सा०कार्णन 576 ( अ ) हाम्योपैथी केन्द्रीय परिषद अधिनिजम 1973 ( 1973 का 54 ) की धारा की उप-धारा ( 1 ) और धारा 32 की उप-धारा ( १ ) द्वारा प्रदत्त शक्तियो का प्रयाग करते हुए केन्द्रीय सरहार एतद्वारा होम्योपैयी केन्द्रीय परिषद (निर्वाचन ) नियम, 1975 में श्रीर संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्-
1. ( 1 ) इन नियमों का नाम होम्योपैथी केन्द्रीय परिजद ( निर्वाचन ) सशोधन नियम, 1942 है ।
12 ) ये भरकारी राजपत्र में प्रश्हाणन की तारीख को प्रवृत होंगे ।
2 होम्योपैयो केन्द्रीय परिषद (निर्वाचन ) नियम,धम, 1975 ( जिते इसके पश्चात उक्न नियम कहा गया है ) के नियम 11 में,
) उप-नियम ( 2 ) के खण्ड ( २ ) लोप किया जायेगा ।
(क
(ख) खण्ड ( च ) म बाद निम्नलिखित खण्ड रखा जायेगा अर्थात्
(छ) प्रस्तावक था भमर्थक के हस्ताक्षर में नियम 9 के उप-नियम ( 1 क) के उपमधों का उल्लघन होता हो । "
3. उक्त नियमों के नियम 13 के स्थान पर निम्नलिखित नियम प्रतिस्थापित किया जाएगा अर्थात.--
"( 23) संकाय या विभाग द्वारा निर्वाचन विश्वविद्यालय के होम्यो पंथी सकाथ था विभाग' के ( चाहे जिस नाम से भी ज्ञात हो) सदस्य केन्द्रीय परिषद के एक सदस्य के रूप में निम्नलिखत रीति से अपने में से एक भदस्य का निर्वाचन करेंगे अर्थात्
(क ) विश्वविद्यालय का रजिस्ट्रार निर्वाचन की तारीख समय और स्थान प्रत्येक सदस्य को उस बैठक की तारीख से कम से कम तीन दिन पूर्व सूचित करेगा जिन बैठक में यह निर्वाचन कराने का विचार है ।
(ख ) बैठक में उपस्थित कोई भी भदस्थ, किसा अन्य उपस्थित सदस्य के नाम का प्रस्ताव करने का इषदार होगा और ऐसे प्रस्ताव के लिए यह अपेक्षित होगा कि उसके प्रस्तावक था जिन व्यक्ति का नाम प्रस्तावित किया गया है , उमसे यभन्न कोई सवस्थ उसका अनुमोदन करे । परन्तु एक भदस्य एक ही नाम प्रस्तावित या अनुमोषित करने का हकदार होगा ।
( ग ) कोई भी अध्वर्थी , वास्तविक निर्वाचन होने के पूर्व अपनी अभ्वथित वापस ले सकेगा ।

(घ) यदि एक ही अभ्यर्थी का नाम सम्यक् रूप से प्रस्तावित या अनुमोषित किया जाता है, तो विश्वविद्यालय का रजिस्ट्रार तुरन्त ऐसे व्यक्ति को सम्यक रूप से निर्वाचित घोषित करेगा ।
(३.) यदि सम्यक्तः प्रस्तावित और अनुमोदित अभ्यर्थियों की संख्या एक से अधिक है तो निर्वाचन गुप्त मतदान द्वारा किया जायेगा ।
(च) वास्तविक निर्वाचन के प्रारंभ के पूर्व विश्वविद्यालय का रजिस्ट्रार भदस्यों को मतपेटी का निरीक्षण करने के लिए यवि वे ऐसा करना चाहें, तो आंबित करेगा भौर तत्पश्चात् वह उस मतपेटी में ताला लगा देगया ।
(छ ) वास्तविक निर्वाचन की तारीख को बैठक में उपस्थित सदस्य, एक -एक करके उस सूची में अपने नाम के सामने हस्ताक्षर करेंगे जिसमें सभी सदस्यों का नाम वर्णक्रम में लिखे हैं और जो मतपेटी के पास रखी है ।
(ज) जब सदस्य उक्त सूची में अपने हस्ताक्षर कर लेगा तब उसे एक मन पत्र दिया जायेगा जिसमें सभी अभ्यर्थियो के नाम और विश्वविद्यालय के रजिस्ट्रार के हस्ताक्षर होंगे । वह ऐसे मनपत्त को उस पर अपनी पसंद के अभ्यर्थी के नाम के सामने ( × ) चिन्ह लगाकर मतपेटी में डाल देगा ।
(क) जैसे ही उपस्थित और मतदान के अधिकार का प्रयोग करन के इच्छुक मनी मदस्य ऐसा कर लेंगे , विश्वविद्यालय का रजिस्ट्रार ऐसे अभ्यर्थियों की उपस्थिति में, जो व्यक्तिगत रूप में उपस्थित ही, मतपेटी खोलेगा भौर उनमें से सभी मतपत्र बाहर निकालेगा, उनका निरीक्षण करेगा और ऐसे किसी भी मतपत्र को प्रविधिमान्य मानकर अस्वीकार कर देगा , जिस पर-
(क ) विश्वविद्यालय के रजिस्ट्रार के हस्ताक्षर नहीं है, था
(ख) भदस्य अपना नाम या कोई शब्द लिख देता है या कोई ऐसा चिन्ह बना देता है जिससे यह पहचान हो सकती है कि वह उसका मनपत्र है।
(ग) कोई मन- चिन्ह नहीं लगाया जाता है , या
(घ ) प्रयुक्त मत अनिश्चितता है, या
( ७ ) मम एक से अधिक अभ्यर्थी के हक में विया गया हैः
(ञ) विश्वविद्यालय का रजिस्ट्रार, विधिमान्य मतों को उन अच्धा- थियों के अनुसार जिनके हक में वे डाले गए है व्यव स्थित करेगा और उनकी गणना प्रत्येक अभ्यर्थी के लिए पृथकतः करेगा:
(८) नणना समाप्त होने के पश्चात् विश्वविद्यालय का रजिस्ट्रार प्रत्येक मभ्यर्थी द्वाय प्राप्त किये गये मतों के बारे में बैठक घोषणा करेगा और वह विधिमान्य मतों की अधिकतम संख्या प्राप्त करने वाले अभ्यर्थी को केन्द्रित परिषद् के सवस्थ के रूप में समभक्तः निर्वाचित भी घोषित करेगा
(ठ) यदि दो या अधिक प्रभ्यषियों को बराबर- बराबर मत प्रास्त होते हैं और ऐसे माँ की संख्धा, बराबर संख्या में भव प्राप्त करने वाले पैसे हो या अधिक अभ्यर्थियों से मित्र किसी अभ्यर्थी द्वारा प्राप्त मतों की संख्या से अधिक है , तो ऐसे अभ्वथियों के बीच अवधारण लाटरी द्वारा क्रिया जायेगा भौर जिस अभ्यार्थी की लाटरी निकलती है, उसे निर्वाचित घोषित किया जायेगा ।
4. उक्त नियमों के उपाबद्ध प्रपत्र 4 में, पैरा 1 के उप-पैरा (घ) बौर श्रीप 2 के उप पैरा (क ) में ' रजिस्ट्रीकृत डाक द्वारा' शब्दों के स्थान पर 'डाक द्वारा शब्द रखे जयेंगे ।

