सा० हा० ति०० 635 ( अ) केन्द्रीय सरकार, भारतीय पत्तन अधि- नियम, 1908 (1908 का 15 ) की धारा 34 के साथ पठित धारा 33 को उपधारा ( 1 ) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के नौवहन और परिवहन मंत्रालय ( पत्तन खण्ड) को अधिसूचना सं० सा० का ० नि० 381 ( म) तारीख 1 जुलाई, 1975 को उन बातों के सिवाय अधिकांत करते हुए जिन्हें ऐसे अधिक्रमण के पूर्व किया गया है या करने का लोप किया गया है , यह निवेश देती है कि इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से साठ दिन की समाप्ति के पश्चात् ठीक अगले दिन से मद्रास पत्तन पर आने वाले और इससे उपाबळ अनुसूची के स्तंभ ( 1 ) में बणित प्रत्येक जलयान पर भौर स्तंभ ( 2 ) की तस्स्थानी प्रविष्टि में विनिविष्ट दरों पर, भौर स्तंभ ( 3 ) की तटस्थानो प्रविष्टि में विनिदिष्ट अंतरालों पर पत्तन फीस उव्ग्रहीत की जाएगी ।

स्पष्टीकरण इस अनुसूची में
(क) "पोत" से पूर्णतः वायुशक्ति से चालित जलयान अभिप्रेत है ,
(ख) "स्टोमर" से पोत से भिन्न कोई जलयान अभिप्रेत है,
(ग) " तटवर्ती पौत और तटवर्ती स्टीमर" क्रमश. ऐमा पोत या स्टोभर अभिप्रेत है जो भारत स्थित एक पत्लन या स्थान से भारत स्थित किसी अन्य पत्नन या स्थान की यात्रियो या सामान का समुद्र द्वारा वहन करता है ,
(घ) "विदेशी पोत" और " विदेशी स्टीमर" से क्रमशः ऐसा पोत या ऐसा स्टीमर अभिप्रेत है जो भारत स्थित एक पत्तन या स्थान भौर किसी अन्य पत्तन या स्थान के बीच या भारत के बाहर परतन या स्थानो के बीच व्यापार में लगा है ।

(Ports Wing) NOTIFICATIONS New Delhi , the 30th October , 1982
G.S.R. 635 (E)-In exercise of the powers conferred by sub section ( 1 ) of section 33 , read with section 34 of the Indian Ports Act , 1908 ( 15 of 1908 ) , and in supersession of the notifi- cation of Government of India in the Ministry of Shipping and Transport (Ports Wing) , No. G.S.R. 381 (E) , dated the 1st July, 1975 , except as respects things done or omitted to be done before such supersession , the Central Government hereby directs that with effect from the day following the expiration of sixty days from the date of publication of this notification in the Official Gazette, ports dues shall be levied on each of the vessels entering the Port of Madras and described in column (1 ) of the Schedule hereto annexed at the rates specified in the corres- ponding entry in column ( 2) , and at the intervals specified in the corresponding entry in column (3 ) , of the said Schedule :

Explanation -In this Schedule,
(a) "Ship" means a vessel propelled solely by wind power;
(b) " steamer" means any vessel other than a ship ;
(c) " coasting ship " and " coasting steamer " mean respec tively a ship or steamer which is engaged in the carriage by sea of passengers or goods from any port or place in India to any other port or place in India;
(d) " foreign ship " and " foreign steamer " mean respectively a ship or steamer employed in trading between any port or place in India and other port or place or between ports or places outside India .

