विषय. 1-1-1983 से 31-12-1983 तक संयुक्त राज्य अमरीका, यूरोपीय आर्थिक ममुदाय के सदस्य राज्यो, भ्रास्ट्रिया, स्वीडन, फिनलैन्ड को खुले सामान्य लाइसेंम-3 के अस्तर्गत पौणाकों और सलाई से तैयार किए गए वस्त्रों का निर्यात करने के लिए योजना-
मिसिल सं० 2/ 54/ 82- ई यह योजना तैयार पौणाको और मलाई से बुने हुए वस्त्रों । कतिपय मदो के सयुक्त राज्य अमरीका , यूरोपीय श्रधिक समुदाय के मवम्य राज्यों ( जर्मन। गणतंत्र मघ फांम, इटली , बेनिलक्स, यू ० के ० , आयरिश गणतंत्र , डेनमार्फ और ग्रोग ) श्रास्ट्रिया, व इन, कनाडा और फिनलैष्ट को 1 जनवरी , 1983 में 31 दिसम्बर , 1983 तक की अवधि के लिए निर्यातो से संबंधित है ।
2. हम मार्वजनिक सूचना में दी गई नीति भारत और संबधिन झायात करने वाले देग के बाण मगन द्विपक्षीय वस्त्र गमझौतों के प्रावधानों पर आधारित मशोधनो/ प्रवर्धनो के श्रवोन है । ऐसे समझौते अभी मौदा तय करने/ अतिम निर्णय लेने के अन है। हम नीत्रि की कुछ अन्य विशेषताओं अर्थात नीति का मंचालन मज्ने के लिए श्रभिकरण , विभिन्न 740 GL/82
प्रणालियों के अंतर्गत विभिन्न खंड़ों (पीएल/ एमए / एचएल/केटी) में मात्रा का आरक्षण , आवंटन की शर्ते, पोनलदान पूर्व औपचारिकताएं और सीमा- शुष्क निकासी श्रादिकी घोषणा उचित समय के भीतर कर दी जाएगी ।
3. भावंटन की प्रणाली और माता
( 1) निर्याप्त के लिए मात्ना प्रत्येक के सामने संकेतित दर पर निम्न- लिखित प्रणाली के अनुमार आबंटित की जाएगी:--

(2 ) यदि मरकार उचित समझे तो उसे द्विपक्षीय समझौते में दी गई उदारता का उपयोग करने का अधिकार होगा ।
4 आवटत वर्ष का विभाजन और प्रधियों के बीच मात्रा का आवंटन
( 1 ) भूतकालीन निष्पादन भौर विनिर्माता/ निर्यातक प्रणाली के मामले में निर्यात के लिए मात्रा का आवंटन करने के प्रयोजनार्थ पूरे कैलेन्डर वर्ष की अवधि के रूप में माना जाएगा । केन्द्रीय राज्य निगम और पहले भाए

