का. आ . 529 (अ) केन्द्रीय सरकार ने वर्ष 1982 को " उत्पादकता वर्ष" के रूप में घोषित किया है ,
और केन्द्रीय सरकार की यह राय है कि अधिकतम संभव सीमा तक सभी मजबूरियों को दूर करके उत्पादन को बढ़ाने क लिए अर्थव्यवस्था के और निश्चयात्मक उत्पादक अभिसंस्करण के लिए दिशा प्रदान की जानी है ;
अतः , केन्द्रीय सरकार , उद्योग (विकास और विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 29 ख की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , ऐसे सभी औद्यो गिक उपक्रमों को , जो उक्त अधिनियम के अधीन रजिस्ट्रीकृत है या जिनकी बाबत जब्त अधिनियम के अधीन अन्भप्ति या अनुजा जारी की गई है , उक्त अर्धािनयम की धारा 12 , की उपधारा ( 1) के खंड (घ) और तद्धीन बनाए गए नियमों के प्रवर्तन में निम्नलिखित शों के अधीन रहते हुए छूट देती है , अर्थात:-
(1) विनिर्माण की वस्तु वह वस्तु नहीं होगी जो भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकाम

विभाग) की अधिसूचना म. का. आ . १४ (अ) उ. वि.वि.अ. (29 ) 73-1 तारीख 16 फरवरी , 1973 की अनुसूची 5 में विनिर्दिष्ट है ;
(2) विनिर्माण की वस्तु नाशकजीवमार विनिर्मितयों मे संबंधित बस्तु नहीं होगी ;
1973 (3) एकाधिकार तथा अवरोधक व्यापारिक व्यवहार अधिनियम , 1969 (1969 का 54), के क्षेत्रान्तर्गत या विदेशी मुद्रा (विनियमन) अधिनियम , (1973 का 46) के क्षेत्रान्तर्गत आने वाले किसी औद्योगिक उपक्रम के संबंध में विनिर्माण की वस्तु इस अधिसूचना में उपाबद्ध अनुसूची में गम्मि लित किमी उद्योग से संबंधित होगी ,
(4) औद्योगिक उपक्रम छूट के लिए तभी पात्र होगा जब् कि यह छूट ऐसे माल के किसी वर्णन की बाबत है जिसके लिए औद्योगिक उपक्रम एकाधिकार तथा अवरोधक व्यापारिक व्यवहार अधिनियम 1909 (1969 का 54) के अर्थान्तर्गत प्रधान उपक्रम नहीं है ;
(5) औद्योगिक उपक्रम ने 1 अप्रैल , 1982 के पूर्ववती 5 वित्तीय वर्षों में से किसी में अपनी अन्ज्ञप्त क्षमता का कम से कम 94 प्राप्त कर लिया है ;
(6) अन्क्रप्ति रजिस्ट्रीकरण प्रमाणपत्र १२ पृष्ठांकित की जाने वाली क्षमता , 1 अप्रैल , 1982 के पूर्ववर्ती THE GAZETTE OF INDIA : EXTRAORDINARY

5 वर्षों में से किमी के दौरान प्राप्त उच्चतम उत्पादन धन उसके 33-1/3 प्रतिशत तक सीमित रहेगी ।
(7 ) औद्योगिक उपक्रम संतुलन उपस्करों के मिवाए स्व- देशी या आयातित कोई भी अतिरिक्त मशीनरी संस्थाप्ति नहीं करेगा किन्तु शर्त यह है कि ऐसे उपम्कर के संस्थापन के परिणामस्वरूप क्षमता में 25 प्रतिशत से अधिक की वृद्धि नहीं होती है ।
2. यह अधिसूचना , सिवाय इस बात के कि वर्तमान अधि- सूचना में छूट का उपबंध भारत मरकार के उद्योग मंत्रालग (औद्योगिक विभाग) की अधिसूचना में 98 (अ) /आई डी आर ए/ 29ख/ 73-1 , तारीख 16 फरवरी , 19735 की मद 3 के नीच द्वितीय परन्तुक में विनिर्दिष्ट अवस्थानिक मजबूरियों के होत हुए भी उपलब्ध हो सके , उक्त अधिसूचना के अतिरिक्त होगा न कि उमके अल्पीकरण में ।

New Delhi , the 26th July, 1982
S.O 529 (E) . Whereas the Central Government have de- clared 1982 as " Productivity Year " ,
And whereas the Central Government is of opinion that directions for a further positive production orientation are to be given to the economy to increase production by remov- ing all constraints to the maximum extent possible .
Now, therefore , in exercise of powers conferred by sub- section ( 1 ) of section 29B of the Industries ( Development and Regulation ) Act , 1951 (65 of 1951 ) , the Central Gov- ernment hereby exempts all industrial undertakings registered 3

:- = under the said Act or in respect of which a licence or per- mission has been issued under the said Act , from the opera- tion of clause ( d ) of sub- section ( 1 ) of section 13 of the said Act and the rules made thereunder, subject to the fol- lowing conditions , namely :--
( i ) the article of manufacture shall not be an article specified in Schedule I or Schedule IV or Schedule V to the notification of the Government of India in the Ministry of Industry ( Department of Indus- trial Development ) No. S.O. 98 ( F ) IDRA 29B 73-1 , dated the 16th February, 1973 ;
(ii) the article of manufacture shall not be an article relating to pesticide formulations ;
(bi) in relation to an industrial undertaking falling within the purview of the Monopolies and Restrictive Trade Practices Act , 1969 ( 54 of 1969) or within the purview of the Foreign Exchange Regulations Act , 1973 (46 of 1973 ) , the article of manufacture shall pertain to an industry included in the Schedule annexed to this notification ;
( iv) the industrial undertaking shall be eligible for ex- emption only if the expansion is in respect of any description of goods for which the industrial under- taking is not a dominant undertaking within the meanig of the Monopolies and Restrictive Trade Practices Act, 1969 ( 54 of 1969 ) ;
(v) the industrial undertaking should have achieved at- least 94 per cent of the licensed capacity in any of the 5 financial years preceding 1st April , 1982 ;
(vi ) the capacity to be endorsed on the licence registra- tion certificate shall be limited to the highest pro- duction achieved during any of the 5 years preced- ing 1st April, 1982 plus 33 13 per cent thereof;
(vii) the industrial undertaking shall not instal additional machinery, indigenous or imported, except balanc- ing equipments subject to the condition that instal- lation of such equipment does not result in increase in capacity by more than 25 per cent .
2. This notification is in addition to and not in derogation of the notification of the Government of India in the Ministry of Industry ( Department of Industrial Development ) No. 98 ( E ) IDRA 29873-1 , dated the 16th February , 1973 , except that the exemption provision in the present notification may be available notwithstanding the locational constraints speci- fied in the second proviso below item 3 of the aforesaid notification .