सा० का ० नि० 636 ( अ) केन्द्रीय सरकार, भारतीय पस्नन अधि- नियम, 1908 (1908 का 15) की धारा 35 की उपधारा ( 1 ) द्वारा प्रवत्म शक्तियों का प्रयोग करते हुए, भाग्न मरकार के नौवहन और परिवहन मज़ालय की अधिसूचना संख्या सा० का ० नि० 382 ( अ) तारीख 1 जुलाईं, 1975 के साथ प्रकाशित मद्रास पत्तन मार्गदर्शन और अन्य कार्य (फोस) श्रध्देश , 1975 को, उन बातो के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण के पूर्व किया गया है या करने का लोप किया गया है, मद्रास पत्नन में मार्गदर्शन और अन्य कार्य के लिए फीस के उग्रहण को विनिय- मित करने के लिए निम्नलिखित निाम अमानी है , अर्थात्
2. संक्षिप्त नाम और प्रारभ ( 1 ) इस भादेश का सक्षिप्त माम मद्रास पत्लन मार्गदर्शन और अन्य कार्य (फोस) भावेश, 1982 है.1
(2) यह तुरन्त प्रवृत्त होगा ।
न हो, 2 इम आदेण में, जब तक कि त्रिषय या सदर्भ से अन्यथा अपेक्षिय
(क ) "भ्रातरिक अंदरगाह में बर्थ" से जवाहर डाक और भारतीय डाक में बर्षों से भिन्न अर्थ अभिप्रेत है ।
(मा) "दिन" से किसी बर्थ में किसी बर्थ का लगाया जाना पूरा होने के समय में 24 घंटे अभिप्रेत है ।
(ग) " कुल टनभार" से पोन द्वारा जब वह अधिकतम ग्रीष्म भारण रेखा (समर लोड लाइन) तक भारित किया गया हो, ले जाए जा रहे स्थीरा, भंडारो ईंधन , यात्रियों भौर नाविक दल का भार अभिप्रेत है ।
(थ) "पत्तन " से मद्रास पत्तन अभिप्रेम है ।
(ङ) "पोन" से पूर्णन. त्रायुशमित से चालित अलयान अभिप्रेत है ।
( ५) 'स्टीमर" से पोभ से भिन्न काई अनयान अभिप्रेत है ।
(छ) ' तदवतों पोल" मौर ' तटवर्ती स्टीमर से क्रमश ऐसा पोत या स्टीमर अभिप्रेत है, जो भारन स्थित एक पलन या स्थान से भारत स्थिम क्रिप्सी अभ्य पत्तन या स्थान को थालियो या सामान का समुद्र द्वारा बहन करभा है ।
(ज) "विदेशी पोत" और " विवेशी स्टीमर" से क्रमशः ऐना पोत या ऐसा स्टीमर अभिप्रेत है , जो भारम स्थित एक पन्चम या स्थान भौर किसी मन्य पत्नन या स्थान के कोष भारत के बाहर पत्नन या स्थानो के बीच ध्यापार में लगा है ।
(स) ' बलत अभयान" से जलयाम का कोई ऐमा प्रकार अभिप्रेत है जिनने पालों द्वारा नौवहन के लिए पर्याप्त पाल क्षेत्र की व्यवस्था है, पाहे उसमे नौवङ्ग नौदन की यात्रिक युक्तियां लगी हो या नहीं और इसमें खेने बानी मौका या केनी सम्मिलित है, किन्तु क्रीड़ा यान इसके अन्तर्गत नहीं है ।
3. मार्गवर्णन, लंगर डालने या लंगर खोलने आधि के लिये फोम:
( 1 ) बन्दरगाह में धौर उभये बाहर जलदानों के मार्गदर्शम के लिये जिसके भन्तर्गत पसन में पाइलटा की सेवाए और नाविक बल सहित 4

(लांचों की सेवाएं है किन्तु जिसके जलयानों को लंगर डालने या लंगर बीलने की संक्रियाओं मैं संलग्न टगों की सेवायें नहीं है । उग्रहणीय फीस नोचे की सारणी में विनिविष्ट वरों पर होगी , अर्थात्

