में परिवर्तन करने के लिए पृथक आवेदन किए जायेंगे ।
(4) नाम निर्देशन या किसी नाम निर्देशन का रद्दकरण या किसी नाम निर्देशन में परिवर्तन संबद्ध प्रधान डाकघर में रजिस्ट्रीकृत किया जाएगा और रजिस्ट्रीकरण का तथ्य पश्न पर लिखा जाएगा भौर ऐसे रजिस्ट्रीकरण पर यथास्थिति उक्त नाम निर्देशन या नाम निर्देशन का रहकरण या परिवर्तन उस तारीख से प्रभावी समझा जाएगा जिस तारीख को पन्त्र प्रस्तुत किया गया था ।
15. परिपक्व होने पर संदाय का किसी पत्न की परिपक्वता अवधि की समाप्ति पर, यथास्थिति उसका धारक या उसकी मृत्यु होने की वशा में, उसका माम निर्देशिती या यदि कोई उत्तरजीवी नामनिर्देशिती महीं है तो धारक का विधिक वारिस , यदि पत्त्र 500 रु ० के अभिधान का है तो ब्याज सहित 1500 रु० या यदि पत्र 1000 रु० के अभिधान का है तो ३००० रु० की राष्थि प्राप्त करने का हकदार होता भौर ऐसा ब्याज नीचे सारणी में यथा विनिर्दिष्ट रूप में प्रत्येक वर्ष के अंत में प्रोवभूत होगा और इस प्रकार प्रोषभूत होने वाला व्याज प्रत्येक वर्ष के अन्त में मवें वर्ष के अंत तक धारक की घोर से पुर्नाभिहित किया गया माना जाएगा और पत्र के अंकित मूल्य की रकम में जोड़ा जायेगा ।

