सा० का० नि० 568 (अ ) केन्द्रीय सरकार, खाद्य अपमिश्रण निवारण अधिनियम , 1954 ( 1954 को 37) की धारा 23 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए, तथा केन्द्रीय खाद्य मानक समिति से परामर्श कारने के पश्चात् खाद्य श्रपमिश्रण निवारण नियम, 1955 मे कतिपय और सशोधन करना चाहती है । जैसा कि उक्त उप- धारा में अपेक्षित है, प्रस्तावित संशोधनों का निम्नलिखित प्रारूप उन सभी व्यक्तियो की जानकारी के लिए प्रकाशित किया जा रहा है, जिनके उससे प्रभावित होने की संभावना है । इसके द्वारा सूचना दी जाती है कि उक्त प्रारूप पर, इस अधिसूचना वाले राजपक्ष की प्रति जनता को उपलब्ध होने की तारीख से नग्मे दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ।
उपरोक्त भवधि की समाप्ति से पूर्व नियमो के उक्त प्रारूप की बाबत जो भी आक्षेप या सुझाब किसी व्यक्ति से प्राप्त होगे , केन्द्रीय सरकार उन पर विचार करेगी ।
आक्षेप और सुझाव , यदि कोई हो भारत सरकार , स्वास्थ्य और परिवार कल्याण मनालय, तितविली के पते पर भेजे जा सकते हैं ।
प्रारूप नियम
1 इन नियमो का मक्षिप्त नाम खाद्य प्रपमिश्रण निवारण ( संशोधन) नियम, 1982 है ।
2 खाद्य अपमिश्रण निवारण नियम, 1955 (जिसे इममे पश्चात् उक्त नियम कहा गया है) के नियम 50 में:--
( 1) उपनियम ( 1) के परन्तुक के पश्चात् निम्नलिखित परन्तुक अन स्थापित किया जाएगा , अर्थात्
"परन्तु यह भौर कि ऐसे दुग्ध उत्पादक को जो किसी दुग्ध सहकारी सभ को प्रसंस्करण के लिए दुग्ध का प्रदाय करता है, इस उपनियम से छूट की जाएगी ।"
( 3) उपनियम 1 ( क ) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा, अर्थात्:-
" 1 ( फक ) खाद्य ( स्वास्थ्य) प्राधिकारी दुग्ध सहकारी संघ को विभिन किसानो से प्रसस्करण के लिए दुग्ध इकट्ठा करने के नि एक अनुज्ञप्ति जारी कर सकेगा । "
3 उक्त नियम के परिशिष्ट " ब" मे:
(1) मदए 11 02 08 , के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्, ए 11 02 08--'कुल्फी' या ' फुल्फा' से गाय या भैंस के पूर्ण से या दोनों के सम्मिश्रण से या किसी अन्य दुग्ध उत्पाद से भসিिঙ্গাড় किया गया हिमशीतित उत्पाद अभिप्रेत है जिसमें गम्ने की चीनी,