(2) " कोल्ड मूव पर जलयान के भार्गदर्शन के लिये अर्थात् जलयान के इंजन की शक्ति के बिना , जो भागतः या पूर्णतः चल रहा हो, मार्ग- वर्शन फीस उपखंड ( 1 ) के अधीन संवेय फीस से दुगुनी वरों पर उद्ग्रहीत कीजायेगी ।
(3) किसी तटवर्ती जलयान या विदेशी जलयान को बर्षस से स्थानान्तरित करने के लिये उसका पुनः लंगर डालने के लिये था उसकी अर्थ में जलयान को घुमाने के लिये फीस, जिसके मन्नर्गत भारी लिफ्टों बाला जलयान भी है, उस बर्थ को बाबत जहां से स्थानान्तरण या घुमाने का कार्य किया जाता हो उपखंड ( 1 ) के अधीन एकतरफा मार्गदर्शन (लंगर डालने या खोलने) के लिये संदेय प्रभार को आधी वर पर उदग्रहीत की जायेगी ।
परन्तु, यह कि ऊपर विनिविष्ट उस दशा में युगनी दर पर उद्ग्रहीत की आयेगी जब जलयास "कोल्ड वेम" पर प्रचालित किया जाता है ।
(4) बन्दरगाह के बाहर किसी जलयान के लंगर डालने के लिये फीस जब वह न तो प्रवेश करता है और न बाहर आता है, पांतरिक बन्दरगाह की बावत उपखंड ( 1 ) के प्रवीन एक तरका मार्गदर्शन (लंगर डालने या बोलने) के लिये संदेव प्रभारों की श्राधी दर पर उद्ग्रहीत की जायेगी ।
(5) 19.00 बजे से 6.00 बजे के बीच लंगर डालने या लंगर खोलने, स्थानास्तरित करने के प्रयोजनों के लिये जजयानों के नौचालन के लिये अतिरिक्त प्रभार अतिरिक्र बन्दरगाह जवाहर बाक या भारती डाक पर विदेशी जलयान के लिये प्रति जी० आर ० टी० 0.15 ३० और तटवर्ती जलयान के लिये प्रति जी० आर० टी० 0.10 रु० उद्द्म होत किया जायेगा ।
स्पष्टीकरण:-इस उपखंड के प्रयोजनार्थ पाइलट द्वारा जलवान पर चढ़ने के समय को प्रारम्भ सभझा जायेगा ।
(6) उपखंड ( 1 ) उपखण्ड ( 2 ) , उपखंड ( 3 ) और उपखंड ( 5) के अधीत उद्ग्रहणीय मार्गदर्शन भौर अन्य प्रभारों के प्रयोजनार्थ पैट्रोल वर्थ भौर प्राउटर एक्रेज को आंतरिक बन्दरगाह समझा जायेगा ।
(7) उन पाइलटों की दशा में जिनकी सेवाओं की अध्यवेक्षा की गयी है किन्तु उनका उपयोग नहीं किया गया है, निम्नलिखित प्रभार उद्ग्रहीत किये जायेंगे , अर्थात्

432 गयी है किन्तु जिनका उपयोग पाईलट के जलयान पर चढ़ने के पश्चात नहीं किया गया है ।
विप्पण: ( 1 ) ऊपर विनिविष्ट वर पर प्रभार जनकान के बाहर की दिशा में मार्गदर्शन के लिये न केवल अध्यपेक्षा के रद्द करण के भामले में ही उद्ग्रहीत किये जायेंगे बल्कि जलधानों के बर्थ के स्थानास्तरण के लिये जलयान को उसके बर्थ में बुमाने के लिये या भारी लिपटों की स्थिति के कारण उसी वर्थ में जलयान के पुनः लंगर डालने के लिये मध्यपेक्षा के रहकरण के लिये भी उद्धहोत कये जायेंने ।
( 2 ) ऊपर के प्रभार से ऐसे रहकरणों की दशा में जो
(क) पाईलटों के जलयान पर चढ़ने से पर्याप्त समय पूर्व ऐसे रकरणों की वणा में जो प्रसाधारण पारेस्थितियों के अधीन ऐसे कारणों से हुए हैं जिन्हें जलयात की मूल स्वरूप माना जा सकता है ।