[PART II-SEC. 3 ( i) ]
17. समय पूर्व भुनाना ( 1 ) नियम 16 में किसी बात के होते हुए , भी, पत्र, धारक के विकल्प पर, पल्ल की तारीख से तीन वर्ष की समाप्ति के पश्चात किसी भी समय बट्टे पर समय पूर्व भुनाया जा सकेगा और पैसे समय पूर्व भुनाए जाने पर संवेय रकम, पत्त्र के अंकित मूल्य और उत्तने पूर्ण वर्षों और मासों के लिए साधारण ब्याज सहित जिन में पत्न धारण किया गया है , रकम, के समतुल्य होगी । ऐसा व्याज उस दर पर संगणित किया जाएगा जो दर भुनाए जाने की तारीख को डाकघर बचत बैंक में एकल बातों के प्रवर्ग के बचत खातों को लागू होगी । पुर्वोक्त साधारण व्याज और नियम 16 के अधीन प्रोवभूत ब्याज के बीच के अन्तर को बट्टा माना जाएगा ।
( 2) उपनियम ( 1) और नियम 16 में किसी बात के होते हुए भी भौर उपनियम ( 3 ) और ( 4) के अधीन रहते हुए, किसी पक्ष को तीन वर्ष की समाप्ति के पूर्व निम्नलिखित परिस्थितियों में समय पूर्व भुनाया जा सकेगा, अर्थात:--
(क) जब गिरवी इन नियमों के अनुरूप है सब ऐसे गिरवीदार द्वारा समपहरण पर, या
(ख) न्यायालय का आदेण होने पर ।
( 3 ) यदि कोई पत्त्र, पत्न की तारीख से एक वर्ष की अवधि के भीतर उपनियम ( 2 ) के अधीन भुनाया जाता है तो पश्न का केबल अंकित मूल्य संदेय होगा और कोई ब्याज मंदेय महीं होगा ।
(4) यदि कोई पत्र, उपनियम ( 2 ) के अधीन, पत्र की तारीख से एक वर्ष की समाप्ति के पश्चात किन्तु तीन वर्ष की समाप्ति के पूर्व भुनाया जाता है तो भुनाया जाना बट्टे पर होगा और संदेय रकम तणा बट्टा वह होगा. जो उपनियम ( 1 ) में विनिर्दिष्ट है ।
18. परिपक्वता अवधि के दौरान धारक के मुत्यु हो जाने की दशा में संदाय: (1) नियम 21 और उपनियम ( 2 ) , ( 3 ) और ( 4 ) , के अधीन रहते हुए , किसी पत्र के धारक की
(क) पश्न के जारी किए जाने की तारीख से दो वर्ष की समाप्ति के पश्चात् और उस पत्त्र की परिपक्वता अवधि की समाप्ति के पूर्व किसी भी समय किसी भी कारण से; या
( ख) पन जारी किए जाने की के पूर्व किसी भी समय कारणों से तारीख से दो वर्ष की समाप्ति किसी एक या अधिक अप्राकृतिक
मृत्यु हो जाने पर, यथास्थिति नामनिवशिती , या; यदि कोई उत्तर जीवी नाम निर्देशिती नहीं है तो धारक का विधिक वारिस, मृत धारक द्वारा धृत प्रत्येक ऐसे पत्र की बाबत यथा स्थिति, 500 रु० या 1000 रु० के पक्ष के अभिधान के अनुसार 1500 रु ० या 3000 रु० की राशि का संदाय प्राप्त करने का हकदार होगा ।
स्पष्टीकरण: खंड ( ख ) के प्रयोजन के लिए "मप्राकृतिक धारण " से बाह्य, हिंसात्मक और दृष्य साधनों से हुई दुर्घटनाएं अभिप्रेत हैं और इसके अन्तर्गत रेल तथा सड़क दुर्घटनाएं विद्युन्मारण, सर्वदश, डूबना भग्नि और जंगली पशुओं द्वारा आक्रमण है किन्तु आत्म-क्षति और आत्म हत्या इसके अंतर्गत नहीं है ।
( 2) यदि इस बाबत शंका उत्पन्न होती है कि धारक की मृत्यु आत्म-ति या आत्महत्या से भिन्न किसी श्रप्राकृतिक कारण से हुई थी या नहीं, तो उस जिला कलक्टर या जिला मजिस्ट्रेट द्वारा जिसकी अधि- कारता में मृत्यु का स्थान श्राता है, प्ररूप 4 में दिया गया प्रमाणपत्र अम्तिम होगा ।
( 3) उपनियम ( 1 ) के प्रधीन सदाय मृत धाररु द्वारा धूम 5000 १० के सफल अंकित मूल्य की सीमा तक निर्बन्धित होगा और मूत धारक द्वारा ऐसी सीभा से अधिक धूत और जो उसकी मृत्यु की तारीख।।
[भाग II-खण्ड 3 ( 1 ) 1
को परिपक्व नहीं हुए हैं किसी पत्त्र की बाबत ऐसे पत्त का अंकित मूल्य उसकी परिपक्वता अवधि की समाप्ति पर ही बिना किसी व्याज के यथास्थिति, धारक के नाम निर्देशिती या विधिक वारिस को संदेय होगा:
परन्तु यह कि ऐसा अंकित मूल्य, यदि पत्त्र
(क) जब गिरवी इन नियमों के अनुरूप है तब ऐसे गिरवीदार द्वारा पत्र के समपहरण पर, या
(ख) न्यायालय का भावेश होने पर, प्रस्तुत किया जाना है तो बिना ब्याज के तुरन्त संषेय होगा ।
( 4) यदि ऐसा पाया जाता है कि धारक की जन्म की तारीख के संबंध में या पक्ष को जारी किए जाने या उसके संदाय से सुमंगत किसी अन्य सारवान तथ्य के विषय में किसी भी प्रक्रम पर कपटपूर्ण अयभायें कथन किया गया है या सूचना छिपाई गई है तो उस दशा में, पैसे पत्त्र का अंकित मूल्य उसकी परिपक्वता अवधि की समाप्ति पर ही बिना किसी ब्याज के यथास्थिति उसके नाम निर्देशिती या विधिक बारिस को संदेय होगा :
परन्तु यह कि ऐसा अंकिन मूष्य , यदि पत्न
(क ) जब गिरधी इन नियमों के अनुरूप , है तब ऐसे गिरवीदार द्वारा पक्ष के ममपहरण पर , या
(ख) न्यायालय का आवेश होने पर,
प्रस्तुत किया जाता है तो बिना ब्याज के तुरन्त संवैय होगा ।
स्पष्टीकरण: इस उपनियम के प्रयोजन के लिए यवि इस संबंध में यह प्रश्न उठता है कि धारक की जन्म की तारीख के संबंध में या पत्र को जारी किए जाने या उसके संवाय से सुसंगत किसी अन्य साम्रान तथ्य के विषय में कपटपूर्ण श्रयथार्थ कथन किया गया है या नहीं श्रभ्यथा सूचना छिपाई गई है या नहीं, तो उस संबंध में केन्द्रीय सरकार का विभिश्चय अंतिम होगा ।
( 5) उय मामलों में जो उपनियम ( 1 ) के खंड ( ख) के अंतर्गत नाही आते है , किसी पक्ष के धारक की, पत्र की तारीख से दो वर्ष की समाप्ति के पूर्व किसी भी समय मृत्यु हो जाने पर, नामनिर्देशिनी या, यदि कोई उत्तरजीवी नाम निर्देशिती नहीं है तो धारक का विधिक बारिस, अपने विकल्प पर-
( i) पत्र को उसकी परिपक्वता अर्षाध की समाप्ति पर भुना सकेगा जिस दशा में वह पत्र के 500 रु० या 1000 रु ० के अभिधान के अनुसार यथास्थिप्ति 1500 रु ० या 3000 रु० की राशि प्राप्त करने का हकदार होगा , या
( ii ) पत्र को उसकी परिपक्वता अर्थाध की समाप्ति के पूर्व किसी समय भुना सकेगा जिम दणा में वह नियम 17 के उपनियम ( 1 ) में यथाविनिद्दिष्ट भ्याज सहित पत्र के अंकित मूल्य के समतुल्य राशि प्राप्त करने का हकदार होगा परन्तु यदि पत्त्र उसकी तारीख से एक वर्ष की समाप्ति के पूर्व भुनाया जाता है तो ऐसा कोई ब्याज संदेय नहीं होगा ।
19. भुनाए आने का स्थान कोई पत्त्र उस आकषर से, जहां बह रजिस्ट्रीकृत है भुनाया जा सकेगा :
परभ्यु पम्न को किसी अन्य डाकघर से यदि उस डाकघर के भार- साधक अधिकारी का, पहचान पर्ची प्रस्तुत करने पर या उसमे रजिस्ट्रीकरण के डाकघर से यह मत्यापन करने पर कि भुनाने के लिए पत्त्र प्रस्तुत करने वाला व्यक्ति उनके लिए हकदार है , समाधान हो जाप्ता है, भुनाया जा सकेगा ।
20 पत्रो का उत्मोचन ( 1 ) किमी पक्ष के अधीन देय रकभ को प्राप्त करने का हकदार व्यक्ति, इसके भुनाए जाने पर, उमके पीछे संदाय प्राप्त करने के प्रमाण के रूप में हस्ताक्षर करेगा ।