ट्रोज, द्रव ग्लुकोज और मुखाधा गया द्रव ग्लुकोज , प्रहे, फल, फल-र र परिक्षित फल, दूत, फल , खाने याग्य मुरूचक और श्रनुज्ञात खाद्य रग हो या न हो । इसमें अनुज्ञात स्थायीकारक श्रीर पा ५मकर भार के अनु- मार ० ९ प्रतिशन में अधिक हा मकते है । ( इसमें अतिरिक्त म्ट्रार्च नही होगा ) । उत्पाद में प्रतिशन दुग्ध प्रक्खन, 3 5 प्रतिशत प्रोटीन और कुल 3 प्रमिशन ठोस पदार्थ से कन नहीं होगे (मवार उन वणा के जब पूर्वास्त निर्मािनश्रा में से किसी में फन या दृश्रुफप बोनो हो तो क्रमश बुग्ध भवन्वन और कुन टोम पवारं भार के अनुमार 60 प्रतिशत और 300 प्रतिशत से कम नष्टही होगे ।
7 11 02 08 01 धाइमत्रीम , चाकलेट श्राइमक्रीम या माफटी आइसक्रीम म गाय या भैंस के दूध से था दानो के सम्मिश्रण से या किसी अम्थ बुग्ध उत्पाद से अभिप्राप्त किया या हिमगीतिन उत्पाद अभिप्रेत है जिममें गन्न की चांनी , डेक्मदाज, द्रव ग्लुकोज और मुम्बाया गय। द्रव ग्लुकोज , अडे फल, फन-ल्म, परिक्षित फन, दूढ कन, चाकलेट, खाने योग्य सुविक और अनुज्ञान खाद्य रग हो या न हा । इसमे अनुज्ञान स्थायीकारक और पायनकर भार के अन्मार 05 प्रतिशत से अनधिक हो सकते है । मिश्रण को हिभणीतित करने के पूर्व ममुवि । रूप से गर्म किया जाएगा । इसमे नियम 43 के उपनियम ( 2 ) में यथाविनिर्दिष्ट लेवल पर घोषणा के प्रधीन अधिक से अधिक 50 प्रतिणन अधिकतम स्टार्च हो सकता है । उत्पाद में 100 प्रतिशत दुग्ध मकान, 35 प्रति- शत प्रोटीन और कुल 36 0 प्रतिशत ठाम पदार्थ से कम नही होगे मिवाय उस दशा के जब पूर्वोक्न निर्मितियो मे से किसी में फल या बुढ़फल या दोनों हो तो दुग्ध मथस्वन भार के अनुसार ५० प्रतिशत से कम नही होना ।
( 2 ) मदए 14 12 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् "ए 19 12- माल्टीकृत दुग्ध श्राहार में पूर्ण दुग्ध, अशत. मলাই हित दुग्ध या दुग्ध पाउडर के साथ ग्राउड बारणी नाल्ट, अस्य माल्टी- कृत अनाज दाने और गेहू के आटे या किसी अन्न थनाज के आदे या माल्ट मार के मैश से अलग किए गए मोर्ट के गाथ मिश्रण करके अभि- प्राप्त किया गया उत्पाद अभिप्रेत है जिसमे मुचि कर्मक और ममाले, पायसवार, पदार्थ, अंडे , प्रोटीन आइसोलेट, खान योग्य माधारण नमक , सोडियम या पाटामियम बाइकार्बनिट, खनिज और विटामिन हो या न हो तथा जा बिना अतिरिक्त चीनी के हो और ऐमी रीति में मिश्रित हो कि स्टार्थों पदार्थ का पूर्ण रूप में जलापघटन हा गया हो और उसे चूर्ण या दाने या पापडी के मध में गभर शुष्कन , स्प्रे शुष्कन, वैकम शुष्कन या किसी अन्य रोनि से तैयार किया गरा हो । इनमे कोकोत्रा चूर्ण हो मकता है । यह गवगी और अन्ध वाक्य पदार्थ से मुक्त होगा । इसमे अतिरिक्त स्टार्ष नही होगा । इसमे भूनी चीनी को छाडकर, कोई अन्य परिरक्षक या अतिरिक्त रंग नहीं होगा । कोकोमा चूर्ण वाले माल्टी- कृत दुग्ध श्राहार में अतिरिक्त चीनी हा सकती है ।
माल्टीकृत दुग्ध श्राहार निम्नलिखित मानको के अनुरूप भी होगा , अर्थात्
कोकोभा पूर्ण रहित मा टीकृत दुग्धश्राहार कोकोआ चूर्ण सहित मा टी- कृत दुग्ध श्राहार

MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health ) NOTIFICATION
New Delhi , the 13th September , 1982
G.S.R. 568(E) . The following draft of certain rules further to amend the Prevention of Food Adulteration Rules , 1955 , which the Central Government proposes to make in exorcise of the powers conferred by sub - section ( 1 ) of section 23 of the Prevention of Food Adulteration Act , 1954 ( 37 of 1954) after consultation with Central Committee for Food Standards is hereby published, as required by the said sub-section for the information of all persons likely to be affected thereby , and notice ishereby given that the said draft rules will be taken into consi- deration after the expiry of a period of ninety days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public .
Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of he period aforesaid will be considered by the Central Govern- ment.
Objections or suggestions , if any , may please be sent to the Secretary to the Government of India , Ministry of Health and Family Welfare , Nırman Bhavan , New Delhi .