मो पहले पाए लघु आदेशो की प्रणाल। के मामले में बनी हुई मदों के लिए वर्ष को तीन -चार मासिक अवधियो में विभाजित किया जाएगा जैसे जनवर। अप्रैल, मई-अगस्त, और सितम्बर - दिसम्बर और मलाई में तैयार की गई मदो के लिए दो अवधियों में अर्थात जनवर। अगस्त और सितम्बर -दिसम्बर मे विभाजित किया जाएगा । इन दो प्रणालियो मे बुनी हुई मत्रों की मात्रा 50.35 : 15 के अनुपात मे तीन अवधियो में वितरित की जाएगी। जबकि सलाई से तैयार मदो के लिए माता 85:15 के अनुपात में दो अवधियो में वितरित की जाएगी ।
( 2) उपर्युक्त प्रतिशत विदेशी बाजार के रूक्षान को देखते हुए सरकार द्वारा समय-2 पर पुन समजित किया जा सकता है ।
5 भूतकालीन निष्पावन
भूतकालीम निष्पादन हकवारी की परिगणना करने के लिए अभिकरण
( 1 ) प्रत्येक निर्यातक के बारे में भूतकालीन निष्पादन प्रणाली के अन्तर्गत माता की हकदारी की गणना के लिए अभिकरण वस्त्र परिधान निर्यात संवर्धन परिषद ( एईपीसी ) होगी । वस्त्र आयुक्त इस सबंध में क्रियाविधि का निर्धारिण करेगा और एईपीसी के कार्य का सर्वेक्षण करेगा ।
मूतकालीन निष्यावन हतवाने के लिए पात्रता ( 2 ) केवल वही निर्यातक 1983 के लिए भूतकाल। न निष्पादन प्रणाली के अन्तर्गत मात्रा के आवंटन के लिए पात्र होगा यदि उसका 1981 का जनवरी -जून 1982 के दौरान सबद्ध देश/ श्रेर्ण। में निर्यात निष्पावन है ।
आधार प्रबंधि
( 3) भूतकालीन निष्पावन हकदारी 1980 और 1981 भौर जनवरी- जून, 1982की भ्राधार अवधि के दौरान औसत वार्षिक निर्यातो के आधार पर प्रत्येक देश/ श्रेण। समूह के यथानुपान के लिए निश्चय किया जाएगा । भूतकालीन निष्पावन हकदारी का यथानुपान आबंटन संबद्ध देण/ श्रेण। में भाधार अवधि के दौरान निर्वामक के औसत वार्षिक निर्यात निष्पादन के बराबर अधिकतम उच्चतम र्स।मा के अधीन होगा । किमी भी व्यक्तिगत निर्यातक की हकदारी में बाद में होने वाले किसी भी परिवर्तन के मामले में यथानुपात मात्रा कः मार्गः प्रक्रिरा पूरा करने की दोबारा आवश्यकता नहीं है ो न संबंधित निर्यातक की हकदार। मे उचित ममजन कर दिया जाएगा ।
भूतकालिन निष्पादन हकवारी का हस्तान्तरण
( 4) भूतकालीन निष्पादन हकदारी। वर्ष के दौरान किर्म। भी। समय या तो पूर्ण रूप मे या आंशिक रूप में पौशाको के अन्य पंजे कृम निर्यातक फो निम्न लिखित शर्तों के अवान हस्तान्तरित किए जा सकते है
( क ) ऐसे हस्तान्तरित हकदार। के मद्दे पोतलदान हस्तान्ततरी के निर्यात के रूप में गिने जाएंगे ।
(ख ) हस्तान्तरी के अधिकार में हस्तान्तरित हकदारी उरही शनों के अधीन होगी जो हस्तान्तरण करने वाले के लिए लागू हूँ ।
( ग) जिम निर्यातक ने अपनी हकदारी एक विशेष वेश- श्रेणी में दूसरे निर्यातक को हस्तान्तरित की हो वह उसो देश-श्रेण। मे किर्म। अन्य निर्यातक से भूतकालीन निष्पावन हकदारी का हस्तान्तरण पूर्ण या भ्रांशिक रूप में मांगने के लिए पात्र नही होगा ।
( घ ) जिम निर्यातक ने पूर्ण या आंशिक रूप म विशेष देश श्रेण में किसी अन्य निर्यातक से हस्तान्तरण द्वारा हकदारी प्राप्त कर ली है तो वह उसी देश/ श्रेणी में अन्य निर्यातक को किर्स। भी हकदारी का हस्तान्तरण करने के लिए पात्र नही होगा ।