(2 ) पन भुनाने वाले किसी व्यक्ति को डाकघर द्वारा उन्मोचन का प्रमाणपत्र विया आ सकेगा ।
21.नामनिवेशितियों या विधिक बारिसों के वाषे :
( 1 ) यथास्थिति , नियम 16 या 18 के अधीन शोध्य के संदाय का दावा करने के प्रयोजन के लिए , धारक का नामनिर्देशिती या विधिक वारिस उस कार्यालय के , जहां पत्र रजिस्ट्रीकृत है , डाकपाल को आवेदन करेगा और ऐसे आवेदन के साथ निम्नलिखित अर्थात्:-- रकम भेजेगा,
(i) वह पत्र जिस पर मंदाय का दावा किया है ;
( ii) पत्र के धारक की मृत्यु का सबूत ;
(iii ) मृत नामनिर्देशिती की , यदि कोई है , मृत्यु का सबूत ;
(iv) नियम 18 के उपनियम ( 1 ) के खंड ( ख ) के अन्तर्गत भाने वाले मामलों में, जिला कलक्टर या जिला मजिस्ट्रेट द्वारा हस्ताक्षरित प्ररूप 4 में मुख्य प्रमाणपत्र;
(2 ) यदि, एक से अधिक यथास्थिति , नामनिर्देशिती या वाशिस हैं तोबेसंवाय प्राप्त करते समय पत्र का संयुक्त उन्मोचन करेंगे ;
(3 ) जय नामनिर्देशिती अवयस्क है तो अधिनियम की धारा 6 की उपधारा ( 3 ) के अधीन नियुक्त व्यक्ति पत्त्र भुनाते समय यह प्रमाणित करेगा कि अवयस्क जीवित है और रकम भवयस्क की ओर अपेक्षित हैं ।
(4) अधिनियम की धारा 7 की उपधारा ( 4) के प्रयोजन के लिए नीचे दशिप्त प्राधिकारी पत्र के धारक की मृत्यु पर प्रत्येक के सामने दी गई सीमा तक उसकी बिल के प्रोबेट या उसकी संपदा के प्रशासन पत्र या भारतीय उत्तराधिकार अधिनियम , 1925 ( 1925 का 39) के अधीन विए गए उत्तराधिकारों प्रमाणपत्र के प्रस्तुत किए बिना दावे को मंजूर करने के लिए सक्षम होंगे:-

22. सेना, वायु सेना और नौसेना के कामिकों द्वारा धूत पत्रों का भुनाया जाता:--जहा पन्त्र ऐसे व्यक्ति द्वारा धूत है जो सेना अधिनियम, 1950 ( 1950 का 46 ) या वायुसेना अधिनियम , 1950 ( 1950 का 45) या नौसेना अधिनियम, 1957 ( 1957 का 62 ) के अधीन है घौर ऐसे व्यक्ति की मृत्यु हो जाती है या वह अभित्यजन करता है वहां उम कोर, विभाग , दुथड़ी , यूनिट या पोत का, जिसका किः मूत व्यक्ति या यभिमाजकः था , यथास्थिति , कमान माफिस या समायोजन समिति उम् डाकघर के भारसाधक अधिकारी को , जहां पत्र रजिस्ट्रीकृत है , पत्र क अधीन देय रकम का उसे संवाय करने के लिए एक अध्यापेक्षा भेज सकेगा 334