(3) यवि उपवाण्ड ( 2 ) के अधीन प्रभारों के संवाय के विषय में कोई शंका है तो उस मामले की अध्यक्ष को निर्देशित किया जायेगा जो उसका विनिश्चय करेगा ।
4. विशेष प्रभार ( 1 ) उस प्रत्येक घण्टे या उसके भाग के लिये जिसके लिये पाईलट को मद्रास पत्तन से किसी जलदान के फरक पर उसके ऐसे जलदान में चढ़ने के पश्चात् तीस मिनट से अधिक प्रतीक्षा करनी पड़ती है, सटवर्ती जलयान की बाबत 144 रुरये भौर विदेशो जलयान की धाबत 288 रुपये फीस उद्ग्रहीत की जायेगी
(2 ) मद्रास पसन की सीमायों के भीतर 30 मिनट और जलते कम की अवधि के लिये पाल जलयान के कर्षण के लिये प्रभार म्यूनतम 72 ६० के अधीन रहते हुए 144 ४० प्राने बंटा होगा इस अवधि के लिये प्रभार उस वर पर उग्रहोत किये जाएंगे जो एस व ०टे या उत हे भाग के लिये नियत है ।
(3 ) माल के उद्धारण के लिये या गोनाम्बोरों की सेहां रु उपयोग के लिये फारों निम्नलिखित रून में होंगी--
(क) उधारण प्रभार उद्धारण भार तोचे पारणी में विनिविष्ठ बरों पर उग्रहणीय होंगे ।

टिप्पण-इन प्रभारों के भरतर्गत माधारण गोताखोरों के प्रभारों का ब्थय भी है किन्तु कोई ऐसे विशेष प्रभार इसने अन्तर्गत नहीं है जो कतिपय दशाओं में प्रावश्यक हों, जैसे कि टगों, बाबों या अन्य यानों का प्रयाग जिसके लिये प्रमार यथास्थिति वास्तविक खर्च या पत्तन के लिये उपवणित वरों के मापनान पर लिये जायेंगे । जल से क्षतिग्रस्त हो सकने वाले माल की दशा में उपर्युक्त प्रतिशतता यथास्थिति विषय मूल्य पर था सीमाशुल्क मूल्यांकन के आधार पर वसूल की जायेगी ।
(ख) गोताखोरों के. प्रभार- गोताखोरों के प्रभार नीचे सारणी में निनिविष्ठ बरों पर उद्ग्रहणीय होगा ।

टिप्पण ( 1 ) ऊपर विनिर्दिष्ट उद्धारण प्रभार पत्तन के प्रन्तःसमुद्र गोताखोरों की सेवानों के लिये विशेष मध्यपेक्षाभों पर किये गये किसी गोताखोरी के कार्य की सभी दशाओं में गोताखोरों द्वारा तलाशी या परीक्षाओं के परिणामों का विचार किये बिना उद्महीत किये जायेंगे । जहां फलक पर खोए भाल को बरामद करने के लिये कोई तलाशी की जाती है और ऐसा भाल बरामद हो जाता है तो ऐसे प्रभार उठ्ग्रहीत किये जायेंगे जो उद्घारण के लिये विहित है ।
(2 ) जब गोताखोरों नौका उसी लांच द्वारा कवित की जाती है तो कर्षण प्रभार इसके अतिरिक्त उद्ग्रहीत किये जायेंगे ।

In exercise of powers conferred by sub- section (1 ) of section 35 of the Indian Ports Act, 1908 ( 15 of 1908) and in supersession of the Port of Madras Pilotage and other Services (Fees) Order , 1975 published with the notifica- tion of the Government of India in the Ministry of Shipping and Transport , No. G.S.R. 382 (E) , dated the 1st July 1975, except as respects things done or omitted to be done before such supersession , the Central Government hereby makes the following Order for regulating the levy of fees for pilotage and other services in the Port of Madras , namely:-
ORDER
1. Short title and commencement ,-(1 ) This order may be called the port of Madras Pilotage and Other Services (Fees) Order, 1982 .
(2) It shall come into force at once.
2. Definition, In this order , unless the context otherwise requires :
(a)," Berths in the Inner Harbour" means berths other than the berths in Jawahar Dock and Bharathi Dock;
(b) "day" means a period of 24 hours from the time berth- ing of a vessel in a berth is completed;
(c) " Dead Weight Tons " means the weight in tons of cargo, stores , fuel , passengers and crew carried by the ship when loaded to her maximum summer load line ;
(d) " Port" means the port of Madras .
(e) " ship" means a vessel propelled solely by wind power.
(f) " steamer" means any vessel other than a ship .
(g) " coasting ship " and " coasting steamer " mean respecti- vely a ship or steamer which is engaged in the carriage by sea of passengers or goods from any port or place in India to any other porto place in India;