6 पहले आए सो पहले पाए लघु आदेश पद्धति
इम पद्धति के अन्तर्गत माता का श्रवटन पहले आए सो पहले पाए के ऑधार पर पर्क। सविदाओ और माखपत्रों द्वारा समर्थित आवेदनपत्त्रो के मद्दे किया जाएगा । साख-पत्त वैद्य , प्रचलित और अपरिवर्तनीय होना चाहिए । मात्रा का आवंटन केवल लघु श्रादेशों के लिए किया जाएगा । लघु आदेश व है जो विभिन्न देश-श्रेणी के लिए वस्त्र आयुक्त द्वारा परिमाणात्मक मी माश्रो के भीतर नियत किए गए हों । ऐसी परिमाणात्मक सीमाए उचिन समय के भीतर घोषित कर दी जाएंगी । इस पद्धति के अन्तर्गत श्राबंटन निम्नलिखित शतों के अधीन होगा
( 1) निर्यामक को 1 जुलाई , 1932 को या इमने पहले परिधान निर्यात संवर्धन परिषद के साथ पत्राकृत होना चाहिए ।
( 2 ) एक विन में एक निर्यातक से एक देश/ श्रेणी के लिए केवल एक आवेदनपत्र स्व। कार्य होगा ।
(3) इम पद्धति के अन्तर्गत आबटन 30 दिनो की अवधि के लिए इस शर्त के अधीन होगा कि सभी आबंटनो की वैधता संबद्ध कोटा अवधि से 10 दिनो के बाद समाप्त होगी । अन्तिम अवधि में आबंटन केवल 31 दिसम्बर, 1983 नक वैद्य होगा ।
( 4) आबटन पहले आए सो पहले पाए के आधार पर मजूर किया जाएगा भौर जिस विन उपलब्ध मात्रा अतिपूर्वक्रीत हो जाएगी। उम विन पात्रता का निर्णय उच्चतर इकाई मूल्य वसूली के आधार पर किया जाएगा ।
( 5) भूतकालीन निष्पादन हुक्रवार। वाला निर्यातक सबंधित देश/श्रेणी के लिए पैरा 5 ( 3 ) के अनुसार यथापरिकलित अपनी भूतकालीन निष्पादन हकदार । का कम से कम 50 प्रतिशत का निर्यात करने के बाद इस पद्धति के अन्नर्गन आवेदन करने के लिए पात्र होगा ।
( 6) इम कडिका में उल्लिखित लघु आदेशों की परिमाणात्मक सीमा कडिका-9 के अनुसार वस्त्र आयुक्त द्वारा घोषित कम मांग वाली मदों के लिए लागू नहीं होगी ।
7. विनिमार्ता/ निर्यातक पद्धप्ति इम पद्धति के अन्तर्गत विनिर्माता/ निर्यातको को वार्षिक स्तर के 10 प्रतिशत की सीमा तक की मात्रा का आबटन किया जाएगा । इस पद्धति के अन्तर्गत पात्रता वस्त्र आयुक्त द्वारा निश्चित के। जाएगा जिसके लिए वह विस्तृत अनुदेश जारी करेगा ।
8 केन्द्रीय/ राज्य निगम पद्धति केन्द्र। य/ राज्य/ सघ शामित सरकारों द्वारा नियत्रित निगमों और केन्द्रीय राज्य स्तरो की शिखर महकारी हथकरघा विपणन समितिया के लिए वार्षिक स्तर के अधिकतम 5 प्रतिशत का विशेष भाषटन किया जाएगा । लेकिन यह आवंटन इन निगमां/ शिखर समितियो द्वारा केवल संधेि निर्माती के लिए होगा । निगम शिखर ममित्रियां नीति में निर्धारित शर्तों को पूर्ण करने पर आमटन क। अन्य पद्धतियों के अतर्गत मात्रा के आबटन के लिए भ। पात्र होगी। । वस्त्र आयुक्त निगमो/ शिखर ममितियो एका हकदारी निश्चित करेगा ।
४ मन्द गति वाली सबै मन्द्र गति वार्ष। मदो पहचान के लिए 1982 के प्रथम चार महीनो का और 1981 का निष्पादन हिसाब में लिया जाएगा । यदि सदर्भ के अन्तर्गत हम अवधि के दौरान किम। मद का निर्यात 1982 प्रथम अत्रधि के लिए या पूर्ण 1981 वर्ष के दौरान निर्धारित फोटे के 60 प्रतिशत से अधिक नही हुया है तो वह मद मन्द गति वाल। ममर्श। जाएगी । लेकिन, सरकार का यह अधिकार सुरक्षिन है कि यत्रि माग फी प्रवृत्ति और वार्षिक स्तर के उपयोग हो प्रगति के अनुसार ऐमा न्याय सगत हुआ तो सरकार फोटा वर्ष के दौरान कसौटी में परिवर्तन करेगे। ।

3. Systems and Quantum of Allotment 10. न्यूनतम निर्यात ( भ्युनतम) मूल्य
(i) Quantities for export will be allotted accord- ing to the following Systems at rates indicat- ed against cach of them:

प्रत्येक श्रेणी की पोशाको के लिए केवल एक ही न्यूनतम मूल्य होगा । बच्चो । पोशाकों के लिए कोई पृथक न्यूनतम मूल्य नहीं होगा । वस्त्र आयुक्त न्यूनतम मूल्य निर्धारित करेगा । उनको निर्धारित करते समय वह उन सभी संबंधित तथ्यों पर ध्यान देंगे । जिसमें यह भी तथ्य शामिल है कि एक विशेष पोशाक को मन्द गति वाली मद के रूप मे अभिशाप्त किया गया है या नहीं ।

(d) Central State Corporation 5 सभी पोशाको और गलाई से बने वस्त्रों के लिए आबंटन साखपत्र आधार पर किया जाएगा । साखपत्र प्रचालित , वैध और अपरिवर्तनीय होने चाहिए । पहले आए सो पहले पाए लघु आदेशो और केन्द्रीय राज्य निगम पद्धत्तियो के मामले में साखपत्र भावेदनपत्र के साथ प्रस्तुत करने चाहिए । भूतकालीन निष्पादन और विनिर्माना /निर्यातक पद्धतियों के मामले में साख- पत्र पृष्ठांकन प्राप्त करते समय प्रस्तुत करने चाहिएं ।
(ii) The Government reserves the right to use flexibilities provided in the bilateral agree- ments as considered appropriate ,
12. निर्यात भारत के किसी भी पत्तन से स्वीकृत किया जाएगा ।

( i) In the case of Past Performance and Manu- facturer Exporters Systems , the full calend- ar year will be considered as one period for the purpose of allotment of quantities for In the case of Central State Cor- export . porations and FCFS Small Orders Systems , the year will be divided into three four monthly periods , namely, January -April , May-August and September -December , in the case of woven items and into two periods , namely January-August and September-De- cember for knitted items . In these two systems , quantities for woven items will be distributed among the three periods in the ratio of 50:35 15 whereas the quantities for knitted items will be distributed between the two periods in the ratio of 85 : 15 .

5. Past Performance System
Sub Scheme for exports under OGL . 3 of Gar- ments and knitwears to USA , EEC Member- States , Austria , Sweden , Finland and Canada from 1-1-1983 to 31-12-1983 .
File No. 25482- EI .-This Scheme relates to the
Agency for Calculation of Past Performance Entitle- ment.( i ) The Agency for calculation of the entitle- ment of quantities under Past Performance Systeın in respect of each exporter will be the Apparels Export Promotion Council ( AEPC ) , New Delhi . Textile Commissioner will lay down procedures in this re- gard and supervise the work of the AEPC .
exports of certain ready - made garments and knitwear items to USA , EEC Member States ( Federal Republic of Germany , France , Italy , Benelux , United King- dom, Irish Republic,Republic , Denmark and Greece ) , Austria , Sweden, Canada and Finland for the period 1st Janu- ary, 1983 to 31st December , 1983 .
Eligibility for Past Performance Entitlement . (ii ) An exporter will only be eligible for allotment of quantities under the Past Performance System for 1983 if he has export performance in the relevant country category during 1981 or January - June , 1982 .
2. The policy indicated in this Public Notice is subject to amendments amplifications based on the provisions of the relevant Bilateral Textile Agree- ments between India and the concerned importing countries . Such agreements are currently under nego- tiation finalisation . Certain other features of this Policy viz . , Agency for Administration of the Policy, Reservation of quantities into various segments (PL MM HL KT) under different systems , terms and con- ditions of allotment , appeal provisions , pre - shipment formalities and custom clearance, etc. will bebe announ- ced in due course .
Base period . ( iii ) The Past Performance entitle- ment will be determined for each country| category combination prorata on the basis of average annual exports during the base period of 1980 and 1981 and January -June , 1982. The prorata allotment of Past Performance entitlement will be subject to a maximum ceiling equivalent to the average annual export perfor- mance of the exporter during the base period in the THE GAZETTE OF INDIA EXTRAORDINARY