सकेगीऔर डाकघर का भारसाधक अधिकारी ऐसी अध्यापेक्षा का अनुपालन करने के लिए तब भी बाध्य होगा जब पत्र के धारक की मूत्यु या अभि- त्यजन के समय किसी व्यक्ति के हक में किया गया कोई नामनिर्देशन प्रवृत्त है ।
स्पष्टीकरण:-उपर्युक्त अध्यापेक्षा , सेना या वायु सेना के व्यक्ति की दशा में सेना और वायुसेना (प्राइवेट मम्पत्ति का व्ययम ) अधिनियम , 1950 ( 1950 का 40 ) की धारा 3 या 4 के अधीन या नौसेना के व्यक्ति की दशा में नौसेना अधिनियम , 1957 ( 1957 का 62) की धारा 171 या धारा 172 के अधीन की जाएगी ।
23. एक अभिधान से दूसरे में संपरिवर्तन :--
( 1) धारक द्वारा इन निमिस आवेदन किए जाने पर कम श्रभिधानों के पश्न उसी सकल अंकित मूल्य के उससे अधिक अभिधान के पत्त्र या पक्षों में बदले जा सकेंगे या अधिक अभिधान का पत्र उसी सक्न अंफित मूल्य के उससे कम अभिधान के पत्रों में बदला जा सकेगा :
परन्तु भिन्न तारीखों वाले, पत्तों को उच्चतर अभिधान के पन या पत्नों में बदलने के लिए मिलाया नहीं जाएगा ।
( 2) बदले गए पत्त्र या पत्रों के जारी किए जाने की तारीख वहो होगी जो अभ्यर्पित किए गए भूल पन्त्र या पत्तों की है , न कि वह तारीख जिसको पत्त्र बदला गया है ।
2.4. श्रयकर :-आयकर अधिनियम , 1961 ( 1961 को 43) के अधीन इम पत्रों के ब्याज पर आयकर, नियम 16 में विनिर्दिष्ट वार्षिक प्रोद्भवन के आधार पर लगेगा किन्तु पत्र के उन्मोचन मूल्य के संदाय के मभय आयकर की कोई कटौती नहीं की जाएगी ।
परम्सु नियम 18 के उपनियम ( 1 ) के अधीन धारक के नामनिर्देशिती याविधिक वारिस को संदेय कोई रकम ऐसे कर के लिए दाधी नहीं होगी ।
25. फीस:--(1 ) निम्नलिखित मंव्यवहारों के बारे में दो रुपए कीफीस प्रभार्य होगी, अर्थात्
(i) पत्त्र का नियम 13 के अधीन अन्तरण ;
(ii ) नियम 14 के उपनियम ( 2 ) के अधीन पत्र की दूसरी प्रति का जारी किया जाना ;
( iii) नियम 20 के उपनियम ( २ ) के प्रधीन उन्मोचन पश्त्र का जारी किया जाना ;
(iv) नियम 23 के अधीन एक अभिधाम से दूसरे प्रभिदान में संपरिवर्तन ।
स्पष्टीकरण:--( 1 ) जहां भिन्न-भिन्न आवेदनों पर क्रय किए गए पत्तों की बाबत उन्मोचन प्रमाणपत्त्र जारी किया जाता है वहां खंड (iii ) के अधीम फीस ऐसे प्रत्येक भाषेवन की बाबत पृथक- पृथक प्रभारित की जाएगी ।

व्यक्ति द्वारा पत्र 26. डाकघर का उत्तरदायित्व किसी कब्जा मभिप्राप्त करने और उसे कपटपूर्वक भुनाने से घारक को हुई हानि के लिए डाकघर उत्तरदायी नहीं होगा ।
27. भूल की परिशुद्धि:-डाकतार महानिदेशक , या महाडाकपाल या डाकः प्रभागों के प्रधान अपनी-अपनी अधिकारित में , या तोस्वप्रेरणा से या इन नियमों के अनुसरण में जारी किए गए पक्ष में हितबद्ध किसी व्यक्ति द्वारा दिए गए भावेदन पर, उस पत्र की बाधत किसी लेखन या गणित सम्बन्धी भूल को परिशुद्ध कर सकेंगे किन्तु यह तब जब इससे सरकार या किसो ऐसे व्यक्ति को कोई वित्तीय हानि नहीं होती है ।
28. अनियमित संवायों की वसूली यदि किसी व्यक्ति को इल नियमों में जैसा उपबन्धित है उसके सिवाय ग्याज के रूप में या अन्यथा किसी रकम का संवाय किया गया है तो उसका तुरन्त सरकार को प्रतिदाय किया जाएगा जिसमें असफल होने पर सरकार को , ऐसे व्यक्ति को सरकार द्वारा संदेय किसी रकम में से या भूराजस्व की मकाया के रूप में वसूल करने का हक होगा ।
29. निर्वचनयवि इन नियमों के निर्वचन के संबंध में कोई प्रश्न उठता है तो उसे विनिश्वय के लिए केन्द्रीय सरकार को निर्दिष्ट किया जाएगा ।
30. शिथिल करने की शक्ति -जहां केन्द्रीय सरकार का समाधान हो जाता है कि इन नियमों के किसी उपबन्ध के प्रवर्तन में यथास्थिति गन के कारक को या उसके नामनिर्देशिती या विधिक वाग्सि को असम्यक् कष्ट होता है , वहां वह कारणों की लेखबद्ध करके आदेश द्वारा उस उपबन्ध की अपेक्षाश्रों को , ऐसी रीति से जो अधिनियम के उपबन्धों से असंगत न हों , णिथिल कर सकेगी ।

