फा०या ० 780 (अ ):-केन्द्रीय सरकार की, असम राज्य के कामरूप जिले में स्थित मैसर्स बहार टी एण्ड टिम्बर कम्पनी लिमिटेड के स्वामित्वाश्रीन बरद्वार जाय सम्पदा न.मक चाय एकक भत्रि मागत , जिसका रजिस्ट्रीकृत कार्यालय , 19 सर्कुलर गार्डन रीच रोड , कलकत्ता 23 में है , यह राय है किः-
( i) उक्त चाय एकक की मौमत उपज, 1977-1981 के पांच वर्षों में से कम से कम तीन वर्ष केलिए , औसत जिला उपज से 25 प्रतिशत या उससे अधिक कम रही है ;
( ii ) उक्त चाय एकक का स्वामित्व रखने वाले व्यक्तियों ने, कसंकारो, के भविष्य निधि शोध्यों तथा अन्य शोध्यों का जिन्हें वे प्रवृत्त विधियो के अधीन संदाय करमे के लिए बाध्यताधीन हैं, संदाय करने में अभ्यासत व्यक्तिक्रम किया है

अतः, अब , केन्द्रीय सरकार चाय अधिनियम, 1953 ( 1953 का 29 ) की धारा 16 व की उपधारा ( 1 ) द्वारः प्रदत्त शक्तियों क प्रयोग करते हुए , उक्त चय एकक के कार्य कलापों का विस्तृत भीर पूर्ण भन्वेषण करने के प्रयोजन के लिए व्यक्तियों के एक निकाय की नियक्ति करती है , जो निम्नलिखित व्यक्तियों से मिलकर बनेगा , अर्थात:--
( 1') निदेशक , चध्य विकास , चाय बोर्ड, कलकत्ता ।
( 2 ) वित्तीय सलाहकार मौर मुख्य लेखा अधिकारी , आय बोर्ड कलकत्ता ।
(3) सचिव, उद्योग विभाग , असम सरकार , दिसपुर ।
( 4) अधीक्षक , ख्वांग , चाय बागान , 8 , वल. इव रो , कलकत्ता ।
( 5) उपनिदेशक ( लेखा ) , कम्पनी विधि बोर्ड , कलकत्ता ।
उक्त व्यक्ति निकाय , इस श्रादेश के राजपक्ष में प्रकासन की तारीख से 90 दिन की अवधि के भीतर , केन्द्रीय सरकार को अपनी रिपोर्ट देगा ।

ORDER
New Delbi , the 2nd November , 1982
S.O. 780 (E) . Whereas the Central Government is of opinion in respect of the tea unit known as Barduar Tea Estate , situated in the District of Kamrup in Assam State owned by M / s . Barduar Tea and Timber Co. Ltd. , having its Registered Office at 19 , Circular Garden Reach Road, Calcutta - 23 that
(i) the average yield of the said tea unit for at least three of the five years 1977-81 has been lower than the district average yield by twentyfive per cent or more ;
(ii) the persons owning the said tea unit have habitually made default in the payment of provident fund dues of workers and other dues as they are under an obligation to pay under laws in force ;
Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) of section 16B of the Tea Act, 1953 (29 of 1953 ) , the Central Government hereby appoints for the purpose of making a full and complete investigation into the affairs of the said tea unit , a body of persons consisting of:
( 1) Director of Tea Development , Tea Board , Calcutta .
(2) Financial Adviser and Chief, Accounts Officer , Tea Board , Calcutta .
(3 ) Secretary , Industries Department , Government of Assam , Dispur .
(4) Superintendent , Khwang Tea Garden , 8 , Clive Row , Calcutta .

(5) Deputy Director , (Accounts), Company Law Board , Calcutta.
The said body of perspersons shall submit its report to the Central Gov ernment withinwithin a period of 90 days from the date of publication of this order in the Official Gazette .