relevant country category. In the case of any subse- quent change in the entitlement of any individual ex- porter the entire exeexercise of prorata quantity need not be re -opened but suitable adjustmentsnents will be made in the entitlement of the exporters concerned.
(v) An exporter with Past Performance entitle- ment will be eligible for applying under this system after exporting at least 50 per cent of his Past Performance entitlement for the rclevant country category as worked out ac- cording to para 5 (iii ) .
Transferability of Past Performance Entitlement .--
(vi ) The quantitative limit of small orders men- tioned in this para shall not apply to slow moving items , declared as such by the Textile Commissioner in terms of para 9 .
(iv) Past Performance Entitlement will be transferable either in full or in part to another registered exporter of garments at any time during the year subject to the following terms and conditions :-
7. Manufacturer Exporter's System (a) Shipments against such transferred entitle- ment will be counted as the exports of the transferce .
In this system quantities to the extent of 10 per cent of the annual level will be allotted to Manufact- urer Exporters . The Textile Commissioner will decide on the eligibility for allotments under this system for which he will issue detailed instructions .
(b) The transferred entitlement in the hands of the transferee will be subject to the same terms and conditions as those applicable to the transferor .
(c) An exporter who has transferred his entitle- ment in a particular country category to another exporter either full or in part , will not be eligible for secking a transfer of Past Performance entitlement from any otherex- porter to himself in the same country| cate- gory.
For Corporations under the control of the Central State Union Territory Governments and Apex Coope- rative Handloom Marketing Societies at the Central State levels , there will be a special allocation not ex- ceeding 5 per cent of the annual level . The alloca- tion will , however , be made only for direct exports by these Corporations Apex Socicties . The Corporati- ons Apex Socicties will also be eligible for allotment of quantities under other systems of allotment subject to fullfilment of conditions laid down in the policy.
8. Central State Corporations Systems .
(d) An exporter who has obtained entitlement by transfer from any other exporter in a particular country category , either full or in part, will not be cligible to transfer any en- titlement to another exporter in the same country category .
The Textile Commissioner will determine the entitle- ment of the Corporations Apex societies .
6. First - come, first-served Small Order System
9. Slow-moving Items
Under this system , quantities will be allotted on First- come, First- served basis against applications supported by firm contracts and letters of Credit . Letter of Credit should be valid , operative and irre- vocable. Allotment of quantities shall be made only for small orders . Small Orders are those which are within the quantitative limits fixed by the Textile Commissioner for different country category . Such quantitative limits will be announced in due course. quantitative The allotment under this system will be subject to the following conditions
For identification of slow moving items , perform- ance during the first four months of 1982 and per- formance during 1981 will be taken into account . An item could be a termed slow-moving if during the period under reference its exports have not exceeded 60 per cent of the level earmarked for the first period of 1982 or during the entire year 1981. Government, however, reserves the right to change the criteria during the course of the year if warranted by the demand trend and pace of utilisation of annual levels .
(i ) The exporter should be registered with the AEPC on or before 1st July, 1982.
10 Minimum Export ( Floor) Prices .
(ii) Only one application will be admissible from one exporter for one country| category one day; on
There shall be only one fleor- price for each category of garments . No separatefloor- price will be prescr bed for children's garments . The Textile Commissioner will prescribe the floor - prices . In determining them, he will take into account all relevant factors , including the fact whether a particular garment item has been identified as a slow- moving one or not .
(iii) Allotment under this system will be valid for a period of 30 days , subject to the condition that validity of all allotments shall expire after 10 days of the concerned quota period . In the last period the allotment will be valid only upto December 31 , 1983 .
11. Letter of Credit ,
are (iv) Allotment will be granted en FCFS basis and . on a day, when available quantities over- subscribed, the eligibility will be dc- cided on the basis of higher unit price reali- sation.
The allocation for all garments and knitwears will be made on L/ C terms . L/ Cs should be operative , val'd and irrevocable . In the case of FCFS Small Orders and Central State Corporations systems . L'Cs 5

In should be submitted alongwith the application . the case of past performance and manufacturer ex- porters Systems , L/ Cs should be produced at the time of obtaining endorsements .
12. Exports will be allowed from any port in India .
13. Government reserves the right to make amend- ment to any of the foregoing provisions without giving prior notice.