3. Denominations in which certificates shall be issued.- The certificates shall be issued in denominations of Rs . 500 and Rs . 1000 .
4. Maturity period. The maturity period of a certificate shall be 10 years from the date of issue of certificate under rule 8.

5. Procedure and conditions for purchase of certificate.-- A certificate may be purchased by any person in his name by presenting at a post office on or after the 1st day of June , 1982, an application in Form J ( obtained free of cost at all post offices) either in person or through an authorised agent of small savings schemes , subject to the following condtions , namely :-

(a) The applicant shall os on the date of presentation of his application to the post office , be not less than 18 years of age and not more then 45 years of age.

Explanation . -For the purpose of this clause, any of the following documents stating the applicant's date of birth shall be accepted as proof of age , namely :-

G.S.R. 259(E) . In exercise of the powers conferred by section 12 of the Government Savings Certificates Act, 1959 (46 of 1959), the Central Government hereby makes the following rules, namely :-
(nv) certificate of baptism ;
1. Short title, commencement and application . ( 1 ) These rules may be called the Social Security Certificates Rules, 1982.
(2) They shall come into force on the 1st day of June , 1982.
(v) life insurance policy or the first receipt for life insu- rance premium where the date of birth therein has been shown as admitted by the Life Insurance Cor- poration of India or the Postal Life Insurance autho rities, or a lester issued by the sold Corporation or authorities .
(3) They shall apply to the Social Security Certificates .
(vi) service record kept by employer provided the em- ployer has accepted the applicant's date of birth ;
2. Definitions .In these rules , unless the context otherwise requires-
(i) "Act" means the Government Saving Certificates Act, 1959 (46 of 1959) ;
(ii ) "Certificate " means the Social Security Certificate ;
(iii) " postal Circle " means the post offices under the administrative authority of a Postmaster General or the Director , Army Postal Services .
(b) the applicant shall be good health and shall not, during the period of three years proceeding the date of application, have suffered from asthma, pneumonia, spitting of blood , tuberculosis , high or low blood pressue , thenumatic fever, diabetes , Jaun- dice, any disease of kidney , prostate or urinary system, paralysis , insanity epilepsy fits of any kind or nervous breakdown or any other disease of the brain or nervous system, cancer leptesy , rheuma- tism, tum ur , or verercal disease , or undergone any surgical operation which has culted in the applicant's hospitalisation for more than ten days :
(iv) " co- operative society " means a society registered or deemed to have been registered under the Co- ope- rative Societies Act , 1912. (2 of 1912) or under any other law for the time being in force :
(c) where a proposal of insurance on the applicant's life has been made at any time to the Life Insurance Corporation of India or under the Postal Life Insu- (v) "Corporation" means a corporation established by or under any law for the time being in force , but does not include a comoney :