New Delhi , the 29th September, 1982
G.S.R. 576 (E) . In exercise of the powers conferred by sub-section ( 1) of section 4 and sub- section ( 1 ) of soction 32 of the Momoeopathy Central Council Act, 1973 ( 59 of 1973 ) , the Central Government hereby makes the following rules further to amend the Homoeopathy Central Council (Election) Rules , 1975 , namely :
1. ( 1 ) These rules may be called the Homoeopathy Cen- tral Council ( Election) Amendment Rules , 1982 .
(2) They shall come into force on the date of their pub- lication in the Official Gazette .
2. In rule 11 of the Homocopatny Central Council ( Elec- tion) Rules , 1975 ( hereinafter referred to as the said rules ) .
( a) clause ( c ) of sub - rule (2 ) shall be omitted;
(b) after clause ( f) , the following clause shall be in- serted, namely : -
"( g) that the signature of the proposer or the seconder is in violation to the provisions of sub - rule ( IA ) of rule 9."
3. For rule 23 of the said rules , the following rule shall be substituted namely :-
"23. Election by Faculty or Department . The members of the Faculty or Department ( by whatever name called ) of Homoeopathy of the University shall elect one member from amonst theinselves as a member of the Central Council in the following manner , namely :-
(a) the date , time and place of the election snall be intimated to each of the members by the Registrar of the University at least thirty days before the date of meeting in which the election is proposed to be held;
(b) any member present at the meeting shall be entitled to propose a name of any member present , and such proposal shall be required to be seconded by a mem- ber other than the proposer or the one whose name is proposed;
Provided that one member shall be entitled to propose or second only one name;
(c) any candidate may withdraw his candidature before the actual election;
(d) if the name of only one candidate is duly proposed and seconded, the Registrar of the University shall forthwith declare such candidate as duly elected ;
(e) if the number of candidates duly proposed and se- conded exceeds one , an election shall be held by secret ballot ;
(f) before the commencement of the actual election, the Registrar of the University shall invite the members to inspect the ballot box, in case they may like to do so, and he shall then lock the box ;

(g) on the date of actual election , the members present in the meeting shall, one by one , sign against their names in the list which contains the names of all the members in alphabetical order and is placed along the side of the ballot box;
(h) after a member has signed his name in the said list, he shallbe given a ballot paper containing the names of all the candidates and signature of the Registrar of the University, which he shall drop into the ballot box after affixing thereon a cross (x) mark against the name of the candidate of his choice;
(i) as soon as all the members present and wishing to exercise the right to vote have done so, the Registrar of the University, shall , in the presence of the con- didates who maybe present in person , open the ballot box and take out from it all the ballot papers , examine them and reject as invalid any ballot paper;
(A) if it does not bear the signature of the Registrar of the University; or
(B) if the member signs his name or writes any word or makes any mark on it by which it becomes re- cognisable as his ballot paper; or
(C) if no vote is recorded thereon; or
(D) if there is uncertainty of the vote exercised ; or (E) if the vote has been given in favour of more than one candidates ;
(j ) the Registrar of the University shall then proceed to arrange the valid vote according to the candidates in whose favour they have been cast and count them separately for each candidates :
(k) after the counting is over, the Registrar of the Uni- versity shall make an announcement in the meeting about the votes secured by each of the candidaten and he shall also declare the candidate securing the largest number of valid votes as duly elected to be a member of the Central Council;
(1) in the event of two or more candidates securing the same number of votes and that number being more than the number of votes secured by any candidate other than the two or mote securing the same num- ber of votes, the determination as between auch can- didates shall be by draw of lots and the candidate on whom the lot falls, shall be declared elected."
4. In Form IV annexed to the said rules , in sub- paragraph (d) of the first paragraph and in sub- paragraph ( a ) of para- graph 2, for the words "by registered post ", the words " by post" shall be substituted .