(il ) Vessels of 60,000 dead wolght tons and ab . ve 1.60 160 1.10 1.10 (1) The fees leviable for piloting vessels in and out of the harbour , which includes services of the Port's Pilots and the services of the launches with the crew but ex- clu les the services of tugs engaged in moring or unmooring operations of vessels , shall be at the rates specified in the Table bolow , namely : -
(2) For piloting a vessel on " Cold Movo " , namely, without the power of the engine of the vessels , partly or fully in any operation, pilotage fee should be levied at double the rates payable under sub - clause ( 1 ) .

(4) For moung a vessol outside the harbour , when it does not enter or leave it , a fee at half the rates payable for one was pilotage (mooring or unmooring) under sub-clause ( 1 ) in respect of inner harbour shall belevled .

(5) For navigation of vessels for purposes of mooring or nooring, shifting or turning between 18-00 hours and 06-00 hours , additional charges at the rates of Rs . 0.15 per GRT for foroign vessel and Rs . 0.10 per GRT for coasting vessel shall belevted at Inner Harbour , Jawahar Dock and Bharathi Dock . Explanation : For the purposes of this sub -clause the time of boarding the vessel by the Pilot shall be deemed as the commencement of Navigation .

Notes : ( 1 ) The Charges at the rates specified above. shall be levied not only in cases of cancellations of requisitions for outward pilutage of vessels but also for the cancellations of requisitions for shifting of berths of vessels and re- rnooring or for turning a vossel arcund in her berth or for re-mooring a vessel in the same berth due to position of heavy lifts .

(2) The above charges are not leviahlein cases of (a ) cancel- lations received sufficiently in time before the Pilots board the vessels and ( b ) cancellations caused under exceptional circums- tances for rea , ons that could not be attributed to the vessel's fault .
(3) If any put arises about the payment of charges under sub-clause (2 ) the matter shall be referred to the Chairman , who shall decide the same .
4. Special Charges ( 1 ) A fee of Rs . 144 in respect of a coasting vessel and Rs . 298 in respect of a Foreign Vessel shall be levied for each hour or part of an hour that a Pilot is kept waiting on board any vessel at the Port of Madras beyond thirty minutes after boarding such vessel .
(2) The charge for towage a sailing vessel within the limits of the port of Ma ' ras shall be Rs . 144 per hour subject to a mininum of Rs . 72 for a duratu nef 30 minutes and loss . Charges for the period in excess of this duration shall be levied at the rate fixed for one hour or part thereof.
(3) Focs for salvago of goods or four use of services ofDivers shall be as follows namely:-

Not : These changes include the cost of ordinary diver's charges but are exclusive of any special charges which may be necessary in certain cases , such as the use of tugs , barges or other crafts which will be charged et actual cost or at the rates set forth in the Port's Scale of Rates , as the case may be . In case of goods liable to damageby water , the above percen- tage shall be recovered on the sale value or Customs valuation , as the case may be
(b) Diver's Charges : Diver's charges shall be leviable at the rates specifled in the Table below:

Noto: (1 ) The Diver's charges specifled above shall be le- vied in all cases of diving work carried out on special requlsi- tions for the services of the Port Submarine Diver irrespective ofthe results of search or examinations by the Divers . Where a search is undertaken for recovery of goods lost over board and such goods are recovered , charges as for salvage shall be levied.
(2) When the diving boat is towed by a launch , the towage charges shall be levied extra .