rejected by the said Corporation er under the said scheme ;
an 11. Identity slip . ( 1 ) If a request for the issue of identity slip is made at any time by the holder of a certificate to the post office where the certificate stands registered , an identity slip shall be issued to such holder on his signing the identity slip .
(2) The identity slip shall be surrendered at the time of the final discharge of the certificate or in case of its loss , a dec- dischadentity laration of such loss shall be furnished to the post office in the form laid down by the Director General , Posts and Tele- graphs.
(d) the application in Form 1 shall be complete in all respects and shall be accompanied by the docu- ments as specified in. the said Fornm and bear the signature of the applicant or his thumb - impression , if he is illiterate , which shall be affixed by him m the presence of an authorised person and no addi- tion, deletion or modincation in any rianner shall be made in the declaratious contained in the said Form save as otherwise directed therein .
12. Transfer from one post office to another .-( 1 ) A certificate may, during its maturity period, be transferred from a post office at which it stands registered, to any other post office on the holder making an application in the form laid down by the Director General , Posts and Telegraphs , at either of the two post Offices .
Explanation. For the purpose of this clause, " authorised person" means the Postmaster of the post office at which the application is presented , or any other official of the post office as may be authorised in this behalf by the Director General , Posts and Telegraphs , or an authorised egent of small savings scheme ;
(e) the application shallbe accompanied by payment of face value of the certificate applied for ;
Provided that where a person holds more than one certifi- cate and their maturity period has not expired, all such certi- ficates shall be registered in a Post Office or post offices in the same postal circle .
(f) details of any certificate already purchased under these rules by the applicant shall be furnished by him .
13. Pledging of certificate.--( 1 ) The Postmaster of the office where a certificate stands registered may permit transfer of the certificate for being pledged as security to 6. Limit on holding of certificates . No person shall purchase or hold at any time certificates for an aggregate face value which exceeds Rs . 5000 .
(a) the President of India or Governor of a State in his official capacity ;
Explanation. For the purposes of this rule-
(b) the Reserve Bank of India or a scheduled bank or a co-operative society including a co - operative bank ;
(a) any certificate held beyond its maturity period by such person shall be ignored .
(c) a corporation or a Government company ; and
(b) any certificate pledged by such person under rule 13 shall be taken into account.
(d) a local authority :
7. Legal tender. Payment for the purchase of a certificate may be made to a post office in any of the following modes . namely :-
Provided that an application for such transfer is made by the holder of the certificate and the pledge in the form lald down by the Director General , Posts and Telegraphs .
(i) cash ;
(ii) a cheque, pay order or demand draft ;
(2) When any certificate is transferred under sub- rule (1) , the Postmaster of the office where the certificate stands registered shall make the following endorse- ment on the certificate , namely :-
(iii) duly signed withdrawal from together with the pass book for withdrawal from the post office sav- ings account ;
"Transferred as security to ...
(iv) surrender of a matured old certificate duly discharged as follows "Received payment through issue of fresh certificate vide application attached" .
(3) Except as otherwise provided in these rules , the pledgee of a certificate under this rule shall, until it is re -transferred under sub -rule (4) , be deemed to be the holder of the certificate .
8. Issue of certificates . (1 ) On payment being made under rule 7, except where payment is made by a cheque , pay order or demand draft , a certificate shall normally be issued, immediately, and the date of such certificate shall be the date of such payment .
(4) A certificate transferred under sub - rule (2) , may, on the written authority of the pledgee , be re - transferred with the previous sanction in writing of the autho- rised Postmaster and when any such re - transfer is made, the Postmaster of the office where the certi- ficate stands registered shall make the following en- dorsement on the certificate :-
"Re- transferred to .....
(2) Where payment for the purchase of a certificate is made by a cheque , pay order or demand draft , the certificate shall not be issued before the proceeds of the cheque , pay order or demand draft, as the case may be , are realised and the date of such certificate shall be the date of encashment of the cheque, pay order or demand draft , as the case may be.
(3) If for any reason a certificate cannot be issued imme- díately, a provisional receipt shall be given to the purchaser which may later be exchanged for a certificate and the date of such certificate shall be as specifled in sub - rule ( 1 ) or sub- rule (2), as the case may be .
Note 1. A gazetted officer of the Government accepting the certificate as security under sub - rule ( 1 ) or releaseing the pledge under sub-rule ( 4) on behalf of the President or the Governor of a State , shall certify that he is duly authorised under article 299 of the Constitution to execute such instru- ments or deeds on behalf of the President or the Governor of the States giving the particulars of the number and date of the notification of the Government authorising him in thisbehalf.
9. Certificate in lieu of proceeds of old certificate . A holder of an old certificate entitled to encash that certificate may make an application in Form one for the issue of a certi- ficate under these rules and on receipt of such application , there shall be issued to the applicant a certificate under these rules, the date of issue being the date on which the old certificate duly discharged is presented.
Note 2. An officer of the Reserve Bank of India or a scheduled bank or a co -operative society including a co- opcrative bank , a corporation or a Government company or a local authority , as the case may be , accepting the certificate as security under sub - rule ( 1 ) or releasing the pledge under sub-rule (4) on behalf of the respective institution, shall certify under his dated signature and seal of office that he is duly authorised under the articles of the said institution, to execute such instruments or deeds on its behalf.
10. Irregular holding. Any certificate purchased or acqur- red in contravention of these rules shall be encashed by the holder as soon as the fact of the holding being in contraven- tion of these rules is discovered and no interest shall be paid on any holding in contravention of these rules.
(5) Where as a result of several endorsements made under sub-rule (2) and (4) on a certificate, no space is left for mak- ing further endorsements of a like character on that certificate , THE GAZETTE OF INDIA EXTRAORDINARY

a fresh certificate may be issued by the Postmaster of the office of registration in lieu of such certificate.
(6) A fresh certificate issued under sub - rule ( 5) shall be treated as equivalent to the certificate in lieu of which it has been issued for all the purposes of these rules .