DRAFT RULES
1. These rules may be called the Prevention of Food Adultera- tion (Amendment ) Rules , 1982 .
2. In the Prevention of Food Adulteration Rules , 1955 ( herein- after referred to as the said rules ) in rule 50 :
(i ) in sub - rule ( 1 ) , after the proviso , the following proviso shall be inserted , namely :-
"Provided further that a producer of milk who supplies milk to a milk co -operative union for processing shall be exempted from this sub - rule , "
(2) After sub - rule 1 (A) , the following sub - rule shall be inserted ,
namely:-
"(AA)-The Food (Health ) Authority may issue one licence to a milk co - operative union to collect milk from different farmers for processing".
(3) In Appendix ' B ' of the said rules :
( 1 ) for item A.11.02.08 , the following shall be substituted , namely:-
"Α.11-02.08-' Kulfi' or ' Kulfa ' means the frozen product obtained from cow or bullalo milk or a combination thereof or from any other milk products , with or without the addition of cane sugar , dextrose , liquid glucose and dried liquid glucose , eggs , fruits , fruit juices , preserved fruits , nuts , chocolates , edible flavours and permitted food colours . It may contain permitted stabilizers and emulsifiers not exceeding 0.5 per centby weight . The mixture shall be suitably heated before freezing . The product shall contain not less than 8.0 per cent milk fat , 3.5 per cent protein and 32 per cent total solids except that when any of the aforesaid preparation contains fruits or nuts or both , the content of milk fat and total solids shall not be less than 6.0 per cent and 30.0 per cent by weight respectively . It shall not contain added starch .
A.11.02.08.01- lce - cream or chocolate ice -cream or softy ice- cream means the frozen product obtained from cow or buffalo milk or a combination thereof or from any other milk products with or without addition of cane sugar , dext - rose , liquid glucose and dried liquid glucose , eggs , fruits , fruitjuices , preserved fruits , nuts , chocolate , edible flavours and permitted food colours . It may contain permitted stabilizers and emulsifiers not exceeding 0.5 per cent by weight . The mixture shall be suitably heated before free- zing . It may contain added starch to a maximum extent of 5.0 percent under a declaration on the label as specified in sub - rule ( 2 ) of Rule 43. The product shall contain not less than 10.0 per cent milk fat , 3.5 per cent protein and 36.0 per cent total solids , except that when any of the aforesaid preparations contain fruits or nuts or both , the content of milk fat shall not be less than 0 per cent by weight" .
(2) for item A.18.12 , the following shall be substituted, namely:- "A.18.12-MALTED MILK FOOD means the product obtained by mixing whole milk, perty skimmed milk or milk powder with the wort separated from a mash of ground barley malt , any other malted cereal grain and wheat flour or any other cereal lour or malt extract with or without addition of gavouring agents and spices , emulsifying agent , eggs , protein isolates , edible common salt , sodium or potassium bicarbonato , minerals and vitamins and without added sugar in such a manner as to secure complete hydro- lysis of starchy material and prepared in a powder or granule or flake form by roller drying/ spray drying , vacuum drying or by any other process . It may contam cocoa powder . It shall be free from dirt and other extraneous matter . It shall not contain any added starch . It shall not contain any preservative or added colour except ceramel . Malted milk food containing cocoa powder may contain added sugar.
Malted milk food shall also conform to the following stan- dards , namely :-

Not less than 13 per cent by weight .
(b) Total protein (N x 6.25) (on dry basis ) .

Not less than 7.5 per cent by weight .
Not less thin 6.0 per cent by weight .
Not more than 5 per centby weight .
(d) Total ash (on dry ba , is)
Not more than 5 per centby weight .
Not more than 0.1 per cent by weight .
Not more than 0.1 per centby weight .
(c) Acid insoluble ash (on dry basis)
(f) Solubility Notless than 85 per cent by weight .
Not more than 80 per centby weight .
(g) Cocoa powder (on dry basis )
Not less than 5 per cent by weight ,
Negative .
(h) Test for starch
Negative.
(i ) Bacterial Count.
Not more than 50,000 per gramm .
Not move than 50,000 per gram .
(j ) Çoliform count
Not more than 10 per cent .
Not more than 10 per gm.
3. In item A.18.14, in the list of ingredients , after the word, "Sugar" , the word " gur, Jaggery , bura or Khandsari " shall be inserted .