17. Premature encashment . ( 1 ) Notwithstanding anything contained in rule 16 , a certificate may, at the option of the holder, be prematurely encashed at a discount at any time after the expiry of three years from the date of issue of the certificate and on such encashment , the amount payable to him shall be equivalent to the face value of the certificate together with simple interest thereon for the complete years and months for which the certificate has been held . Such interest shall be calculated at the rate applicable as on the date of encashment to savings accounts of the category of single accounts in the Post Office Savings Bank. The diffe- rence between the aforesaid simple interest and the interest accrued under rule 16 shall be deemed to be the discount.
(4) A duplicate certificate issued under sub - rule ( 3) shall be treated as equivalent to the original certificate for all the purposes of these rules except that it shall not be encashable at a post office other than the post office at which such certi- ficate is registered without previous verification .
(2) Notwithstanding anything contained in sub -rule ( 1) and rule 16 and subject to sub - rules (3 ) and (4) , a certificate may be prematurely encashed before the expiry of three years-
15. Nomination.-( 1 ) Subject to the provisions of sub-
(i) on forfeiture by a pledge of the certificate , when the pledge is in conformity with these rules , or
( ii) when ordered by a court of law .
(3) If a certificate is encashed under sub - rule ( 2) within a period of one year from the date of the certificate , only the face value of the certificate shall be payable and no interest shall be payable .
rules ( 2) to (4), the holder of a certificate may, by filling In necessary particulars in Form 1 at the time of purcha ing the certificate , nominate any person or persons who, in the event of death of the holder shall become entitled to the certificate and to the payment of the amount due thereon. If such nomination is not made at the time of purchasing the certificate , it may be made by the holder at any time after the purchase of the certificate but before its maturity, by submitting an application in Form 2, together with the certificate to the Post master of the office where the certificate stands registered.
(4) If a cetificate is encashed under sub - rule ( 2 ) after the expiry of one year but before the expiry of three years from the date of the certificate , the encashment shall be at a discount and the amount payable and discount shall be as specified in sub - rule ( 1) .
(2) A nomination made by the holder of a certificate under this rule may be cancelled or varied by submitting an application in Form 3 , together with the certificate , to the Postmaster of the post office at which the certificate stands registered.
18. Payment in the event of death of the holder during maturity period .
(1) Subject to rule 21 and sub - rules ( 2 ) , ( 3 ) and (4 ) , on the death of the holder of a certificate- (3) Separate applications for nomination or cancellation of a nomination or variation of a nomination shall made in respect of certificates registered on different dates .
(a) due to any cause , at any time after the expiry of two years from the date of issue of the certificate and before the expiry of its maturity peroid, or
(b) duc to one or more non- natural causes at any time before the expiry of two years from the date of issue of the certificate ,
ог (4) The nomination or the cancelleation of a nomination the variaton of a nomination shall be regis- tered in the Head Post Office concerned and the fact of regis- tration shall be noted on the certificate and on such registra- tion, the said nomination or cancellation or variation of nomination , as the case may be , shall be deemed to be effective from the date on which it was presented .
16. Payment on maturity. On the expiry of the maturity perlod of a certificate , its holder or, in the event of his death, his nominee, or if there is no surviving nominee, the legal heir of the holder, as the case may be , shall be entitled to receive a sum inclusive of interest of Rs . 1500 if the

Explanation. For the purpose of clause (b ) , 'non -natural causes' shall mean accidents due to external , violent and visi- ble means and shall include rail and road accidents , electro- cution, snake -bite , drowning , fire and attack by wild animal but shall not include self- injury and suicide .
(2) If a doubt arises as to whether the death of the holder was or was not due to a non-natural cause other than self- injury or suicide, the certificate in Form 4 by the district collector or the district magistrate in whose jurisdiction the place of death falls shall be deemed final .
21. Claims of nominees or legal heirs .-( 1 ) For the pur- pose of claiming payment of the amount due under rule 16 or 18, as the case may be , the nomince or legal heir of the holder shall make an application to the Post-master of the office where the certificate stands registered and such application shall be accompanied by-
(i) certificate on which payment is claimed;
(ii) proof of death of the holder of the certificate ;
( iii) proof of death of deceased nomince , if any ;
(3) Payment under sub-rule ( 1 ) shall be restricted to the certificates held by a deceased holder upto a maximum limit of aggregate face value of Rs . 5000 and in respect of any certificate held in excess of such limit by the deceased hold- er and not matured as on the date of his death , the face value of such certificate shall be payable only on the expiry of its maturity period without any interest to the nominee or legal heir of the holder , as the case may be :
(iv) death certificate in Form 4 signed by the district collector or the district magistrate , in cases cover- ed by clause ( b) of sub -rule ( 1 ) of rule 18 .
Provided that such face value shall be payable immediately without any interest if the certificate is presented for en- cashinent
(2) If there are more than one nominee or legal heir as the case may be, they shall give a joint discharge of the certificate at the time of receiving payment .
(i) on forfeiture by a pledgee of the certificate when the pledge is in conformity with these rules , or
( ii ) when ordered by a court of law.
еп- (3 ) When the nomince is a minor , the person appointed under sub - section ( 3 ) of section 6 of the Act , while cashing the certificate, shall certify that the minor is alive and the money is required on behalf of the minor .
(4) In case it is found that there has at any slage been a fraudulent mis- statement or suppression of information re- lating to the date of birth of the holder or any other material fact relevant to the issue of the certificate or pay- ment thereon , the face value of such certificate shallbe pay- able only on the expiry of its maturity period without any interest to the nominee or legal heir of the holder as the case may be :
(4) For the purposes of sub- section ( 4 ) of section 7 of the Act, the authorities named below shall be competent to sanction claims upto the limit noted against each on the death of the holder of the certificate , without proudction of the probate of his will or letters of administration of his estate or succession certificate granted under the Indian Succes sion Act , 1925 (39 of 1925 )

(ii) encash the certificate at any time before the expiry of its maturity period , in which case he shall be en- titled to receive a sum equivalent to the face value of the certificate together with interest as specified in sub - rule ( 1 ) of rule 17; provided that no such interest shall be payable if the certificate is encashed before the expiry of one year from the date of the certificate.
19. Place of encashment . A certificate shall be encash- able at the post office at which it stands registered :
22. Encashment of certificate held by Army, Air Force and Navy Personnel. Where a certificate is held by a per- son who is subject to the Army Act , 1950 (46 of 1950 ) or the Air Force Act , 1950 ( 45 of 1950 ) or the Navy Act, 1957 (62 of 1957) and such person dies or deserts , the Commanding Officer of the Corps , department , detachment, unit or ship to which the deceased or deserter belonged or the Committee of Adjustment , as the case may be , may send requisition to the officer in charge of the post office where the certificate stands registered to pay to him or it , the amount due under the certificate and the officer in charge of the post office shall be bound to comply with such re- quisition even though there is in force at the time of death or desertion of holder of the certificate a nomination made in favour of any person .
Provided that a certificate may be encashed at any other post office if the officer- in - charge of that post office is satis- fied on production of identity slip or on verification from the office of its registration that the person presenting the certificate for encashment is entitled thereto .
20. Discharge of cerificate.-( 1 ) The person entitled to receive the amount due under a certificate shall , on its en-

23. Conversion from one denomination to the other.- (1) On an application being made in this behalf by the holder, certificates of lower denomination may be exchanged for a certificate or certificates of higher denomination of the same aggregate face value or a certificate of higher denomination may be exchanged for certificates of lower denomination of the same aggregate face value :
Provided that certificates bearing different dates shall not be combined for being exchanged for certificate or certifl- cates of higher denomination.
(2) The date of the certificate or certificates issued in exchange shall be the same as that of the original certificate or certificates surrendered and not the date on which the exchange is made .
24. Income-tax.--Interest on the certificates shall be liable to tax under the Income - tax Act , 1961 (43 of 1961 ) , on the basis of the annual accrual specified in rule 16, but no tax shall be deducted at the time of payment of discharge value :

25. Fees . ( 1 ) A fee of two rupees shall be chargeable in respect of the following transactions , namely :-

(2) The fee to be charged for a conversion under clause (iv) shall be based on the number of certificates required to be Issued on such conversion .
2. A fee of one rupee shall be chargeable on every appli- cation for registration of nomination , or of any variation in nomination or cancellation thereof ;
Provided that no fee shall be charged on an application for registration of the first nomination.
26. Responsibility of the Post Office. The post office shall not be responsible for any loss caused to a holder by any person obtaining possession of a certificate and fraudulently encashing It.
27. Rectification of mistakes . The Director General , Posts and Telegraphs , or the Postmasters General or Heads of Postal Divisions in their respective jurisdictions , may either suo moto or upon an application by any person interested in any certificate issued in pursuance of these rules , rectify any clerical or arithmetical mistakes with respect to that certi- ficate if It does not involve any financial loss to the Govern- ment or to any such person .
28. Recovery of irregular payments . If any amount has been paid as interest or otherwise to any person save as pro- vided in these rules , it shall be forthwith refunded to the Government failing which the Government shall be entitled to recover the amount from any money payable by the Gov- ernment to such person or as an arrear of land revenue .
29. Interpretation. If any question arises relating to the Interpretation of these rules, it shall be referred to the Cen- tral Government for a decision.
30. Power to relax. Where the Central Government is satisfied that the operation of any of the provisions of these rules causes undue hardship to the holder of a certificate or his nominee or legal heir, as the case may be , it may, by order, for reasons to be recorded in writing, relax the re- quirements of that provision in a manner not inconsistent with the provisions of the Act .

सा० फा० ति० 260 (अ): केन्द्रीय सरकार , सरकारी बचत -पक्ष श्रधिनियम, 1959 (1959 का 46 ) की धारा 1 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह विनिविष्ट करती है कि सामाजिक सुरक्षा-पत्र, बचत पत्रों का वह बर्ग होगा जिसे उक्त अधिनियम सागू होता है ।

G.S.R. 260(E) . In exercise of the powers conferred by sub-section (3 ) of section 1 of the Government Savings Certi- ficates Act, 1959 ( 46 of 1959) , the Central Government hereby specifies that the Social Security Certificates shall be the class of Savings Certificates to which the said Act applies .
